EXPLNATION FOR DELAY: This case is filed before this court under POCSO Act. In this case on 03-07-2018 charges under sections 376, 313 IPC and under Section 5 read with 6 of POCSO Act, 2012 and under Section 3 (ii)(v) of SCs, STs (POA) Act were framed against accused. In this case, Pws 1 to 18 were examined and Ex.P.1 to 23 were marked. The accused was examined under section 313 Cr.P.C., on 03.06.2019. After concluding arguments, Judgment was pronounced on 12-06-2019.

The bail bonds of the accused shall stands cancelled after expiry of appeal time. The unmarked non valuable property, if any, shall be destroyed, after expiry of appeal time.

J U D G M E N T
1.Criminal law set into motion upon registration of statement Y.P.J.
(victim girl) recorded by Inspector of Police, II Town Police Station,
Vizianagaram at 0.30 hours on the intervening night of 12/13.08,2017 for the offences punishable under Sections 376, 313 IPC and Sections 3(II)(V) of
SC/ST (POA) Act, 1989 in Crime No.238/2017.
2.The brief facts of the case are :
One Y.P.J. studied 1st to 4th standard in Government Primary
School and V to VII in Z.P.High School in Pogiri Village and 8th to 10th standard in G.Sigadam Village in A.P.Model School. She also studied her Intermediate
Bi.P.C. Group in M.R.College, Vizianagaram. During that period, she stayed in
SC Society Government Hostel i.e., during 2016-17. She was born on 17.06.2000 and she belongs to S.C., mala caste. She fell in love with accused while she was studying 8th standard. That during her study of 10th standard, accused stated to her that he would marry her and on 20.12.2016 during Christmas holidays, the accused took her to fields in the outskirts in their village and by making her to believe his false promise and that since they were going to be married, there would not be any wrong even if they participate in sexual intercourse and then they participated in sexual intercourse and also at 5.00 p.m., they again participated in sexual intercourse two or three times. In February, the accused gave her touch screen mobile for taking farewell photos with mobile number 7013877362 and from then onwards they talked through that phone and her mobile phone 4 which is ordinary phone was taken by the accused. During farewell function she took photographs and saved them in the memory card and by keeping memory card, she gave back touch screen mobile to the accused and she took return of her ordinary mobile. That victim girl examinations were completed by 14th March and after she reached her house, within one week accused made phone call to her to talk with her with urgently and she went and they had sexual intercourse. Similarly they participated in sexual intercourse in same place and after summer vacation on 3rd July upon opening of college, she returned to Vizianagaram. While she was in hostel, her periods had stopped from the day they participated in sex and in the meanwhile accused went to Hyderabad. On 4.8.2017, she went to her village and informed accused that her periods had stopped and she became pregnant and demanded him to marry her. Then accused demanded her that initially, she should get her pregnancy aborted and thereafter only they would celebrate their marriage. The accused gave some tablets to her and asked her not to reveal it to any one and after holidays on 9.8.2017, she returned to hostel in Vizianagaram and took one tablet each on 9th, 10th, and 11th during night. On 12.8.2017, due to ill-health, she remained in hostel.
During afternoon, she felt discomfort and she could understand that due to tablets given by the accused for abortion, something was going to happen to her. She slept in the room and at around 3.30 p.m. she experienced pain in her stomach so also on her back and she went to toilet and in the toilet from her stomach one baby fell and it was not crying and it was a still born child.
By then in the hostel or in the bathroom none were present and out of fear she had thrown away the dead baby over hostel compound wall. At about 7.30 p.m., Vijaya Nirmala, her hostel warden questioned her and she narrated the incident to her. That she was admitted in Gosha Hospital with the help of police and was given medical treatment.

3.The charge sheet was taken on file for offences Under Sections 376, 313 IPC and under Section 5 read with 6 of POCSO Act, 2012 and under
Section 3 (ii)(v) of SCs, STs (POA) Act against the accused and it was registered as POCSO S.C.No.30/2018.
4.After appearance of accused, copies of case documents were furnished to him and upon hearing both sides, charges under Sections 376, 313 IPC and under Section 5 read with 6 of POCSO Act, 2012 and under
Section 3 (ii)(v) of SCs, STs (POA) Act were framed against accused, read over and explained to him in Telugu, for which he pleaded not guilty and claimed to be tried.
5.The prosecution examined PWs.1 to 18 and exhibited Exts.P1 to
P23. Additional Public Prosecutor has given up evidence of LWs.3, 11, 15 to 18, 20, 22 to 24, 26, 28,29, 32 and 33 viz., Yagati Surya Rao, Yagati
Ramakrishna, Boodi Chandrunaidu, Warden of SC Boys Hostel-II,
Vizianagaram, Polumuru Sasibhushanarao, Assistant Social Welfare Officer,

6. After closure of the prosecution evidence, the accused was examined under section 313 of Cr.P.C. explaining incriminating material appearing against him in the evidence of prosecution witnesses. The case of accused is one of total denial .However, he reported no defence evidence.
7.Heard arguments advanced by learned Additional Public
Prosecutor and learned defence counsel for the accused.
8.Now, the points that arise for determination in this case is:
Whether the prosecution could prove the guilt of accused for the charges leveled against him, beyond all reasonable?
POINT:
9.During the course of evidence, PW1 though deposed that she knows the accused and that he belongs to Kapu community and he also lives in the same street, she pleaded ignorance of any facts in this case. She even admitted that she had stomach pain but she did not reveal the cause for her stomach ache. She went to the extent of stating that she was not examined by the police, but she admitted that she put her signature in her statement recorded by some one i.e., Ex.P2. At one stage, PW1 has the audacity to deny giving statement before the Judicial Magistrate of The First Class. But she regained her composer and stated that she gave statement before Judge i.e., Judicial Magistrate of The First Class, Special Mobile Court, Vizianagaram and she admitted and exhibited her statement in Ex.P3 recorded under
Section 164 Cr.P.C. (Public Prosecutor, District Court insisted for marking entire statement). She also admitted that she was taken to Hyderabad and her blood samples were collected. That she pleaded ignorance of purpose for collecting her blood samples. During her chief examination she exhibited
Ex.P4 bunch of 3 photographs showing herself and Maize crop. She also exhibited Ex.P5 bunch of 4 photographs showing her dead body of girl child by the side of a room. She also exhibited Ex.P6 CD for Exs.P4 and P5 photos.

She also deposed that dead baby was lying near their hostile during the year in which she was admitted in hospital. It was prior to her admission in hospital. Her hostel mates alleged that it was her baby. Once again PW1 stated that she was not examined by any one. But she again regained her composer and stated that some one came and recorded something. She admitted that more than Rs.1,00,000/- was credited into her savings bank account of State Bank of India. PW1 was cross-examined by incharge Public
Prosecutor and she denied what all was suggested to her. During cross- examination by defence counsel, she admitted that accused is her husband and she was carrying 5th month pregnancy. She pleaded that she is not aware of contents in Exs.P2 and P3. She further deposed that dead baby found in Ex.P5 is not her baby. She explained that she became confused and stated that dead baby was her baby. She also deposed that herself and her husband i.e., accused have been living happily.
10.PW2 father of PW1 contended that he is not aware of the facts in this case and some one took his daughter to hospital due to ill health.
11.PW3 did not support the case of the prosecution.
12.PW4 deposed that Lw.7-A.S.Raja is known to him. He does not
Know accused. A hostel is present by the side of his house. He found one dead baby lying by the side of hostel while he was going to attend his work in the house of Narasinga Rao, at about 4.00 p.m., about one and half years back. Ex.P.5 photograph shows dead child. He informed the same to L.W.7-
A.S.Raja. Subsequently he went to attend his work. Police did not examine him.
13.PW5 deposed that previously he worked as Warden, SW Girls
Hostel No.II, Vizianagaram. Her duty times in the hostel were from 6.00 a.m., to 9.00 a.m., and from 12.00 noon to 2.00 p.m., and evening from 5.00 8 p.m., to 9.00 p.m. Pw.1, Lw.8-Lalitha, L.W.9-Dhanalaxmi were students, who stayed in their hostel. He does not know parents of Pw.1. 138 girl students of Intermediate, Degree, P.G., and Engineering, stayed in their hostel during that period. On 12.8.2017, she applied for leave and she went to her house on personal work. At 5.00 p.m., he received phone call. He immediately rushed to their hostel. She found one dead baby lying on other side of hostel compound wall. In the assembly he questioned all the students. Pws 7 and 8 stated to her that Pw.1 did not attend college on the ground that she was weak. She questioned Pw.1 and she stated to her that she had thrown away the baby over the compound wall. Herself and S.I. of police took Pw.1 to Gosha Hospital. Pw.1 was given blood due to bleeding.
14.According to PW6, PW4 informed him that still born child was present by the side of hostel compound wall and it was a dead baby.
15.According to PW7, she, PW1 and L.W.9-Dhanalaxmi used to stay in SC Hostel, Vizianagaram. But she pleaded ignorance of facts in this case.
16.PWs.8 and 9 did not support the case of the prosecution.
17.According to PW10, incident took place in hostel at Vizianagaram and PW1 delivered daughter in the hostel.
18.PW11 pleaded ignorance of facts in this case.
19.According to PW12, in the presence of LWs.15 and 16 Boddi
Chandrunaidu and Polumuru Sasibhushanarao and himself, inquest was conducted over dead baby of a still born child and which was drafted by
LW15 Chandrunaidu. He also exhibited Ex.P17 scene of offence observation report and Ex.P5 photos were taken at the scene of offence.

20.According to PW13, in his presence, accused was interrogated by
Deputy Superintendent of Police and accused confessed the offence and he exhibited relevant portion of arrest of accused in their presence. That he and
LW20 Yeddu Ramu signed in it.
21.PW14 the then Head Master, A.P. Model School, G.Sigadam deposed that Ex.P.1 was issued by him to P.w.1. Pw.1 joined in their school in 8th standard and she was relieved in their school during 2015-2016. She was born on 17.6.2000. Students join in 8th standard with Transfer Certificate of 7th standard. They admit students in 8th standard based on Transfer
Certificate and based on particulars of 7th standard. They enter all particulars in admission register for 8th standard. He issued Ex.P.1 based on admission register for 8th standard.
22.PW15 deposed that he has been working as Professor,
Department of Pathology, Andhra Medical College, Visakhapatnam; on 24.8.2017 he received specimen from C.A.S., District Hospital, Vizianagaram, through constable, of P.w.1. After thorough examination, he issued opinion that section studied show decidual tissue, congested blood vessels, area of haemorrahages and fibrinoid necrosis. Ex.P.19 is report with his opinion.
23.PW16 deposed that he has been working as Civil Assistant
Surgeon, Government District Hospital, Vizianagaram. On 14.8.2017, at 12.30 p.m., he received requisition to conduct P.M. examination over dead foetus of P.w.1, 8 months intra uterine age. he commenced P.M. examination at 12.35 p.m. he found following during P.M. findings:
1. No rigor mortis. 2. Black hair present on head and eye brows. 3. Weight 1.4 kilograms. 4. Length of aborted female baby is 41 centimetres. 5. Crown rump length 27 centimetres. 6. Length of foot (right and left) – 6 10 centimetres. 7. Gall bladder of liver is full with bile. 8. Meconium present in and throughout large intestine. 9. Eyelids present, no membrance on pupils.
10. Caecum is present in right iliac fossa of abdomen. 11. Cut pieces of lungs sunk in water, not floating. 12. Nails present. 13. Skin is not wrinkled.
14. Nails of fingers grown beyond and above tips of fingers. 15. Skin is not wrinkled. 16. Pieces of placenta brought is 2500 grams. 17. Age of aborted foetus end of eighth month. 18. Foetus is dead born at the time of abortion.
He issued certificate accordingly. Ex.P.20 is the certificate.
24.PW17 deposed that he has been working as Professor, KGH,
Visakhapatnam, for the last 10 years. On 29.8.2017 he examined accused for potency test. Accused is potent. Ex.P.21 is the potency certificate issued by him.
25.PW18 deposed that previously he worked as Tahsildar,
G.Sigadam Mandal. He received requisition from Sub Divisional Police
Officer, Vizianagaram and he issued Ex.P.22-caste certificate of Pw.1 showing that she belongs to S.C. Mala. He also received requisition from Sub
Divisional Police Officer, Vizianagaram and he issued Ex.P.23-caste certificate of accused showing that he belongs to Turpu Kapu B. C - D.
26.A thorough reading of entire evidence deposed by PWs.1 to 18 shows that not even a single person did depose anything against accused person touching any one of the charges under Sections 376, 313 IPC and under Section 5 read with 6 of POCSO Act, 2012 and under Section 3 (ii)(v) of
SCs, STs (POA) Act framed against him. Hence, it can be safely concluded that the prosecution has miserably failed to bring home guilt of accused for any one of charges under Sections 376, 313 IPC and under Section 5 read with 6 of POCSO Act, 2012 and under Section 3 (ii)(v) of SCs, STs (POA) Act.

27.PW1 as discussed above in her chief-examination identified
Exs.P4 to P6 photos and CD and deposed that the still born child seen in
Ex.P5 is her baby. Even her hostel-mates commented against her that said dead baby belongs to her. She also admitted that she was sick on that day and was admitted in private hospital and was given medical treatment in
Ghosha Hospital, Vizianagaram, which is meant for treatment women. If
PW1 did not give birth to a still born child, there was no necessity for her to become sick. On the very same day still born child appeared by the side of room along compound wall of their hostel. All these facts and circumstances go to show that in chief-examination, PW1 admitted that she is mother of said still born child. But she denied her version during cross-examination by defence counsel. It is also brought on record that accused married her. But the fact remains that PW1 though deposed before this Court that the dead body was her baby. But, during cross-examination by defence counsel, she changed her version totally and she did not claim dead baby as her baby.
Hence, it can be safely concluded that PW1 had spoken falsehood before this
Court and she shall be dealt with under Section 344 of Cr.P.C. Office is directed to register STC against PW1 for speaking falsehood before this Court and to issue show-cause notice to her as to why she shall not be punished under Section 195 read with 344 Cr.P.C., for giving false evidence before this
Court. This point is answered accordingly.
28. In the result, Accused is found not guilty for the charges under
Sections 376, 313 IPC and under Section 5 read with 6 of POCSO Act, 2012 and under Section 3 (ii)(v) of SCs, STs (POA) Act and he is accordingly acquitted under Section 235 (1) Cr.P.C. The bail bonds of the accused shall stands cancelled after expiry of appeal time. The unmarked non valuable property, if any, shall be destroyed, after expiry of appeal time.
