This petition is coming before me for final hearing in the presence of learned APP. and Sri R.R.Manyam Advocate for Accused No.1 to 3, upon perusing the material on record and upon hearing the arguments, the court made the following: - : COMMITTAL ORDER::

The Sub-Inspector of Police, PS Devarakadra filed a charge sheet against the accused 1. in Cr.No. 106/2025 of PS Devarakadra for the offence under Sec 109 r/w 3(5) of BNS.

The allegations of the prosecution are: Arun, who is the brother in law of 2. complainant/LW1 had eloped with A2/Kappali Maibu's daughter, due to which disputes arose between them. Having a grudge and with an intention to kill, all the accused on 28.03.2025 at about 06:30 pm, went to the house of LWI/Buddolla Bagyamma and her husband/LW5/

Buddolta Ravi Kumar when they were present at their house. Al attacked LW5 with a knife and A3 held him. The neighbors intervened and rescued them. During the incident.

Al taAY also beat and pushed the complainant and LW5 who sustained bleeding injuries on the head, left shoulder, right-hand finger and elbow. They were shifted to Government

Hospital, Mahabubnagar for ireatment. Based on the report of Buddolla Bagyanuna Lw1. a case has been registered.

3. During the course of investigation, the witnesses were examined. scene of offence and seizure panchanamas were conducted. The presence of accused was secured through judicial remand. They later obtained bail from the Hon'ble Judge Family Court -cum-I|l Addl.

District and Sessions Judge at Mahabubnagar, notices were served, copies were furnished and charge sheet was filed.

Cognizance has been taken for the offence U/sec. 109 r'w 3(5) of BNS. On appearance 4. of the accused person, copies of documents were furnished to them.

The offence under Sec. 109 r/w 3(5) of BNS is exclusively triable by the Hon'ble 5. Court of Sessions. As such the case is committed u/s. 232 (a) BNS, record of the case is to be sent to the Hon'ble Prl. District & Sessions court Mahabubnagar with documents and articles if any as per Sec. 232 (c) BNS and the committal of the case shall be notified to the public prosecutor as per Sec. 232 (d) BNS.

6. The accused are directed to appear before the Hon'ble Prl. District and Sessions Cout Mahabubnagar on 01.07.2026 at 10.30 A.M.

1. The Sub-Inspector of Police, PS II-Town file a charge sheet against the accused in Cr.No.231/2025 of PS II-Town for the offence under Sec 108 of BNS.

2. The allegations of the prosecution are: the accused followed the deceased in the name of love and they loved each other. On 03.07.2025, the accused called the deceased/Dharpally Sandya near the railway track and told her that he disliked her and would not marry her. He suggested that she was better off dead and dropped her home. Distressed by his words, the deceased consumed pesticide at her house. Later she was shifted to SVS Hospital, then to Government Hospital, Mahabubnagar, and later to Osmania Hospital, Hyderabad, where she

Juidied oạ 04.07.2025 at about 03:00 pm while undergoing treatment. Based on the report of

Dharpalt Balraj/LW1, a case has been registered.

It is seen that salary attachment warrant was served on R2 and R3 long back in the month of November-2023. Thereafter jDr No.2 has preferred

CRP.No.3822 of 2023 where in the Hon'ble High Court has granted interim stay of

EP.No.8 of 2023 for a period of 6 weeks as per order Dt:29-12-2023. So far there

is no update about extension of stay and no copy of extension of stay is filed by JDr No.2. As a salary attachment warrant of R2 and R3 was served in the year 2023 itself and in view of the guidelines of the Hon'ble Supreme court for disposal of EP's within 6 months, in the interest of Justice, the EP is closed.
