This case is coming before me for final hearing on 18­5­2015 in the presence of Learned A.P.P, for the State and Sri G.N.S.Chandra Bose, Advocate for A.1 and A.30, after having stood over for consideration, till this day, the court delivered the following :

J U D G M E N T

1.State represented by SI of Police, PS Narayanaguda filed charge sheet against A.1 to A.138 in Crime No.286/2004 for the offences u/Secs 3 and 4 of A.P Gaming Act alleging that on 5­4­2004 on receipt of information the then SI of Police, Chandpasha along with staff proceeded to the H.No.3­5­ 1060/5, Narayanaguda as common gaming was being conducted with the 

C.C. 1612 of 2004 Page 12 of 17 help of three cards and before proceeding to the scene of offence he obtained search warrant and also collected panchas Mahender and Mohd.Yafai and the 

Advocate Commissioner was appointed for the said Majestic Sports and 

Cultural Club was also present and the raid party found Abdul Vilayath ali 

Khan and Nanak were the owners, 126 punters, 5 supervisor and 3 workers and also found 21 tables and punters were paying three cards came by putting cash of Rs.35, 329/­ and also found 42 bundles of playing cards, 126 chairs and 21 tables and the said persons were taken into custody and panchanama was conducted and the property was seized and subsequently case was registered and during course of investigation A.3 to A.138 were produced for judicial custody and after completion of investigation filed charge sheet. 

2.This case was taken cognizance for the offences u/Secs 3 and 4 of A.P 

Gaming Act against A.1 to A.138 and when A.1 was present and A.2 to 

A.138 were absent and as NBW pending against them since long time as such case against A.2 to A.138 was split up in C.C.1173/2014 and this case was proceeded against A.1 only.

3.When A.1 present copies of documents were furnished to him u/Sec.207 Cr.P.C. A.1 was examined u/SEc.251 Cr.P.C for he pleaded not guilty for the offence u/Secs.3 and 4 of A.P Gaming Act.

4.During pendency of this case A.30 was arrested and produced in 

C.C.1173/2014 and subsequently case against A.30 was clubbed in 

C.C.1612/2004 and C.C.1612/2004 was proceeded against A.1 and A.30 only.

5.During the course of trial prosecution examined P.Ws.1 to 3 and marked Exs.P.1 to P.3. No documents was marked by defence and M.O.1 was exhibited. After closure of the prosecution evidence A.1 and A.30 were examined u/Sec 313 Cr.P.C and when the incriminating material in the 

C.C. 1612 of 2004 Page 13 of 17 evidence of P.Ws.1 and 2 were put to them, A.1 and A.30 denied the evidence as false, did not state anything and did not wish to examine witnesses on their behalf. After hearing arguments this case is posted for judgment.

6.Now the point for determination is ;

Whether the prosecution proved the offences u/Secs 3 and 4 of A.P Gaming Act against A.1 and A.30 beyond all reasonable doubts ?

7.Prosecution though cited 8 witnesses but examined P.Ws.1 to 3 and the evidence of L.Ws.2 to 6 viz., ITVS Suryanarayana, D.Gangadhram, Chanda 

Reddy, Prabhakar, K.Mahender Kumar was closed as the witnesses were not produced inspite of giving several chances. Out of the witnesses examined 

P.W.1 is the SI of Police and defacto­complainant, P.W.3 is the panch witness and P.W.2 is the officer who registered the FIR and investigated the offence. 

8.The defence taken by the A.1 and A.30 is that of total denial.

9.The investigation in this case was commenced on the report of P.W.1 which is marked as Ex.P.1 which shows about conducting raid on 5­4­2004 at 7pm on information about conducting of common gaming with three cards at 

H.No.3­5­1060/5, Narayanaguda, obtaining search warrant from Asst. 

Commissioner of Police, Abids, collection of panch witnesses, proceeded to the scene of offence, found the organizers, punters, supervisors and workers and took them into custody and seized cash and tables, chairs and playing cards, etc. Ex.P.1 is the report. Ex.P.2 is the panchanama.

10.Ex.P.1 was registered as a case in Crime No.286/2004 for the offence u/Secs.3 and 4 of A.P Gaming Act and Ex.P.3 is the FIR.

11.When the evidence of P.W.2 is seen he is the officer who registered the 

FIR and conducted investigation. The evidence of P.W.2 shows that he received report from P.W.1 and registered the same as FIR and he visited the 

C.C. 1612 of 2004 Page 14 of 17 scene of offence, effected arrest of A.3 to A.138 and produced them for judicial custody and A.1 and A.2 surrendered before the court and obtained bail. M.O.1 is fixed deposit receipt for Rs.35,329/­. P.W.2 also deposed that other property 126 chairs and tables were returned to the accused for interim custody.

12.When the evidence of P.W.1 is seen he deposed the same facts which are mentioned in Ex.P.1 report about conducting of raid and etc facts and also taking panchnas and organizers into custody and seizure of cash, tables and chairs. Ex.P.2 is the panchanama. Eventhough the record in this case shows that P.W.1 obtained search warrant from Asst. Commissioner of Police, 

Abids but the same was not filed in this case. In the cross examination of 

P.W.1 it was elicited that he did not enquire the neighbours at the place where the raid was conducted and it is also not the case of the prosecution that the neighbours complained against the accused for conducting such common gaming house. When the evidence of P.W.3 is seen he is the panch witness in this case and he deposed that he was taken by the police to the gambling house where 100 persons were present, plice seized cash, tables and chairs in his presence and P.W.3 could not say whether A.1 to A.30 were present at the spot at the time of conducting raid and therefore P.W.3 was declared hostile and he did not support the case of the prosecution and when he was cross examined by the learned A.P.P. In the cross examination of 

P.W.2 also shows that he did not examine any independent witness at the scene of offence.

13.After going through the above material on record except the evidence of P.W.1 there is no other evidence to show that A.1 and A.30 are the persons who were present in the common gaming house and A.1 was the organizer and A.30 was the punter. The evidence on record is not at all sufficient to hold that A.1 and A.3 are involved in betting and playing three cards game and prosecution failed to prove the offence u/Secs.3 and 4 of A.P 

Gaming Act against A.1 and A.30 beyond all reasonable doubt and therefore 

C.C. 1612 of 2004 Page 15 of 17 they are entitled for acquittal.

14.A.1 and A.3o are found not guilty for the offences u/Secs 3 and 4 of 

A.P Gaming Act.

15.In the result, A.1 and A.30 are acquitted u/sec 255 (1) Cr.P.C for the offences u/Secs 3 and 4 of A.P Gaming Act and they are directed to set at liberty and their bail bonds shall stands cancelled after appeal time is over. 

M.O.1 shall be transferred to C.C.1173/2014 where case against A.2 to A.29, 

A.31 to A.138 is pending.

This case is coming before me for final hearing on 18­5­2015 in the presence of Learned A.P.P, for the State and Sri G.N.S.Chandra Bose, Advocate for A.1, after having stood over for consideration, till this day, the court delivered the following :

J U D G M E N T

1.State represented by SI of Police, PS Narayanaguda filed charge sheet against A.1 and A.2 in Crime No.305/2010 for the offences u/Secs 36 (1)(b)

(c)(d) of A.P Excise Act alleging that on 6­8­2010 at 00­15hours while the then SI of Police M.Janardhan Rao while performing night patrolling along with other police constables found Majestic Bar and Restaurant opened 

C.C. 395 of 2011 Page 1 of 5 beyond bar and restaurant timings and some customers are being allowed to take alcohol and liquor was supplied to them and the bar and restaurant people did not produce any valid licence or permission from the 

Commissioner of Police and the Manager i.e., A.2 told them that he was selling liquor on the instructions of A.1 who is their owner and therefore A2 was taken into custody and his confession was recorded and subsequently on the report of Janardhan Rao a case was registered and during course of investigation witnesses were examined, A.1 surrendered before the court and obtained bail, A.2 was produced for judicial custody and after completion of investigation filed charge sheet. 

2.This case was taken cognizance for the offence u/Sec 36(1)(b)(c)(d) 

A.P. Excise Act against A.1 and A.2.

3.During pendency of this case A.1 was present and A.2 was reported died and death certificate was not filed and case against A.2 was split up in 

C.C.207/2015 and this case i.e., C.C.395/2011 was proceeded against A.1 only.

4.When A.1 appeared copies of documents were furnished to him u/Sec 207 Cr.P.C. A.1 was examined u/Sec 239 Cr.P.C for which he denied the offence. After consideration charge u/Secs. 36 (1)(b)(c)(d) of A.P Excise Act against A.1, read over and explained to him for which A.1 pleaded not guilty and claimed to be tried.

5.During the course of trial prosecution examined P.Ws.1 and 2 and marked Exs.P.1 and P.2. No documents was marked by defence and no M.O was exhibited. After closure of the prosecution evidence A.1 was examined u/Sec 313 Cr.P.C and when the incriminating material in the evidence of 

P.W.1 was put to him, A.1 denied the evidence as false, did not state anything and did not wish to examine witnesses on his behalf. After hearing arguments this case is posted for judgment.

6.Now the point for determination is ;

Whether the prosecution proved the charge u/Secs 36(1)(b)(c)(d) of A.P Excise Act against A.1 beyond all reasonable doubts ?

7.Prosecution though cited 8 witnesses but examined P.Ws.1 and 2 and the evidence of L.Ws.2 to 5, 7 and 8 viz., Narender, Sudershan, Shravan 

Kumar, Gnaneshwar, Raghunath was closed as the witnesses were not produced inspite of giving several chances. Out of the witnesses examined 

P.W.1 is the defacto­complainant and detective officer and P.W.2 is the panch witness. 

8.The defence taken by the A.1 is that of total denial.

9.The investigation in this case was commenced on the report of P.W.1 which is marked as Ex.P.2 which shows that while conducting patrolling duty on 5­8­2010 at about 11­45pm found Majestic Bar and Restaurant and A.2 being the Manager of the Bar and Restaurant was supplying liquor to the customers beyond bar and restaurant timings fixed by the Commissioner of 

Police, Hyderabad city and A.2 disclosed that A.1 was the owner instructed them to sell the liquor and A.2 was taken into custody and panchanama was conducted in the presence of panchas Shravan Kumar and Abdul Rasheed . 

Ex.P.1 is the panchanama. The evidence of P.W.1 is seen he deposed the same facts which are mentioned in Ex.P.2 report and he also marked Ex.P.1 as the panchanama. The cross examination of P.W.1 clearly shows that he has not recorded the statements of the customers who are present at the spot. 

The evidence also did not show anything about P.W.1 collected any material documents from the Majestic Bar and Restaurant to show that a.2 is the 

Manager and A.1 is the owner of the bar and restaurant. When the evidence of P.W.2 is seen he is the panch witness and he turned hostile to the case of the prosecution and he did not support the case of the prosecution and he was cross examined by the learned APP. The Investigating Officer not examined therefore FIR is not marked.

10.After going through the above evidence except the evidence of P.W.1 there is no other documents to show that Majestic Bar and Restaurant is owned by A.1 and Managed by A.2. No documents were collected in support of the same. Further no documents regarding the orders promulgated by the 

Commissioner of Police regarding the fixation of bar and restaurant timings in Hyderabad city and there is no evidence at all to show that A.1 running 

Majestic Bar and Restaurant beyond bar and restaurant timings and selling liquor to the customers. Hence, prosecution failed to prove the charge u/Sec.36 (1)(b)(c)(d) of A.P Excise Act beyond all reasonable doubt and therefore they are entitled for acquittal.

11.A.1 is found not guilty for the charge u/Secs 36(1)(b)(c)(d) of A.P 

Excise Act.

12.In the result, A.1 is acquitted u/Sec 248 (1) Cr.P.C for the charge u/Secs 36 (1)(b)(c)(d) of A.P Excise Act and he is directed to set at liberty and his bail bonds shall stands cancelled subject to Sec.437 (A) Cr.P.C.

7.The defence taken by the A.1 and A.2 is that of total denial.

8.The investigation in this case was commenced on the report of P.W.1 which is marked as Ex.P.1 which shows that on the intervening night of 20/21­5­2010 while P.W.1 along with staff were conducting patrolling found 

Majestic Bar and Restaurant opened beyond bar and restaurant timings at 11­55pm and A.2 being the Manager was running bar and supplying liquor the customers and A.1 was their owner and A.2 disclosed that A.1 instructed him to sell lliquor and Ex.P.1 is the report of P.W.1 and that A.2 was handed over to the PS Narayanaguda along with Ex.P.1. 

9.Ex.P.1 was registered as a case in Crime No.194/2010 for the offence u/Sec.36(1)(b)(c)(d) of A.P Excise Act and original FIR is not marked in this case as Investigating Officer is not examined in this case.

10.When the evidence of P.W.1 is seen he deposed the same facts whicha re mentioned in Ex.P.1 report. When P.W.1 cross examined he clearly admitted that he did not give any report prior to the arrest of A.2. Further 

P.W.1 did not give any report to the excise station with regard to the offence eventhough the offence comes under A.P Excise Act. As already discussed the 

Investigating Officer not examine and the witness who arrested P.W.1 not examined. There is absolutely no evidence to show that A.2 is the Manager of 

Majestic Bar and Restaurant and A.1 was the owner. The evidence is not at all sufficient to prove the charge u/Sec.36 (1)(b)(c)(d) of A.P Excise Act. 

11.A.1 and A.2 are found not guilty for the charge u/Secs 36(1)(b)(c)(d) of A.P Excise Act.

12.In the result, A.1 and A.2 are acquitted u/Sec 248 (1) Cr.P.C for the charge u/Secs 36 (1)(b)(c)(d) of A.P Excise Act and there are directed to set at liberty and their bail bonds shall stands cancelled subject to Sec.437 (A)

8.The investigation in this case was commenced on the report of P.W.1 which is marked as Ex.P.1 which shows that on 15­10­2009 at 12am mid night found Majestic Bar and Restaurant opened beyond bar and restaurant timings and A.2 being the watchman supplying liquor to the customers and 

A.1 was the owner. Ex.P.1 was registered as case in Crime No.338/2009 for the offence u/Sec.36 (1)(b)(c)(d) of A.P Excise Act. The original FIR is not marked as the Investigating Officer is not examined. 

9.When the evidence of P.W.1 is seen he deposed the facts which are mentioned in Ex.P.1 report and the evidence of P.W.2 also shows that he deposed the facts which are mentioned by P.W.1. The cross examination of 

P.Ws.1 and 2 shows that Deepak theatre is near to the Majestic Bar and 

Restaurant. It is the contention of the accused that the persons who come out of the movie theatre has to come before the Majestic Bar and Restaurant and as such P.Ws.1 & 2 mistook for the fact that A.1 and A.2 are selling liquor to the customers. As already discussed the Investigating Officer not examined and further the alleged confession of the accused that they are selling liquor to the customers beyond bar and restaurant timings there is no other material on record to prove the same. There is absolutely no material to prove the charge u/Sec.36(1)(b)(c)(d) of A.P Excise Act against A.1 and A.2 and therefore they are entitled for acquittal.

10.A.1 and A.2 are found not guilty for the charge u/Secs 36(1)(b)(c)(d) of A.P Excise Act.

11.In the result, A.1 and A.2 are acquitted u/Sec 248 (1) Cr.P.C for the charge u/Secs 36 (1)(b)(c)(d) of A.P Excise Act and there are directed to set at liberty and their bail bonds shall stands cancelled subject to Sec.437 (A)

This case is coming before me for final hearing on 18­5­2015 in the presence of Learned A.P.P, for the State and Sri G.N.S.Chandra Bose, Advocate for A.1 and A.2, after having stood over for consideration, till this day, the court delivered the following :

J U D G M E N T

1.State represented by SI of Police, PS Narayanaguda filed charge sheet against A.1 to A.3 in Crime No.153/2010 for the offences u/Secs 36 (1)(b)

(c)(d) of A.P Excise Act alleging that on 18­4­2010 at 02­30hours while the then SI of Polic, DCP Taskforce, Central Zone was conducting patrolling he found Majestic Bar and Restuarant was opened beyond bar and restaurant timings and liquor was being supplied to the customers and therefore he took 

A.2 and A.3 into custody, conducted panchanama and seized liquor bottles mand brought them to the police station, effected their arrest and produced for judicial custody. A.1 surrendered before the court and obtained bail and after completion of investigation filed charge sheet. 

2.This case was taken cognizance for the offence u/Sec 36(1)(b)(c)(d) 

A.P. Excise Act against and when A.1 and A.2 only and when A.1 and A.2 was present and A.3 was absent and death certificate against A.3 was not filed since long time as such case against A.3 was split up vide C.C.206/2015 and this case was proceeded against A.1 and A.2 only. 

3.When A.1 and A.2 present copies of documents were furnished to them u/Sec 207 Cr.P.C. A.1 and A.2 were examined u/Sec 239 Cr.P.C for which they denied the offence. After consideration charge u/Secs. 36 (1)(b)(c)(d) of A.P Excise Act was framed against A.1 and A.2, read over and explained to them for which A.1 and A.2 pleaded not guilty and claimed to be tried.

4.During the course of trial prosecution did not examine any witness and no documents were marked. After giving several chances to the prosecution the evidence of the witness was closed. As there is no incriminating material against the accused the examination of the accused u/Sec.313 Cr.P.C is dispensed. After hearing arguments this case posted for judgment.

5.Now the point for determination is ;

Whether the prosecution proved the charge u/Secs 36(1)(b)(c)(d) of A.P Excise Act against A.1 and A.2 beyond all reasonable doubts ?

6.Prosecution though cited 5 witnesses but did not examine anybody. 

Eventhough the case of the prosecution is that A.2 and A.3 were found on 17/18­4­2010 at 1am mid night at Majestic Bar and Restaurant supplying liquor to the customers beyond bear and restaurant timings and A.1 was their owner and he instructed them to do so and eventhough the case of the prosecution is that the investigating agency seized liquor bottles in the presence of panchas K.Kumar and K.Venkatesh and drafted panchanama but none of the witnesses were examined and no documents were marked and hence there is absolutely no material against A.1 and A.2 for the charge u/Sec.36(1)(b)(c)(d) of A.P Excise Act. 

7.A.1 and A.2 are found not guilty for the charge u/Secs 36(1)(b)(c)(d) of A.P Excise Act.

8.In the result, A.1 and A.2 are acquitted u/Sec 248 (1) Cr.P.C for the charge u/Secs 36 (1)(b)(c)(d) of A.P Excise Act and their are directed to set at liberty and their bail bonds shall stands cancelled subject to Sec.437 (A) 

Cr.P.C. Unmarked case property shall be transferred to C.C.206/2015 where case against A.3 is pending.
