This case coming before me for final hearing on 31.10.2012 in the presence of Additional Public Prosecutor for the prosecution and that of Sri Sri B.Ashok and Sri D.Sayanna, Advocates, Nizamabad for accused and having stood over for consideration to this day, the court delivers the following:
:: J U D G M E N T :::
1.The Sub Inspector of police, PS Navipet filed charge sheet against the accused for the offence U/s 354 IPC
2.The brief facts of the case of prosecution are as follows:
On 29.4.2011 at 1930 hours, the complainant Miryala Sayamma lodged complaint stating that her husband Neeradi Allamaiah is neglecting her and not looking afer her and on 22.4.2011 at 0800 she saw her husband (accused) and asked as to why he is not coming to her and not looking after her, upon which the accused 2

picked up quarrel with her and torn her jacket and insulted her and outraged her modesty. The incident was witnessed by Guthpa Laxman, Miriyala Laxman,
Ganishetti Laxman. The village Sarpanch Neeradi Laxman has called her husband and asked to settle the matter by discussing but the accused has not listened to the
Sarpanch.
3.That as per the contents of statement, the HC 1077 has registered case in Cr No. 98/2011 for the offence U/s 354 IPC and examined the complainant.
Thereafter visited the scene of offence and examined Guthpa Nadipi Laxman,
Ganishetty Laxman and Miryala Laxman. On 1.4.2011 notice U/s 41(A) Cr P C was issued and served on accused on 3.5.2011 but he failed to produce surety. Hence on 4.7.2011 the accused was apprehended and he voluntarily confessed commission of offence. The accused was sent for judicial remand. After completion of investigation, the SI laid charge sheet.
4This case was taken on file by taking cognizance by the II Addl JFCM,
Nizamabad in PRC No. 58 of 2011 against the accused for the offence U/s 354 IPC .
On appearance of accused, copies of documents were furnished to him as contemplated U/s 208 Cr P C. After complying provisions U/s 209 Cr P C, the case was committed to the Hon’ble Sessions Court, Nizamabad where it was registered as
SC No. 274 of 2011 and made over to this court for disposal.
5.On production of accused the Addl.PP reopened the case under section 226 Cr.P.C .
FRAMING OF CHARGES:-
6.Heard both sides on framing of charge. A charge U/s 354 IPC was framed, read over and explained to the accused. Accused pleaded not guilty and claimed to be tried.
7The prosecution cited (07) witnesses and got examined PWs 1 to 7 and got marked Ex P1 to P5.

EVIDENCE BEFORE THE COURT:-
8.Pw-1 M.Sayamma deposed that about (20) years back, she married to accused at Pedda Gutta (Bada Pahad). About one and half year back, at
Kishtagoud Hotel at 8.30 a.m at Jalalpur village, the accused came to the hotel and when she asked as to why he is not coming to her and not maintaining her, accused torn her jacket. Immediately to save her dignity, she covered her body with her saree (Kongu) and that accused beat her. At that time, Gutpa Laxma, Neeradi Laxman and
Miryala Laxman came and rescued her and she informed the Sarpanch of the village who advised the accused to look cordially. The accused stated before the Sarpanch that he will look her cordially but never looked her. She waited for one week and then lodged complaint under Ex P1 and Ex P2 is her photo with the accused.
9.PW2 G.Laxman turned hostile and his 161 Cr P C statement is marked as Ex P3.
10.PW3 M.Laxman deposed that the accused is the second husband of
PW1 and about one year back, at 8 a.m at Kishtagoud hotel, there was a galata between the accused and PW1 and the accused torn the jacket of PW1 and she covered the same with her saree (Kongu) and along with her, one Laxman was also present.
11.PW4 Neradi Laxman deposed that the accused and PW1 used to live separately in the village and previously galata took place at bus stand between the accused and PW1 and PW1 came to him with a torn jacket and saree and on enquiry he came to know that maintenance of Rs 1500/- was granted by the Court and when the accused did not pay the maintenance, the galata took place and accused asked to grant some time for payment of maintenance and he advised PW1 and accused to live cordially and after that PW1 stated to him that she is having threat to her life from accused and asked to give undertaking by accused and when accused refused, she approached the Court.

12.PW5 Guthpa Laxman turned hostile and his 161 Cr P C statement is marked as Ex P4.
13.PW6 Mogulaiah, Head Constable deposed that on 29.4.2011 at 1930 hours, he received complaint from PW1 and registered a case in Cr No. 98/2011 for the offence U/s 354 IPC and issued FIR in Ex P5 and on the same day he examined
PW1 and on the next day visited Jalalpur and examined Pws 2 to 5.
14.PW7 P.Sateesh, Inspector of police deposed that previously he worked as SI of police, and on 1.5.2011 he took up investigation and found it on correct lines and on 4.7.2011 he apprehended the accused at Jalalpur village and sent him for judicial remand along with charge sheet.
313 Cr.P.C. Examination:- 15That on closure of prosecution evidence, accused was examined U/s 313 Cr P C to explain the incriminating evidence. Accused denied the incriminating evidence and reported no defence.
16.Heard both sides.
17.The learned Addl Public Prosecutor submitted that normally a wife will not file case against her husband but this incident took place at open place and the offence of outraging modesty is corroborated with the evidence of brother of victim,
Sarpanch of the village. He further argued that the delay may be condoned since the incident was narrated to the Sarpanch wherein the accused never agree and hence delay can be condoned in filing the case. Hence he prayed to convict the accused.
18.On the other hand, the learned defence counsel submitted that the case of the prosecution cannot be considered when PW1 clearly admitted that there was dispute regarding maintenance amount between PW1 and the accused and there is no corroboration to the case of prosecution and the prosecution failed to examine the owner of the hotel where the incident took place. He submitted that the other witnesses are not eyewitnesses and the complaint is not lodged immediately but 5

lodged after (7) days and there are several contradictions and omissions which cannot be considered. The complainant is in nature of filing several false cases and there are disputes between the accused and PW1 and hence he submitted that PW1 filed false complaint and hence prayed to acquit the accused.
19.Now the point for consideration is whether the prosecution has proved the guilt of accused for the offence U/s 354 IPC beyond all reasonable doubt?
20.Coming to the case of prosecution, the evidence of PW1 is the victim and complainant. She admitted that she is illiterate and she worked as Upa sarpanch of Jalalpur village. And about (20) years back she married the accused at Peddagutta.
She admitted that after 10 or 15 days of the incident, she lodged complaint. She admitted that she filed maintenance case against the accused and she also filed criminal case against the accused in Special Mobile Court, Nizamabad and this is the third case filed against the accused. She cannot say what is the stage of the maintenance case. She further stated that she filed maintenance case as the accused is not maintaining her. She clearly clarified in the cross examination that she questioned the accused at the hotel for paying maintenance amount on which the accused beat her. This admission goes to show that there is dispute between PW1 and accused regarding maintenance and the accused beat her when she demanded the amount. It further goes to show that there was no intention of accused to outrage modesty of victim. She admitted that PW3 is her own brother. She further stated that she did not witness Laxman and another Laxman at the hotel. This clearly goes to show though she mentioned the names of said persons, they were not actually present there. She denied the suggestion that she is filing cases after every six months.
21.It is worthwhile to mentioned that since PW1 admitted during cross examination the dispute with regard to maintenance and she cannot say the stage of the case. Hence,the evidence of other witnesses has to be considered.

22.PW2 turned hostile and his 161 Cr P C statement is marked as Ex P3.
Similarly, PW5 also turned hostile and his 161 Cr P C statement is marked as Ex P4.
Hence, the evidence of Pws 2 and 5 are not corroborated. There remains evidence of
PW3 who is brother of PW1. He supported the case of the PW1 and clearly stated that the incident took place near Kishtagoud hotel and it occurred on the other side of the hotel. He further deposed that he came to the scene (15) minutes after and he does not know the earlier case between PW1 and accused. Thus evidence of PW1 does not inspire confidence when he came to the place of incident after 15 minutes of accused beating PW1. Hence, his evidence cannot be considered to attract the offence U/s 354
IPC. The evidence of PW1 can be considered to the extent that when he demanded maintenance, the accused quarreled with her. Hence, evidence of PW1 is not corroborated by any other witness. There are three eyewitnesses out of them two did not support the case and the brother of PW3 came after the incident.
23.Admittedly, there is delay in lodging complaint. Since PW4 clearly admitted that PW1 approached her when he was at Gram Panchayat. It is worthwhile to mentioned that he stated to police that people were present and rescued PW1 and he cannot say the exact date of incident. He clearly admitted that galata took place between PW1 and accused due to non payment of maintenance amount of Rs.1500/-.
PW4 is Sarpanch of village and PW1 was Upa Sarpanch of the same village. Hence, evidence of PW4 cannot be trustworthy and reliable.
24.PW6 clearly admitted during cross examination that the incident took place 22.4.2011 and there is delay of 7 days and as per the complaint, the accused is husband of complainant. He denied the suggestion that the complaint does not disclose the ingredients of Section 354 IPC. He also admitted that Pw1 lodged two or three cases against the accused. The character of PW1 can be considered when the
Investigating Officer clearly admitted that PW1 and 4 placed chappal garland on the
Ambedkar statue. This allegation can be considered since maintenance amount is not 7

paid by the accused. Hence, evidence of Investigating Officer also clearly disclosed the character of PW1 for filing false case against the accused.
25.On thorough and careful consideration of entire evidence on record, this court is of view that the evidence of Pw1 is not reliable and trustworthy since there is dispute for payment of maintenance from the accused and the court granted maintenance which is not paid by the accused. The eyewitnesses have not supported the case of prosecution. Hence the accused is entitled for acquital.
26.In the result, accused is found not guilty of the offence punishable U/s 354 IPC and he is acquitted U/s 235(1) Cr P C. Bail bonds of accused shall remain in force for a period of Six Months.
