ORDER

The matter is placed before the National Lok Adalath. Accused Nos.1 to 3 are present. Accused are examined u.Sec.239 of Cr.P.C and a charge u.Sec.447 and 379 IPC is framed against them read over and exaplained to them in Telugu. Having understood the same, accused is pleaded guilty voluntarily, Satisfied with the pleas of guilt tendered by accused, as it is a voluntary one. Accordingly, the accused found guilty under Sec.241 of Cr.P.C. The accused are explained as to the quantum of sentence prescribed under the law. The accused submitted this is only the case involved by them and they will be careful hereinafter. Hence, prayed the same. Taking the plea of the accused into consideration, I am of the view that sentencing the accused to pay fine would meet the ends of justice. In the result, accused Nos.1 to 3 are found guilty of the offence u/Sec. 447 and 379 IPC, as such, they are convicted u/Sec.241 Cr.P.C and they are sentenced to pay fine of Rs.1,000/- (Rs.One Thousand Only) each for the offence u.Sec.447 IPC, in default they have to undergo S.I for a period of one month each. Further they are sentenced to pay fine of Rs.3,000/- (Rs.Three thousand Only) each for the offence u.Sec.379 IPC, in default they have to undergo S.I for a period of one month each. The case property i.e.Tractor and Trailor bearing No.TS.04.UB.1581 and AP.20.TB.7480 which was given to interim custody to A1 vide orders in Crl.M.P.No.571/2018, dt.16.10.2018 and the case property i.e.Tractor and Trailor bearing No. TS.28.T.6951 and TS.28.T.6952 which was given to interim custody to A2 vide orders in

Crl.M.P.No.570/2018, dt.16.10.2018 and the case property i.e.Tractor and Trailor

bearing No.AP.20.TC.0929 and AP.20.TC.0930 which was given to interim custody to A3 vide orders in Crl.M.P.No.578/2018, dt.25.10.2018, shall be made absolute.

ORDER

The matter is placed before the National Lok Adalath. Accused is present. Accused is examined u.Sec.239 of Cr.P.C and a charge u.Sec.379 IPC is framed against him read over and explained to him Telugu. Having understood the same, accused is pleaded guilty volutarily. Satisfied with the plea of guilt tendered by accused, as it is a volutary one, Accordingly, the accused found guilty under sec.241 of Cr.P.C. The accused explained as to the quantum of sentence prescribed under the law. The accused submitted this is only the case involved by him and he will be careful herein after. Hence, prayed the court to take lenient view considering the same. Taking the plea of the accused into consideration, I am of the view that sentencing the accused to pay fine would meet the ends of justice. In the result, accused found guilty of the offence u.Sec.379 IPC, as such, he is convicted u/Sec.241 Cr.P.C and he is sentenced to pay fine of Rs.3,000/- (Rs. Three thousand Rupees only) offence u.Sec.379 IPC, in default he has to undergo S.I for a period of one month. The case property i.e. Tractor bearing No. TS 28 T 4288 and Trailor bearing No. TS 28 T 4289 which was given to interim custody to owner vide orders in Crl.M.P.No.32/2019, dt.08.02.2018, shall be made absolute.
