This appeal is coming before and of Sri Ravishankar Goud, advocate, counsel for Appellants and Madhuri, Advocate, counsel for Respondents, upon hearing both sides and perusal of material on record, this court passed the following:

This matter has been registered and numbered as per the orders of the

Hon’ble High Court in CRP No.5188/2013, dated 27.11.2024. As the appellants

counsel was not representing, this court issue fresh court notice to the appellants/parties. RP of appellant No.1 and 3 returned with endorsement that they had passed away and RP of appellant No.2 returned as address cannot be located. In the said circumstances, the matter cannot be proceeded further in view of non representation for the appellants. Had the appellants had been diligent pursuant to the order of the Hon’ble High

Court, they could have made representation in this matter either in person or engaging another counsel. As the appellant Nos.1 and 3 had passed away and address of appellant No.2 cannot be located as per the address mentioned in the petition, this court is handicapped to proceed further in this matter. In the said circumstances, this appeal is dismissed as abated against appellant No.1 and 3 and dismissed for default against appellant No.2.
