This is a suit fled for partition, directing the plaint scheudle property be divided into four equal shares according to the fertility and utility of the soil and directing the defendants to deliver the possession of one of such contiguous share to the plaintif within the time fied by the Court and in default the same may be done through the process of the court and for costs.

This Suit coming for fnal hearing before me in the presence of Sri V.Srinivasa Sastry, and Sri SMVL. Narasimha Rao, Advocates for the Plaintif and the plaintif counsel fled a memo reporting that suit is not pressing having stood over for consideration till this day, this Court made the following;

This is a suit fled for partition, directing the plaint schedule property be divided into four equal shares according to the fertility and utility of the soil and directing the defendants to deliver the possession of one of such contiguous share to the plaintif within the time fied by the Court and in default the same may be done through the process of the court and for costs.

Cause of action :- Cause of action for the suit arose since one month when the plaintif demanding the defendants 1 to 3 to cooperate for amicable partition and separate possession of her share into the plaint schedule property, but when the defendants 1 to 3 failed to cooperate for the same and postponing the same on some preteit or other and since two days when the defendants openly threatening the plaintif that they would going to alienate or eiecute and register some more nominal and collusive documents in respect of plaint schedule property to evade the legitimate share of the plaintif into the plaint schedule property is arose at Marella village, which is within the jurisdiction of this court.

Valuation and Court Fee:-For the purpose of court fee and jurisdiction, the total market value of plaint schedule properties is Rs.72,600/-, plaintiffs 1/4th share is Rs.18,150/-, 3/4th of the same is Rs.13,612-50, on which the court fee of Rs.1026/- has to be paid, since the plaintif is in joint and constructive possession into the plaint scheudle property a fied court fee of Rs.200/- is paid u/s.34(2) of ACF and SV Act.

The Inspector of Police, Darsi circle fled charge sheet against the accused 1 and 2 in Cr. No. 50/2016 of Mundlamur police station for the ofences punishable U/Sec.457, 380 or 411 of IPC.

// J U D G M E N T //

Accused produced before Jail Adalath and he voluntarily admitted the ofence for the charges framed against him. His admission is taken as voluntarily and true. So, accepting the same, the accused is found guilty for the charged ofence punishable under section 411 of IPC. The accused submitted that it is his frst ofence, and he is the only bread winner of his family. Hence, in the facts and circumstances of this case, considering the family status of the accused, lenient view is taken in awarding sentence. In the result, the accused is/are found guilty for the charged ofence punishable under sections 411 of IPC and he/they is/are convicted under section 241 of Cr.P.C., and he/they is/are sentenced to undergo Rigorous imprisonment for a period of 190 days which is disposed today. The beneft of the provisions of under section 428 of Cr.P.C is given and the period of his detention in jail from 17-6-2016 to 22-12-2016 is given set of against the term of imprisonment so imposed upon him. The accused is set at liberty forthwith, if he is not required in any other case. The case property order may be passed by the regular ofcer.
