Prosecutor for the State, and after hearing both sides, this Court made the following:

This petition is filed under section 482 of Bharatiya Nagarik Suraksha
Sanhita, 2023 by the Petitioner/Accused No.2 in Cr.No.33/2026 of Pattikonda
Prohibition and Excise Police Station, seeking anticipatory bail for the offence 2 under sections 7 (A) r/w 8 ( e ) of AP Prohibition Act, 1995. He contended that he has not committed the alleged offences and that he is innocent. He further contended that the entire investigation is completed and as such, the question of tampering any evidence does not arise. He further averred that he is doing business at Guntakal Town and he is an aged person suffering from old aged ailments and that his family is dependent upon his income only. He contended that in view of his medical condition, his presence is necessary at his house for supporting his family. Hence, he sought for granting anticipatory bail to him in the event of his arrest with the above said crime.
2. Notice is given to the learned APP who opposed the bail and filed counter denying all the allegations made in the petition and contended that the case is under pending investigation and that the petitioner is a habitual offender.
Hence, he sought for dismissal of the petition with costs.
3. Heard both sides and perused the record.

Whether the Petitioner/Accused No.2 is entitled for anticipatory bail as prayed for ?
5. As seen from the record, the case in Cr.No.33/2026 was registered by the SHO of Patthikonda Prohibition and Excise Police Station for the offence
U/sec.7(A) r/w 8 (e) of AP Prohibition Act, 1995 basing upon a panchanama dt.12- 3-2026 while conducting raid near in Maddikera Town. It is mentioned in the panchanama that during the course of raid, the police observed that one
Sathupati Krishna (A1) was found with Four Iron Drums of 200 liters of FJ Wash and 10 plastic cans of each 20 liters of FJ Wash and one plastic pot containing 15 3 liters ID liquor and that the same was seized. The CD file shows that on 4-4-2026 the said Sathupati Krishna/A1 was arrested near Ambedkar Circle, Pattikonda mandal and he confessed about committing crime in this case and further confessed that he had got acquaintance with the petitioner herein in course of
Cr.No.11/2024 of Maddikera PS and that he had transferred the contraband to the petitioner herein in the past. The CD file further shows that investigation is not yet completed. Further, it shows that the petitioner/Accused No.2 was involved in
Cr.No.11/2024 of Maddikera PS and that he is an habitual offender. Hence, when the investigation is not yet completed, charge sheet is not yet filed and when the petitioner is shown as habitual offender, this court feels that granting anticipatory bail to the petitioner/Accused No.2 is not permissible. Hence, in view of the afore said discussion, the petition is liable to be dismissed.
In the result, petition is dismissed.
