This suit is coming up before me for final hearing on 25­9­2019 in the presence of Sri J. Rama Krishna, Counsel for Plaintiff and defendant set exparte and the matter having been heard and stood over for consideration till today, this Court delivered the following:

J U D G M E N T

1.This suit is filed for partition and seperate possession.

2.In brevity, the averments of the plaint are that the plaintiff and defendant are real sisters and they are children of late K. Sunkana and

Shobharani. During life time of her mother i.e, Shoba Rani purchased the house site plot No.38 on land admeasuring 125 sq.yds or 104.50 Sq.Mtrs in

Sy.No.123 and 124 situated at Dwaraka Nagar, Quthbullapur Municipal circle and Mandal (previously Ranga Reddy District) from her vendor

N.Pentaiah S/o. Sathaiah under a registered sale deed bearing document No.

22096/2006 dated 07­11­2006 registered at D.R.O. Ranga Reddy District and house premises bearing No. 49­115, on plot No.90/A on a land admeasuring 100 sq.yards or 83.6 Sq.Mtrs with plinth area 100 Sq.Ft in Sy.No.128 situated at Cherukupalli colony, Quthbullapur village, Municipal circle and

Mandal, GHMC , Medchal District from her vendor K. Mariyadas S/o. K.

Samson under a registered sale deed bearing document No.24523/2006

dated 02­12­2006 registered at D.R.O. Ranga Reddy District, in respect of suit

schedule properties. After purchase of the above said properties, she constructed ground + first floor and schedule “A” and ground + 2 floors in

Schedule “B” properties. During the life time of her mother, she performed the marriage of defendant in the year 1998 and eversince her marriage, the defendant used to stay with her family at Dwaraka Nagar colony, Chintal,

Quthbullapur municipal circle and Mandal, GHMC, Medchal District i.e.,

Schedule “A” property as tenant. Evenafter the marriage of the plaitniff, plaitniff and her husband used to stay in the portion of schedule “B” property and they used to look after the welfare of her parents. The father of the planitiff died on 13­07­2014 and since then the planitff and her husband used to looked after the welfare of her mother Shobha Rani. When her mother demanded the rents from defendant, the defendant and her husband beat her mother and they also committed theft of ATM card and gold of her mother.

They have withdrawn the sum of Rs.1,80,000/­ from the bank account of

Shoba Rani without her knowledge and consent. Upon which Shoba Rani lodged a report before P.S. Jeedimetla and a case was registered against the defendant. When Shoba Rani was admitted in Basavatarakam hospital for

treatment, plaintiff pledged her Mangal Sutram and cleared the medical bills of the hospital. Smt. Shoba Rani died on 13­05­2019 leaving behind her two daughters i.e., plaintiff and defendant, who are the legal heirs and successors to her estate. The suit schedule properties were not partitioned during her lifetime and after the death of Shoba Rani, plaintiff and defendants are in joint posession and enjoyment of the suit schedule properties by succeding the same without their being partition with metes and bounds. After death of

Shoba Rani, plaintiff approached the defendant for partition of the suit schedule properties with metes and bounds. But the defendants have not come forward for partition and protracted the matter with some lame excuses.

Plaintiff being the daughter of late Shoba Rani, is entitled for 1/2 share in the suit schedule properties along with defendant and in that connection she demanded the defendant to partition the suit schedule properties into two equal shares by metes and bounds on 10­06­2019, but the defendant dodged the matter and again on 15­06­2019 plaintiff approached the defendant along with elders with a demand to partition the same, even then the defendant did not come forward for partition. Hence prayed to pass a preliminary decree for partition and seperate possession partitioning the suit schedule properties into two equal shares by metes and bounds and allot 1/2 such share each to plaintiff and defendant and appoint advocate commissioner for partitoning the suit schedule properties into metes and bounds as per the preliminary decree and pass a final decree for partition in view of preliminary decree and award costs of the suit.

3.On the other hand defendant remained exparte.

4.Plaintiff got examined herself as P.W.1 and got exhibited Ex.A.1 to

Ex.A.7. Ex.A.1 is the certified copy of registered sale deed vide document

No.22096/2006 dated 07­11­2006, Ex.A.2 is the certified copy of registered sale deed vide document No.24523/2006 dated 02­12­2006, Ex.A.3 is original electricity bill, Ex.A.4 is the market value certificates two numbers dated 22­ 06­2019, Ex.A.5 is the death certificate of K. Shoba Rani, dated 09­07­2019,

Ex.A.6 is the community nativity and date of birth certificate dated 18­05­ 2009, Ex.A.7 is the SSC certificate of K. Sujatha dated 29­11­1996. 

5.Heard the learned counsel for the plaintiff and perused the documentary evidence.

6.Now the points that emerge for consideration is

i). Whether the suit can be decreed as prayed for dividing the suit

schedule properties into two equal shares each to plaintiff and defendant

by partition with metes and bounds?

ii) To what relief?

7.P.W.1 filed evidence affidavit in lieu of examination in chief and the contents of plaint are reiterated in the affidavit that the plaintiff and defendant are real sisters and they are children of late K. Sunkana and

Shobharani. During life time of her mother i.e, Shoba Rani purchased the house site plot No.38 on land admeasuring 125 sq.yds or 104.50 Sq.Mtrs in

9.The occular and documentary evidence adduced by the plaintiff remained unrebuted. A perusal of the occular and documentary evidence does not disclose anything patent to discredit the evidence of P.W.1. The occular and documentary evidence on record amply proves the claim of the plaintiff for partition of suit schedule properties and seperate possession of her respective shares as prayed for.

10.POINT No.2:

In the result, the suit is preliminarily decreed with costs dividing the suit schedule property i.e., House site plot bearing No. 38, on a land admeasuring 125 sq.yds or 104.50 sq.mts in Sy.Nos.123 and 124 situated at

Dwaraka Nagar, Quthbullapur municipal circle and mandal, GHMC, Medchal

District (Previously Ranga Reddy District ) and house premises bearing No.

49­115, on plot No.90/A on a land admeasuring 100 sq.yds or 83.6 sq.mtrs, with a plinth area 100 sq.ft in sy.No. 128 situated at Cherukupalli colony,

Quthbullapur village, Municipal circle and Mandal, GHMC, Medchal District ( Previously Ranga Reddy District) in two equal shares by metes and bounds and allotting half such share to each plaintiff and defendant.
