This Petition was presented on: 2020

This petition was referred to the Lok-Adalat at the request of the both parties

on the memo filed by the Advocate for the petitioner by the Motor Accident

Claims Tribunal (XVIth ADDITIONAL DISTRICT JUDGE, NANDIGAMA)

for the injuries of Petitioner, who injured on road accident Occurred on 19-1-2019in a Motor Vehicle Accident. The petitioner filed the claim application against the Respondents seeking compensation of Rs. 3,00,000/-.

This petition is coming on for inal settlement in the presencee ot

petitioner and the respondent No.3 and Sri B.Ramakrishna Advocate for the

petitioner and Sri. Darsi Arjuna advocate for the 3rd Respondent. The O.P, against R.1 & R2 is dismissed as not-pressed. Both the parties to the petition have agreed for settlement and filed terms of compromise with free will and volition. Hence, the following Award is passed as per the settlement arrived by the parties.

A WARD

1.] After negotiations and conciliation between the parties, the claim of the petitioner is settled at Rs.1,25.000/- (Rupees One lakh twenty five thousand only). The Respondent No.3 is being the insurance Company agreed to award the amount of Rs.1,25,000/- to the petitioner towards full and final settlement of entire claim amount.

The petitioner is entitled an amount of Rs. L, 2 5000-and he is

permitted to withdraw the total amount immediately.

31 Respondent No.3 shall deposit the above amount within one month from today. If the Respondent Na3 does not deposit the above amount within one month from today, the amount so awarded shal carry interest at @24 % per annum from the date of this Award.

4 The petitioner is entitled for refund of the Court Fee.

Both Parties have affixed their signatures in evidence of their consent for the terms of Award.

The appellant /defendant filed this Appeal against the respondent/plaintif challenging the Judgment and Decree dated 30.12.2019 in O.S.No.167/2017 on the file of Senior Civil Judge’s Court, Nandigama.

When the Appeal is coming for hearing, the appellant/defendant filed a memo duly giving notice to other side stating that they adjusted the matter out of Court before elders and he was not pressing the Appeal. The memo is recorded.

In the result, the Appeal is dismissed as not-pressed and as settled out side the Court. No costs.
