This case is coming on this day for final hearing before me in the presence of Learned APP for the prosecution and the Accused in person and upon hearing and having stood over the matter for consideration to this day, this Court delivered the following:

J U D G M E N T

1. The State represented by the Sub Inspector of Police, Gurla Police Station has filed a charge sheet against the Accused 1 and 2 for the offence under section 447 and 379 of IPC in Cr.No.9/2020.

2. The brief averments of the Charge-Sheet are that:

LW.5/ V.Paparao, SI of Police, Gurla Police Station on 05.02.2020 at 04.00 hours received credible information regarding illegal transportation of sand, forthwith he along with staff rushed to the Champavati River at Kotagandredu

Village at about 14.30 hours and found that the A1 who is the driver of Tractor and

Trailers bearing Nos.AP 07 TF 9432/AP 35 Y 6752 criminally trespassed into the

Champavathi River and excavated the sand from unauthorized sand reach and loading the same into the vehicle, then L.W.5. V.Paparao, SI of Police took him into custody and on enquiry, the A1 disclosed his name and identity and also disclosed that the Accused No.2 is the owner of the crime vehicle, basing on the confession of the Accused, an occurrence report was drafted and basing on the same, a case in Cr.No.9/2020 of Gurla Police station for the offence punishable under sections 447 and 379 of The Indian Penal Code,1860 against the Accused 1 and 2, and then served notice to the accused under section 41(A) of Cr.P.C and after 2 completion of investigation, L.W.6/V.Paparao, SI of Police filed charge sheet against the accused 1 and 2 for the offence punishable under sections 447 and 379 of the Indian Penal Code,1860.

3. On perusal of entire record, this case was taken on file for the offence punishable under section 447 and 379 of IPC against the Accused 1 and 2 and the relevant copies of case papers are furnished to the Accused 1 and 2 as required under section 207 of The Criminal Procedure Code, 1973.

4.On examination of the Accused 1 and 2 under Section 239 Cr.P.C, they admit the charge sheet allegations levelled against them. Hence, the charge under

Sections 447 and 379 of IPC has been framed, read over and explained to Accused 1 and 2 in Telugu, for which, A1 and A2 pleaded guilty for the charge under

Sections 447 and 379 of IPC and this Court followed the procedure contemplated

Under section XIX Cr.P.C.

5.Hence, the Accused 1 and 2 is found guilty for the charge under Sections 447 and 379 of IPC and they admitted the guilty as such they are convicted under Section 241 Cr.P.C.

6. When Accused 1 and 2 are questioned about the quantum of sentence, they stated that they are poor and they have to look after their families.

7. In the result, A1 and A2 are found guilty for the offence punishable under

Sections 447 and 379 of IPC and they are convicted U/s 241 Cr.P.C. for the said offence and A1 is sentenced to pay fine of Rs.2,000/- (Rupees Two Thousand only) for the offence under Section 379 of IPC and also sentenced to pay fine of

Rs.500 /- (Rupees Five Hundred only) for the offence under Section 447 of IPC, in total Rs.2,500/- (Rupees Two Thousand and Five Hundred only). The A2 is sentenced to pay fine of Rs.5,000/- (Rupees Five Thousand only) for the offence under Section 379 of IPC and also sentenced to pay fine of Rs.500 /- (Rupees Five

Hundred only) for the offence under Section 447 of IPC, in total Rs.5,500/- (Rupees Five Thousand and Five Hundred only) in default of payment of fine, A1 and A2 shall suffer Simple Imprisonment for a period of one week each for the offence punishable u/S. 447 and 379 of IPC each.

2. The brief averments of the Charge-Sheet are that:

L.W.5. V.Paparao, Sub-Inspector of Police, Gurla Police Station filed charge sheet alleging that they arrested the accused at Penubarthi Village Road Junction while he was performing vehicle checking along with staff on 18.12.2019 at about 14.30 hours since the accused drove the Tractor bearing No.AP 35 TB 4410 proceeding towards Viziangaram Side from Cheepurupalli with sand load and on enquiry, the accused stated that he excavated the sane from unauthorized

Gadigedda near their village Tatavarikithali and transporting the sand for selling at surrounding villagers, then the said Tractor was seized along with sand under cover of occurrence report, basing on the same, the SI of Police/L.W.5 registered the same as a case in Cr.No.178/2019 of Gurla Police station under the cover of occurrence report for the offence punishable under sections 447 and 379 of The

Indian Penal Code,1860 and then he served notice to the accused under section 41(A) of Cr.P.C and after completion of investigation, L.W.6 filed charge sheet 2 against the accused for the offence punishable under sections 447 and 379 of the

Indian Penal Code,1860.
