J U D G M E N T

1. This is a suit filed to pass a decree in favour of the plaintiff and against the defendant by granting a decree of Divorce by dissolving the marriage solemnized on 26.04.2008 at Neelapuram village of Kalasapadu mandal of Kadapa District between the plaintiff and the defendant and award costs and grant such other relief or reliefs.

02.The averments made in the plaint in brief are as follows :-

The marriage between the plaintiff and the defendant was solemnized on 26.04.2008 at Neelapuram village of Kalasapadu mandal of Kadapa District as per the caste and customs. After the marriage, the defendant has joined the plaintiff to lead matrimonial home at Guntakal to lead the marital life. The marriage of the plaintiff and defendant was not registered. The plaintiff and defendant lead happy married life for a period of two years. Thereafter the defendant statrted to pick up quarrels with the plaintiff and his aged parents and she used to go to her parents home frequently. On several occasions the plaintiff advised to defendant to change her behaviour but she was not changed her behaviour. In the month of 2016 the plaintiff convened the panchayath before the elders. In the panchayath the elders advised to plaintiff and defendant to put up separate family by leaving the aged parents of the plaintiff. Even the plaintiff put up separate family, the defendant has not changed her attitude and she continued her harassment towards plaintiff but the plaintiff is look after the defendant with most love and affection. In the month of May,2018 the defendant left the company of the plaintiff without any intimation and since then the defendant resided with her parents house.

On 12.12.2018 the plaintiff when to the house of defendant's parents houe and conducted a panchayath in the presence of elders. The defendant bluntly refused to joined with plaintiff and openly proclaimed that she is not interested to live with the plaintiff and she is ready to willing to go for divorce. On 27.12.2018 the plaintiff got issued a legal notice thourhg his counsel to join the marital life with the plaintiff. Even after receipt of the said legal notice the defendant did not care to join the plaintiff and neglected and failed to join the defendant to lead marital life.

The plaintiff came to conclusion that no meaning to continue the marital life with the defendant. Subsequently award was passed and hence the suit.

03.The defendant, in spite of opportunity, failed to appear and file written statement and ultimately, remained exparte to the proceedings.

04.In support of her case, the plaintiff, apart from examining herself as P.W.1 and got marked Exs.A1 to A4 on his behalf.

05.Heard the learned counsel appearing for the plaintiff.

06.Now the point for determination is:

Whether the plaintiff is entitled to the relief of dissolution of marriage as prayed for?”

07.P O I N T :- The plaintiff, as P.W.1, by way of his chief- affidavit reiterated the contents of the plaint in support of his case and also exhibited Exs.A1 to A4 to prove his marriage with the defendant. Ex.A1 is her marriage invitation card with the defendant dated 26.04.2008. Ex.A.2 is Joint photograph. Ex.A3 is office copy legal notice and Ex.A4 caste certificate issued by the Tahsildar, Guntakal infavour of plaintiff. This is a suit for dissolution of the marriage between plaintiff and defendant. As seen from the pleadings, the defendant is not disputing the relationship existed between the parties. The only dispute is whether the defendant subjected the plaintiff to cruelty leading his to seek for the dissolution of the marriage. The plaintiff, in order to substantiate his claim that the defendant has not shown any love and affection towards the plaintiff and thus the marriage was consummated, relied on his testimony to know about the harassmenmeted out against Pw1 by the defendant and his family members.

8.The case of plaintiff is that since the date of marriage the defendant joined the plaintiff at and lived 2 years. Thereafter the defendant statrted to pick up quarrels with the plaintiff and his aged parents and she used to go to her parents home frequently. On several occasions the plaintiff advised to defendant to change her behaviour but she was not change her behaviour. In the month of 2016 the plaintiff convened the panchayath before the elders. In the panchayath the elders advised to plaintiff and defendant to put up separate family by leaving the aged parents of the plaintiff. Even the plaintiff put up separate family, the defendant has not changed her attitude and she continued her harassment towards plaintiff but the plaintiff is look after the defendant with most love and affection. In the month of May,2018 the defendant left the company of the plaintiff without any intimation and since then the defendant resided with her parents house. The plaintiff, by examining P.W.1 and by producing Exs.A1 to A4 documents, has proved his marriage with the defendant and by virtue of oral evidence, established that his marriage was not consummated and he was subjected to cruelty in the hands of the defendant. The defendant did not choose to adduce any evidence to disprove the case of plaintiff. The evidence of P.W.1 remained unchallenged and proved.

9.There is no doubtful circumstance to suspect the case of plaintiff.

There is nothing to suspect the case of plaintiff either on limitation or on jurisdiction. Hence, the suit is fit to be decreed.

10.In the result, the suit is decreed with costs and the marriage between the plaintiff and the defendant on 26.04.2008 is hereby dissolved as prayed for.

Cause of action for the petition arose on 26.04.2008 when the marriage between the plaintiff and the defendant had been performed as per the customs and rite prevails in their community and on when the plaintiff convened the panchayath before elders at Guntakal and on when the defendant herself has left the company of the plaintiff and on 27.12.2018, when the plaintiff got issues the legal notice to the defendant calling her to join him are all within the jurisdiction of this Hon'ble court and this court has jurisdiction to entertain the suit.

A fixed court fee of Rs.10/- is paid under Schedule –II Article-I (vii) and Schedule II of A.P.C.F. and S.V. Act.

This petition coming on this day for disposal before me in the presence of Sri.D.C.Shekhar, advocate for the plaintiff and defendant remained exparte, and the matter having stood over for consideration till this day, this court doth order and decree:

This suit came up finally on 9.11.2022 for hearing before me in the presence of Sri.S.Eduruvali, advocate for the plaintiff and defendantremained ex-parte and on perusing the material available on record, the matter having stood over for consideration till this day, and this court made the following:

J U D G M E N T

1.This is a suit filed by the plaintiff against the defendant for recovery of

Rs.5,46,700/- (Rupees five lakhs forty six thousands and seven hundred only) being the principal amount and interest due under A to E marked promissory notes dated 5.09.2021,10.09.2021,16.09.2021,11.10.2021 and 15.10.2021 said to be executed by the defendant, in favour of plaintiff for

Rs.5,00,000/- (Rupees five lakhs only) each with interest agreeing to repay the same with interest of 24% per annum and for costs.

2.The averments of plaint in brief are as follows:-

The defendant borrowed an amount of Rs.5,00,000/- (Rupees five lakhs only) on five occasions from the plaintiff and executed i.e., A to E marked suit promissory notes on 5.09.2021,10.09.2021,16.09.2021,11.10.2021 and 15.10.2021, agreeing to repay the same with interest at 24% per annum.

Inspite of repeated demands made by the plaintiff, the defendant did not paid any amount neither principal nor interest due under the suit promissory notes. Hence, the plaintiff filed the present suit for recovery of suit amount of Rs.5,46,700/- with interest thereon.

3.The suit summons were retuned as absent affixed. On 22.9.2022

Publication filed and verified. The defendant called absent. No representation and did not choose to contest the suit. On seeing his absence, the Court set the defendant as Exparte on 22.09.2022 and proceeded with Trial.

4.During the course of Trial, the plaintiff himself examined as PW1 and marked Exs.A1 to A5 are the original promissory note i.e., A toE marked promissory notes executed by the defendant in favour of the plaintiff for

Rs.1,00,000/- each, 5.09.2021,10.09.2021,16.09.2021,11.10.2021 and 15.10.2021. No oral or documentary evidence adduced for defendant, as the defendant remained exparte.

5.Heard the learned Advocate for Plaintiff. Perused the oral and documentary evidence available on record.

6.Now the point for consideration is that :

Whether the plaintiff is entitled for recovery of the suit

amount of Rs.5,46,700/- along with interest from defendant ?

7. Point:

The plaintiff in her chief affidavit as PW1 reiterated the contents of plaint. It is the contention of PW1 that on 5.09.2021,10.09.2021,16.09.2021, 11.10.2021 and 15.10.2021, the defendant borrowed a sum of Rs.5,00,000/- on five occasions from him agreeing to repay the same with interest at the rate of 24% per annum and executed Exs.A1 to A5 i.e., A toE marked suit promissory notes in his favour. Inspite of requests made by the plaintiff, the defendant did not repay the amount. Hence, the plaintiff filed the present suit for recovery of suit amount of Rs.5,46,700/- with interest under Exs.A1 to

A5 - suit promissory notes, 5.09.2021,10.09.2021,16.09.2021, 11.10.2021 and 15.10.2021.

8.In support of her contentions, plaintiff is examined as PW1. According to PW1, the suit promissory notes transaction took place in his presence and he confirmed that suit Pro notes are genuine documents.

9.As seen from the evidence of PW1 and Exs.A1 to A5, it is clear that the defendant borrowed a sum of Rs.5,00,000/- on five occasions from the plaintiff on 5.09.2021,10.09.2021,16.09.2021, 11.10.2021 and 15.10.2021 and executed A to E marked suit promissory notes respectively in favour of the plaintiff. PW1 was not cross examined by the defendant, as the defendant remained exparte. The unchallenged evidence of PW1 proved his case. The evidence of PW1 is corroborating with that of Exs.A1 to A5.

Hence, the Court finds no reason to disbelieve the evidence of PW1. The plaintiff succeeded in proving the suit transactions. The plaintiff established his case that the defendant borrowed an amount of Rs.5,00,000/- on five occasions on 5.09.2021,10.09.2021,16.09.2021, 11.10.2021 and 15.10.2021 and executed Exs.A1 to A5 i.e., A to E marked suit promissory notes in favour of the plaintiff and also sufficiently proved that inspite of demands made by the plaintiff, the defendant did not choose to repay the suit amount and did not choose to contest the suit. In the circumstances, claim of the plaintiff is proved and he is entitled for decree, as sought for. Accordingly, the point is answered in favour of the plaintiff in the following manner:

10. In the result, the suit is decreed with costs in favour of

plaintiff and against the defendant, directing the defendant to pay a

sum of Rs.5,46,700/- (Rupees Five lakhs forty six thousands and

seven hundred only) to plaintiff with subsequent interest at the rate

of 12 percent per annum from the date of the suit to till the date of

decree and thereafter at the rate of 6 percent per annum till the

date of realization on principal amount of Rs.1,00,000/- (Rupees one

lakh only) each under A to E marked suit promissory notes

respectively.
