This case is coming on 23rd day of April, 2018 for hearing
before me in the presence of learned public prosecutor for the
state, and Sri T. Ravikiran, Advocate for accused appeared and having stood over for consideration till this day, the court made the following:
:: J U D G E M E N T ::
1.The Sub-Inspector of Police, Ibrahimpatnam Police Station laid Charge Sheet against the accused in Crime No. 125/2014, for the offence punishable under section 420, 409 of Indian Penal
Code.
2. The brief facts of the facts of the case are as follows:

On 26.03.2014 at 1100 hrs complainant of LW1/B. Krishna
Reddy, Assistant B.C. Welfare Officer, Hayathnagar division, R. R.
District, in which stated that the accused person/ Dr. Adapa
Srinivas Rao S/o. Sri Raja Rao, Aged 66 years, Caste: Telaga, Occ:
Principal of Suprabhath college of Engineering, Sheriguda village
was fraudulent claimed the PMS & RTF in respect of LW2/Sri B.
Gopal. All the records of the college pertaining to scholarships have verified by the ABCWO and DBCWO and himself for all four years from 2009-10 to 2012-13, and found satisfactory expect in the case of LW2. Hence, the complainant requested to take necessary action.
3.As per the contents of above complaint, LW4/Md. Ghouse registered a case in crime. No. 125/2014 under section 409, 420 of Indian Penal Code and took up the investigation.
4.During the investigation, LW4 examined and recorded the detailed statement of the LW1 and LW3/M. Ravinder Reddy. As per the instructions of LW4, the LW3 went to Siripur of Nizamabad and examined the LW2 and recorded his detailed statement.
Verified the all relevant documents from Suprabhath college of
Engineering and technology, Sheriguda village, Ibrahimpatnam
Mandal i.e. 1) Student admitted list issued by Government of
Andhrapradesh, 2) Scholarships sanctioned details, 3) copy of students register, 4) Student admission register and also collected the certified copies of the relevant documents from 3 office of the Dy. Director (BCW) Rangareddy district i.e. 1)
Application for post-metric scholarship (frees) for the year 2009- 10, 2) Intermediate Marks Memo, 3) SSC Marks Memo, 4) T.C.
Issued by Shaakary Jr. college, Pangara village, Hyderabad, 5)
Bonafide/dated of Birth certificate, 6) Community Native ad date of Birth certificate, 7) Income certificate of Residence, 8)
Certificate of residence, 9) Distance certificate, 10) Ration Card,
11) Local candidate certificate, 12) Bonafide certificate issued by
Suprabath Engineering & Technology, college Ibrahimpatnam.
Thereafter collected the application status report (fee reimbursement) as of 200902405047 from BC welfare office,
Hayath Nagar, Ibrahimpatnam, R. R. district for the academic year 2009-10, 2010-11, 2011-12, 2012-13. Total fee reimbursement Rs. 1,32, 800/- claimed by the accused. As per the collection of evidence the prima facia prove against the accused. A such LW4 served notice under section 41-A Cr.P.C.
against the accused.
5.The investigation done so far is well established that the accused who is the Principal of Suprabhath college of Engineering and Technology, Sheriguda village. The LW2 is the victim by name Boddu Gopal and he is the presently as per the filing of date he studying MPCS Degree final year in Nishitha Degree college at Nizamabad. In the year 2009 he applied for entrance of EAMSET through online. At that time he uploaded his all 4 relevant education documents like Intermediate marks memo,
SSC Marks memo, Transfer Certificate, Bonafide, Caste certificate, Income certificate, Residential certificate, Distance certificate, Ration card and local candidate certificate etc., taking advantage the accused downloaded all the certificates of victim
LW2 through online and created fake admission in their college vide admission no. 20090196 dated 05-10-2009 for the academic year 2009-10 for Rs. 34,700/- 2010-11 for Rs. 32,700/-, 2011-12 for Rs. 32,700/- and 2012-13 for Rs. 32,700/- claimed the PMS &
RTF scholarships total amount Rs. 1,32,800/- in respect of victim
LW2 by affixing another photo instead of victim cheated the government and also fraud intention to misappropriation and cheated the government and also victim LW2 for wrong full gain.
Thus, the accused persons found to have committed an offence punishable under section 420, 409 of Indian Penal Code. Hence, the charge against the accused.
6.This case was taken on file for the offenses under section 420, 409 of Indian Penal Code against the accused.
7.On the appearance of the accused the copies of the relevant papers and documents were furnished under section 207
Criminal Procedure Code. The accused persons were examined under section 239 Criminal Procedure Code for which he denied 5 the prosecution case and pleaded not guilty and claimed to be tried. The matter posted for trial.
8.During trial, the prosecution examined PW1/B. Krishna
Reddy, PW-2/Md. Gouse are examined. On behalf of the prosecution Ex.P1 to P5 marked. Ex. P1 is the application given by the college authorities for fees reimbursement, Ex. P2 is the application of post-metric scholarship of the victim, Ex. P3 is the complaint of PW1, Ex. P4 is the First Information Report and Ex.P5 is the letter dated Nov 2014 addressed Dy. Director, BC welfare committee to SHO PS Ibrahimpatnam.
9.After closure of the prosecution evidence the accused examined U/Sec 313 Criminal Procedure Code, he denied the prosecution evidence and reported no evidence.
10.Heard both sides. Perused oral documentary evidence.
11.Now the point for consideration is:
Whether the prosecution proved the guilt of the
accused for the offence punishable under section 420,
409 of Indian Penal Code against the accused beyond
reasonable doubt?
a) The main case of the prosecution is that the accused who is the Principal of Suprabhath college of Engineering and
Technology, Sheriguda village. The LW2 is the victim by name
Boddu Gopal who is LW2 was applied for entrance of EAMSET through online in the year 2009 through online counseling. LW2 6 uploaded his all relevant education documents like Intermediate marks memo, SSC Marks memo, Transfer Certificate, Bonafide,
Caste certificate, Income certificate, Residential certificate,
Distance certificate, Ration card and local candidate certificate etc., taking advantage the accused who is the Principal of
Suprabhath college at Sheriguda downloaded all the certificates of victim LW2 through online and created fake admission in their college vide admission no. 20090196 dated 05-10-2009 for the academic year 2009-10 for Rs. 34,700/- 2010-11 for Rs. 32,700/-, 2011-12 for Rs. 32,700/- and 2012-13 for Rs. 32,700/- claimed the

In order to establish the case of the prosecution examined PW1/B.
Krishna Reddy Assistant Secretary of Residential schools and PW2 is the Investigation Officer. PW1 in his chief examination deposed that as per the records the LW2 had joined in B.Tech Ist year in
Suprabath Engineering College at Sheriguda in the year 2009-10.
LW2 joined in the said college through EAMCET counseling. In the counseling list his name shown in serial no.9. Ex. P1 is the
Attested Copy of the counseling list. On 20-11-2009 the college authorities applied for fees reimbursement in respect of LW2. Ex.
P2 is the application given by the college authorities for fees reimbursement. On physical verification found that LW2 who 7 joined in the college after Appling for scholarship reimbursement left the college by taking the transfer certificate from the college authorities. Meanwhile the department sanctioned the amount of Rs. 1,32,800/- for three academic years and credited in the account of the college Principal. And Rs. 18,700 for maintenance credited in the account of the LW2. After that the college authorities re-deposited the entire amount of Rs.1,32,800 and also Rs. 18,700 into the Government account under two different challans. He lodged the complaint against the college
Principal by alleging that actually LW2 not joined the said college
and the accused falsely submitted Ex. P2. Ex. P3 is Police complaint.
b)The evidence of PW1 shows that when the LW2 applied for admission in the college, the accused applied for reimbursement and when the LW2 left the college by taking the transfer he re- deposited the amount. The cross examination of the PW1 also shows that the college students used to submit their applications directly to the department for reimbursement facility. It is also admitted fact that the LW2 was the student of Suprabhath
Engineering college as per the records. The evidence shows that there is no fraudulent intention on the part of the accused. When the LW2 joined in the college by way of admission, the accused applied for fees reimbursement through student only. When the
LW2 student himself made application there is no question of 8 playing fraud on LW2 by the accused. After taking the Transfer
Certificate by LW2 he re-deposited the amount, as such there is no question of misappropriation of funds of the Government by the accused. As such the court held that the prosecution failed to prove the guilty of the accused beyond reasonable doubt and the accused is liable to be acquitted.
In the result, the accused found not guilty for the offense punishable under section 420, 409 of Indian Penal Code.
Accordingly the accused acquitted under section 248 (1) of
Criminal Procedure Code. The bail bonds of the accused shall be cancelled after appeal time.
