This case coming on this day before me for final hearing in the presence of Assistant Public Prosecutor on behalf of the prosecution and of Sri N. Srinivas Raju, Counsel for the accused, and having stood over for consideration till this day, this court delivered the following:

J U D G M E N T

01.The Sub­Inspector of Police, Dichpally Police Station,

Nizamabad filed a charge sheet in Crime No. 291/2013 against the

Accused for the offence punishable Under section 338 Indian Penal

Code alleging as follows:

02.That on 19.09.2013 at about 1700 hours, while the Sai

Kumar, who is the grand son of defacto­complainant/LW1/Pedda Sailu, went along with other children on the top of building of his neighbor by name Golla Anjaiah and they were playing. At that time Sail Kumar 2 came in contact with LT electricity contact wires, which were passing in front of said building, due to which the said Sai Kumar sustained severe burning injuries to his right hand and right leg. Immediately

Injured/Sai Kumar was shifted to Govt. Hospital, Nizamabad. As per the advise of the doctors, injured/Sai Kumar was again shifted to

Gandhi Hospital, Secunderabad for expert treatment, where doctors amputated the right hand and right leg of the injured. On knowing same, the officials of Electricity Department has removed the wires and placed the wires with some deistance. If the plastic pipes were fitted to the LT current wires by the Electricity Department, the said Sai Kumar would not have sustained burn injuries and because negligence on the part of Accused as linemen, the injured Sai Kumar became handicapped and the Accused is responsible for the said offence. Thus, the accused committed the offence punishable Under section 338 of

Indian Penal Code.

03.Cognizance was taken for the offence under Section 338 of

Indian Penal Code against the Accused by the 2nd Addl. Judicial

Magistrate of First class, Nizamabad.

04.Thereafter this case was transferred from II Addl. Judicial

Magistrate of First Class, Nizamabad to this court proceeding of Hon’ble

District Court, Nizamabad vide Dis No.3602, Dt. 10.07.2017 and on receipt of this case, the case was renumbered vide CC. No. 112 of 2017 and accordingly proceeded with.

05. Case papers were furnished to the accused on his appearance as contemplated Under Section 207 of Criminal Procedure Code.

06.The Accused was examined under Sec.251 Cr.P.C by explaining substance of accusation for the offence punishable Under

Section 338 of Indian Penal Code, for which he denied the same, pleaded not guilty and claimed to be tried.

07.The prosecution in support of its case examined P.Ws 1 to 6 and marked Exs.P1 to P4 documents.

08.After the closure of prosecution evidence, the accused was examined under Sec.313 Cr.P.C. by explaining the incriminating circumstances appearing against him in the evidence of the prosecution witnesses. He denied the same and stated that he did not commit any offence.

09.The Accused was himelf examined DW1 and also DW2 was examined on his behalf. 

10.Heard arguments on either side.

11.The point that arises for consideration is whether the prosecution has established the guilt for the offence Under section 338 of Indian Penal Code against the accused beyond all reasonable doubt?

12. POINT: To bring home the guilt for the said offence against the accused the prosecution has examined P.Ws 1 to 6 and relied on

Exs.P1 to P4 documents.

13.PW1/Chakali Pedda Sailu, who is complainant and grand father of the injured according to the case of prosecution and it is his evidence that about 5 years back on one day at about 5­00 pm, when his grand son namely Sai Kumar was playing with a ball on the up stair of house of Golla Anjaiah which is situated near by their house in their village and the said Sai kumar came in contact with LT electricity conductor wires which were passing very near infront of house of said

Golla Anjaiah and his grand son Sai Kumar sustained severe burn injuries on his right hand and right leg. On seeing the Lw3/Pw2 switched off electricity supply. At that time he was in his house and on hues and cries of children he went out from the house. Immediately he/PW1 and Lw2, shifted Govt. Hospital, Nizamabad and from there on the advise of doctors his grand son was shifted to hospital in

Hyderabad for better treatment. Where the doctors operated his grand son Sai kumar and amputated his right hand and right leg. This incident was occurred due to negligent act of the linemen of their area.

He lodged a police report, and the same was marked as Ex.P1 in his evidence. 

14. Pw2/Sangem Pedda Sailu, and it is his evidence that about 5 years back on one day at about 5­30 pm, when one boy Sai Kumar son of Sailu who is resident in his locality, who was playing with other children at the upstair of house of one Golla Anjaiah got electrical shock in contact with electricity wires which were passing in front of

Golla Anjaiah and on knowing the same as some of the persons loudly spoke about the incident and immediately he switched off the power 5 supply from small transformer. Thereafter he went to incident place where he observed that the said Sai Kumar sustained severe injuries and he was shifted to Govt. Hospital Nizamabad and from there he was shifted to hospital in Hyderabad where Sai kumar operated and his right hand and right leg were amputated.

15. Pw3/Kashetty Abhiram, who is eye­witness according to the case of prosecution, and it his evidence that he know Pw1, Pw2, Lw2 and Lw4 as they all belong to same village. He knows the injured Sai

Kumar as he is residing in front their house. On 19­09­2013, at evening hours 4­00 to 5­00 pm, when he and Sai Kumar were playing with ball along with other friends at the up stair of house of Golla Anjaiah, and when the ball was falling down from the up stair of said house the Sai

Kumar tried to caught hold the ball and suddenly his hand touched to the electrical wires which were passing in front of the said house of

Golla Anjaiah and the Sai Kumar sustained severe burning injuries on his right hand, right leg and on his stomach. On hearing of their hues and cries, the Pw2 switched off power supply from the transformer which is situated near the house of Golla Anjaiah. Thereafter the locality people and parents of Sai kumar came there and shifted the injured Sai Kumar to the hospital for treatment. After some days he came to know that the right hand and right leg of Sai Kumar were amputated in the hospital.

16.Pw4/Upriyala Sridhar, who is panch witness according to the case of prosecution and he deposed that on 19­9­2013 at morning hours about 9 a.m the police conducted panchanama at the house of 6 one Golla Anjaiah in their village as one boy got electrocution shock and sustained injuries to his hand and leg. He observed at the accident place that the electrical wires are very near to Golla Anjaiah. After completion of panchanama he and Lw6 signed on it and the Crime details form was marked as Ex.P2.

17.PW5/J. Naresh, and PW6/SK. Mujeeb­Ur­Rahman, who are investigating officers and they deposed about their investigationon the lines of charge sheet. Ex.P3 is F.I.R was marked during the evidence of

PW5.

18.PW­3 who is eye witness to the alleged electrocution accident, and clearly deposed that on 19­9­2013 at evening hours 4­00 to 5­00 Pm, when he and Sai Kumar/injured were playing with ball along with other friends at the up stair of house of Golla Anjauaiah, and when the ball was falling down from the up stair of said house, the said Kumar tried to caught hold the ball and suddenly his hand touched to the electrical wires which were passing in front of the said house of Golla Anjaiah and the said Kumar sustained severe burning injuries on his right hand, right leg and on his stomach. PW­2 who is immediately eye witness, and it is his evidence that on knowing the same as some of persons lodly spoken about the incident and immediately he switched off the power supply from small transformer, and thereafter he went to incident place where he observed that the said Sai Kumar sustained severe injuries. The evidence of PW2 and

PW3 is sufficient to show that the said Saikumar sustained injuries in electrocution accident. However, mere proving that the said Kumar 7 sustained injuries in electrocution accident is not sufficient to connect the accused as he the electrocution accident was occurred due to his negligence while discharging his duties as a Lineman. The Prosecution has to positively establish that the electrocution accident was occurred due to his negligence while discharging his duties as a Lineman. 

19.Counsel for the Accused argued that the Accused was

Junior Lineman and it is only to help the Senior Lineman. Further, the electrical wiere which were passing infront of Golla Anjaiah are 11 K.V.

electrial wires but not LT current wires, and the said 11 K.V. electrial wires comes under the preview of Senior line Inspector, Asst. Engineer, and Additional Divisional Engineer, but the same same does not come under the preview of Junior Lineman. Thus, the Accused is no way concerned with alleged accident, and there is no negligence on his part while discharging his duties, and he was falsely implicated in this case. 

20. PW1 deposed in his cross­examination that about 5 or 6 years back from the date of alleged incident the electricity department laid electricity wires in front of house of Golla Anjaiah, and further he deposed that the said Golla Anjaiah constructed his house about 4 or 5 years back from the date of alleged incident. Further, PW1 deposed in his cross­examination that the said Golla Anjaiah never submitted any application to the electricity department for removal of electricity wire which were passing in front of his house.

21.PW2 deposed in his cross­examination that he does not know when the accused has joined his duty as Junior lineman in their 8 village. Further he deposed in his cross­examination that he does not know whether the accused joined the duty prior to 2 ½ months of alleged incident. Further, he deposed in his cross­examination that he does not know who made installation of the alleged electricity passing wires in front of house of Golla Anjaiah. Further, he deposed in his cross­examination that he cannot say when the said electricity passing wires in front of house of Golla Anjaiah were installed.

22.PW4 who is one of panch witness for conducting scene of offence panchanama under Ex.P2 and he deposed in his evidence that he observed at the accident place that the electrical wires are very near to Golla Anjaiah. In his cross­examination he deposed that for the last 20 years the said 11 K.V. current wires were existing near by houae of said Golla Anjaiah. But, Investigating officer/PW5 deposed in his cross­examination that the alleged electrical wires referred in this case are LT wires. It is necessary to appreciate the scene of offence panchanama/Crime details form which was marked under Ex.P4. It is mentioned in Column No.10 of Ex.P4/Crime Details form it is mentioned as there 11 K.V. electricity wires near by house of Golla

Anjaiah. But, according to the evidence of PW5 the electricity wires are

LT wires. Here there is discrepancy that whether the electrical wires 11 K.V. or LT wires. Further, he also admitted a suggestion in his cross­examination that it is mentioned as 11 KV wires at coloumn

No.10 in Ex.P4/Crime details form. Further, he deposed in his cross­ examination that he did not enquire that since how long the electrical wires have been passing in front of house of Golla Anjaiah. Further, he 9 deposed in his cross­examination that he did not enquire that whether any person gave any complaint for removal of electrical wires which are passing in front of house of Goll Anjaiah. Further, he deposed in his cross­examination that the Golla Anjaiah house is R.C.C. construction.

Further, he deposed that he does not know whether the said Golla

Anjaiah obtained permission from Gram panchayat for construction of his house. The Investigating officers also failed to examine the Golla

Anjaiah and the injured Sai Kumar.

23.The evidence of DW1 that the 11 K.V. electrical wires referred in this case was installed about 20 years back. Further, it is his evidence that the said 11 K.V. electrical wire comes under the preview of senior Line Inspector, Asst. Engineer, Asst. Additional

Divisional Engineer and it is not come under the perview of Junior

Lineman.

24.DW2 who is Assistant Divisional Engineer was examined on behalf of the Accused by issuing summons on the application filed by the Accused. It is evidence of DW2 that at the time of alleged incident the accused worked as Junior Lineman in their department, and further deposed that after joining of three months of accused the alleged accident was occurred in Chandrayanpally village. Further he deposed that after the alleged accident he visited scene of place and he observed that there is a distance of 4 or 5 feets from the house to electrical wires. Further, he deposed that 11 K.V. electrical wires maintenance come under the preview of Senior Line Inspector, 10

Chandrayanpally village, and accused is no way concerned with the alleged electrician accident.

25.Further, PW5/Investigating officer deposed in his cross­ examination that he did not enquiry from how many days the accused working as Lineman at the area of alleged scene of place as on the date of alleged accident. Thus, the prosecution failed to prove that when the alleged wires were installed near by house of Golla Anjaiah, and who maintain the alleged electrical wires which are passing near by house of

Golla Anjaiah. Further, he admitted in his cross­examination that during his part of his investigation and he did not collect information that who maintain the 11 K.V. electrical wires from electricity department. Further, PW6 who is another Investigating officer also deposed in his cross­examination that according to his investigation the concerned A.E. of Electrical department and other officials will maintain 11 K.V. wires. The Investigating officers failed to examine any one of official witness of electricity department to come to conclusion that whether the alleged electrical wires are L.T. wires or 11 K.V. wires. 

26.The cardinal principle of criminal law cannot be forgotten that the prosecution has to prove the case against accused persons beyond reasonable doubt. The standard of proof is not preponderance of probabilities but proof beyond reasonable doubt. It is well settled legal proposition that the any benefit of doubt goes in favour of the accused persons.

27.In view of my foregoing discussion, this court finds that though the injured Sai Kumar sustained injuries due to electrocution, but the prosecution has failed to establish that the alleged electrocution accident was occurred due to his negligence on the part of the Accused while discharging his duties as Assistant Lineman in the

Chandhrayanpally village beyond all the reasonable doubts and in the circumstances the Accused is entitled for benefit of doubt and acquittal.

28.In the result, the accused is found not guilty for the offence

Under section 338 Indian Penal Code and he is accordingly acquitted under section 255(1) of Cr.P.C. The bail bonds of the accused shall stand cancelled after expiry of appeal period as per section 437­A of

Cr.P.C.

J U D G M E N T

01.The Sub­Inspector of Police, I Town, Police Station,

Nizamabad filed a charge sheet in Crime No. 314 of 2016 against the accused for the offence punishable Under sections 338 of Indian

Penal Code and Section 181 Motor Vehicle Act, alleging as follows: 

That on 27.08.2016 at around 6­00 pm, the injured/LW2/ Gunda Devidas left for Medical shop situated nearby the bus stand, Nizamabad on bicycle to bring medicine, came to medical shop and after taking medicine the injured was returning home on the same bicycle on the way, when the injured/LW2 2 CC.No.124/2018 reached nearer the entrance of bus stand, Nizamabad on Gandhi

Chowk­Railway station Main road, at around 7­30 pm, meantime an auto bearing No. TS­16­UV­5938 proceeding in the same direction and its driver ie., the accused drove the auto in a rash and negligent manner and dashed to the bicycle of the LW2, resulting that the injured/LW2 sustained grievous injuries to his right leg thigh and right hand forearm. After the incident the injured/LW2 was shifted to the Guru Raghavendra Hospital, Nizamabad and got admitted for treatment. The accused was not holding driving license at the time of accident. Thus, the accused committed the offence punishable under sections 338, Indian Penal Code and section 181 Motor Vehicle Act.

02.Cognizance was taken for the offences punishable Under sec.tion 338 of I.P.C, and sec. 181 M.V. Act., against the accused by the 1st Addl. Judicial Magistrate of First class, Nizamabad.

03.Copies of documents are furnished to the accused under

Sec.207 Cr.P.C. on his appearance.

04.At this stage the case was transferred from the 1st Addl.

Judicial Magistrate of First Class, Nizamabad proceeding of Hon’ble

District Court, Nizamabad vide Lr. Dis. No. 7015, Dt. 28.12.2017 to this Court, and the same was renumbered as C.C. No. 124 of 2018 and accordingly proceeded further.

05.When examined under Sec.251 Cr.P.C. explaining the substance of the accusation for the offences under sections 338, of

I.P.C, and sec. 181 M.V. Act., the accused denied the same, pleaded not guilty and claimed to be tried.

06.The prosecution in support of its case examined the PWs1 to 6 and marked Exs.P1 to P6 documents. 

07.After the closure of prosecution evidence, the accused was examined under Sec.313 Cr.P.C. explaining the incriminating circumstances appearing against him in the evidence of the prosecution witnesses. He denied the same and stated that he did not commit any offence.

08.No witnesses were examined and no exhibits marked on behalf of the accused and the defence is accordingly closed.

09.Heard arguments on both sides.

10 The point for consideration is whether the prosecution has established the guilty for the offences punishable Under sections 338 of I.P.C, and sec. 181 M.V.Act.,against the accused beyond all reasonable doubt?

11. POINT: To bring home the guilt for the said offence against the accused the prosecution has examined Pws1 to 6 and relied on

Exs.P1 to P6 documents.

12.PW­1 Gunda Devender, who is complainant and son of the injured and it is his evidence that LW2 is his father. On 26­8­ 2016 at evening hours his father/Lw2 went to medical shop and after purchasing medicines and he returned home on his cycle, on the way when he was reached near bus stand, Nizamabad at about 6 pm, meantime an auto came from his back side and dashed him.

Due to which father/Lw2 sustained injuries on his right hip. At that time he was at his working place i.e., Mee Seva center, Subashnagar, 4 CC.No.124/2018

Nizamabad. One person informed him over phone stating his father/Lw2 met with an accident and sustained injuries.

Immediately he rushed to the accident place and he shifted his father/Lw2 in the same auto i.e., crime vehicle to Guru Raghavendra hospital, Nizamabad. The said auto bearing No.TS­16­UA­5938. He came to know that the driver of name is Mujeeb. Further he deposed that he can identify driver of said auto. Accordingly he identified the accused. On the next day he lodged a police report. In his evidence marked police report as Ex.P1.

13.PW­2 Gunda Devidas who is injured and it is his evidence that PW1 is his son. On 26­8­2018 at evening hours, he went to medical shop at Gandhi chowk in Nizamabad. After purchasing medicines he returned his home on his cycle, on the way when he reached near bus stand at about 6 pm, meantime an auto came from his back side and dashed him. Due to which he sustained severe injuries on his right hip. After some time the Pw1 came and shifted him in the same auto to Guru Raghavendra hospital,

Nizamabad for treatment.

14.PW­3 Sk. Dastagir who is one of panch witness for conducting scene of offence panchanama, according to the case of prosecution, but he turned hostile and it is his evidence that he does not know Lw5. About one year back on one day the police obtained his signatures at police station on one panchanama regarding accident. He does not know contents of panchanama. In his evidence his signature on crime detail form was marked as Ex.P2.

15.PW­4 Macha Vinod, who is also who is one of panch witness for conducting scene of offence panchanama, according to the case of prosecution, but he turned hostile and it is his evidence that he does not know PW3. About one year back on one day the police obtained his signatures at police station on one panchanama regarding accident. He does not know contents of panchanama. In his evidence his signature on crime detail form was marked as

Ex.P3.

16. PW­6 Bheemula Ravi Kumar, who is also eye witness according to the case of prosecution and he deposed that about 2 years one day at about 7 pm, when he was going on bike from

Gandhi Chowk towards Ambedkar colony in Nizamabad on the way when he was reached near bus stand at that time one auto dashed one cyclist, due to which the cyclist fell down on the road and he sustained injuries on his hand, after that he made a phone call to son of injured and son (injureds son) came there and took injured along with him. He cannot say the bearing auto number. Further he deposed that he can identify the driver of auto. Accordingly witness identified the accused as he was the driver of auto.

17. PW­5 P. Suresh Kumar, the then Sub­Inspector of Police who is Investigating Officer, according to the case of prosecution in his evidence First Information Report marked as Ex.P4, Crime

Details Form marked as Ex.P5 and Medical Certificate of PW2 marked as Ex.P6.

18.Counsel for the Accused argued that the Accused was not the driver of crime vehicle and he is is no way concerned with the alleged accident and he was falsely implicated in this case.

19.Now coming to the cause of the accident, it is the case of the Prosecution that the accident occurred due to the rash and negligent driving of the driver of the Crime vehicle. PW­2 is injured in the alleged accident and PW6/Lw3 who is eye witness to the accident according to case of prosecution and their evidences are very crucial. PW2 deposed in his cross­examination that he cannot identify the driver of auto/crime vehicle. PW6 deposed in his evidence that he can identify the driver of auto, and accordingly he identified the accused as he was driver of auto. Mere identifying the accused by the PW6 as the driver of the crime vehicle is not sufficient to implicate the accused for the rash or negligent driving. The evidence of PW­2 that after purchasing medicines he returned his home on his cylce, on the way when he reached near bus stand at about 6 PM, mean time an auto came from his back side and dashed him. It is evidence of PW6 that when he was reached near bus stand at that time, an auto dashed one cyclist, due which which the cyclist fell down on the road and sustained injuries on his hand. The

Prosecution has to positively establish that the accused drove the vehicle in a rash or negligent manner and caused the accident.

However, the evidence on record is not at all sufficient to establish the rash or negligent driving on part of accused. Hence, this court hold that the Prosecution has failed to prove the rash or negligent driving of the accused beyond all reasonable doubt.

20.Further, PW3 and PW4 who are panch witnesses for scene of offence panchanamaunder Ex.P5, but they did not support the case of prosecution as they turned hostile.

21.In view of my foregoing discussion, the prosecution has failed to establish the guilt for the offence Under Section 338 of

Indian Penal Code and section 181 of M.V. Act against the Accused beyond all the reasonable doubts and in the circumstances the

Accused is entitled for benefit of doubt and acquittal.

22.In the result, the accused is found not guilty for the offences Under section 338, I.P.C, and section 181 M.V.Act., he is accordingly acquitted under section 255(1) of Cr.P.C. The bail bonds of the accused shall stand cancelled after expiry of appeal period as per section 437­A of Cr.P.C.

This case coming on this day before me for final hearing in the presence of Assistant Public Prosecutor on behalf of prosecution and of Sri G. Goverdhan, counsel for accused No.2 to 4, and having stood over for consideration till this day, this court delivered the following: 

J U D G M E N T

01. The Circle­Inspector of Police, IV Town Police station, Nizamabad filed charge sheet in Crime No. 349 of 2014 against the Accused No.1 to 4 for the offences punishable Under Sections 3 and 4 of Immoral Traffic (Prevention) Act, 1956 :

02. That on 30.11.2014 the Accused No.1 is running the brothel house with LW3/Smt. Vakodi Pavitra @ Priya and Lw4/Smt. Vuggude Swapna in his house by calling Accused No.2 to Accused No.4 and providing room for prosecution and obtaining money from Accused No.2 to 4 and also seized an amount of Rs. 1500/­ from the possession of Accused No.1 and three condom packets from the possession of Accused No.2 to 4 which was one condom packet from each, which contained three pieces. Thus, the accused No.1 to 4 committed the offences punishable under section 3 and 4 of Immoral Traffic Prevention Act 1956.

03.Cognizance was taken for the offences under Sections 3 and 4 of

Immoral Traffic Prevention Act, 1956 against the Accused No.1 to 4 by the 1st

Addl. Judicial Magistrate of First class, Nizamabad.

04. At this stage case was transferred from the 1st Addl. Judicial Magistrate of First Class, Nizamabad vide proceeding of the Hon’ble District Court,

Nizamabad Lr. Dis.No 3602, dt. 10.07.2017 to this court, and renumbered as

C.C. No. 302 of 2017, and accordingly proceeded further.

05.As per docket order dated 01.10.2018 the case against the Accused

No.1 was split up vide C.C. No.1821 of 2018 as NBW is pending against him.

06Copies of documents are furnished to the Accused No.2 to 4 under

Section 207 Cr.P.C. on their appearance.

07When examined under Sec.251 Cr.P.C. explaining the substance of the accusation for the offence under sections 3 and 4 of Immoral Traffic

Prevention Act­1956 the Accused No.2 to 4 denied the same, pleaded not guilty and claimed to be tried.

08. The prosecution, in support of its case examined the PW­1 & Pw2 and

Exs.P1 & P2 and MO's­1 to 4 were marked.

09.After the closure of prosecution evidence, the Accused No.2 to 4 examined under Sec.313 Cr.P.C.. explaining the incriminating circumstances appearing against them in the evidence of the prosecution witnesses. They denied the same and stated that they does not commit any offence.

10.Heard arguments on either side.

11. The point that arises for consideration is whether the prosecution has established the guilt for the offence punishable U/secs 3 and 4 of Immoral Traffic Prevention Act against Accused No.2& 3 beyond all reasonable doubt?

12.POINT: To bring home the guilt for the said offence against the accused

No 2 to 4 the prosecution has examined PWs1 & 2 and relied on Exs.P1 & P2 documents and MO's­1 to 4 were marked.

13.PW­1/Kanukutla Laxman, who is one of panch witness for conducting confession­cum­seizure panchanama, according to the case of prosecution, but he did not support the case of prosecution and turned hostile and it is his evidence that he does not know Lw1. He does not knows anything about this case. The police never conducted any panchanama at any time in his presence. The signature on confession­cum­seizure shown to him is not his.

14.PW2/J. Naresh Sub­Inspector of Police, IV­ Town Police Station

Nizamabad and it is his evidence that On 30­11­2014 at 8.25 pm, he received reliable information that prostitution is being run in a rented house of accused

No.1 and immediately he obtained search proceedings from SDPO, Nizamabad vide Proc. Lr. Dis. NO.1389/SDPO­NZB/2014. After that he secured Lw1 and 4

Lw2/Pw2 as mediators and after that he along with mediators and their staff rushed to the rented house of accused No.1 and raided house at about 9.15 pm, and in that house they found four male persons and two female persons. On his enquiry the male persons disclosed their names as Baduri Ram Reddy (A1),

Rapalli Santosh (A2), Gangishetty Ramesh (A3) and Padmawar Suresh Kumar (A4), when they about to confess the offence and he recorded the confessional statements of accused No.1 to 4 in his presence of Lw1 and Pw2/Lw2 and recovered Rs.500/­ x 1 = Rs.500 and Rs.100 x 10= Rs.1000, total amount of

Rs.1500/­ from accused No.1 and one condom packet which contained three condoms from accused No.2, one condom packet which contained three condoms from accused No.3 and one condom packet which contained three condoms from accused No.4. Confession­cum­seizure panchanama was marked as Ex.P1. MO.1 is Rs. 1500/­ Cash, MO.2 is one condom packet which contained three condoms, MO.3 one condom packet which contained three condoms and MO.4 is one condom packet which contained three condoms. After that the female persons disclosed their names as Vakodi Pavithra @ Priya and

Vuggudi Swapna. After that he brought the accused No.1 to 4, Lw1 and

Lw2/Pw2 to the police station and suomotu he registered a case vide Cr.

No.349/2014 for offences U/sec.3 & 4 of Immoral Traffic (Prevention) Act, 1956.

First Information Report was marked as Ex.P2. After that he examined the Lw3 and Lw4 and recorded their statements. Later he informed to Lw10 for further investigation.

15. According to the case of prosecution the evidence of LW1 and LW2/PW1 are very crucial to this case to support version of prosecution case, but the PW1 did not support the case of prosecution as he turned hostile and nothing was elicited during his examination by the learned A.P.P. under section 154 of Indian

Evidence Act. Further, the prosecution failed to examine LW1, and his evidence was closed on 21.12.2018 on filing of report by the police stating that LW1 went 5 other country. Further, the proseuction also failed to examine the LW3 and LW4 who are victims and their evidences were also closed on filing of report by the police are not residing in their addresses and they do not know w know where about the LW3 and LW4.

16. LW­5 to LW8 who are police officials and they assisted the

PW2/Investigating officer and LW10 who is also Investigating officer and filed charge sheet, but the prosecution failed to examine them even after giving several adjournments and their evidences were closed on 19­2­2019. Further, the Investigating officers also failed to examine any one of independent witnesses who are residing near by alleged house. PW2 who is first Investigating officer and it is not safe to rely on his evidence without the supporting evidence of independent witnesses. Moreover, PW2 is highly interested witnesses to succeed the case of prosecution. Thus, the prosecution failed to prove the alleged offences against the Accused No. 2 to 4 beyond all reasonable doubt.

17 In view of above foregoing discussion, absolutely there is no sufficient evidence against the Accused No. 2 to 4 to connect them with the alleged offences under sections 3 and 4 of Immoral Traffic (Prevention) Act 1956. Thus, the prosecution failed to prove the alleged offences against the Accused No. 2 to 4 beyond all reasonable doubt.

18.In the result, the accused No.2 to 4 were found not guilty for the offence punishable Under Sections 3 and 4 of Immoral Traffic Prevention Act, and they are accordingly acquitted U/s.255 (1) Cr.P.C. The bail bonds of the accused No.2 to 4, shall stand cancelled after expiry of appeal time as per the 6 provisions of Section 437­A Cr.P.C. No case property is ordered as the case against the Accused No.1 was split up and the same is pending.

01.The Sub­Inspector of Police, Rural Police station, Nizamabad filed charge sheet in Crime No. 35 of 2014 against the Accused for the offence punishable Under Sections 457, 380 of Indian Penal Code alleging as follows:

That on the night of 28/29.01.2014, the accused Bodasu

Mahesh gained entry into the Lw1/Gusiri Mohan Rao Quarters, by brake opening the lock of the door and committed theft of 1) Micromax Mobile,

2) Celkon Mobile and Cash of Rs. 12,000/­, spent away Rs.12,000/­ for his lavish expenses. Thus, the accused committed the offences punishable under sections 457, 380 of Indian Penal Code.

02.Cognizance was taken for the offences punishable Under sections 457, 380 of Indian Penal Code, against the accused by the 2nd

Addl. Judicial Magistrate of First class, Nizamabad.

03.Copies of documents were furnished to the Accused under

Section 207 Cr.P.C. on his appearance.

04.At this stage the case was transferred from the 2nd Addl.

Judicial Magistrate of First Class, Nizamabad, proceeding of the

Hon’ble Court, Nizamabad vide Lr. Dis.No 3602, dt.10.07.2017 to this

court, and renumbered as C.C. No. 66 of 2017, and accordingly proceeded further.

05When examined under Sec.239 Cr.P.C. the accused denied the offence. Charge Under Sections 457, 380 of Indian Penal Code were framed, read over and explained to him. He pleaded not guilty to the charge and claimed to be tried.

06. The prosecution, in support of its case examined the PW­1 to

PW5 and got marked Exs.P1 to P4 and MO’s­1 and 2.

07.After the closure of prosecution evidence, the Accused is examined under Sec.313 Cr.P.C. explaining the incriminating circumstances appearing against him in the evidence of the prosecution witnesses. He denied the same and stated that he does not commit any offence.

08.Heard arguments on either side.

09. The point that arises for consideration is whether the prosecution has established the guilt for the offences under sections 457, 380 of Indian Penal Code against the Accused beyond all reasonable doubt?

3 10.POINT: To bring home the guilt for the said offence against the accused the prosecution has examined PWs1 to 5 and relied on Exs.P1 to P4 documents and MO’s­1 and 2.

11.PW1 Gusri Mohan Rao who is complainant and it is his evidence that previously he worked as Deputy Jailer, Dist. Jail,

Nizamabad from the year 2013 to 2015 and in the month of January, 2014, on one day at night hours, when he was slept in a room of their jail quarters and he wake up at early morning and he found that some unknown offenders gained entry in to their house by damaging house doors and they committed theft of Micro Max mobile and

Celkon/Carbon mobile phone and also cash of Rs.12,000/­.

Immediately he lodged a police report was marked under Ex.P1. The police examined him and recorded his statement. Further he deposed that he received his two cell phones from the Court from interim safe custody and in his evidence Micro Max cell phone was marked as

MO­1 and Cellkon mobile was marked as MO­2.

12.PW­2 is D. Kalidas, who is one of panch for conducting scene of offence, according to the case of prosecution and he deposed that previously he worked as Jailer, Dist. Jail, Nizamabad and he know Lw5 who is his colleague. On 29­1­2014 at about 3 pm, the then Sub­Inspector of police, Rural conducted scene of offence panchanama and drawn rough sketch at the residential quarters of

PW1 in his presence and in the presence of Lw5 as some unknown offenders committed theft of two mobile phones and cash of 4

Rs.12,000/­. After completion of panchanama he and Lw5 singed on it. In his evidence Crime details form was marked as Ex.P2. 

13. PW3/Padakanti Sailu, who is one of panch witness for conducting confession­cum­seizure panchanama, but he did not support the case of prosecution as he deposed that he know LW7 as he is his villager. He does not know any thing about this case and the police never conducted any panchanama and nothing was seized in his presence at any time. The signature on confession­cum­seizure panchanama shown to him is not him. He does not know the accused person.

14.PW4/Gavvala Nadipanna who is also panch witness along with PW3 for confession­cum­seizure panchanama according to the case of prosecution, but he also did not support the case of prosecution. It is his evidence that he knows PW3 as he is his villager. He does not know any thing about this case and he does not know accused. The police never conducted any panchanama and nothing was seized in his presence at any time. Police obtained his thumb impression on some papers but, he does not know for what purpose they obtained. 

15.PW5/B. Ravinder, the then Sub­Inspector of Police, who is

Investigating Officer in this case and he deposed on the lines of charge sheet. In his evidence marked Ex.P3 and P4 documents i.e.,Ex.P3 is

First Information Report and Ex.P4 is Confession cum seizure panchanama. He denied a suggestion in his cross­examination that the accused never confessed the offence and nothing was seized from the possession of the accused. Further he denied that the accused is no 5 way concerned with the alleged MO.1 and MO.2 and they are planted for the purpose of this case. Further he denied that the accused is falsely implicated in this case.

16.There is no direct evidence against the accused to show that they gained entry into the house of Pw1 and committed the theft of MO­1 and MO2.

17.PW­3 and PW4 who are panch witnesses for confession­ cum­recovery panchanama of the Accused and they are crucial witnesses, but they did not support the case of prosecution as they turned hostile and their evidence is not supporting the evidence of the

PW­5, Investigating Officer. In these circumstances, it is not safe to rely the evidence of Investigating Officer/PW5 without supporting the evidence of independent mediators. Moreover, the confession before the police officers are not admissible in the evidence and hit by section 25 of Indian Evidence Act. Thus, there is no sufficient evidence against the accused No.2 for the offence Under sections 457, 380 of IPC and he is entitled for benefit of doubt and acquittal.

18.In view of the above discussion, the prosecution failed to prove the alleged offences against the Accused beyond all reasonable doubt and absolutely there is no sufficient evidence against the Accused to connect him with the charges leveled against him and that he became entitled for benefit of doubt and acquittal.

19.In the result, the accused is found not guilty for the offence punishable Under Sections 457, 380 of Indian Penal Code, and accordingly he is acquitted Under Sec.248(1) Cr.P.C. The accused was 6 produced before this court on 12.11.2018 on execution of P.T. warrant and now he is in judicial custody. Therefore, the jail authorities are directed to release the accused in this case, forthwith, if he is not required in any other case. The Accused is here by directed to execute bond for Rs.10,000/­ under section 437­A of Cr.P.C. for a period of six months. The case property which were deposed in this case vide CPR

No. 34/2014 ie., MO­1 is Mixcromax Cell phone, MO­2 is

Cellkon/Karbon mobile phone and the same were already given to its owner ie., PW1/Gursi Mohan Rao vide orders dated. 05.03.2014 of the II Addl. Judl. Magistrate of F.C., Nizamabad and the same are ordered to be retained with him after expiry of appeal period.

J U D G M E N T

01.The Sub­Inspector of Police, Rural, Police Station, Nizamabad filed a charge sheet in Crime No. 195 of 2014 against the accused for the offence punishable Under sections 338 of Indian Penal Code, alleging as follows: 

That on 03.05.2014 at about 1000 hours, while LW3/Kumar

Kallur Laxmaiah going to attend natural call on the road at Veerabhadra colony, in the meantime, the accused/rider of the motorcycle bearing No.

AP­25­AQ­0561 drove his vehicle in rash and negligent manner and dashed to Lw3, due to which he fell down on the ground. As a result, LW3 sustained grievous injuries. Thus, the accused committed the offence punishable under sections 338 of Indian Penal Code.

05.When the accused was examined under Section 251 Cr.P.C.

explaining the substance of the accusation for the offence under sections 338 of Indian Penal Code, the accused denied the same, pleaded not guilty and claimed to be tried.

06.The prosecution in support of its case examined the PW­1 and

PW3 and marked Exs.P1 to P5 documents. 

07.After the closure of prosecution evidence, the accused was examined under Sec.313 Cr.P.C. explaining the incriminating circumstances appearing against him in the evidence of the prosecution witnesses. He denied the same and stated that he did not commit any offence.

08.No witnesses were examined and no exhibits marked on behalf of the accused and the defence is accordingly closed.

09.Heard arguments on both sides.

10. The point for consideration is whether the prosecution has established the guilty for the offence punishable Under sections 338 of Indian Penal Code, against the `accused beyond all reasonable doubt?

11. POINT:The prosecution in support of its case examined the

PWs1 and 3 and marked Exs.P1 to P5 documents. 

12.PW1­Kalluri Bheemavva, who is the complainant according to the case of prosecution, but she did not support the case of prosecution and turned hostile and it is her evidence that about five years back on one day her son Laxmaiah/LW3 met with an accident when he was going to school. She does not know how the accident was occurred, but in the accident her son sustained injuries. Further she deposed that she does not know anything about this case. She never lodged any police report.

Further she deposed that she cannot identify the thumb impression on police report shown to her. The police never examined her and not recorded her statement. In her evidence, her section 161 Cr.P.C.

statement was marked as Ex.P1. 

13.PW2­Kulluri Laxmaiah @ Laxman, who is injured according to the case of prosecution, but he also did not support the case of prosecution and turned hostile and it is his evidence that about four years back on one day at morning hours, when he was going to School on the way when he was crossing the road one unknown bike dashed him, due to which he sustained injuries and he was unconscious. Further he deposed that he did not observe bike perfectly and he did not see its driver. He was admitted in private hospital for treatment. Except the same he does not know anything about this case. The police never examined him and not 4 CC.No.102/2017 recorded his statement. In his evidence, his section 161 Cr.P.C. statement was marked as Ex.P2. 

14.PW3­Guruvappa, who is Investigating officer and he deposed about his investigation on the lines of charge sheet and in his evidence marked First Information Report as Ex.P3, Crime Details Form as Ex.P4,

Medical Certificate of PW2 as Ex.P5. He denied a suggestion in his cross­ examination that the accused was not the driver of crime vehicle on the day of alleged accident and the accused is no way concerned with the alleged accident. 

15. According to case of prosecution PW1 is complainant, LW­ 3/PW2 is injured in the accident and their evidence is very crucial in this case, but they did not support the case of prosecution as they turned hostile and nothing was elicited during their cross­examination in supporting case of prosecution. During the cross­examination of PW­1 and PW­2 by the learned A.P.P. under section 154 of Indian Evidence,

PW­1 denied the suggestions that she stated before the police as stated in Ex.P1 i.e., his 161 Cr.P.C. Statement, and PW­2 denied the suggestion that he stated before the police as stated in Ex.P2 i.e., his 161 Cr.P.C. Statement. The evidence of PW­3, who is Investing officer is not safe to rely upon without the evidence of PW1 and PW2 .

 16.In view of my foregoing discussion, the prosecution has failed to establish that the accused was the driver of the crime vehicle at the time of alleged accident and the alleged accident was occurred due to his negligence with the Crime vehicle. Thus, the prosecution has failed to establish the guilt for the offence Under Section 338 of Indian Penal Code 5 CC.No.102/2017 against the Accused beyond all the reasonable doubts and in the circumstances the Accused is entitled for benefit of doubt and acquittal. 

17.In the result, the accused is found not guilty for the offence under sections 338 of Indian Penal Code, and accordingly he is acquitted under section 255 (1) of Cr.P.C. The bail bonds of the accused shall stand cancelled after expiry of appeal period as per provision under section 437­

A of Cr.P.C.
