This petition coming before me for hearing in the presence of Learned APP for state and accused present and on perusal of material papers on record and having stood over for consideration till this day this court has delivered the following:-

DOCKET ORDER, DT.24-09-2021

Accused are present. Copies furnished to accused. They are examined under section 251 Cr.P.C. Accusation for the offence under Sec.188 of IPC and Sec.9(i) of AP Gaming Act, have been explained and read over to the accused in Telugu. They pleaded guilty. They submitted that they are voluntarily admitting their guilt. Hence, they are found guilty and convicted under section 252 Cr.P.C for the offence U/Sec.188 of IPC and Sec.9(i) of AP Gaming Act.

The accused are questioned with regard to quantum of sentence. They submitted that they are the sole bread winners of their respective families. Hence prays to take lenient view with regard to quantum of sentence.

It is not a fit case to invoke the provisions of P.O.Act. However, considering the dependency of the family members of the convicted, nature of the case and circumstances, stated supra, this court is taking lenient view with regard to quantum of sentence.

In the result, accused are imposed to pay fine of Rs.1,000/- (Rupees One thousand only) each for the offence U/Sec.188 of IPC. In default of payment of fine they shall undergo simple imprisonment for a period of one week.

Further they are imposed to pay fine of Rs.300/- (Rupees Three hundred only) each for the offence U/Sec.9(i) of AP Gaming Act. In default of payment of fine they shall undergo simple imprisonment for a period of one week. The seized amount of Rs.3,300/-(Rupees Three thousand three hundred only) shall be confiscated to the state and the seized 52 playing cards shall be destroyed.
