The brief facts of the case as per charge sheet are that: 2.

On 09.10.2019 at 16:00 hours, PW1/V.Satyam came to police station and lodged a report stating that he is resicdent of Baleraopet village. On 06.10.2019 in between 8.00 p.m. to 8.30 p.m., Chindam Praveen came to his colony where women were playing Bathukamma, he came in an auto and stopped the auto, abused women in filthy language taking their caste name and threatened with dire consequences by shouting as to why they have caused delay in giving side to his auto. When he went to Praveen and requesting him to go away from the place as the women were playing

Bathukamma, on that said Praveen/ A1 abused him in filthy language on the name of caste and threatened him and left that place. Later A1 developed grudge against him with an intention to kill when he was going to Mancherial on his personal work, he abused him in filthy language. On 09.10.2019 in between 9.00 a.m. to 9.30 a.m. he was present in front of his house and talking to RMP Sirra Murali. Meanwhile the accused No.1 and 2 came to him in an auto. They got down the Auto. A2 while talking to him, Al picked up a stick from the auto and beat him indiscriminately by

abusing in filthy language. Then, the colony people rescued him.

After that, grandfather of accused No.1 by name Chindam Shankaraiah/ A3, grandmother of

Later he examined and recorded the Jatcianama and drawn rough sketch

PW2/Banavva, PW6/K.Rajeshwari, PWI/Velpula Satyam, of atements LW7/R.Rajaiah, PW5/B.Sumalatha, NG/ KBaravva, PW4/V. Posavva,

LW10/K.Rayamallu, LW11/N.Lingaiah, LNE/B Rajaiat, LW9/S.Sathaiah,

LNI2 RPochaiah, LW13/S.Murali and videographed their statements with the help cf LNI/V.Raiagopal Rao. Thereafter on 13.10.2019 he apprehended accused No.1 n enauiry, he corfessed the offence. He secured the presence of panch witnesses

LWI7/V Srinivas, LW18/B.Kiran and recorded confession statement of accused and

EZ re stick under cove of panchanarna. He proceeded to the house of A2 and rergateri hirn On interrogation he confessed the offence. Thereafter he arrested

A1 and A2 and pr (duced before the court for judicial custody. On 13.10.2019 he

Spl.SC No. 110 of 2019 Page 5 of9 issued notice U/sec.41-A CrPC to A3 to A6. Thereafter he collected caste particulars of complainant and accused persons from LW20/ P.Narsaiah, Tahsildar, Luxettipet.

He collected medical certificate of complainant from LW19/Dr P.Kumara Swamy.

After completion of investigation he has filed charge sheet.

The offence was taken cognizance by the Spl.Judge for trial of cases under

SCs/STs (POA) Act-Cum-V Additional District And Sessions Judge, Adilabad, vide

orders dated 06.12.2019 and registered as Spl.SC No.110/2019.

On appearance of the accused Nos.1 to 6 and on hearing the learned counsel 4 and learned public prosecutor charges were framed for the offences under Sections 323, 506 IPC, Sections 3(1)(s), 3(2)(va) of the Act 33 of 1989 against accused No.1; for the offences U/sec.323 IPC, Section 3(2)(va) of the Act 33 of 1989 against Accused

No.2; for the offence under Section 3(1)(s) of the Act 33 of 1989 Accused Nos.3 to 6, read over and explained to them in Telugu language, accused pleaded not guilty and claimed to be tried.

On completion of prosecution evidence, as there is no

in the evidence of PWs 1 to 6., the examination of accused under Section 313 CrPo 6 is dispensed with.

After hearing the arguments of both sides, today the matter stood for 7.

judgment.

Now the sole point that falls for consideration is: "Whether the prosecution could prove the charges for the offences under 8 Sections 323, 506 IPC, Sections 3(1)/s), 3(2)(va) of the Act 33 of 1989 against accused No.1; for the offences U/sec.323 IPC, Section 3(2)(va) of the Act 33 of 1989 against Accused No.2; for the offence under Section 3(1)(s) of the Act 33 of 1989 against accused Nos.3 to 6, beyond all reasonable doubts or not?"

POINT: At the time of trial, the prosecution examined PWs 1 to 6, and got marked the 9.

documernts Ex.P1 to P7.

PWi/Velpula Satyam is complainant, PW2/B.Banavva, PW3/K.Banavva, 10. PW4/B.Posavva, PW5/Sumalatha, PW6/Rajeshwari are eye witnesses to the incident and speaks about the facts of the case.

11. The PW1/Velpula Satyam deposed he does not know anything about this case

and he never lodged report. The PW1 did not support prosecution case. So, the

learned PP requests the court to declare the witness hostile and cross examined him by explaining the contents of 161 CrPC statement. Even though PW1 did not support

the prosecution case. So the evidence of PW1 is not helpful to the prosecution.

PW2/B.Banavva, PW3/K.Banavva, PW4/B.Posavva, PW5/Sumalatha,

PW6/K.Rajeshwari, alleged to be eye witnesses to the incident, they did not support prosecution case and categorically stated they do not know anything about this case and police never examined them. So, the learned PP requests the court to declare the witnesses hostile and cross examined them by explaining the contents of 161 CrPC statements. Even though they did not support prosecution case. So the evidence of

PWs 2 to 6 is not helpful to the prosecution.

13. As the material witnesses turned hostile and did not support prosecution, so the learned PP given up the remaining witnesses.

Therefore, there is no

incriminating evidence against the accused. Hence, the accused persons are entitlecd

to benefit of doubt. Point is answered accordingly.

JUDGMENT

1. The Asst.Commissioner of police, Mancherial filed a charge sheet against the accused in Cr.No.127/2019 for the ofence U/sec 290 IPC and Section 3(1)(s) of

SCs/STs Act.

2 The brief facts of the case as per charge sheet are as follows:

On 18.08.2019 at 17:30 hours PW1/Islavath Gopal came to police station and lodged a report stating that on 18.08.2019 at about 10:00 hours he came to Dandepalli village to attend the panchayath of K.Srilatha. After arrival of panchayath elders, wife and husband all together went to Primary agriculture cooperative society new building for panchayath. At about 1.30 p.m. while they were discussing the issue, he intervened and advised Kotte Rayamallu father-in-law of Kotte Srilatha to take her home. Then, K.Rayamallu got up and started to abuse him by taking his caste name and questioned him - "who called you to panchayath". As K.Rayamallu abused him in the presence of elders, so he felt insulted. Hence, he lodged a report.

Basing on this report, LW13/B.Sanjeev, SIP registered case in Cr.No.127/2019 U/ sec.290 IPC and Section 3(1)(s) of SCs/STs Act and issued FIR.

9 The prosecution in order to bring home the guilty of the accused, examined

PW1 and got marked Exs.P1 and P2.

10. The testimony of PW1/1.Gopi shows on 18.08.2018 at 10:00 a.m. Some

unknown persons abused him by taking his caste name at Teegalpahad village. On

that he approached police and his signatures were obtained on some papers. He

does not know the contents of complaint. PW1 did not support prosecution case. So,
