This case is coming on this day before me for hearing in the presence of the learned Assistant Public Prosecutor for prosecution and upon perusing the material on record, this Court made the following :

COMMITTAL ORDER

1.The Inspector of Police, Polavaram Circle, Polavaram filed this

case in Crime No.01/2018 of Buttaigudem Police Station alleging that the

accused has committed the offences punishable U/Sec.302 of Indian Penal

Code, 1860 (for short, ‘I.P.C.’) and Secs.25 (1) (B) and 27 (C) of the Indian

Arms Act, 1959.

2.The case of the prosecution, in brief, as follows…

(i)The Deceased – Kattam Nageswara Rao is the resident

of Kottha Aliveru Dam Colony, H/o.Doramamidi Village, Buttaigudem

Mandal. The L.W.1 – Madivi Akkamma is the elder sister of the deceased.

The L.W.1 reported that the first wife and daughter of the deceased were

died and then the deceased married his second wife Urmila and set their

resident in Kottha Aliveru Dam Colony, H/o.Doramamidi Village and about

five years back, the second wife of the deceased also died and from that

time, the deceased was living alone in his thatched house by doing coolie

works. Recently, the Government allotted cultivating land AC.03-50 Cents

of land to the deceased and deposited Rs.1,16,000/- in the account of

deceased and also allotted cultivating land AC.03-50 Cents of land to his

sister-in-law Kattam Lakshmi and deposited Rs.1,16,000/- in the account of

Kattam Lakshmi. But, the sister-in-law of Deceased – Kattam Nageswara

Rao by name Kattam Lakshmi was disputing with the deceased that, she

has to receive AC.05-00 Cents of land and the deceased should give his

AC.01-50 Cents of land to Kattam Lakshmi.

(ii)As a matter stood thus, on 01-01-2018 at about 07-00

AM, the accused phoned Kattam Lakshmi and informed her that, the

deceased found died in his house and then Kattam Lakshmi along with her

relatives rushed to the house of the deceased and found that, the

deceased was died on his navvaru cot and the deceased has deep

bleeding injury over right side of head below right ear and said injury might

caused due to fire with country made fire arm and also the deceased

received burnt injuries over his right hand and also found the pool of blood.

(iii)Then, Kattam Lakshmi and her relatives shifted the dead

body of the deceased along with cot and placed outside of house. Hence,

the L.W.1 – Madivi Akkamma presented with a report in Buttaigudem Police

Station for taking necessary action.

(iv)Basing on the report of L.W.1, L.W.28 – Sub-Inspector of

Police, Buttaigudem Police Station registered a case in Crime No.01/2018,

U/Sec.302 of I.P.C. and Sec.25 (1) (B) of the Indian Arms Act, 1959 and

took up investigation; subsequently, L.W.29 took up further investigation

and investigated into the case; and later, L.W.30 took up further

investigation and after completion of investigation L.W.30 filed charge sheet

against the accused for the offences U/Sec.302 of I.P.C. and Secs.25 (1)

(B) and 27 (C) of the Indian Arms Act, 1959.

3.Upon perusal of material placed by L.W.30 – Inspector of

Police, Polavaram Circle, Polavaram, this Court took cognizance for the

offences U/Sec.302 of I.P.C. and Secs.25 (1) (B) and 27 (C) of the Indian

Arms Act, 1959.

4.On appearance of accused, copies of case papers furnished as

contemplated U/Sec.207 of Cr.P.C., and when he was examined, he stated

that he got means to engage counsel to defend him before the Hon’ble

Court of Sessions.

5.Having heard the learned Assistant Public Prosecutor, and

upon perusing the material on record and keeping in view of the fact that as

the offence U/Sec.302 of I.P.C. is exclusively triable by a Court of Session,

this Court is of the view that it is a fit case to commit the case to the

Hon’ble Court of Session, West Godavari Division, Eluru.

In the result, the case against accused is committed to the Hon’ble Court of

Session, West Godavari Division, Eluru U/Sec.209 (a) of Cr.P.C. Accused who is

on bail is ordered to be appeared before the Hon’ble Court of Session as and

when summons are received, and the Station House Officer, Buttaigudem Police

Station is directed to produce the accused before the Hon’ble Court of Session as

and when summons are received as provided U/Sec.209 (b) of Cr.P.C. The Office

is directed to submit the entire case record along with the property to the Court of

Hon’ble Sessions Judge, West Godavari, Eluru U/Sec.209 (c) of Cr.P.C. Notify the

committal of the case to the learned Public Prosecutor U/Sec.209 (d) of Cr.P.C.

This case is coming on 28-10-2019 for consideration before me in the presence of the learned Assistant Public Prosecutor for prosecution and of Sri

M.Eswaraiah,the learned Counsel for the accused, and having stood over till this day for consideration, this Court delivered the following :

J U D G M E N T

1.The Station House Officer, Koyyalagudem Police Station filed charge- sheet against the accused for the offences punishable U/Secs.498 – A and 324 of

I.P.C.

2.The case of prosecution is that…

(i)About 7 years back the marriage of P.W.1 – Tagaram Estheru was got performed with the accused in the presence of both elders and relatives in accordance with their caste customs and religious. After the marriage of P.W.1 joined with the accused at Ramanujapuram for conjugal life. During their wedlock, the

P.W.1 blessed with two sons and a daughter. Recently, the accused sold away the house of addicted to drinking alcohol, playing cards and beating P.W.1 on the plea that P.W.1 is questioning the accused about the sale amount of the house. On 23- 12-2018 morning at about 10-30 AM the accused brought some fish and asked the

P.W.1 to cook the same. On that P.W.1 when stated that there are no groceries to cook the fish, the accused abused her with filthy language and beat her with stick

Calender Case No.30 of 2019 over her head, left hand, right hand and back, resulting which, the P.W.1 received bleeding injuries over her head, below left elbow and contusions over the injured/P.W.1 to the Area Hospital, Jangareddigudem on 108 Ambulance for treatment.

(ii)Basing on the strength of Hospital intimation and the statement of P.W.1, L.W.9 – Sub-Inspector of Police, Koyyalagudem Police Station registered a case in Crime No.353/2018, U/Secs.498 – A and 323 of I.P.C. and took up investigation and his investigation reveals prima-facie case against the accused, hence, he filed charge sheet against the accused for the offences U/Secs.498 – A and 324 of I.P.C.

3.Upon perusal of material placed by the Station House Officer,

Koyyalagudem Police Station, this Court took cognizance for the offences

U/Secs.498 – A and 324 of I.P.C. against the accused. On appearance of accused, copies furnished as contemplated U/Sec.207 of Cr.P.C.

4.The accused was examined U/Sec.239 of Cr.P.C. and the charges for the offences punishable U/Secs.498 – A and 324 of I.P.C. were framed. The charges and the accusations leveled against the accused were explained to him in his mother tongue i.e., Telugu, on that he pleaded not guilty and claimed to be tried.

5.In support of Prosecution evidence, P.W.1 was examined, and got marked Exs.P.1 and P.2. The learned Assistant Public Prosecutor given up the evidence of L.W.2 – Adamilli Veerayamma; L.W.3 – Adamilli Yesu; L.W.4 – Adamilli

Venkayamma; L.W.5 – Muppidi Sujatha; L.W.6 – Gavaravarapu Lakshmaiah; L.W.7 –

Dr.E.Hema Kumar (C.A.S.); L.W.8 – P.Rambabu (PC 2556); and L.W.9 – M.Surya

Bhagavan (S.I. of Police) and reported no further evidence. As crucial witness / victim did not support the case of prosecution. As there is no incriminating evidence, the examination of the accused U/sec.313 of Cr.P.C is dispensed with.

Exs.P.1 and P.2. P.W.1 is said to victim. Ex.P.1 is the thumb impression of P.W.1; and Ex.P.2 is Sec.161 of Cr.P.C. statement of P.W.1.

9.The case of prosecution is that, the accused subjected the P.W.1 to cruelty and harassed her both physically and mentally by addicting alcohol, playing cards and cock fights and beat her indiscriminately, as such the accused has committed the offences punishable U/Secs.498 – A and 324 of I.P.C. But,

P.W.1/Victim did not support the case of prosecution. The P.W1/Victim did not say anything against accused and she deposed that accused is her husband, and that on one day she fell down and sustained injury to her left hand and head and as such she was admitted in Area Hospital, Jangareddigudem, and that the Police came to

Hospital and obtained her thumb impression on a paper, but the contents of such paper have not been read over to her and as such she does not know the contents of the same, and also deposed that accused never harassed her and never beat her and that Police never examined her.

10.The P.W.1 gave clean chit to the accused by deposing that the accused never subjected P.W.1 to any sort of cruelty and they never harassed P.W.1 by demanding any dowry. The crucial witness turned hostile and she did not support the case of prosecution. Even the P.W.1 did not admit contents of her report on which this case is registered. Ex.P.1 is her thumb impression on the complaint. It seems due to compromise the P.W.1 deposed against the prosecution case. Hence, P.W.1 got declared as hostile to the prosecution and was cross-examined by the learned

Assistant Public Prosecutor. However, during her such cross-examination also, nothing tangible, incriminating, could be elicited by the learned Assistant Public

Prosecutor. The learned Assistant Public Prosecutor has given up examination of remaining witnesses as the victim herself did not depose anything against the accused. So, there is no evidence on the record to show that the accused subjected

P.W.1 to any sort of cruelty and he harassed her by demanding any additional dowry.

11.Therefore, in the circumstances, as per the reasons stated above, this

Court holds that the prosecution failed to prove the guilt of the accused for the offences U/Secs.498 – A and 324 of I.P.C. beyond all reasonable doubt and the benefit of doubt should necessarily go to accused. As such, the accused are entitled for acquittal.

In the result, the accused is found not guilty for the offences punishable

U/Secs.498 – A and 324 of I.P.C. and he is acquitted U/Sec.248 (1) of Cr.P.C. The bail bonds of accused shall stand cancelled after expiry of appeal time.

Court delivered the following :

J U D G M E N T

1.The Sub-Inspector of Police, Polavaram Police Station filed charge- sheet against the accused for the offences punishable U/Sec.304 – A of I.P.C. and

Sec.196 of M.V.Act.

2.The prosecution case nut-shell as follows…

(i)On 09-06-2019 at 04-45 PM, the Deceased – Doola Ram Babu took his hero HF Deluxe motorcycle bearing No.AP 37 EH 0653 from his house

Ramayyapeta Village from Polavaram Village, and when he was reached to near

Nallakaluva Bridge, Itikulakota Village and the accused being rider of Hero HF

Deluxe motorcycle bearing No.AP 37 CV 2592 ridden the same in a rash and negligent manner and dashed against the motorcycle of the Deceased from opposite direction and then the deceased fell on the Bridge iron rod and received bleeding injuries over his ear and left hand shoulder and the deceased died on the spot due to severe bleeding injuries.

(ii)Basing on the report of P.W.1, L.W.13 – S.I. of Police, Polavaram

Police Station registered a case in Crime No.84/2019, U/Sec.304 – A of I.P.C. and took up investigation; subsequently, L.W.14 – S.I. of Police, Polavaram Police Station took up further investigation and his investigation reveals prima-facie case against the accused for the offences U/Sec.304 – A of I.P.C. and Sec.196 of M.V.Act, hence, he filed charge sheet against the accused.

3.Upon perusal of material placed by the Sub-Inspector of Police,

Polavaram Police Station, this Court took cognizance for the offences U/Sec.304 – A of I.P.C. and Sec.196 of M.V.Act against the accused. On appearance of accused, copies furnished as contemplated U/Sec.207 of Cr.P.C.

4.Thereafter, the accused was examined U/Sec.251 of Cr.P.C. for the offences punishable U/Sec.304 – A of I.P.C. and Sec.196 of M.V.Act, after explaining substances of accusation leveled against him in his mother tongue i.e., Telugu and he pleaded not guilty and claimed to be tried.

5.In support of Prosecution evidence, P.Ws.1 to 4 were examined, and got marked Exs.P.1 to P.5. The learned Assistant Public Prosecutor given up the evidence of L.Ws.3 to 5 and L.Ws.8 to 14 and reported no further evidence. After completion of prosecution evidence, the accused was examined U/Sec.313 of Cr.P.C.

and he denied the incriminating material recorded against him and reported no defence evidence.

6.Heard both sides. Perused the record.

7.Now, the point for determination is…

Whether the prosecution has proved the guilt of accused for the offences punishable U/Sec.304 – A of I.P.C. and Sec.196 of M.V.Act beyond reasonable doubt ?

P O I N T :

8.The case of prosecution, in brief is that, on 09-06-2019 at 04-45 PM,

9.In order to prove it’s case, prosecution examined as many as 4 witnesses who are P.Ws.1 to 4, and got marked Exs.P.1 to P.5.

10.On perusal of the evidence of P.W.1, it is observed that he only stated

before the court that the Deceased – Doola Ram Babu is her husband, who died in

an accident about five months back; and that about five months back on one day, when she was at her home, P.W.2 who is her son informed her through phone that her husband met with accident at Bridge in Polavaram; and that immediately, she rushed to the accident spot and found dead body of her husband; and also deposed that she does not know as to how that accident occurred; and later Police obtained her signature on a paper by informing her that her signature was required for case purpose, but, she does not know the contents of the said paper. P.W.2 who is the son of deceased also deposed on the same lines, as deposed by P.W.1.

11.On perusal of the evidence of the prosecution, it is observed that

P.Ws.3 and 4 who are listed as eyewitness, totally turned hostile and did not support the prosecution case and they stated that they did not state anything before this

Court, and during cross examination also, the learned Assistant Public Prosecutor has not elicited any useful material in connection with accident of the deceased.

12.Having regard to above discussion and reasons, it is held that prosecution utterly failed to prove it’s case against the accused beyond reasonable

In the result, the accused is found not guiltyfor the offences punishable

1.The Prohibition & Excise Inspector, Polavaram Police Station filed charge-sheet against the accused for the offence punishable U/Sec.34 (a) of A.P.

Excise Act.

2.The case of prosecution in brief as follows…

(i)On 13-03-2019 at about 06-00 PM, P.W.2 along with his staff and mediators while patrolling for detection of Prohibition & Excise offences at Polavaram

Village & Mandal, found the accused in possession of Any Time Whisky 180 ML in size – 124 bottles. On seeing them, the accused tried to escape from the scene of offence place. They stopped the accused, on enquiry he revealed his particulars and stated that he purchased the above IML bottles from the shops at Polavaram Village.

Then, he arrested the accused and seized the property after drawing Three (3) sample bottles.

(ii)P.W.2 registered the mediators report as a case in

Judicial Magistrate of I Class Court, Jangareddigudem.

Calender Case No.684 of 2019

Cr.No.41/2019, U/Sec.34 (a) of AP Excise Act and issued Ex.P.3 – FIR. He sent samples to analyst and received Ex.P.4 – Chemical examination report and filed charge sheet.

3.Upon perusal of material placed by the Prohibition & Excise Inspector,

Jangareddigudem Police Station, this Court took cognizance for the offence U/Sec.34

(a) of A.P. Excise Act against the accused. On appearance of accused, copies furnished as contemplated U/Sec.207 of Cr.P.C.

4.The accused was examined U/Sec.239 of Cr.P.C. and the charge for the offence punishable U/Sec.34 (a) of A.P. Excise Act was framed. The charge and the accusation leveled against him was explained to the accused in his mother tongue i.e., Telugu, on that he pleaded not guilty and claimed to be tried.

5.In support of Prosecution evidence, P.Ws.1 and 2 were examined, and got marked Exs.P.1 to P.4 and M.Os.1 to 3. The learned Assistant Public Prosecutor given up the evidence of L.W.2 – B.Venkata Rao; and L.W.3 – G.Nooka Raju and reported no further evidence. After completion of prosecution evidence, the accused was examined U/Sec.313 of Cr.P.C. and he denied the incriminating material recorded against him and reported no defence evidence.

6.Heard both sides. Perused the record.

7.Now, the point for determination is…

Whether the prosecution has proved the guilt of accused for the offence punishable U/Sec.34 (a) of

A.P. Excise Act beyond reasonable doubt ?

P O I N T :

8.The burden of proof lies on the prosecution to prove the guilt of the accused beyond reasonable doubt.

9.P.W.2 who is Inspector, Prohibition and Excise Station, Polavaram deposed that on 13-03-2019 at about 6.00 p.m., himself along with his staff and

Mediators went to Polavaram Village and Mandal, near Bus Stand, where they found the accused while the accused is in possession of 124 bottles of Any Time Whisky 180 ML., each, and he arrested the accused and interrogated in the presence of

Mediators and the accused confessed this offence. Basing on which he recovered said Contraband under cover of Ex.P.2 – Mediators Report. He has drawn Three (3) samples out of seized liquor. He has registered the Mediators report as a case in

Cr.No.41/2019, U/Sec.34 (A) of AP Excise Act. Ex.P.3 is original FIR. He has taken samples out of seized bottles. He has sent samples to analyst. He has set free the accused as the accused responded to his notice U/Sec.41-A of Cr.P.C. notice. He received Ex.P.4 – Chemical examination report. M.Os.1 to 3 are sample bottles.

10.In this case P.W.1 is the crucial mediator for seizure of contraband from the possession of accused. But the said crucial mediator did not support the case of prosecution and he simply deposed that he signed on the mediators report at the instance of Police. Hence, his evidence is not at all useful to the case of prosecution.

P.W.1 is also independent witness, but, he did not support the case of prosecution and he simply deposed that he does not know anything about this case. The learned

Assistant Public Prosecutor declared him as hostile and cross examined him with the permission of the Court, but, nothing was elicited in support of case of prosecution.

On the other hand, the evidence of P.Ws.1 and 2 is creating a reasonable doubt on the alleged arrest and recovery of said contraband from the possession of accused under the cover of mediators report and the benefit of doubt shall goes to the accused. As such, this Court holds that the prosecution failed to prove it’s case beyond all reasonable doubt and the benefit of doubt should necessarily go to the accused.

11.In the light of foregoing discussions, I hold that the prosecution has failed to prove the guilt of the accused for the offence U/Sec.34 (a) of A.P. Excise Act beyond reasonable doubt and the accused is entitled for acquittal. The point is

Calender Case No.684 of 2019 answered accordingly.

In the result, the accused is found not guilty for the offence punishable

Judicial Magistrate of I Class Court, Jangareddigudem.

Calender Case No.685 of 2019

Mediators went to Polavaram Village and Mandal, opposite to State Bank of India, where they found the accused while the accused is in possession of 144 bottles of

Any Time Whisky 180 ML., each, and he arrested the accused and interrogated in the presence of Mediators and the accused confessed this offence. Basing on which he recovered said Contraband under cover of Ex.P.2 – Mediators Report. He has drawn Three (3) samples out of seized liquor. He has registered the Mediators report as a case in Cr.No.42/2019, U/Sec.34 (A) of AP Excise Act. Ex.P.3 is original FIR.

He has taken samples out of seized bottles. He has sent samples to analyst. He has set free the accused as the accused responded to his notice U/Sec.41-A of Cr.P.C.

notice. He received Ex.P.4 – Chemical examination report. M.Os.1 to 3 are sample bottles.

P.W.1 is also independent witness, but, he did not support the case of prosecution and he simply deposed that he does not know anything about this case. The learned

Assistant Public Prosecutor declared him as hostile and cross examined him with the permission of the Court, but, nothing was elicited in support of case of prosecution.
