This case is coming on 25­07­2018 for final hearing before me in the presence of Assistant Public Prosecutor Grade­II for the prosecution and of Sri D.Nookaraju, Counsel for accused and after having perused the evidence adduced on either side and exhibits marked and the material papers available on record and stood over for consideration till this day, this Court delivered the following:

J U D G M E N T

01.The Sub Inspector of Prohibition and Excise Station,

Yellamanchili filed a charge sheet against the accused for the offence punishable under section 34(a) of A.P Excise Act in Cr.No.144/2017 alleging as follows:

02.On 28­8­2017 at about 2.15 p.m, during the patrolling conducted by P.W.1 along with her staff reached Kokkirapalli village and where they found the accused in possession of polythene bag. Under suspicious circumstances, on verification of bag, they found different brands of liquor bottles. P.W.1 tried to secure mediators but in vain. Then she

arrested the accused, seized the contraband. She then sent sample for chemical analysis. After obtaining analyst report and upon completion of investigation, she filed charge sheet. 

03. Cognizance of the offence u/sec. 34(a) of A.P Excise Act was taken.

04.  On appearance of accused, copies of records were furnished to him as contemplated u/sec.207 Cr.P.C.

05.When examined u/sec.239 Cr.P.C, the accused denied the substance of accusation. After hearing both sides and perusing the material on record, charge u/sec.34(a) of A.P Excise Act was framed, read over and explained to accused in Telugu language for which he pleaded not guilty and claimed the accused to be tried. 

06.  To prove the case of prosecution, the prosecution examined P.W.1 and Ex.P.1 to P.3 and Mos.1 and 2 was marked. The evidence of

Constable, L.W.3/D.Ramesh, P & E Constable and L.W.4/N.Demudu Raju, P & E Constable was given up by Learned Asst. Public Prosecutor.

07.After closure of the prosecution side evidence, accused was examined under section 313 Cr.P.C for the incriminating material against him for which he denied. He did not adduce any evidence on his behalf. 

08.Heard both sides.

09.The learned Asst. Public Prosecutor argued that the sole testimony of P.W.1 is consistent to prove the guilt of the accused beyond reasonable doubt and therefore, considering the evidence of P.W.1 the accused may be convicted for the charge leveled against him.

10.On the other hand, the learned counsel for the accused argued that P.W.1 did not try to secure independent witnesses and the sole testimony of P.W.1 is not believable since P.W.1 is a excise official and she is

an interested witness and further, she argued that the prosecution did not place the seized contraband before this court and as such the accused is entitled to be acquitted. 

11.The point for determination is: ­

1. “Whether the accused was in possession of contraband without having any valid permit or license?”

2. “Whether the prosecution has proved the guilt of the accused for offence punishable u/sec 34(a) of A.P Excise Act beyond reasonable doubt?”

12. A nswer to Point 1 :

The prosecution let the evidence of P.W.1 who happened to be

Sub Inspector of Prohibition and Excise and she conducted patrolling, detected the crime, seized the contraband from the possession of the accused, arrested the accused, released the accused on bail, sent the sample bottle to the chemical examiner and filed the charge sheet. Apparently, the rest of the listed witnesses in the charge sheet also are belonging to the excise department. As argued by the learned counsel for the accused, it is an admitted fact that no independent witness was examined. In such circumstances, the sole testimony of P.W.1 is to be scrutinized so cautiously since at best she can be termed as an interested witness as to see fruitful results to the part of her investigation. 

13.P.W.1 categorically stated that on 28­8­2017 at about 2.15 p.m, he along with his staff reached Kokkirapalli village and where they found a mob of people and on seeing them, he ran away. Further, they found the accused was in possession of polythene bag and on verification of polythene bag, she found 125 nip bottles of HD Heavens Door whiskey in one bag and 125 nip bottles of HD Heavens Door whiskey. Admittedly, she did not speak the actual place of occurrence and she simply stated that the

place of occurrence is out skits of the village. She further stated a different version that she noticed a mob of people and on seeing them, she ran away but there is no any such whisper in occurrence report (Ex.P.1).

14.Ex.P.1 shows that P.W.1 deputed one of their constable to the village for securing mediators and after passing sometime she returned back and informed that none came forward to act as mediators. It is so surprising from Ex.P.1 which shows that it was commenced in drafting from 2.15 p.m onwards. If at all the version of P.W.1 which shown in Ex.P.1 is correct, then P.W.1 might have waited till arrival of the constable who was deputed to secure mediators. 

15.P.W.1 admitted in her cross examination that the scene of offence was located in a busy locality. Apparently without trying to secure mediators at the scene of offence, P.W.1 deputed their constable to the village for securing mediators. The reasons are best known to P.W.1 for non securingmediators at the scene of offence itself. As per the confession of the accused that she purchased the seized contraband from an unknown person but apparently, there is no any further investigation in such lines to detect the said unknown person. 

16.P.W.1 admitted in her cross examination that she did not mention the batch numbers of the seized contraband in Ex.P.1. Though

Ex.P.1 shows about the efforts made by P.W.1 for securing mediators but surprisingly, she admitted that she did not mention about her efforts for not securing mediators in Ex.P.1. 

17.As per the case of prosecution, this case was detected on 28­8­2017 but whereas the chemical examiner analyzed the sample bottle on 21­9­2017. There is an abnormal delay in anlysing the sample bottle by the chemical examiner and the reasons for delay in analysing the sample

bottle were not explained by the prosecution. Further there is no any whisper about the seizure of contraband since it was not produced before this court. It may be that the Investigating officer might have produced the seized contraband before the Deputy Commissioner of Prohibition and

Excise, Visakhapatnam for seeking necessary orders and in such lines no piece of document has been exhibited on behalf of the prosecution.

18.Though the scene of offence is near by the excise station and this case was detected by 2.15 p.m but P.W.1 did not register the crime till 3.00 p.m. The reasons for delay in registering the crime were not explained by the prosecution.

19.As I discussed above, the sole testimony of P.W.1 is so inconsistent with that of Ex.P.1 and her evidence does not make me to believe that the accused was in possession of contraband. Accordingly, this point is answered. 

20. Answer to Point No.2 : 

In view of my finding under point No.1, it is clear that the prosecution failed to establish the basic ingredients of Sec. 34(a) of A.P

Excise Act for proving contraband, which is in possession of the accused and as such the accused is entitled to be acquitted. Accordingly, this point is answered.

21.In the result, I find accused not guilty for the offence punishable u/sec. 34(a) of A.P Excise Act and acquit him under section 248(1) Cr.P.C. The bail bonds of accused with that of his sureties shall be remained in force for a period of six months from the date of judgment as per Sec. 437­A Cr.P.C.

01.The Sub Inspector of Prohibition and Excise Station,

Yellamanchili filed a charge sheet against the accused for the offence punishable under section 34(a) of A.P Excise Act in Cr.No.183/2017 alleging as follows:

02.On 2­12­2017 at about 5.00 p.m, during the patrolling conducted by P.W.3 along with her staff reached Chinagollalapalem Village and where they found the accused in possession of polythene bag. Under suspicious circumstances, on verification of bag, they found liquor bottles.

P.W.3 tried to secure mediators but in vain. Then he arrested the accused, seized the contraband. He then forwarded the case file to P.W.1 who

registered the case and sent sample for chemical analysis. After obtaining analyst report and upon completion of investigation, he filed charge sheet. 

03. Cognizance of the offence u/sec. 34(a) of A.P Excise Act was taken.

04.  On appearance of accused, copies of records were furnished to him as contemplated u/sec.207 Cr.P.C.

Sub Inspector were given up by Learned Asst. Public Prosecutor.

09.The learned Asst. Public Prosecutor argued that sole testimony of P.W.1 is consistent to prove that the accused was in possession of contraband and further though the evidence of P.W.1, the prosecution proved the seizure of contraband and considering his evidence, the accused may be convicted.

10.On the other hand, the learned counsel for the accused argued that the mediator(P.W2) was examined to corroborate with the evidence of

P.W.1 and P.W.3, being an excise officials, is an interested witnesses, but he(P.W2) did not depose anything about arrest of the accused and seized the contraband and P.W3 did not speak from where she secured P.W2, as such the accused is entitled to be acquitted. 

11.The points for determination are : ­

1. “Whether the accused was in possession of contraband without having any valid permit or license?”

2. “Whether the prosecution has proved the guilt of the accused for offence punishable u/sec 34(a) of A.P Excise Act beyond reasonable doubt?”

12. A nswer to Point 1 :

As per the case of prosecution, P.W.3 seized the contraband from the possession of the accused in the presence of P.W2 who happened to be a mediator. The said (P.W2) turned hostile and he did not support the case of the prosecution. Now there is only one evidence available on record is that of P.W3 who happened to be an Investigating Officer and as per her evidence she stated that on 2­12­2017 at about 5.00 p.m., at

Chinagollalapalem village she noticed the accused in possession of 12 nip bottles of Officers choice reserve whiskey and she separated one bottle as a sample(MO.1) under the cover of occurrence report (Ex.P.1).

13.Admittedly, P.W1 did not speak the actual place of occurrence and she simply stated that the case was detected at Chinagollalapalem village. In cat, as per Ex.P.1, the incident occurred at Ramalayam temple and admittedly, it is situated at a busy locality, but P.W1 did not speak from where she secured P.W.1. As per Ex.P.1, the excise raid party raided the

place of occurrence by 5.00 p.m., and later, P.W3 deputed their constable for securing mediators and after passing some time the said constable brought P.W2 as a mediator, but ex.P.1 shows that it was started in drafting from 5.00 p.m., onwards i.e., before the arrival of the mediator.

14.As seen from Ex.P.1, P.W3 also seized polythene cover along with the contraband. Apparently, the said polythene cover and contraband produced before this court. As per the case record, the excise officials obtained permission from Deputy Commissioner of P & E for disposal of the seized contraband, but no such order was placed before this court. Though, this case was detected by 5.00 p.m. As per Ex.P.1, it was registered by P.W.1 by 10.00 p.m. Apparently, the scene of offence is situated just nearby the

Excise Station and time was taken for registering crime and the reasons for delay in registering the crime were not explained by the prosecution. 

15.As per the case of the prosecution, this case was detected on 2­ 12­2017, whereas, the analyst report shows that the chemical examiner analyzed MO.1 on 10­1­2018. There is abnormal delay in analyzing the sample bottle by the chemical examiner. The reasons for delay were not explained by the prosecution.

16.Pw.1’s evidence is no way helpful to the case of the prosecution since she registered a crime, sent MO.1 to Chemical Examiner, obtained analyst report and filed charge sheet. Though, she served the notice u/sec.

41­A Cr.P.C., to the accused but she did not speak the said fact. There is so much of ambiguity with regard to prosecution o the accused since Ex.P.1 shows that he was apprehended by P.W3 but P.W1 did not speak about release of the accused by applying any mode.

17.The sole testimony of P.W.3 shows so many infirmities and her evidence is not believe in any extent that the accused was in possession of contraband. Accordingly, this point is answered.

18. Answer to Point No.2 : 

In view of my finding under point No.1, it is clear that the prosecution failed to establish the basic ingredients of Sec. 34(a) of A.P

Excise Act for proving contraband, which is in possession of the accused and as such the accused is entitled to be acquitted. Accordingly, this point is answered.

19.In the result, I find the accused not guilty for the offence punishable u/sec. 34(a) of A.P Excise Act and acquit him under section 248(1) Cr.P.C. The bail bonds of accused with that of his sureties shall be remained in force for a period of six months from the date of judgment as per Sec. 437­A Cr.P.C.

01.The Inspector of Prohibition and Excise Station, Payakaraopeta filed a charge sheet against the accused for the offence punishable under section 7A r/w 8 (e) of A.P Prohibition Act in Cr.No.59/2018 alleging as follows:

02.On 28­04­2018 at about 8.05 a.m, during the patrolling conducted by P.W.2 along with his staff and mediator reached Rajayyapeta

Village and where they found the accused in possession of one plastic cane

Under suspicious circumstances, on verification of plastic can, they found 10 liters of I.D liquor. After drawal of sample from the I.D liquid, P.W.1 arrested the accused, seized the contraband under the cover of mediator

report, basing upon the mediator report he registered a case, released the accused on bail, sent the sample bottle to the chemical examiner, obtained analyst report and filed charge sheet 03. Cognizance of the offence u/sec. 7A r/w 8 (e) of A.P

Prohibition Act was taken. 

04.  On appearance of accused, copies of records were furnished to her as contemplated u/sec.207 Cr.P.C.

07.After closure of the prosecution side evidence, accused was examined under section 313 Cr.P.C for the incriminating material against her for which she denied. She did not adduce any evidence on her behalf.

09.The learned Asst. Public Prosecutor argued that testimony of

P.Ws.1 and 2 is consistent to prove that the accused was in possession of contraband and further through the evidence of P.W.1 and P.W2, the

prosecution proved the seizure of contraband and considering his evidence, the accused may be convicted.

10.On the other hand, the learned counsel for the accused argued that there are contradictions between P.Ws 1 and 2 and further no independent witness was examined at scene of offence and as such the accused is entitled to be acquitted. 

11.The points for determination are : ­

1. “Whether the accused was in possession of contraband without having any valid permit or license?”

2. “Whether the prosecution has proved the guilt of the accused for offence punishable u/sec u/sec. 7A r/w 8

(e) of A.P Prohibition Act  beyond reasonable doubt?”

12. A nswer to Point 1 :

P.W.1 being a mediator in whose presence P.W.2 seized the contraband, arrested the accused and lifted the sample. He categorically stated that on 24­08­2018 at about 8.00 AM at Rajayyapeta, they found the accused in possession of a cane containing with I.D liquir. Then the

Inspector of Prohibition and Excise arrested the accused and seized a case under the cover of mediator report (P.1) and lifted the sample from the plastic can into a bottle (MO.1). Admittedly he did not speak how much quantity of I.D liquor was found in the plastic can and in the same way he deposed he did not know how many liters of I.D liquor was seized.

13.P.W.1 further stated that Ex.P.1 was scribed by Inspector of

Prohibition and Excise but in fact the Inspector of Prohibition and Excise did not scribe Ex.P.1 and as per the evidence of the Inspector of Prohibition and

Excise (P.W.2), Ex.P.1 was scribed by Head Constable of Prohibition and

Excise. P.W.1 further stated that they were at the scene of offence for one

hour but whereas P.W.2 stated that they were at the scene of offence for two hours.

14.P.W.1 categorically stated that he did not know the name of the accused and particulars of the accused but Ex.P.1 shows the name of the accused as well as particulars of the accused. Though he stated about lifting of sample but in his cross examination that he did not notice of lifting sample. Therefore, the evidence of P.W.1 is quite contrary to the case of prosecution and his evidence is no way helpful to the case of prosecution.

15.P.W.2 being Inspector of Proh & Excise he categorically stated that he sent the sample bottle to the chemical examiner and obtained the analyst report(Ex.P.3). As seen from Ex.P.3, there is abnormal delay in analyzing the sample bottle and the reasons for delay were not explained by the prosecution. Further there is no any whisper from the case of the prosecution that P.W.2 took any steps for disposal of the seized contraband as per the provisions laid down under A.P Prohibition Act. 

16.Either P.W.1 or P.W.2 did not speak the actual place of occurance and further P.W.2 did not speak from where he could secure

P.W.1. Further there is delay in registering the crime and the reasons for registering crime in delay were not explained by the prosecution.

17.As I discussed above, it is clear that the evidence of PW.2 is contradictory with the evidence of P.W1 and with the contents of Ex.P.1.

Their inconsistent version does not make me to believe that the accused is in possession of contraband without any permit or license. Accordingly, this point is answered.

18. Answer to Point No.2 : 

In view of my finding under point No.1, it is clear that the prosecution failed to establish the basic ingredients of Sec. u/sec. 7A r/w 8

(e) of A.P Prohibition Act for proving contraband, which is in possession of the accused and as such the accused is entitled to be acquitted. Accordingly, this point is answered.

19.In the result, I find the accused not guilty for the offence punishable u/sec. 7A r/w 8 (e) of A.P Prohibition Act and acquit her under section 248(1) Cr.P.C. The bail bonds of accused with that of her sureties shall be remained in force for a period of six months from the date of judgment as per Sec. 437­A Cr.P.C. 

20.M.O1 shall be destroyed after expiry of appeal time.

This case is coming on 26­10­2018 for final hearing before me in the presence of Assistant Public Prosecutor Grade­II for the prosecution and of Sri S.Ganesh, Learned counsel for the accused and after having perused the evidence adduced on either side and exhibits marked and the material papers available on record and stood over for consideration till this day, this Court delivered the following:

J U D G M E N T

01.The Inspector of Prohibition and Excise Station, Payakaraopeta filed a charge sheet against the accused for the offence punishable under section 7A r/w 8 (e) of A.P Prohibition Act in Cr.No.59/2018 alleging as follows:

02.On 28­04­2018 at about 8.05 a.m, during the patrolling conducted by P.W.2 along with his staff and mediator reached Rajayyapeta

Village and where they found the accused in possession of one plastic cane

Under suspicious circumstances, on verification of plastic can, they found 10 liters of I.D liquor. After drawal of sample from the I.D liquid, P.W.1 arrested the accused, seized the contraband under the cover of mediator

report, basing upon the mediator report he registered a case, released the accused on bail, sent the sample bottle to the chemical examiner, obtained analyst report and filed charge sheet 03. Cognizance of the offence u/sec. 7A r/w 8 (e) of A.P

Prohibition Act was taken. 

04.  On appearance of accused, copies of records were furnished to her as contemplated u/sec.207 Cr.P.C.

05.When examined u/sec.239 Cr.P.C, the accused denied the substance of accusation. After hearing both sides and perusing the material on record, charge u/sec.34(a) of A.P Excise Act was framed, read over and explained to accused in Telugu language for which she pleaded not guilty and claimed the accused to be tried. 

06.  To prove the case of prosecution, the prosecution examined P.W.1 and P.W.2 and exhibits P.1 to P.3 and Mo.1 were marked. The evidence of

L.W.2/Md.Yunus, Excise Constable and L.W3/D.Baga Shankar, Excise constable and L.W.3/K.Sakunthala, Excise Constable was given up by

Learned Asst. Public Prosecutor.

07.After closure of the prosecution side evidence, accused was examined under section 313 Cr.P.C for the incriminating material against her for which she denied. She did not adduce any evidence on her behalf. 

08.Heard both sides.

09.The learned Asst. Public Prosecutor argued that testimony of

P.Ws.1 and 2 is consistent to prove that the accused was in possession of contraband and further through the evidence of P.W.1 and P.W2, the

prosecution proved the seizure of contraband and considering his evidence, the accused may be convicted.

10.On the other hand, the learned counsel for the accused argued that there are contradictions between P.Ws 1 and 2 and further no independent witness was examined at scene of offence and as such the accused is entitled to be acquitted. 

11.The points for determination are : ­

1. “Whether the accused was in possession of contraband without having any valid permit or license?”

2. “Whether the prosecution has proved the guilt of the accused for offence punishable u/sec u/sec. 7A r/w 8

(e) of A.P Prohibition Act  beyond reasonable doubt?”

12. A nswer to Point 1 :

P.W.1 being a mediator in whose presence P.W.2 seized the contraband, arrested the accused and lifted the sample. He categorically stated that on 24­08­2018 at about 8.00 AM at Rajayyapeta, they found the accused in possession of a cane containing with I.D liquir. Then the

Inspector of Prohibition and Excise arrested the accused and seized a case under the cover of mediator report (P.1) and lifted the sample from the plastic can into a bottle (MO.1). Admittedly he did not speak how much quantity of I.D liquor was found in the plastic can and in the same way he deposed he did not know how many liters of I.D liquor was seized.

13.P.W.1 further stated that Ex.P.1 was scribed by Inspector of

Prohibition and Excise but in fact the Inspector of Prohibition and Excise did not scribe Ex.P.1 and as per the evidence of the Inspector of Prohibition and

Excise (P.W.2), Ex.P.1 was scribed by Head Constable of Prohibition and

Excise. P.W.1 further stated that they were at the scene of offence for one

hour but whereas P.W.2 stated that they were at the scene of offence for two hours.

14.P.W.1 categorically stated that he did not know the name of the accused and particulars of the accused but Ex.P.1 shows the name of the accused as well as particulars of the accused. Though he stated about lifting of sample but in his cross examination that he did not notice of lifting sample. Therefore, the evidence of P.W.1 is quite contrary to the case of prosecution and his evidence is no way helpful to the case of prosecution.

18. Answer to Point No.2 :

01.The Inspector of Prohibition and Excise Station, Payakaraopeta filed a charge sheet against the accused for the offence punishable under section 7A r/w 8 (e) of A.P Prohibition Act in Cr.No.59/2018 alleging as follows:

02.On 28­04­2018 at about 11.30 a.m, during the patrolling conducted by P.W.2 along with his staff and mediator reached

Bangarammapeta Village and where they found the accused in possession of one plastic bag under suspicious circumstances, on verification of plastic bag, they found 5 liters of I.D liquor. After drawal of sample from the I.D liquid, P.W.1 arrested the accused, seized the contraband under the cover of
