J U D G M E N T
01.The Sub Inspector of Police, Police Station, Nirmal Town has filed charge sheet against the sole accused for the offence punishable Under section 306 IPC.
Case of the Prosecution:
02.The brief facts of the prosecution case are that:
On 31.05.2022 at 13:00 hours, the complainant has lodged a written report stating that his wife deceased/Bikka Suvarna looking his family welfare by doing coolie work and the complainant performed his elder daughter marriage. One year back, his son/Bikka Laxman i.e., accused performed love marriage with daughter of his wife’s sister and since then, frequently quarrels took place in between them. On 23.05.2022 the complainant along with his wife went to their relatives house at Dhannur village by locking their house. On 26.05.2022 when they returned to home found the door lock was changed. Then his wife called his son/Bikka Laxman i.e., accused and asked about the door lock change. On that the accused replied that when they went to their relative house, meantime the accused entered into their house by broke open the lock and took his certificates and locked the door with another lock. In this regard, some quarrel took place in between them and continued for two days. The complainant along with his wife cooked under Margosa tree and slept. On 29.05.2022 at about 03:30 pm, his son/Bikka Laxman i.e., accused abused his wife in filthy

Suvarna/deceased committed suicide by consuming unknown pesticide poison and shifted to government hospital, Nirmal through 108
Ambulance and while undergoing treatment she died on 31.05.2022 at 12:00 hours.
Basing on the contents of the report, the PW14 has registered a case in Cr.No. 191/2022 U/sec. 306 IPC, issued FIR and took up the investigation. During the course of investigation, the PW14 has examined and recorded the statement of PW1 in part II CD U/sec. 161
Cr.P.C. Later, he visited the government hospital, Nirmal and observed the dead body of the deceased and photographed of the deceased with the help of Edla Dikshith, examined and recorded the statements of
PW2 to PW5 and Edla Dikshith U/sec. 161 Cr.P.C in part II CD and secured the presence of mediators i.e., PW6 and PW7, held inquest over the dead body of the deceased and later handed over the dead body for Postmortem Examination to PW13 to know the actual cause of death. The PW13 has conducted the Autopsy over the dead body of the deceased and preserved the viscera. Later, the PW14 visited the scene of offence situated at PW1’s house at Gajulpet, Nirmal and secured the presence of PW8 and PW10 before whom prepared the crime detail form and drawn rough sketch of the scene of offence.
Later, PW14 secured the presence of PW9 and PW11, observed the scene minutely and prepared the scene of offence observation

The plastic bottle containing 180 ml capacity and bottle liquid is in blue colour. On 01.06.2022 at 12:30 hours, on reliable information PW14 along with his sufficient force rushed to Mancherial Chowrastha, Nirmal and apprehended the accused at 13:00 hours. Immediately PW14 has secured the presence of two mediators PW12 and Darshanam Srikanth and on interrogation, the accused voluntarily confessed to have committed this offence. The PW14 has recorded the confession panchanama of the accused in the presence of mediators and later brought the accused to police station at 15:30 hours duly affected his arrest by issuing arrest memo and produced the accused before the
Additional Judicial Magistrate of First Class, Nirmal for judicial remand.
The Medical Officer i.e., PW13 has issued the postmortem examination report preserving the viscera for examination and report to send RFSL,
Karimnagar. Accordingly, the PW14 along with seized plastic bottle send to the RFSL, Karimnagar for examination and report. The Doctor
G.Gopinath, Regional Head and Assistant Director, RFSL, Karimnagar has examined the viscera and poison bottle and issued the report opining that Item No.1, 2 and 3 are analyzed and paraquat Dichloride a
Herbicide poison is found in all of them. Basing on the strength of the
RFSL report, the PW13 has issued the final opinion that the cause of death due to shock, due to Paraquat, a herbicide poison and poisoning.

Nirmal town has filed the charge sheet.
Committal of the case:
3.On filing and verification of the charge sheet, the learned
Additional Judicial Magistrate of First Class, Nirmal has taken
cognizance of the offence punishable under Sec.306 IPC against the sole accused. The learned Additional Judicial Magistrate of First Class,
Nirmal has supplied the copies as contemplated under Sec.207 of
Cr.P.C. to the accused. After following the due procedure of law, the learned Additional Judicial Magistrate of First Class, Nirmal has committed the case to the Hon'ble Court of Sessions and in-turn, the
Hon’ble Court of Sessions has made over the case to this Court for
disposal according to law.
Charges framed against the accused:
4.When the accused has appeared before this court, the charge for the offence Sec. 306 IPC was framed against the accused, read over and explained to him, for which he denied the charge, pleaded not guilty and claimed to be tried.
Evidence adduced by the prosecution:
5.During the course of trial, the Prosecution has examined PW1 to
PW14 and got marked Ex.P1 to Ex.P24 and MO.1 is marked on behalf of prosecution.

6.After closure of Prosecution evidence, the accused is examined
U/Sec.313 Cr.P.C for the incriminating material found against him through the prosecution witnesses, for which the accused has denied and reported no defence evidence on his behalf.
Arguments:
7.Heard arguments on both sides.
8. Now the point for determination is:
Whether the prosecution has able to bring the guilt of accused for the offence punishable U/sec. 306 IPC beyond all reasonable doubt?
9. POINT:
The PW1 is the husband of the deceased and the complainant who testified that the accused is his son and his wife deceased/B.
Suvarna unable to bear the pain, she has consumed the poison.
Thereafter they have taken her to the hospital. The PW1 has put his signature at the request of police. The PW1 has not stated anything to the police.
10.The PW1 who is material witness has turned hostile and did not supported the prosecution case. Except admitting his signature on the report, the PW1 did not disclosed the contents of the report. Even when the Additional Public Prosecutor cross examined PW1, he denied the contents of the report and that he stated before the police in 161
Cr.P.C as in Ex.P2.

11.PW2 is the eye witness and younger daughter of PW1, who deposed that the accused is elder brother, PW1 is her father and deceased/Bikka Suvarna is her mother. The elder brother i.e., accused has performed the marriage with the daughter of her mother’s sister.
On that day, there was a quarrel with regard to the lock of the house, due to which they have slept outside of the house. The accused has brought the unknown pesticide poison. In this regard her mother given the complaint to police for two times. The police did not taken any action against their complaint. Her mother went to the police station and asked about the complaint. On that day when they slept outside her mother has consumed the unknown pesticide poison, due to that quarrel.
12.PW2 also did not supported wholly the prosecution case. She turned hostile and did not supported the prosecution case. Even when the Additional Public Prosecutor cross examined PW2, she has denied to have given the statement to the police in 161 Cr.P.C as in Ex.P3.
13.PW3 is the sister of the deceased, who has deposed that the accused is the son of her elder sister and deceased. Her elder sister/deceased went to Dhannur(v). When she came back to their house, the accused has locked the door of their house. In this regard, there was quarrel, in which the accused has insisted the deceased/
Suvarna to commit suicide and given the poison bottle. In that quarrel, her elder sister deceased/ Suvarna has consumed the poison. Later, they got shifted their elder sister to the hospital. The children of her

Page 8 of 18 Judgment in SC.No.04/2023 on the file of ASJ Court, Nirmal sister/deceased informed over phone. As such PW3 has came to the hospital and after one hour of the arrival to the hospital, her elder sister/deceased has died.
14.The PW3 has also not wholly supported the prosecution case and turned hostile. Even when the Additional Public Prosecutor cross examined PW3, she has admitted that the marriage of daughter of her elder sister was performed with the accused, but her elder sister i.e., deceased/Bikka Suvarna was not happy with their marriage and thereby disputes in between them and further admitted that PW3 has stated this fact to the police in addition what she has stated in her chief examination.
15.PW4 is the elder brother of the deceased/Bikka Suvarna, who deposed that his sister went to attend a function at Dhannur(v). Later, she returned back from the function to Gajulapet, Nirmal to her house.
The accused has break open the lock of their house and locked with another key to their house. In this regard, his sister/Suvarna has questioned the accused why he has locked with another key. PW4’s sister and her husband i.e., PW1 slept outside under a Neem tree for two days. The accused in that quarrel has insisted the PW1 to commit suicide and given the poison bottle. Therefore, the sister of PW4 has consumed the poison and she was shifted to the government hospital,
Nirmal. After two days of the treatment his sister died. PW1 has informed over phone to PW4.

16.PW5 is also the 3rd brother of the deceased/Suvarna who testified that the deceased/Suvarna went to Dhanora (v) for two or three days.
The accused has locked the door with another key. When the deceased/
Suvarna came to the house, she noticed that the accused has break open the lock of the house and locked with another key. The deceased/
Suvarna has slept under a tree. The accused has given the poison bottle to deceased/Suvarna and she has consumed the poison. Later, she was taken to the hospital and while undergoing treatment she died.
PW5 received the phone call, as such the PW5 came to their house.
17.PW6 is the panch witness for inquest panchanama, who deposed that on the information of the death of the deceased, they went to the hospital. When PW6 was present outside the hospital at that time his signature was obtained. The PW6 has turned hostile and did not supported the prosecution case. Except admitting his signature on inquest panchanama, PW6 has not disclosed the contents of the inquest panchanama.
18.PW7 is also the panch witness for inquest panchanama, who also turned hostile and did not supported the prosecution case. He simply deposed that when they went to the area hospital to see the dead body, at that time the police obtained his thumb impression. Even when the learned Additional Public Prosecutor cross examined PW7, he has denied about conducting of inquest panchanama and the contents of the inquest panchanama.

19.PW8 is the panch witness for the crime detail form who deposed that this incident was happened about one and half year back. PW8 went to see the deceased dead body. When PW8 was present there, the police obtained his signature. The PW8 waited that the dead body would pass nearby his house. Thus, PW8 has also turned hostile and did not supported the prosecution case. Except admitting his signature on the crime detail form and rough sketch map, PW8 did not disclosed the contents of the crime detail form and the rough sketch map drawn.
20.PW10 is another panch witness for the crime detail form, who has deposed that the police have obtained his signature on the white paper at his house. PW10 do not know anything. PW10 also turned hostile and did not supported the prosecution case. Except identifying his signature on the crime detail form and rough sketch map, PW10 has not disclosed anything about the crime detail form and rough sketch map drawn.
21.The prosecution examined the panch witnesses for the scene of offence observation panchanama as PW9 and PW11. PW9, who is one of the panch witness has turned hostile and did not supported the prosecution case. He simply deposed that the police came to Gajulapet and seized one bottle. The police shown the bottle and obtained the signature. Thus, the PW9 has also except identifying his signature on the scene of offence observation panchanama, did not disclosed anything about the scene of offence observation panchanama.

22.PW11 has deposed that while he was on the delivery, at that time the police called him The police have asked PW11 about the occurrence of the death of deceased. PW11 informed to the police that he do not know anything. Thereafter the police obtained his signature. Thus, the
PW11 has also except identifying his signature on the scene of offence observation panchanama, has not disclosed anything about the scene of offence observation panchanama. PW11 has turned hostile and did not supported the prosecution case.
23.PW12 is the panch witness for confession panchanama. PW12 has deposed that while he was walking in the evening hours, at that time one police constable made a phone call to him informing to come and put the signature. PW12 went to the police station and put his signature. Except identifying his signature on the confession panchanama, the PW12 has not disclosed anything about the confession made by the accused under the panchanama.
24.PW13 who worked as Civil Assistant Surgeon in District Hospital,
Nirmal has deposed that on 31.05.2022 he received a requisition from
SHO, PS, Nirmal Town to conduct autopsy on the dead body of deceased/Suvarna.Accordingly,heconductedpostmortem examination. They received specimens for RFSL and sent to RFSL,
Karimnagar. Postmortem examination was concluded at 06:15 pm on the same day. According to the RFSL, Karimnagar report, the cause of death is due to shock, due to paraquat a herbicide poison poisoning.
The PW13 has given his final opinion basing on the RFSL report.

25.PW14 is the Investigating Officer who deposed with regarding to the entire investigation done by him.
26.In the present facts of the case, the deceased/Bikka Suvarna who is the wife of the complainant has died due to consumption of Paraquat herbicide poison. PW13 who worked as Civil Assistant Surgeon in the
District Hospital, Nirmal has conducted the detailed Postmortem
Examination of the deceased/Bikka Suvarna. The postmortem examination was conducted on 31.05.2022. As per the Postmortem examination report, which is Ex.P15 the viscera was sent for the chemical examination and report. As seen the report of the Regional
Forensic Science Laboratory, Karimnagar, expert has found in the stomach and a piece of intestine in Crystalline substance and a pieces of liver and kidney and also trace of blue colour liquid found in the plastic bottle that a Paraquat Dichloride a Herbicide poison is found.
Thus, as seen from the report under Ex.P23, the deceased/Bikka
Suvarna has consumed Paraquat dichloride Herbicide poison due to which she died. The final opinion under Ex.P16, which is given by the
Civil Assistant Surgeon i.e., PW13 that the death of the deceased was caused due to shock due to Paraquat herbicide poison poisoning.
Hence, the death of the deceased/Bikka Suvarna was occurred due to the consumption of the poison which is found in her body.
27.The prosecution has placed the accused before this court that he has abated the deceased/Bikka Suvarna to commit suicide. The accused has given the Herbicide Paraquat poison bottle to the

28.There are disputes in the house of PW1 and accused. The accused has married with the daughter of deceased/Bikka Suvarna’s sister. The marriage of the accused with the daughter of the deceased/Bikka Suvarna sister was opposed and thus there was a quarrel in their house. In this regard, a incident was occurred when the deceased/ Bikka Suvarna went to Dhannur(v) to attend a function. The lock of the door of the house of PW1 and deceased/Bikka Suvarna was broke open by the accused. The accused has locked the door with another key, due to which the deceased/Bikka Suvarna and PW1 slept outside of the house. As per the report under Ex.P17, the PW1 and deceased/Bikka Suvarna along with the family members went to
Dhannur(v) on 22.05.2022 and they have returned back to their house on 26.05.2022. When the accused has locked with the another key to their house by taking all the certificate from the house, as such the
PW1, his wife deceased/Bikka Suvarna and children have slept outside of the house under a Tree.
29.The present incident of abatement to commit suicide has occurred on 29.05.2022 in the afternoon at 03:30 pm. The accused has abated the deceased/Bikka Suvarna, abusing her in filthy language and abated her to die. But the PW1, who is the husband of the deceased/
Bikka Suvarna and the complainant, who lodged the report did not supported the prosecution case and turned hostile. Even the PW1 denied the suggestion made by the learned Additional Public

Prosecutor, the contents of the report. The PW1 has stated that his wife consumed poison due to stomach pain.
30.The evidence of PW2 is somewhat helpful to the prosecution case. The PW2 evidence shows that the accused has brought unknown pesticide poison. On that day there was a quarrel with regard to the lock of the house, due to which PW1, PW2 and deceased/Bikka Suvarna slept outside of the house. On that day, when they slept outside, her mother has consumed the unknown pesticide poison due to that quarrel.
31.But as seen, the report which is Ex.P17, the incident of consumption of poison was occurred on 29.05.2022. The incident with regard to the lock of the door with another key was occurred on 23.05.2022. Thus, from the evidence of PW2, it does not show that the accused has abated the deceased/Bikka Suvarna on that day to consume the poison to die.
32.Even the PW3 to PW5, who are the brothers and sister of the deceased/Bikka Suvarna have whispered about the incident. But they came to the hospital after receiving the phone call about the consumption of pesticide poison by the deceased/Bikka Suvarna. The
PW3 to PW5 have heard about the incident occurred but they are not the eye witnesses to the incident, who have seen the deceased/Bikka
Suvarna has consumed poison. Though the evidence of PW3, PW4 and
PW5 is helpful to the prosecution case, but does not fully establishes that the accused has abated the deceased/Bikka Suvarna to commit

33.The incident was occurred under a Tree which is situated in front of house of the PW1. As seen the crime detail form under Ex.P20, the place of occurrence is shown under a Neem Tree in front of the house of complainant. The Investigating Officer i.e., PW14 has visited the scene of offence on 31.05.2022 at 16:30 hours and noted down the scene details. When the Investigating Officer i.e., PW14 was observing the scene, he has found plastic bottle containing 180 ml of blue colour liquid. Thus, the poison bottle which is used by the deceased/Bikka
Suvarna to commit suicide was seized by the Investigating Officer i.e.,
PW14 under the scene observation panchanama.
34.The prosecution though able to prove that the deceased/Bikka
Suvarna died due to the consuming Paraquat Herbicide poison but it is not establishes beyond all reasonable doubt that the accused has abated the deceased/Bikka Suvarna to commit suicide. The evidence brought on record from the prosecution witnesses does not establishes that there was an instigation made by the accused to the deceased/
Bikka Suvarna to commit suicide. In the present facts and circumstances of the case, it does not shows that the accused has instigated the deceased/Bikka Suvarna to commit suicide. Hence, I find that the prosecution has failed to bring home the guilt of accused beyond all reasonable doubt for the offence U/sec. 306 IPC.
35. In the result, the accused is found not guilty for the offence punishable U/Sec.306 IPC and accordingly he is acquitted U/Sec. 235(1)
