This case is coming before me for final hearing in the presence of APP for the State and Sri U. Rajanna, Advocate for the accused, having been heard and having stood over for consideration, the Court delivered the following:­ :: J U D G M E N T ::

The Sub Inspector of Police, PS Peddapalli has filed the charge sheet against the accused for the offences punishable U/Sec.63 r/w 51, 52A, 68A, 65 of Copy Right Act 1957 in Cr.No.281/2012.

2.The brief facts of the prosecution story are as follows:

The LW1 is working as Investigator in the Indian Music Industry, the IMI is a registered society under West Bengal Societies Registration

Act having its head Office at Kolkatta and administrative at Mumbai, the IMI is having the membership of 140 leading Music companies such as Saregama, Sony, Aditya Music India Pvt Ltd., TIPS and Universal etc., the main object of the IMI is to protect the interest of their members companies from Audio piracy, LW1 was given General power of Attorney to conduct survey and to detect Audio Piracy and to lodge complaint in the concerned police stations for taking legal action against erring persons, the LW1 along with LWs2 to 4 came to

Peddapalli town and visited the cell point shops, verified and noticed that A1 to A7 are running mobile phone selling shops and loading MP3 piracy movies songs in the memory cards on the demand of the customers selected movies songs and collecting money from them without having any License or Copy Right Agreement from copy right holders and also selling memory cards preloaded with Telugu movies songs owned by Aditya company, on 04.10.2012 in morning LWs1 to 4 visited the Peddapalli town and found the accused persons were violating the norms of the copy right act by under taking the recording of cinemas songs in the memory cards on the demand of customers of their choice songs and collecting money from them for the songs they recorded in memory cards and are displaying and selling the pre recorded Telugu Cinema songs memory cards to IMI member companies in Adithya Music into Pvt Ltd., etc without having any valid license or

Copy Right agreement from the concerned music companies. Hence, the charge.

3.The case was taken cognizance for the offence punishable

U/Sec.63, 65, 68A r/w 51, 52­A of copy right act, 1957 against the accused No.1, 6 and 7 and U/sec.63, 68A r/w 51, 52A of copy right act 1957 against the accused No.2 to 5. On appearance of the accused, the

K. Balachander JFCM., Peddapalli DOJ : 25.02.2020 3 of 10C.C.193 of 2015 copies of the charge sheet and other documents were furnished to them as contemplated U/Sec. 207 of Cr.P.C. Accused were examined

U/Sec.251 Cr.P.C with the allegations that are made against them, for which they denied the said allegations, read over and explained to them in Telugu, for which they pleaded not guilty and claimed to be tried.

4.During the course of trial to prove its case, the prosecution has examined PWs1 to 4 and got marked Ex.P1 to P17.

5.After closure of the prosecution evidence, accused have examined

U/Sec. 313 of Cr.P.C, with the incriminating material available against the accused in the evidence of prosecution witnesses, for which they denied and reported no defence evidence.

6.Heard both sides.

7.Now the points for determination is:­

Whether the prosecution has been able to establish the guilt of the accused for the offence punishable U/s. 63, 65, 68A r/w 51, 52­A of copy right act, 1957 against the accused No.1, 6 and 7 and U/sec.63, 68A r/w 51, 52A of copy right act 1957 against the accused No.2 to 5 beyond all reasonable doubt?

POINT:

8.PW1 who is panch for confession and seizure panchanama, he categorically deposed that he know LW8, he does not know the accused, he does not know anything about the case facts, nobody confessed the offence and nothing was seized in his presence. At about four years back on one day he went to police station Peddapalli on his personal work where the police obtained his signature on some papers, he identified his signatures on confession cum recovery panchanamas of

A1 to A7, which are marked as Exs.P1 to P7. Then, he was declared as hostile.

9.Whereas PW2, who is complainant and Investigator IMI, he categorically deposed that he know LWs2 to 5, previously he worked as investigator in IMI Warangal Zone from 01.03.2012 to 15.08.2014, the head office of IMI is at Calcutta and administrative work office at

Mumbai, on 04.10.2012 he along with LWs2 to 5 proceeded to

Peddapalli town PS Limit to survey of the Mobile Shops, he directed

LWs2 to 5 to survey the mobile shops then they surveyed 7 mobile shops by names, 1. Reddy Mobile Shop, 2. Bharathi Communications,

3. Altaj Mobile Shop, 4. Bhavana mobile Shop, 5. Vittal Mobile Shop, 6.

Akshya Mobile Shop and 7. Vamshi Krishna Mobile Shop, in which they found that the owners of the above shops were downloading cinema songs without having any license from the internet, then they immediately informed him, thereafter, he went to police and lodged a complaint under Ex.P8, he also handed over the power of attorney to police under Ex.P9 along with Ex.P8, basing on Ex.P9 the SI of Police registered a case, during the course of investigation himself, SI of Police,

PW1, LW8, LW6 and 7 were went to the above shops where conducted confession and recovery panchanama before PW1 and LW8, the SI of

Police also seized case property from the above shops, police examined him and recorded his statement, he cannot identified the owners of the above shops.

10.In his cross examination, he categorically deposed that he did not file any document to shows that the IMI is the registered society and the details of members, on 01.03.2012 the Ex.P9 was issued to him and he further admitted that he has not given any documentary proof to shows that the accused are the owners of the above shops. 11.Whereas PW3, who is Junior Investigator IMI, Warangal, he categorically deposed that he know PW2 and LWs3 to 5, he does not know accused, previously he worked as investigator in IMI Warangal

Zone from 01.03.2012 to 16.09.2016, the head office of IMI is at

Calcutta and administrative work office at Mumbai, on 04.10.2012 he along with PW1 and LWs3 to 5 were proceeded to Peddapalli town PS limit to survey of the Mobile shops, PW2 directed him and LWs3 to 5 to survey the mobile shops then they searched 7 mobile shops by names

1. Reddy Mobile shop, 2. Bharathi Communications, 3. Altaj Mobile shop, 4. Bhavana Mobile Shop, 5. Vittal Mobile shop, 6. Akshya Mobile shop and 7. Vamshi Krishna Mobile shop, in which they found that the owners of the above shops were downloading Cinema Songs without having any license from the internet, then they immediately informed to

PW2, he also purchased memory card from Bharathi Cell point and

Akshya Cell point, police examined him and recorded his statement, he cannot identified the owners of the above shops.

12.In his cross examination he categorically deposed that after 2.00

PM the PW2 directed them to survey the above mobile shops, police examined him on the same day, he stated to the police as in Ex.D1.

The remaining questions put by counsel for defence on suggestion basis, for which he denied.

13.As could be seen from the evidence of PWs2 and 3, it reveals that on 04.10.2012 themselves along with LWs3 to 5 proceeded to Peddapalli to search the mobile shops and they searched 7 mobile shops by names

1. Reddy Mobile shop, 2. Bharathi Communications, 3. Altaj Mobile shop, 4. Bhavana Mobile Shop, 5. Vittal Mobile shop, 6. Akshya Mobile shop and 7. Vamshi Krishna Mobile shop, in which they found owners

Balachander JFCM., Peddapalli DOJ : 25.02.2020 6 of 10C.C.193 of 2015 of the said shops were downloading Cinema songs without having any license from the internet, but they cannot identified the owners of the above shops, if they really searched the said shops, they identified the owners of the shops, but they failed to identify the said owners.

Thereafter they handed over the power of attorney to police under Ex.P9 along with Ex.P8. The SI of police went to the shops and conducted confession and recovery panchanama before PW1 and LW8, but the

PW1 did not depose anything about the conducting of confession and recovery panchanama. In their cross examination they deposed that they did not file any document to shows that the IMI is the registered society and the details of members. Therefore, there is no evidence against the accused persons. They stated the names of the shops, but they did not disclose the identity of the owners of the said shops and they too did not disclosed that what audio is they got piracy.

14.Whereas PW4, who is investigation officer, he categorically deposed that he has been working as CI of Police, Intelligence from 18.02.2015, previously he worked as SI of Police, Peddapalli from 28.08.2011 to 30.05.2013, on 04.10.2012 at 3.30 PM he received Ex.P8 from PW2, basing on it he registered a case in Cr.No.281/2012,

U/sec.63 r/w 51, 52A, 68A, 65 of AP Copy Right Act, 1957 and issued

FIR under Ex.P10, during the course of investigation he examined and recorded the statement of PW2 at police station, later he posted to the shop of accused along with PW2, LW8 and PW1, in their presence the accused confessed the offence and seized case property under confession cum recovery panchanama under Exs.P11 to P17, MO1 is the Sim 2G memory card, MO2 is the Laptop (Wipro note book), MO3 is the Card Reader, MO4 is the 2 GB memory card, MO5 is the 2 GB memory card, MO6 is the 2 GB memory card, MO7 is the 2 GB memory

Mouse (Quantum), MO13 is the Card Reader (Unix), MO.14 is the 2 GB memory Card, MO.15 is the CPU (Zebronic), MO.16 is the Monitor (Acer), MO.17 is the Key Board (Hy­Tech), MO.18 is the Mouse and

MO.19 is the Card Reader (VSB2C4 Parts), thereafter he returned to police station along with A1 to A7 and seized property and affected their arrest and produced them before the court for judicial custody, after completion of investigate he filed charge sheet.

15.In his cross examination, he categorically deposed that he has not filed any document to prove that existence of IMI and he further admitted that he has not examined any independent witness. The remaining questions put by counsel for defence on suggestion basis, for which he denied.

16.As could be seen from the evidence of PW4, it reveals that basing on Ex.P8 he registered a case in Cr.No.281/2012 and issued FIR under

Ex.P10, during the course of investigation he examined and recorded the statement of PW2 at police station, laster he posted to the shop of accused persons along with PW2, LW8 and PW1, in their presence the accused confessed the offence and seized case property under confession cum recovery panchanama under Exs.P11 to P17, but the

PW1 deposed in his evidence that he does not know anything about the case facts, nobody confessed the offence and nothing was seized in his presence, then he was declared as hostile, there is a contradiction between the evidence of PW4 and PW1. Thereafter he returned to police station along with A1 to A7 and seized property and affected their arrest and produced them before the court for judicial custody. His bounded

K. Balachander JFCM., Peddapalli DOJ : 25.02.2020 8 of 10C.C.193 of 2015 duty to collect the document that the IMI is the registered society and the details of members, but he failed to do so. There is no evidence against the accused persons, and also to prove that the IMI is the registered society. The PWs2 and 3 also not supported the case of the prosecution. Therefore, the accused persons are entitled for acquittal.

PWs2 to 4 who did not disclose that what audio has got piracy by the

A1 to A7, to that extent PWs2 to 4, who did not place any records of certificates to establish that the accused persons through the MO1 to 7.

17.This court was passed conditional orders on 20.01.2020 to produce the witnesses i.e., LWs3 to 5 and 8 i.e., LW3/Modem Babu, who is Jr. Investigator IMI, LW4/Thota Aneel, LW5/Gurram Mahender, who are assisted to LW1, LW8/Jenna Ramana Reddy, who is panch for confession and seizure panchanama of accused to examine them. Even after passing of conditional order the prosecution did not produce the witnesses LWs3 to 5 and 8. In­spite of several adjournments, passed a conditional orders as finally, has a last chance, in­spite of its prosecution did not shown any pronounced negligence on the part of police concerned and prosecution. This court is not having any other alternative steps for getting the interest for production of the above said witnesses. It clearly shows that presence of the above said witnesses except closer of their evidences. Accordingly the evidences of LWs3 to 5 and 8 are closed by this court on 12.02.2020. The evidences of LWs6 and 8 are given up by the APP on 17.01.2018.

18.As discussed above supra, the prosecution is miserably failed to prove the guilty of the accused for the offence U/s. 63, 65, 68A r/w 51, 52­A of copy right act, 1957 against the accused No.6 and 7 and

U/sec.63, 68A r/w 51, 52A of copy right act 1957 against the accused

No.3 to 5 beyond all reasonable doubt, as such they are entitled for acquittal.

19.In the result, the accused No.3 to 5 are found not guilty for the offence U/sec.63, 68A r/w 51, 52A of copy right act 1957 against the accused No.3 to 5 and the accused No.6 and 7 are found not guilty for the offence U/s. 63, 65, 68A r/w 51, 52­A of copy right act, 1957 and they are acquitted U/s.248(1) Cr.P.C. The bail bonds of the accused shall stands closed after appeal time is over. The Mo.1 to 19 were given to police for safe custody, the MO.2, 9, 10, 15 and 16 shall return to its owners after appeal time is over under proper acknowledgment and also file the same before this court. The case property i.e., Mo.1, 3 to 8, 11 to 14 and 17 to 19 shall destroy after appeal time is over.

This case is coming before me for final hearing in the presence of APP for the State and Sri U. Rajanna, Advocate for the accused, having been heard and having stood over for consideration, the Court delivered the following:­ :: J U D G M E N T ::

The Sub Inspector of Police, PS Peddapalli has filed the charge sheet against the accused for the offences punishable U/Sec.304­A of

IPC and Sec.3 r/w 196 of MV Act in Cr.No.210/2014.

2.The brief facts of the prosecution story are as follows:

The LW1 is resident of Peddakalvala village, due to old age the

LW1 is not doing any work and staying in house, the accused is resident of Tenuguwada, Peddapalli and he is driver of Jeep bearing

No.AP 36 R 5413, the deceased is third daughter of LW1, on 21.09.2014 at 8.00 PM the deceased along with her relatives LWs2 to 4 left from house to Peddakalvala bus stage with an intention to go Kothagudem, at 8.30 PM while the deceased is crossing the road, the accused drove the jeep from Peddapalli to Karimnagar in rash and negligent manner with high speed and overtaking a lorry from wrong side and dashed to the deceased, as a result, the deceased fell down on the road and

K. Balachander JFCM., Peddapalli DOJ: 26.02.2020 2 of 6C.C.425 of 2014 received sever injuries on her left hand, left leg and trunk and died on the spot, the LWs2 to 4 witnessed the incident. Hence, the charge.

3.The case was taken cognizance for the offences punishable

U/Sec. 304­A of IPC and Sec.196 of MV Act against the accused. On appearance of the accused, the copies of the charge sheet and other documents were furnished to him as contemplated U/Sec. 207 of

Cr.P.C. Accused was examined U/Sec. 251 Cr.P.C with the allegations that are made against him, for which he denied the said allegations, pleaded not guilty and claimed to be tried.

4.During the course of trial to prove its case, the prosecution has examined PWs1 to 4 and got marked Ex.P1.

5.After closure of the prosecution evidence, accused has examined

U/Sec. 313 of Cr.P.C, with the incriminating material available against the accused in the evidence of prosecution witnesses, for which he denied and reported no defence evidence.

6.Heard both sides.

7.Now the points for determination is:­

Whether the prosecution has been able to establish the guilt of the accused for the offences punishable U/s.304­A of IPC and Sec.196 of MV Act beyond all reasonable doubt?

POINT:

8.Whereas PW1, who is complainant, PW2, who is mother of deceased, PW3, who is brother­in­law of deceased and PW4, who is sister of deceased, they categorically deposed in one voice that at about five years back the deceased went to bus stop of Peddakalvala, mean while one jeep proceeded from Peddapalli and dashed against the K. Balachander JFCM., Peddapalli DOJ: 26.02.2020 3 of 6C.C.425 of 2014 deceased by crossing the road, due to which she received multiple injuries and died on the spot, they do not know the name of the driver of crime vehicle as well as number of crime vehicle, thereafter they went to police station and lodged a complaint under Ex.P1, police examined them and recorded their statements.

9.In the cross examination of PWs1 and 2, they categorically deposed that Ex.P1 scribed by police, Peddapalli, they do not know the contents of it, police never examined them and not recorded their statements. They further admitted that they have filed compensation

O.P. before the Hon’ble Prl. Dist. And Sessions Judge, Karimnagar. The remaining questions put by counsel for defence on suggestion basis, for which they denied.

10.In the cross examination of PWs3 and 4, they categorically deposed that police never examined and not recorded their statements, they have not witnessed the incident on the date of alleged incident.

11.As could be seen from the evidence of PWs1 to 4, it reveals that at about five years back the deceased went to bus stop Peddakalvala, while crossing the road, one Jeep proceeded from Peddapalli and dashed against her, but they do not know the name of driver of crime vehicle as well as number of crime vehicle. They did not depose the rash and negligent driving of the accused and also the name of the accused and also the number of crime vehicle. They deposed in their cross examination that the police never examined them and not recorded their statements. There is also contradiction in between their

Balachander JFCM., Peddapalli DOJ: 26.02.2020 4 of 6C.C.425 of 2014 chief examination and cross examination about the examination of them by the police and also the recording of their statement by the police. The PWs1 to 4 are the blood relatives of deceased as such, basing on their evidence this court cannot come to the conclusion that the accident was occurred due to the rash and negligent driving of accused only, and also from their evidence it cannot be established in the absence of evidence about the rash and negligent act of the driver of the crime vehicle. They are not the eye­witnesses to the incident, so they do not know the rash and negligent act done by the accused. The other evidences of witnesses were closed by this court. Except the

PWs1 to 4 nobody was examined by the prosecution, as such there is no proper evidence against the accused to believe that the alleged incident was done by the accused.

12.This court was passed conditional orders on 04.02.2019 to produce the witnesses i.e., LWs5 to 15 i.e., LW5/Salendra Srinivas, who is son of deceased, LW6/Narla Anjaiah, who is paternal uncle of the deceased, LW7/Gandam Vishnu, who is photographer, LW8/Nakka

Sathish, who is owner of crime jeep, LW9/Narla Swaroopa,

LW10/Salendra Rajaiah, who are panch witness for inquest,

LW11/Pegada Srinivas, LW12/Narla Srinivas, who are panch for CDF,

LW13/Dr. B.Anjaneyulu, who conducted autopsy over the dead body of deceased, LW14/D. Manohar, who inspected the crime vehicle and

LW15/K.Kishore, who is investigation officer and filed charge sheet to examine them. Even after passing of conditional order the prosecution did not produce the witnesses LWs5 to 15. As this case is pertaining to the Pre­2015 and as per the orders of the 1) Hon'ble High Court vide

dated 25.04.2019 this case shall be disposed off on priority basis. In­

spite of several adjournments, passed a conditional orders as finally, has a last chance, in­spite of its prosecution did not shown any

pronounced negligence on the part of police concerned and prosecution.

This court is not having any other alternative steps for getting the interest for production of the above said witnesses. It clearly shows that presence of the above said witnesses except closer of their evidences.

Accordingly the evidences of LWs5 to 15 are closed by this court on 18.02.2020.

13.As discussed above supra, the prosecution is miserably failed to prove the guilty of the accused for the offences U/sec.304­A of IPC and

Sec.196 of MV Act beyond all reasonable doubt, as such he is entitled for acquittal.

14.In the result, the accused is found not guilty for the offences

U/Sec.304­A IPC and Sec.196 of MV Act and he is acquitted U/s.255(1)

Cr.P.C. The bail bonds of the accused shall stands closed after appeal time is over.

Accused called present, copies furnished to him and examined U/sec. 251 Cr.P.C and the accused admitted the substance of prosecution case for the offence U/sec. 337, 338 IPC. I found the admission of accused true and voluntary one. Accordingly the accused found guilty and convicted U/sec. 252 Cr.P.C for the offence U/sec. 337, 338 IPC. The accused is heard the quantum of sentence and submitted there are no person to look after his family members. Keeping in view of the submissions of I am of the view that it is not the fit case to extend the provisions of P.O Act however the accused can be shown some lenient view since the offence U/sec.337, 338 IPC punishable with imprisonment or with fine or with both. As there are no other person to look after his family members, he can be punished with fine only. In the result the accused is found guilty under section 252 Cr.P.C for the offence U/sec. 337 IPC and sentenced to pay fine of Rs.500/­ in default to suffer SI for 1 month. for the offence U/sec. 338 IPC and sentenced to pay fine of Rs.1,000/­ in default to suffer SI for 2 months. The bail bonds of accused shall be in force for six months. ( Total fine of Rs.1,500/­)
