OFFENCE UNDER SECTION: U/Sec.9(1) of IPC

This case is coming before me on this day for hearing in the presence of Learned APPO

for the complainant and the accused is in person, and having heard and having perused the

record, having stood over for consideration till this day, this court delivered the following: - :: ADMISSION OF CLAIM::

Accused No.1 to 8 are present. Copies furnished to them and they are examined U/sec.251 Cr.P.C explaining the allegation for the offence punishable U/Sec.9(1) of TS Gaming Act for which they pleaded guilty voluntarily and submitted that they are poor persons, eking his lively hood by doing petty works and then their family members depended on them and also they requested the Court to take lenient view as they are only earning members in the family. Hence, accused No.1 to 8 are found guilty for the offence U/sec. 9(1) of TS Gaming Act and are convicted U/sec. 252 Cr.P.C. and sentenced to pay a fine of Rs.1000/- (Rupees One thousand only) in default to suffer SI for a period of (30) days for the offence U/sec. 9(1) of T.S. Gaming Act.Total fine amount is Rs.8000/- (Rupees Eight thousand only) Accordingly, this case is disposed off and accused No.1 to 8 are set at liberty. The SEIZED amount of Rs.80,140/- (Rupees Eighty thousand one hundred and forty only) shall be confiscated to the State immediately, and 52 playing cards shall be destroyed after expiry of appeal time. 8 mobile phones and 4 motorcycle bearing Nos.TS-22-G-3488, TS-22-E-6032, AP-09-BK-3880 and TS-02-FC-9736 which were deposited before this Court vide PSL.No.136/2021 shall be returned to the its original owner and file acknowledgement before this court forthwith.

for the complainant and the accused is in person, and having heard and having perused the

record, having stood over for consideration till this day, this court delivered the following: - :: ADMISSION OF CLAIM::

Accused is present and he is examined U/sec.251 Cr.P.C. explaining the substance of accusation for the offence punishable U/Sec.279 of IPC for which he pleaded guilty voluntarily and submitted that he is the poor person, eking his lively hood by doing petty works and then his family members depended on him. And also he requested the Court to take lenient view as he is only earning member in the family. In view of submissions of accused, this court inclined to take a lenient view against accused in awarding sentence. Hence accused is found guilty for the offence punishable U/Sec.279 of IPC. Accused is convicted U/Sec.241 Cr.P.C. and sentenced to pay a fine of Rs.1000/- (Rupees One thousand only) in default to suffer S.I. for a period of (10) days for the offence punishable U/sec.279 IPC. The total fine amount is Rs.1000/- (Rupees One thousand only) No property deposited in this case.

Accordingly, this case is disposed off and accused is set at liberty. His bail bonds stands canceled after expiry of appeal time.
