This Criminal Revision Petition came before me for final hearing on 23.06.2021 through Video Conference, through Blue Jeans in the presence of Sri Sk.Karimulla, Advocate for the revision petitioner and of Sri Y.Babu Rao, Addl., Public Prosecutor for 1st respondent, upon perusing the material on record and the matter having stood over to this day for consideration, this Court made the following:

O R D E R

This Criminal Revision Petition is filed by the Revision Petitioner praying to set aside the Order, dt.23.02.2021 in Crl.MP.No.42/2021 in

Cr.No.496/2020 of Vatsavai P.S on the file of Prl., Junior Civil Judgecum

Judicial Magistrate of First Class, Jaggaiahpet by ordering the release the

Swift car bearing No.AP 16 DQ 4243 to the revision petitioner which was seized in the above crime No.496/2020.

2. The parties in the main petition were taken as it is as petitioner and respondent for easy sake of discussion in this revision petition.

3.The brief averments as per the petition in Crl.R.P.No.8/2021 are as follows:

The petitioner averred that police seized Swift car and the same is in the custody of respondent/police and if it is kept idle in open sky there are chances of damage to the property and will create mechanical problems.

Further, if the Swift car kept idle in the police custody, the petitioner will not only sustain monetary loss, but also inestimable damage.

The petitioner further averred that she undertakes that she will not sell, create mortgage or deal with the case property in any manner during the pendency of trial and she is ready and willing to produce sufficient securities and undertakes that she will produce the property before the trial

Court whenever ordered. Therefore, prays to grant interim custody of the property by setting aside the trial Court Order.

4.Now the Point for determination is.

Whether the petition can be allowed by granting interim custody of the case property by setting aside the Order, dt.23.02.2021 in

Crl.M.P.No.42/2021 on the file of Prl., Junior Civil Judgecum

5. POINT:

The petitioner is the Revision petitioner who is the owner of the case property in Crl.M.P.No.42/2021 which was seized in Crime No.496/2020 of

Vatsavai P.S. The case property i.e., Swift car, which was seized in Crime

No.496/2020. The petitioner filed Crl.M.P.No.42/2021 on the file of Prl.,

Junior Civil JudgecumJudicial Magistrate of First Class, Jaggaiahpet for interim custody of the property seized in the above crime by the respondent /police. The trial Court dismissed the Criminal M.P. Hence, the present revision petition is filed.

6.It is undisputed fact that if the property i.e., Swift car kept idle, without any overhauling it will subject for rust and it will become obsolete as it is a mechanical device. If it is exposed to sun and rain, it will become rust and it will become obsolete. Therefore, in the above circumstances I am inclined to allow the revision petition by ordering for interim custody of the case property during the pendency of case in Crime No.496/2020 of

Vatsavai P.S. with the same conditions imposed in Crl.M.P.No.41/2021 in this revision petition, dt.26.04.2021 and with a condition that the petitioner must produce the Swift car whenever directed by the trial Court relating to

Crl.R.P.No.8/2021 4 Dt:24.06.2021

Crime No.496/2020. With the above conditions I am inclined to allow the revision petition.

7.In the result, the Revision petition is allowed by setting aside the

Order passed on 23.02.2021 by the Prl., Junior Civil Judge.cumJudicial

Magistrate of First Class, Jaggaiahpet in Crl.M.P.No.42/2021 in Crime

No.496/2020 of Vatsavai police station by granting interim custody of the property in this case pending disposal of the Calendar Case or Crime

No.496/2020 of Vatsavai police station with the same conditions imposed in Crl.M.P.No.41/2021, dt.26.04.2021 in this Revision Petition No.8/2021.
