This Sessions Case is coming on 20.02.2026 for final hearing before me in the presence of learned Additional Public Prosecutor for Prosecution and of Sri M.Damodara Rao, Ld. Counsel for accused and upon hearing on both sides and having stood over till this day for consideration, this Court delivered the following:

1.The Sub Inspector of Police, R.A.Valasa Police Station filed charge sheet against Accused/A1 to A23 for the offence punishable under Sections 147, 148, 307, 26, 324, 452, 341, 427 r/w 149 of IPC in Cr.No.65/2019 of
R.A.Valasa Police Station.
2.The brief facts of the Prosecution case are that:-
L.W.1/Kuppili Tirumalarao is the de-facto complainant. On 31.03.2019 on receipt of information from Area Hospital, Palakonda, L.W.17/Sub Inspector of Police, R.A.Valasa Police Station rushed to hospital and recorded the statement of de-facto complainant, in which, he stated that he is resident of

Sombaru, S/o Daliram and some other youngsters have collected Rs.356/-,
Rs.2,000/- and Rs.5,000/- per house from SC street in name of AIM (Ambedkar Indian Mission) for Ambedkar Stateu. They had collected amounts from nearly 55 of their families and but they were not invited for the inauguration of statue. In this regard they have been disputing for about 20 days, ultimately on 29th March they were disputed and beat each other. Ganapathi beat on his head with a stout stick yelling out that today they would kill them. Kuppili Sai, Jagadeesh beat on his both wrists with stout sticks.
Kuppili Annaji, Kuppili Ramu beat on his both legs with stout sticks and caused him severe injuries. They have damaged his Pulser Motor cycle bearing No.
A.P.30 AS 985. In the meanwhile when Sura Nagaraju came to that side with his auto, they have collected some more stout sticks from that auto, rushed tohi house by crying loudly that they would kill them today, damaged his house doors, entered into the house and beat his elder maternal uncle Kuppili
Laxmana on his head. Also they have damaged his scooty bearing No.A.P.30
AJ 7422 completely. Also they have damaged Royal Enfield bearing No.A.P.30

Annarao, S/o Ramayya and Uppadayya Yallayya, S/o Ramayya came and raised cries loudly, the above persons were scattered. All the injured got admitted in government hospital, Palakonda, the de-facto complainant gave police complaint in consciousness.
Basing on the contents of statement, the Sub Inspector of Police,
R.A.Valasa Police Station registered a case in Cr.No.65/2019 for the offence under sections 307, 341, 452, 427, 323, 147, 148 r/w 149 IPC of R.A.Valasa
P.S on 31.0.2019 at about 20.00 hours and submitted the original FIR along with original statement of de-facto complainant to the Honourable court and conducted investigation in this case.
During the course of investigation, on 31.03.2019, the Sub Inspector of
Police, R.A.Valasa Police Station examined all the witnesses , recorded their statements under section 161(3) Cr.P.C., visited the scene of offence on 01.04.2019 in the presence of mediators, seized three stout sticks from the first scene of offence i.e near by Dr.Ambedkar Statue, Devudala village, four sticks and blood stains from the 2nd scene of offence i.e the house of de-facto complainant and three stout sticks and blood stains from the 3rd scene of offence, i.e the house of L.W.5/Kuppili Chinna under cover of separate scene observation reports duly attested by the mediators, examined witnesses and recorded their statements.

The Sub Inspector of Police, R.A.Valasa P.S arrested the accused A1 to
A4, A6 to A12, A14 to A19 on 01.04.2019 and forwarded them to the court for judicial custody. The S.I of Police apprehended A5 being Juvenile conflict with child on 03.04.2019 and he was forwarded to the home. A.13 and A20 got anticipatory bail from the Honourable Family Court cum III Additional District and Sessions Judge, Srikakulam on 19.06.2019. On the directions of the
Honourable court, they were surrendered before the Honourable Judicial First
Class Magistrate , Rajam and they were enlarged on bail. A21 to A24 approached the Honourable high Court of Andhra Pradesh vide
Crl.M.P.No.3227 of 2019 dated 27.06.2019 and on the directions of the
Honourable court, L.W.18 issued notices to A21 to A24 under section 41-A
Cr.P.C. L.W.15/Medical Officer who treated the de-facto complainant, issued wound certificate and opined that the injuries are grievous in nature. Basing on the opinion of Medical Officer, Inspector of Police, RA Valasa P.S added section 326 IPC to section 307, 341, 452, 427, 323, 147, 148 r/w 149 IPC .
L.W.16/Medical officer who treated the injured, issued wound certificates to them and after completion of entire investigation the Investigating Officer filed charge sheet against all the accused for the above said offences. Hence, the charge sheet.

3.The learned Judicial Magistrate of I Class, Rajam, took cognizance of the offence punishable under sections 147, 148, 326, 324, 452,341, 427 r/w 149 of Indian Penal Code and registered the same as P.R.C.
03/2020 and after furnishing copies of documents under section 207 of
Criminal Procedure Code to all the accused, committed the same to the court of Sessions, Srikakulam. The Hon’ble Principal District and Sessions Judge,
Srikakulam registered the said P.R.C.03/2020 as Sessions Case No.125/2023 and made over the same to this court for disposal according to law.
4.After receipt of file, this court has issued summons to the accused/A1 to
A23 for their appearance, after their appearance they were examined under section 228 of Criminal Procedure Code, read over and explained the contents of the charge for the offence punishable under sections 147,148,307,341,326,324,452 and 427 r/w 149 of Indian Penal Code in
Telugu to them, after having understood the same, they pleaded not guilty, denied the same and claimed to be tried.
5.During the trial, the prosecution side as many as L.W.s 1 to 18 witnesses, out of which, examined PWs 1 to 10 and got marked Exs.P1 to
P14 and M.O.s1 to 3. On behalf of defence, none were examined and no document was marked. The evidence of L.W.9/Jarajana Daliramu,

Adeyya is filed , hence, the evidence of Kuppili China Adeyya is closed on 23.01.2026. In view of L.W.15/Dr.Sudha Mohan details are not found after resignation GMR care Hospital, hence, his evidence is closed. The evidence of L.W.16/Dr.Visveswararao died, his evidence is closed.
6.After closure of the prosecution evidence, the Accused/A1 to A23 examined under section 313 Cr.P.C., the incriminating evidence is available on record, for understood the same, they denied and reported no defence evidence.
7.Heard, the Learned Additional Public Prosecutor and learned Counsel
for the accused/A1 to A23.
8. Now, the point for determination is:-
Whether the prosecution proved the guilt of the Accused/A1 to A4 and A6 to A24 for the offence punishable under sections 147, 148,307,341,326,324,452 and 427 r/w 149 of Indian Penal Code?

9.To prove its case, the prosecution examined PWs 1 to 10 and got marked Ex.P1 to P14 and M.Os.1 to 3 . On behalf of defence, no witness was examined and no document was marked.

11.At the outset the prosecution case is that with ill feelings A1 hatched up a plan along with his men A2 to A24 to kill the de-facto complainant as she is the route cause for the incidents, formed themselves into an unlawful assembly arming with deadly weapons i.e stout sticks, waylaid him while he

was coming into the village on a motor cycle and attacked him with an intent to kill him by raising huge cries that they would kill him, A1 beat on the head of him with a stout stick, A4 beat the de-facto complainant with stout sticks on his both knees, A2 and A8 beat him with stout sticks on his both legs and caused him bleeding injuries. The accused caused mischief by damaging motor cycle and later all the accused trespassed into the house of L.W.2 after making preparation for hurt, caused mischief by damaging sooty of him and another bike and house doors , beat the P.W.s 2 to 6 and 8 with deadly weapons and caused them bleeding injuries.
12.To prove the case of the prosecution, P.W.s 1 to 10 and got marked
Ex.s P1 to P14 and M.O.s 1 to 3. P.W.1 who is the de-facto complainant deposed that himself and his villagers and his relatives donated some amount for establishing the Ambedkar statue in his village, said donation collected by A1 and kept with him , when they questioned the amount collected by accused, then, accused gave a reluctant reply, so that the accused supporters and himself and L.W.2 to 12 pushed away each other in that galata, he sustained injury on his forehead and left hand. He went to the
Palakonda Area Hospital, and stayed there for ten days. The police came to him and obtained signature on one blank white paper. Police prepared report,

so he do not know the contents of his report. During cross examination he stated that he never stated before police as per his report and as per his section 161(3) Cr.P.C. Statement and he admitted that he compromised the matter before elders. He further admitted that another criminal case
C.C.No.97/2020 is pending before the JFCM, Rajam, in that matter also accused herein this case agreed to withdraw the said cae and further admitted that both the accused and de-facto complainant entered into compromise and executed memorandum of under standing.
13.The de-facto complainant is the crucial witness to prove that the accused caused injuries to him along with other injured persons, but he clearly stated in his cross examination that he himself along with other injured compromised with accused herein and another criminal case which was filed by the accused against the de-facto complainant is also compromised and executed memorandum of understanding.
14.The injured persons by name Kuppili Lakshmayya, Kuppili
Ganapathirao, Kuppili Venkataramana, Kuppili Trinadhamma, Kuppili Apparao, and Kuppili Mugatayya examined as P.W.s 2 to 6 and P.W.8 who are turned hostile and did not support the prosecution case. Out of P.W.2 to 6 and 8,

P.W.2 clearly stated in his evidence that he was sustained head injury and went to take treatment at Area Hospital, Palakonda but he cannot identified the persons stand in the accused dock and he never saw them to this day. P.W.4,
P.W.5,P.W.6 and P.W.8 deposed in their evidence that some unknown persons pushed them from back side then, they fell down and they sustained injuries and immediately they are admitted into Area Hospital, Palakonda and taken treatment for . They also did not support the case of prosecution. The material witnesses are turned hostile to the case of prosecution.
15.The witnesses could not like to stand their own statements recorded by the police. All the injured witnesses denied their own statements that they did not state before police anything. All the injured witnesses elicited that some galata took place between the accused and injured in that galata some one pushed them due to that they fell down and sustained injuries. But, they did not elicited who treated him and who given treatment to them and about the wound certificates got issued by medical officer.
16.P.W.9 and 10 are the Investigating officers, both of them are also did not elicit that they received wound certificates from the medical officer and what date they received , they simply stated that basing on the wound certificates issued by L.W.15/Medical Officer who treated the de-facto complainant opined

that the injuries are grievous in nature. So, that they added section 26 of IPC, those wound certificates did not mark by the prosecution either of the witnesses due to non examination of medical officer. One Medical Officer died, another one i.e L.W.15 Dr.Sudha Mohan, her details are not found after resignation from GMR Hospitals, so her evidence was closed and another medical officer by name Dr.Visveswararao died . So, there is no evidence to corroborate the evidence adduced by the prosecution with regarding to the injured. The prosecution did not taken steps to mark the wound certificates through concern. So, the wound certificates on record no way helpful to conclude that the P.W.1 to 6 and 8 sustained injuries in the hands of the accused. The accused are also not identified by the injured witnesses so, the evidence available on record is insufficient to come to conclude that the galata took place on 31.03.2019 and in the said galata the injured/P.W.s 1 to 6 and 8 are sustained injuries in the hands of the accused.
17. Basing on the insufficient evidence confirming the conviction to the accused is not sufficient. However, prosecution failed only reason that material witnesses not supported to the prosecution case. When the evidence is insufficient or unreliable due to lack of witness testimony, the accused is entitled to acquittal. Ravi Vs. State of Punjab 2025, the APEX court

reaffirmed that conviction cannot be based on suspicion of incomplete proof and onus remains on the prosecution. So, it seems that the prosecution failed to prove the guilt of the accused beyond all reasonable doubt for the offence under sections 147,148,307,341,326,324,452 and 427 r/w 149 of Indian Penal
Code, therefore, the benefit of doubt is given to all the accused and its leads acquittal for that charges.
18.In view of the above facts and circumstances considering the material on record, the prosecution failed to establish the ingredients under sections 147,148,307,341,326,324,452 and 427 r/w 149 of Indian Penal Code against accused. Hence, the benefit of doubt shall goes to the accused and accordingly, the accused/A1 to A2 are acquitted for the said offences. Point is answered accordingly.
19. In the result, the Accused/A1 to A23 (A1 to A4 and A6 to A24,
A5 is the Juvenile) are found not guilty for the offence punishable under
sections 147,148,307,341,326,324,452 and 427 r/w 149 of Indian Penal
Code (sections 191,192,109,124(1),117(2),117(1),331 and 324(4) r/w 190 of
Bharatiya Nyaya Sanhita) and they are acquitted under Section 235 (1) of
Code of Criminal Procedure (section 258(1) of Bharatiya Nagarik

b) in the Trial: This case was received as made over by the Hon’ble CourtPrincipal District & Sessions Judge, Srikakulam to this Court. After appearance of the Accused/A1 to A23 charge has been framed under Sections 147,148,307,341,326,324,452 and 427 r/w 149 of Indian Penal Code against accused, read-over and explained to them in Telugu, for which they pleaded not guilty and claimed to be tried.
On 21.11.2025 the trial schedule was fixed, PWs.1 to 10 are examined and Exs.P.1 to P.14 and M.Os.1 tow 3 were marked and the prosecution evidence is closed. On 20.02.2026 the Accused were examined under Section 313 of Cr.P.C., by explaining the incriminating material appearing against them and they denied the same and reported no defence evidence on their behalf and on the same day arguments heard on both sides. Finally, on 24.01.2026 the Judgment is pronounced (vide separate Judgment).
Sentenceor:In the result, the Accused/A1 to A23 (A1 to A4 and A6 to A24, A5 Orderis the Juvenile) are found not guilty for the offence punishable under sections 147, 148, 307, 341, 326, 324, 452 and 427 r/w 149 of Indian Penal Code (sections 191,192,109,124(1),117(2),117(1),331 and 324(4) r/w 190 of Bharatiya Nyaya Sanhita) and they are acquitted under Section 235 (1) of Code of Criminal Procedure (section 258(1) of Bharatiya Nagarik Suraksha Sanhita) for the said offences.
