This case is coming before me on 21.09.2021 for final hearing in the presence of Assistant Public Prosecutor for the state and Sri M.V Rajendra Prasad, Advocate for accused: Upon perused the record and after hearing both sides this court delivered the following:

J U D G M E N T

1. This is a case arising out of the charge­sheet filed by Inspector of Police,

Sathupally P.S. against the accused in Cr.No.56/2015 for the offences

U/sec.354 and 506 of Indian Penal Code.

2. The brief facts of the case are that the defacto complainant lodged petition on 22.02.2015 at 05.30 pm in which she stated that previously the accused resided along with his wife and children besides her house on rent.

Earlier, her husband worked as auto driver and at that time the accused also worked as auto driver and frequently came to their house as the accused having friendly relationship with her husband. At that time keeping the 2/13

intimacy with them, she used to offer Tea to him. On 21.02.2015 when her husband went for attending work, at about 03.00 pm when she was alone in the house, the accused came to her house and asked about her husband. She repled to him that her husband was went for work. Immediately, he caught hold her hand saying that “ Ninnu Eppatinundo Anubhavinchalani

Anukuntunnanu, Neevante Naku Estam” and asked the defacto complainant to desire his lust and tried to compel her modesty. Immediately, she removed her hand from his clutches and rushed out from the house. Further, the accused threatened her that if she told to anybody he will kill her and her husband. Later, she informed to her husband and her brother in law’s about the act of the accused. On receipt of the report from the P.W.1 the P.W.7 who is the investigation officer registered a case in Cr.No.56/2015 U/sec.354 and 506 of Indian Penal Code and took up the investigation and during the course of investigation he examined and recorded the statement of P.W.1, P.Ws.2 and

3. Later, he visited the scene of offence and prepared the scene of offence panchanama in the form of CDF in the presence of L.W.6/Sk. Abbas Ali and

P.W.4. Later, he secured the presence of P.W.5 and 6 and examined recorded their statements. On 25.02.2015 at 11.00 am the P.W.7 arrested the accused and released him on furnishing sufficient sureties.

3.This court took cognizance for the offences punishable under section 354 and 506 of Indian Penal Code, against the accused.

4. After appearance of the accused, case papers furnished to him as contemplated under section 207 of the Criminal Procedure Code.

5.The accused was examined under section 239 of the Criminal

Procedure Code and charges framed for the offence U/sec.354 and 506 of

Indian Penal Code which are read over and explained to him, and he pleaded not guilty and claimed to be tried.

6. In order to prove the case of prosecution, the learned APP examined the

PWs.1 to 7 and got marked Exs.P.1 to Ex.P5. Police filed the report of

L.W.6/Sk.Abbas Ali stating that his whereabouts are not known hence, closed his evidence.

7. After closure of prosecution evidence the accused was examined under section 313 of Criminal Procedure Code by explaining the incriminating material appearing in the prosecution evidence to which he denied the same and reported no defence on his behalf.

8.Heard arguments on both sides.

9. Point for Consideration:

1.“Whether the prosecution did prove the guilty of the accused beyond shadow of all reasonable doubt for the offences punishable under 354 and 506 of IPC, against the accused? 

2. “To what finding”?

10. Point Number 1:

The case of the prosecution is that on 21.02.2015 at 03.00 pm the accused came to the house of P.W.1 when her husband was went for work, and he caught hold her hand and outraged her modesty and also threatened with dire consequences. In order to prove the same, the prosecution examined the

court that the accsued is the friend of her husband and he used to visit their house due to the acquintance of her husband and on 21.02.2015 at 03.00 pm the accused came to their house when she was alone in her house and her husband was not present in the house the accused by stating that “ Nuvvu

Naku Kavali”  and tried to outrage her modesty and also the accused caught­ hold her hand with an intention of the accused “ Naa Daggara Padukovalani”.

She further deposed that she went outside of the house with fear and she informed the incident to P.W.3 and the accused left her house and later her husband came to their house and she informed about the incident and she lodged the police report on the next day and the police report exhibited as

Ex.P.1 and further deposed the the police examined her and recorded her statement. The P.W.1 was cross examined by the learned counsel for the accused and during the cross examination the P.W.1 categorically deposed on her dictation the police scribed the police report. P.W.1 further admitted that prior to the six months of the alleged incident there was a panchayath was conducted with regard to the money transactions in the presence of C.I and

DSP. Further, the P.W.1 denied the suggestion that the accused is the caste elder in the gouda community. Further the P.W.1 denied the suggestion that due to the auto union disputes and monitory disputes between the family of

P.W.1 and accused she lodged a false case and also denied the suggestion that she deposed false.

Coming to the evidence of P.W.2 who is the husband of the P.W.,1 and he deposed that the accused is his friend and since nine years the accused and himself eking lively­hood by driving a auto. On 21.02.2015 the accused came to their house when he was not in the house and tried to outrage the modesty of P.W.1 and when returned to the house, the P.W.1 informed about 5/13

the incident. During the cross examination the P.W.2 categorically admitted that neither the P.W.1 nor his parents and no one informed the incident through phone to him and further denied the suggestion that he is having disputes with the accused with regard to the auto union election and also monitory disputes and so also caste disputes and further denied the suggestion that to extract the money from the accused he got filed this case through

P.W.1. P.W.3 who is another witness and his evidence also corroborating with the evidence of P.W.2. P.W.4 who is the panch witness for the scene of offence panchanama and he deposed that on 23.02.2015 the police conducted the panchanama at the house of P.W.2 and drafted the rough sketch and obtained his signature. During the cross examination of P.w.4 denied the suggestion that no panchanama was conducted in his presence. P.W.5 and 6 are said to be eye witnesses but they did not supported to the case of prosecution. P.W.5 is cross examined by the learned counsel for the accused and during cross examination the P.W.5 admitted that P.W.2 contested as president in the auto union election and he know about the disputes between the Rajaka and gouda community members with regard to the auto union elections. Remaining evidence is the investigating officer and he deposed before this court that on 22.02.2015 at 05.30 pm the P.W.1 lodged a petition and he registered a case and issued FIR and he examined P.Ws.1 to 3 and recorded their statements.

Later he visited the scene of offene and prepared the panchanama in the presence of P.Ws.4 and L.W.6 and he examined and recorded the statements of

P.Ws.5 and 6. On 25.02.2015 at 11.00 am he arrested the accused and released on furnishing sufficient sureties. During the cross examination of the

P.W.7, the P.W.7 admitted that there is a correction at month column in the police report and there is a delay of one day in lodging the police report from the time of happening of the offence and further the P.W.7 categorically 6/13

deposed that he examined the neighbours of the house of P.W.1 but they did not stated anything. So, he did not examined them and further the P.W.7 deposed that he do not aware of the disputes in between the Rajaka and gouda community and denied the suggestion that there are monitory disputes between P.W.1 and accused family, so the P.W.1 lodged this false case. The learned APP submitted that the evidence of P.W.1 is very clear that the accused came to their house when she was alone and caught­hold her hand and tried to outrage her modesty and the evidence of P.W.1 coupled with the evidence of

P.Ws.2 to 4 and with the investigating officer evidence. The prosecution proved the case beyond doubt. Further, the learned APP submitted that even though the P.W.1 admitted during cross examination that there are monitory transactions between the accused and P.W.2 but it was no way fatal to the case of the prosecution and further the P.W.1 to 3 categorically denied the suggestion that due to the monitory disputes between them only the P.W.1 filed this case. On the other hand the learned counsel for the accused submitted that the P.W.1 filed this false case and during the cross examination she categorically admitted that she filed this false case as there are money transactions between the accused and P.W.2. So the evidence of P.W.1 is not trustworthy, P.W.2 and 3 evidence are only hearsay evidences and the P.W.4 who is the panch witnesses and he is a relative of P.W.1 to 3. Further the learned counsel for the accused submitted that the investigating officer i.e.,

P.W.7 not examined and recorded the statements of in­law’s of P.W.1 as the

P.W.1 deposed that after the incident the in­law’s came to the house and she informed about the incident. Further the investigating officer failed to examine the independent eye witnesses and neighbours of P.W.1. So, the prosecution utterly failed to prove the guilty of the accused beyond reasonable doubt. Further, the learned counsel for the accused relied on the decision 7/13

reported in 2005 (1) ALD (Crl) 379 SC beteen Pandurang Seetharam

Bhagavath Vs. State of Maharastra:  in which the Hon’ble Supreme court held that:

“ Theory that a lady would not “ put her character at stake” cannot have universal application and each case has to be judged on its own factual matrix.” and further held that the strained relationship between the parties is not disputes. If the contents of the first informant and her husband to the effect that they had already taken a decision to shift from the said premises is believed, they does not appeared to be a plausible reasons as to why the appellant and three other accused who tress passed into the house and assault them. And further opined that each case has to be determined on the touch stone of the factual matrix thereof. The law reports are replete with the decisions where the charges

Under Sections 376 and 354 of IPC have been found to have been falsely advanced.

 The learned counsel for the accused submitted that the P.W.1 filed this false case in order to grab the amount and also due to the monitory disputes between them. This court opined that after hearing the arguments of learned APP and defence counsel and after gone through the evidence adduced by the prosecution, the P.W.1 evidence is very much clear that in the absence of the her husband at their house the accused came to the house and caught­ hold her hand and also she deposed the words used by the accused that “ 8/13

Nuvvu Naku Kavali” is very much believable and reliance can be placed on the evidence of P.W.1 as that the Ex.P.1 is very much corroborating with the oral testimony of the P.W.1. As rightly pointed out by the learned counsel for the accused that the P.Ws.2 and 3 evidence are hearsay evidence but, whenever any incident occurred within the four walls of the house this court cannot expect that some one witness the incident. Because the offences, of these nature are committed when, the person alone present in the house and if the offence was committed to the victim, the victim definitely inform the incident to the relatives or to her husband after their arrival to the house. So in the present case also the P.W.1 informed to the incident to the P.Ws.2 and 3 after they returned to the house so there is no ambiguity or suspicious circumstances arised in this case to disbelieve the evidence of P.W.1. Another contention of the learned counsel for the accused is that the investigating officer not examined the neighbours. But, it is not a considerable lacuna on the part of the prosecution because, as deposed by the P.W.1 that the incident happened in the house of P.W.1. So, in the present case even­though the

P,.W.1 admitted that there are monitory transactions between the P.W.2 and the accused but it is not a ground to disbelieve the evidence of the P.W.1.

Because, the P.W.1 deposed the evidence on her oath. Further, this court by relying on the decision reported in 1973 SCC (2) 793 between SHIVAJI

SAHEBRAO BOBADE AND ANR Vs. STATE OF MAHARASTRA:  The Hob’ble

Supreme court held that:

The dangers of exaggerated devotion to the rule of benefit of doubt at the expense of social defence and to the soothing sentiment that all acquittals are always good regardless of justice to the 9/13

victim and the community, demand special emphasis in the contemporary context of escalating crime and escape. The judicial instrument has a public accountability. The cherished principles or golden thread of proved beyond reasonable doubt which runs through the web of our law should not be stretched morbidly to embrace every hunch, hesitancy and degree of doubt. The excessive solicitude reflected in the attitude that a thousand guilty men may go but one innocent martyr shall not suffer is a false dilemma. Only reasonable doubts belong to the accused. Otherwise any practical system of justice will breakdown and lose credibility with the community. If unmerited acquittals become general, they trend to lead to a cynical disregard of the law, and this in turn leads to a public demand for harsher legal presumptions against indicate person and more sever punishment of those who are found guilty. Jurisprudential enthusiasm for presumed innocence mus be moderated by the pragmatic need to make criminal justice potent an realistic. A balance has to be struck between chasing chance possibilities as good enough to set the delinquent free and chopping the logic of preponderant probability to punish marginal innocents.

Further the decision reported in 1957 SCR 981 BETWEEN VADIVELU

THEVAR Vs. STATE OF MADRAS in which the Hon’ble Supreme court held that:

“The question whether in such a case the court could convict him depended upon the facts and circumstances of the case and unless corroboration was a statutory requirement a court could act upon such evidence, though uncorroborated, except in cases where the nature of the testimony of the single witnesses itself required, as a matter of prudence, that corroboration should be insisted upon, as in the case of child witness, an accomplies or any others of an analogous character.

Further held that: 

(1) as a general rule, a court can and may act on the testimony of the single witness though uncorroborated. One credible witness out weighs the testimony of a number of other witnesses of indifferent character.

2. Unless corroboration is insisted upon by statute, courts should not insist on corroboration except in cases where the nature of the testimony of the single witness itself requires as a rule of prudence, that corroboration should be insisted upon, for example in the case on a child witness or of a 11/13

witness whose evidence is that of an acomplies are of analogous character.

3. Whether the corroboration of the testimony of a single witness is or is not necessary, must depend upon facts and circumstances of the each case and no general rule can be laid down in a matter like this and much depends upon the judicial discussion of the

judge before whom the case comes. Section 134 of

Indian Evidence Act as categorically laid down that “No particular number of the witnesses shall in any case be required for proof of any fact”.

So in both the above cases the Hon’ble Supreme court categorically held that the evidence must be weighed but not counted. And the judgment relied upon by the learned counsel for the accused also the Hon’ble Supreme court held each case has to be judged on its own factual matrix. So in the present case on hand also the evidence of P.W.1 is trustworthy and the evidence of investigating officer and P.W.4 corroborating with the oral evidence of P.W.1. This court held that the prosecution successfully proved the guilty of the accused beyond reasonable doubt. In the result, the accused found guilty.

10.Point No.2.

In view of finding given in Point No.1, IN THE RESULT, the accused is found guilty for the offences punishable under sections 354 and 506 of Indian

Penal Code, he is convicted under section 248(2) Cr.P.C.

After finding the accused is found guilty for the offences under section 354 and 506 of Indian Penal Code. He is questioned with regard to quantum of sentence proposed to be imposed on him for which the accused is submitted that he is having wife and children and old aged father and he is the sole bread winner of his entire family and requested the court to take lenient view in awarding sentence against him. 

“In view of the above facts and circumstances of the case, the court is inclined to take any lenient view but is not a fit case to extend the benefit under the provisions under the probation of offenders Act. Therefore, the accused is sentenced to suffer Simple Imprisonment for a period of two years and to pay a fine of of Rs.10,000/­ for the offence U/sec. 354 IPC.

In default of payment of fine the accused shall suffer Simple Imprisonment for a period of six months. Further the accused is imposed to pay a fine of

Rs.10,000/­ for the offence under section 506 of IPC. In default of payment of fine the accused shall suffer Simple Imprisonment for a period of six months. Both the default sentences shall run concurrently with the main sentence imposed for the offence under Section 354 of IPC. The accused is informed about the right of appeal and the availability of free legal aid. A copy of the judgment given to the accused with free of cost”.

J U D G M E N T

This is a case arising out of the charge­sheet filed by Inspector of

Police, Sathupally P.S. against the accused Nos 1 and 2 in Cr.No.217/2012 for the offences U/sec.394 of Indian Penal Code.

2.The brief facts of the case according to the charge­sheet are that on 14.8.2012 at 7:15 hours the de­facto complaint came to police station and lodged a report stating that since last 16 years he is residing near

Medisettivaripalem cross roadalong with his wife and son and eking out their livelihood by running petty Kirana shop at Medisettivaripalem cross road.

On 13.08.2012 after having supper, the de­facto complainant and his wife slept in the house and his son slept in varanda and at about 2.15 hours he heed hues and cries from his son who slept in varanda , upon which he opened doors and found (4) persons with veil and while they beating his son with sticks, his son made struggle in the meantime out of (4) persons one person tried to stab his son with knife, immediately his son picked up knife with hand and he sustained cut injuries to the fingers, another person beat his son with stick on the head of his son and caused bleeding injury, remaining (2) persons threatened him and his wife and beat him with stick and caused injuries to him and immediately, forcibly robbed his gold ring from his hand and also focible robbed gold pusteletadu and pustleu from the neck of his wife, when the injured persons made hues and cries the unknown offenders fled away with robbed gold ring , pusthelatadu and pusthelu and the de­facto complainant further stated that the said unknown offenders are aged about 22 – 25 years and they speak in Telugu, on hearing the hues and cries their villagers Yamala Radha Krishna, Buri Rangarao came there and shifted his son to Government Hospital, Sathupally through 108 Ambulance.

Basing on the report lodged by the PW­1, the PW­11 registered a case in

Cr.No; 2172012 for the offence under section 394 IPC and issued F.I.R.

During the course of investigation the PW­11 visited the Government

Hospital, Sathupally, where the injured persons i.e. PW­1, PW­2 and PW­6 taking treatment, from there he visited the scene of offence and prepared scene of offence panchanama in the CDF in the presence of PW­4 and LW­12 and again the PW­11 visited the Government Hospital, Sathupally, where he examined and recorded the statements of PW­1, PW­2 and PW­6 and also gave a requisition to PW­9/Doctor to prove treatment to the injured persons and certificate. Subsequently, the PW­12 took up further investigation in this case, during the course of investigation , he examined and recorded the 3 statements of PW­3 and LW­5. On 6.3.2013 the PW­12 arrested the accused

Nos 1 and 2 with the assitance of LW­7, LW­8, PW­5 and PW­10 and on interrogation the accused No­1 and 2 voluntarily confessed that they have committed this offence along with other offence along with other accused persons i.e. A3 and A4 and the accused Nos 3 and 4 are absconded. The

Accused No­1 further confessed that the stolen gold ring, Pusthelatadu and

Pusthelu were mortgaged at Pw­7 and took an amount of Rs.42,000/­ and shared the amount equally. In pursuance of their confession he recovered the above gold ring, Pusthelatadu and pusthelu all worth of Rs.52,000/­ from

PW­7 who is pan broker under a cover of panchanama in the presence of PW­ 8 and LW­14. The accused used the auto bearing registration No: AP­37­TB­ 2082 in this case and other property offences in committing the offences. The accused Nos 1 and 2 produced before this court for judicial custody. The doctor/PW­9 who treated the injured persons i.e. PW­1, PW­2 and Pw­6 he opined that the injuries sustained by the inured persons are simple in nature. 

3.Cognizance was taken on file for the offences U/Sec.394 IPC against the accused No­1 and 2 and the process was issued.

4.On appearance of the accused before the court, copies of documents upon which the prosecution proposed to be relied upon, were furnished to them as required U/Sec.207 Cr.P.C. During the case proceedings, the A2 died. Hence, the case against A2 was abated. 

5. The accused No­1 was examined U/Sec.239 Cr.P.C. and he denied the accusation. Charges U/Sec.394 IPC was framed, read over and explained to him in Telugu, to which he pleaded not guilty and claimed to be tried.

6.In order to prove the guilty of the accused the prosecution examined

PWs1 to 13 and got marked Ex.P1 to P7 and Mos 1 and 2. on its behalf. The learned A.P.P. given up the evidences of LW­7, LW­8 , LW­12, LW­14 and LW­ 18.

7.After closure of the prosecution evidence, the accused No­1 was examined U/Sec.313 Cr.P.C., with regard to the incriminating material appearing against him in the evidence of prosecution witnesses for which he denied the same and reported no defense evidence.

8.Heard both sides arguments.

9.Now the point for determination is whether the prosecution has proved its case against the accused for the offences U/Sec. 457 and 380 IPC beyond all reasonable doubt or not ?

10.POINT:

It is the case of prosecution is that the accused Nos 1 and 2 along with

A3 and A4 committed robbery at Medisettivaripalem cross road. In order to prove the same the prosecution examined PW­1, PW­2 and PW­6 who are the victims in the hands of accused persons. Out of which, the PW­1 deposed

before this court that on 13.8.2012 when the PW­1, his wife/Pw­6 were slept

in the house and his son/PW­2 was slept in the Varanda of his house at

Medisettivaripalem cross­road at about 2:15 a.m. (4) persons came to their house and they were beating his son, when he opened the door, two of them attacked on him and beat him with sticks and when he laid his hands across, he sustained fracture of right hand as such he also sustained injuries to ring fingers of both the hands. He further deposed that his son escaped and ran away to Prakash nagar and he further deposed that all the persons kicked at the door and it was broken. They snatched Nanuthadu of his wife 5 and also one gold ring, while snatching Nanuthadu, the head of his wife was hit to wall and she sustained injury to her head and the said persons were covering masks with clothes. He further deposed that when his son raised shouting, public gathered, thereafter they shifted his son to Government

Hospital in 108 ambulance, later he went to police station and lodged a report of the incident with the police, the police recorded his statement.

Further, he obtained interim custody of the gold Nanuthadu and gold ring which are marked as MO­1 and MO­2. 

During the cross­examination nothing was elicited by the defence counsel, except with regard to the identification of the accused persons and the PW­1 categorically deposed that he cannot identify the accused persons as they are wearing masks. 

In support of the version of PW­1, the PW­2 who is son of Pw­1 , he deposed that on 13.8.2012 when he was sleeping in Varanda , PW­1 and his mother were sleeping inside the house situated at Madeisettivaripalem cross road. At about 2­15 a.m,. (4) persons came to their house and they were covering their faces with masks and one of them held pestile and another holding a knife and they switched off the lightys and woke him up and one of the said persons beat him with pestle on his head and another person tried to stab him, but he held the knife firmly and that he sustained injury to his left hand and he also sustained injury over head. He further deposed that the

PW­1 sustained fracture injury and his mother also sustained injury on his head as her Nanuthadu was pulled and one gold ring was pulled from the finger of PW­1, and they were shifted to Government Hospital, Sathupalli in 108 Ambulance. 

During the cross­examination nothing was elicited from him, to disbelieve his evidence. Pw­3 who shifted the injured person to Govenrment

Hospital, in 108 ambulance, his evidence is also corroborating with the 6 evidence of PW­1 and PW­2. During the cross­examination of PW­3, nothing was elicited from him, except putting formal suggestions and which are denied by the PW­3. 

The prosecution also examined the panch witness for scene of offence panchanama, who was examined as PW­4 and he deposed before this court that in the year, 2012 the police came to the house of PW­1 and prepared the

Crime Details Form and obtained his signatures with regard to the commission of theft and the Crime Details Form is exhibited as Ex.P2. Pw­4 was not cross­examined. Hence, the evidence of PW­4 remains un­challenged and proved. 

PW­5 who is the police constable, who assisted the Investigation Officer in apprehending the accused persons. He deposed before this court that on 6.3.2013 when himself along with his colleagues accompanied with

Investigation officer and went to Aswaraopet Santha at 1­00 or 2­00 p.m. and they found (4) persons in an auto and apprehended them and the accused present in the court hall was one among the said four persons. The

Investigation Officer secured the presence of panch witnesses and in their presence the accused persons disclosed their names as Guthi Srinivasa rao,

Guthi Rambabu, Pallapu Appa Rao and Vallepu Venkateswar rao, and further they disclosed that they along with four others were beating and robbing the properties form them and further confessed that he along with his brother beat one old woman near Thallada and robbed her gold

Nanuthadu and their panchanama was also recorded. The PW­5 was cross­ examined, during the cross­examination nothing was elicited from him to disbelieve the evidence of PW­5. 

Pw­6 who is another injured and victim in the hands of accused persons, she deposed before this court that at about 6 years back during the midnight herself and her husband were slept in the house and his son was 7 slept in the varnda, at that time (4) persons came to their house and switched off the lights and broken the door and that they came inside, beat her and her husband and they also pulled her and as such she fell down and she sustained injury to her head and they snatched her Nanutadu and they also committed theft of gold ring of Pw­1 , thereafter they went to

Government Hospital, Sathupally. PW­6 was cross examined, but during the cross examination nothing was elicited from her to disbelieve the evidence of

Pw­6. 

Pw­7 who is another independent witness, but he did not support the case of the prosecution. 

Coming to the evidence of Pw­8 who is panch witness for confession and recovery panchanama, He deposed before this court that on 6.3.2013 during the evening hours the police Aswaraopet called him to the Bhadrachalam

Road and when he reached there, already the accused was in the custody of police. Then he inquired with the accused and the accused confessed that he committed the theft at Medisettivaripalem cross road at one house and committed theft of one gold chain, one ring and police seized the gold chain and gold ring from the possession of accused and drafted the confession and recovery panchanaama in his presence and in the presence of LW­14 and obtained his signature. Ex.P4 is the attested copy of confession and recovery panchanama. Pw­8 identified the accused who is present in the court hall.

During the cross­examination nothing was elicited by the defence counsel, except putting the suggestions that he deposed false at the instance of police.

The prosecution also examined the Doctor, who gave treatment to the injured persons i.e. PW­1, PW­2 and Pw­6, examined as PW­9, through the

PW­9 Ex.P5 and Ex.P6 were marked. During the cross­examination nothing was elicited from the doctor except the suggestion that the above injuries 8 may be possible if the persons fell down while driving the cycle and which was admitted by the Doctor. 

Pw­10 who is another police constable, who assisted the Investigation officer in apprehending the accused persons and his evidence is also very much corroborating with the evidence of PW­5. 

PW­11 to 13 are the Investigation Officers. The evidence of PW­11 to

PW­13 are with regard to the procedure of investigation. During the cross­ examination of PW­12 and PW­13 nothing was elicited by the defence counsel, except putting the suggestions. 

11. So, on overall considering the entire prosecution case, the evidence of

PW­1, 2 and 6 are very much corroborating with the evidences of other prosecution witnesses. Further, in order to prove the injuries sustained by the PW­1, 2 due to the acts of accused the Ex.P5 and Ex.P6 evidencing the same. Even though, the doctor gave opinion that the above injuries may also possible if the persons falls from the cycle. But on perusal of the injury certificate issued by the Doctor/PW­9 which are showing that injuries sustained by the PW­1 and PW­2 in the hands of the accused persons.

The learned counsel for the accused submitted that decide the case on merits. The learned APP submitted that the prosecution witnesses evidence are very much corroborating with each other. Further, to connect the accused persons with this crime the confession panchanama is clearly prove that the case of the prosecution and evidencing that the MOS 1 and 2 are recovered from the possession of accused persons. So, the prosecution successfully proved the guilt of the accused beyond reasonable doubt for the offence under section 394 IPC.

IN RESULT, the accused No­1 is found guilty for the offence U/Sec.457 and 394 IPC and accordingly the accused is convicted U/Sec.248 (2) Cr.P.C

12. After finding the accused No­1 is found guilty for the offence under section 394 IPC, he is questioned with regard to quantum of sentence proposed to be imposed on him for which the accused is submitted that he is having wife and children and old aged parents and he is the sole bread winner of his family and requested the court to take lenient view in awarding sentence against him. The offence committed by the accused is aggravated form of offence and undoubtedly reflects anti social depravity of mind and that the accused further confessed that in his confession he committed the theft of property offences in various places. Hence, It is not a fit case to invoke the provisions of the Probation of Offenders Act. In­view of the facts and circumstances of the case, and submission of the accused and that in­ view of the nature of the offence it is not a fit case to take lenient view.

Therefore, the accused is sentenced to suffer Rigorous Imprisonment for a period of THREE YEARS and to pay a fine of of Rs.10,000/­ for the offence

U/sec. 394 IPC. In default of payment of fine the accused shall suffer Rigorous

Imprisonment for a period of SIX MONTHS. The de­fault sentence shall run consecutively with the main case. The Mos 1 and 2 which were given to PW­1 shall be made as absolute after expiry of appeal period. The accused is informed about his right to prefer appeal before the Hon’ble Court of

Sessions, Khammam. The accused is also informed that if he is in need of

legal Aid, he can approach the Hon’ble District Legal Services Authority,

Khammam. The remand period under gone by the accused shall be set off as 10 per Sec. 428 Cr.P.C. The accused was lodged in jail from 7.03.2013 to 5.4.2013. Office is directed to furnish copy of the Judgment to the accused forthwith.

This case is coming before me on 05.10.2021 for final hearing in the presence of Assistant Public Prosecutor for the state and Sri P.V.G.B Bhaskar Rao, Advocate for accused: upon perused the record and after hearing both sides this court delivered the following:

J U D G M E N T

1. This is a case arising out of the charge­sheet filed by Inspector of Police,

Sathupally P.S. against the accused in Cr.No.327/2015 for the offences

U/sec.447 and 509 of Indian Penal Code.

2. The brief facts of the case are that on 24.12.2015 at 08.00 pm the defacto complainant/victim/Gunja Radha lodged petition stating that since last five months her neighbour Anil aged about 25 years who is son of Paster misbehaving with her indecently and mentally suffered her by entering into her house in the absence of her husband and talking with her with indecent words.

On that she warned him, but due to not change of his behaviour, she told the 2/12

same to her husband and her husband informed the same to the father of accused. Even though the accused did not change his attitude against her and continued misbehaviour over her with indecent words thereby outraged her modesty. Basing on the report lodged by the defacto complainant herein the investigating officer who is the P.W.8 registered a case in Cr.No.327/2015 for the offence U/sec.447 and 509 of Indian Penal Code and took up the investigation. During the course of investigation he examined and recorded the statements of P.Ws.1 and 2 who are the wife and husband and there after visited scene of offence and there he secured the presence of P.Ws.5 and 6 and prepared the Crime Detail Form. Further, the P.W.8 examined and recorded the statements of the P.W.3, 4 and 7. On 29.12.2015 the accused has surrendered before the S.H.O, P.S Sathupally voluntarily and admitted his guilty and the P.W.8 who is the investigating officer released the accused on station bail on execution of sufficient sureties.

3.This court took cognizance for the offences punishable under sections 447 and 509 of Indian Penal Code, against the accused.

4. After appearance of the accused, case papers furnished to him as contemplated under section 207 of the Criminal Procedure Code.

5.The accused was examined under section 239 of the Criminal

Procedure Code and charges were framed for the offences U/secs.447 and 509 of Indian Penal Code which are read over and explained to him, and he pleaded not guilty and claimed to be tried.

6. In order to prove the case of prosecution, the learned APP examined the

PWs.1 to 8 and got marked Exs.P.1 to Ex.P.6.

7. After closure of prosecution evidence the accused was examined under section 313 of Criminal Procedure Code by explaining the incriminating material appearing in the prosecution evidence to which he denied the same and reported no defence on his behalf.

8.Heard arguments on both sides.

9. Point for Consideration:

1.“Whether the prosecution did prove the guilty of the accused beyond shadow of all reasonable doubt for the offences punishable under Sections 447 and 509 of IPC, against the accused? 

2. “To what finding”?

10. Point Number 1:

The case of the prosecution is that the accused misbehaved with the

P.W.1 by uttering indecent words. So, in order to prove the same, the prosecution examined the the defacto complainant as P.W.1 who is the victim in this case. She deposed before this court that P.W.2 is her husband and she know the P.Ws.3 to 5 and also the accused. She further deposed that in the year 2015 the accused used to harass mentally when his husband was not in the house, the accused harassed her by saying that she is looking handsome, and also he harassed her to fulfill his sexual desire and further deposed that she informed the matter to her husband and her husband went to the father of accused and told about the incident. Thereafter, when her husband went for work the accused came to her house and again repeated the same harassment.

Then she lodged police report which is Ex.P.1. P.W.1 was cross examined by 4/12

the learned counsel for the accused and during the cross examination the

P.W.1 deposed that she was not aware of whether the accused used to quarrel with the persons further deposed that the reason for the delay was caused due to her husband working at far place and she when first informed about the incident to her husband and he in­turn told the matter to the father of the accused and thereafter the accused repeated his harassment. P.W.1 was cross examined by putting suggestion that the accused being paster used offer prayers on every Sunday and it is causing disturbance to the P.W.1 family so, her husband several times quarreled with the accused, but P.W.1 denied the same. Further the P.W.1 was recalled by the learned counsel for the accused for further cross examination and during the cross examination, the P.W.1 categorically deposed that the accused came to the house at 08.00 pm and

P.W.1 admitted that she stated before the police about the time of arrival of accused to her house. The P.W.1 further admitted that she did not informed to her husband with a hope the accused will change his attitude. Further

P.W.1 admitted that before lodging police report she admonished the accused for coming to her house and P.W.1 further deposed in the cross examination that if the incident known to the neighbors it will defame her, so she kept quite. So, from the cross examination of the P.W.1 nothing was elicited by the defence counsel to disbelieve the evidence of P.W.1 and also P.W.1 evidence is very much inspiring confidence that the accused came to the house of P.W.1 and misbehaved with her while in the absence of her husband. In order to prove the case of the prosecution, the prosecution examined P.Ws.2 and 3 who are the husband and brother of P.W.1. P.W.2 deposed that in the year 2015 the accused used to harass her wife when he was not present in the house and the accused harassed the P.W.1 by saying that she is looking handsome and also he harassed her to fulfill her sexual desire, she informed about the 5/12

incident to P.W.2 and he told the above incident to the father of accused but the accused again repeated the same, then the P.W.1 lodged police report.

During the cross examination of P.W.2 also nothing was elicited by the defence counsel and the learned counsel for the accused put suggestion that the P.W.2 quarreled with acused due to disturbance of prayers offered by accused and and the same was denied by the P.W.2. P.W.3 evidence also corroborating with the evidence and during cross examination also nothing was elicited to the disbelieve the evidence of P.W.3. P.W.4 and 7 are cited as eye witnesses but they did not supported the case of the prosecution. P.W.5 who is the panch witness and he deposed that the police conducted panchanama at the house of

P.W.1 and obtained his thumb impression with regard to the quarrel at the hosue of P.W.1. During cross examination of P.W.5 categorically deposed that he put his thumb impression and nothing else. P.W.6 who is the panch witness and he did not supported the case of the prosecution. Coming to the evidence of investigating officer who is examined as P.W.8 and he deposed that on 24.12.2015 at 08.00 pm the P.W.1 came to the police station and lodged a report and basing on the report received from the P.W.1 he registered a a case

U/sec.447 and 509 of IPC and issued the FIR which is exhibited as Ex.P.5 and he took up the investigation and during the course of investigation he examined and recorded the statements of P.Ws.1 and 2 later he visited the scene of offence and prepared the CDF in the presence of P.Ws.5 and 6 and also examined P.Ws.3, 4 and 7. On 29.12.2015 the accused surrendered

before the P.W.8 voluntarily and admitted to have committed to this offence.

During the cross examination of the P.W.8, the P.W.8 admitted that the police report is silent with regard to the exact date when the accused came to the house of P.W.1 and again the P.W.8 admitted that when he recorded the statement of P.W.1 U/sec.161 Cr.P.C she stated the date 24.12.2015. cross examination with regard to the putting suggestions that the accused father being paster and he used to conduct the prayers so there are disputes arose between P.W.1 family, and the accused family. So, the P.W.1 lodged this false case. The P.W.8 denied the same. Learned APP submitted that the evidence of P.W.1 was very much clear with regard to the coming of the accused to the house of P.W.1 when her husband was not in the house and misbehaved with P.W.1 by stating that she is looking handsome and also he harassed her to fulfill his sexual desire. The same evidence was corroborative with the evidence of P.Ws.2 and 3 and with that of the investigating officer who was examined as P.W.8. The learned counsel for the accused submitted that the P.W.1 in the police report did not mentioned date and time of the occurrence of offence and also submitted that no eye witnesses supported the case of the prosecution. As stated by the investigating officer in the charge sheet further the learned counsel for the accused submitted that the accused is not a paster and his father is the paster. So, the P.W.1 is not having any clarity with regard to the accused occupation. Further, the learned counsel

for the accused submitted that the P.Ws.2 and 3 evidences are hearsay

evidence and no reliance can be place on the evidences of P.W.2 and 3. This court after hearing the arguments of the learned counsel for the accused the learned APP for the state opined that the accused misbehaved with the P.W.1 in the absence of her husband. So the evidence of P.W.1 categorically discloses that the accused came to the house of P.W.1 and uttered words “she is looking handsome” and also harassed her to fulfill his sexual desire. During the cross examination of P.W.1 the learned counsel for the accused put the suggestions that the accused being paster offered prayers on every Sunday and she admitted the same and further put the suggestion that due to the offering 7/12

prayer of the accused on every Sunday and which is causing disturbance to the family of P.W.1, so several times her husband quarrled with the accused but she totally denied the suggestions. So, as per the argument of the learned counsel for the accused is that the father of the accused is paster, but whereas during cross examination of the P.W.1 he put contrary suggestion being the accused working as paster and he used to offer prayers, so the learned counsel

for the accused giving contrary version at the time of the arguments and

compared with the cross examination of P.W.1. The contention of the learned counsel for the accused is that there is no evidence in the present case except

P.W.1 version. Already the P.W.1 categorically deposed in the chef examination that the accused came to the house in the absence of her husband and alleged offence took place in the house of P.W.1. So, there is no chance to witness the incident which was occurred in the home of P.W.1. Further the learned counsel for the accused further submitted that the P.W.1 having three children but the investigating officer not examined her children. This court opined that if the investigating officer failed to examine the children of the P.W.1 the evidence of P.W.1 who is the victim in the present case cannot be discarded.

Further, the learned counsel for the accused during cross examination categorically elicited that if the P.W.1 informs to neighbors it will defame her so she kept quite. This this court opined that theory that a lady would not put her charactr at stake. So in the present case also due to the dispute between the P.W.1 family and accused family. The P.W.1 lodged this false case cannot taken into consideration and this court cannot accept the contention of the learned counsel for the accused. With regard to the date and time of the happening of the alleged incident the P.W.1 occupation is housewife so, she is the illiterate. We cannot except that any report lodged by the P.W.1 that the

P.W.1 is having knowledge of mentioning the date and time and which is 8/12

suffies to prove that the accused came to her house and uttered the words that she is looking handsome, and also he harassed her to fulfill his sexual desire and that can be considered. This court relied the evidences of P.W.1. 

11. Further, this court relied on the decision reported 1973 SCC (2) 793 betweenSHIVAJI SAHEBRAO BOBADE AND ANR Vs. STATE OF

MAHARASTRA:  The Hob’ble Supreme court held that:

The dangers of exaggerated devotion to the rule of benefit of doubt at the expense of social defence and to the soothing sentiment that all acquittals are always good regardless of justice to the victim and the community, demand special emphasis in the contemporary context of escalating crime and escape. The judicial instrument has a public accountability. The cherished principles or golden thread of proved beyond reasonable doubt which runs through the web of our law should not be stretched morbidly to embrace every hunch, hesitancy and degree of doubt. The excessive solicitude reflected in the attitude that a thousand guilty men may go but one innocent martyr shall not suffer is a false dilemma. Only reasonable doubts belong to the accused. Otherwise any practical system of justice will breakdown and lose credibility with the community. If unmerited acquittals become general, they trend to lead to a cynical disregard of 9/12

the law, and this in turn leads to a public demand for harsher legal presumptions against indicate person and more sever punishment of those who are found guilty. Jurisprudential enthusiasm for presumed innocence mus be moderated by the pragmatic need to make criminal justice potent an realistic. A balance has to be struck between chasing chance possibilities as good enough to set the delinquent free and chopping the logic of preponderant probability to punish marginal innocents.

12. Further the decision reported in 1957 SCR 981 BETWEEN VADIVELU

THEVAR Vs. STATE OF MADRAS in which the Hon’ble Supreme court held that:

“The question whether in such a case the court could convict him depended upon the facts and circumstances of the case and unless corroboration was a statutory requirement a court could act upon such evidence, though uncorroborated, except in cases where the nature of the testimony of the single witnesses itself required, as a matter of prudence, that corroboration should be insisted upon, as in the case of child witness, an accomplies or any others of an analogous character.

13.So, in the present case the evidence of P.W.1 is very trustworthy and the evidence of P.W.1 very much corroborating with the evidence of

P.W.8 who is the investigating officer. Further there is no suggestion put­forth by the learned counsel for the accused during cross examination of P.W.8 that the accused not surrendered before P.W.8 and not admitted to have committed this offence. But during chief examination of P.W.8. he categorically deposed that on 29.12.2015 the accused was surrendered before P.W.8 and admitted that he committed this offence. What made the accused to confess before

P.W.8 about the commission of this offence. So this was not put forth by the learned counsel for the accused it prove that the accused surrendered before the P.W.8 and voluntarily admitted to have committed this offence. So in view of the above reasons, this court by relying on the evidence of P.W.1 and 8 and agreeing with arguments of the learned APP, this court held that the prosecution successfully proved the guilty of the accused beyond reasonable doubt. In the result, the accused found guilty. 

10.Point No.2.

In view of finding given in Point No.1, IN THE RESULT, the accused is found guilty for the offences punishable under sections 447 and 509 of Indian

Penal Code, he is convicted under section 248(2) Cr.P.C.

“In view of the above facts and circumstances of the case, the court is inclined to take any lenient view but is not a fit case to extend the benefit under the provisions under the probation of offenders Act. Therefore, the accused is sentenced to suffer Simple Imprisonment for a period of Two years and to pay a fine of of Rs.10,000/­ for the offence U/sec. 509 Indian

Penal Code. In default of payment of fine the accused shall suffer Simple

Imprisonment for a period of three months. Further the accused is sentenced only to pay a fine of of Rs.500/­ for the offence U/sec.447 Indian

Penal Code. In default of payment of fine the accused shall suffer Simple

Imprisonment for a period of three months. Both the default sentences shall run concurrently with the main sentence imposed for the offence under Section 509 of IPC. The accused is informed about the right of appeal and the availability of free legal aid. A copy of the judgment given to the accused with free of cost”.

This case is coming before me 8.01.2019 for final hearing before me in the presence of Assistant Public Prosecutor for the state and Sri M.H.Venkata Krishna, Advocate for accused: Upon perused the record and after hearing both sides this court delivered the following:

J U D G M E N T

1. This is a case arising out of the charge­sheet filed by Inspector of Police,

Vemsoor P.S. against the accused in Cr.No.16/2013 for the offences U/sec.304­A of Indian Penal Code, Sec. 181 and 196 of Motor Vehicle Act. 

2. The case of the prosecution is that on 25.2.2013 at 22:30 hours the de­facto complainant/PW­1 Dankari Srinivasa Rao, came to police station and lodged a report stating that on 25.2.2013 at about 19:00 hours his brother­in­law’s wife

Dane Kumari @ Yesu Kumari was proceeding towards Lachannagudem

Tirupatamma Temple by walking, on the way the accused being the rider of motor cycle bearing registration No: AP­05­AG­1758 drove it in rash and negligent manner and dashed against the Dane Kumari @ Yesu Kumari and caused severe 2 bleeding injuries on her head and the blood oozing from his nose and ears and she was shifted to Government Hospital, Sathupally in 108 Ambualnce for treatment.

Basing on the report of PW­1, the PW­8/SI of police, P.S. Vemsoor, registered a case in Cr.No: 16/2013 for the offence under section 337 IPC. During the course of investigation, he visited the scene of offence noted the scene particualrs and drawn rough sketch of the scene of offence in the CDF in the presence of two mediators i.e. PW­4 and LW­10. Later, he visited the Government Hospital,

Sathupally, where the injured taking treatment for her injuries, where he examined and recorded the statements of PW­1, PW­2 and also recorded the statement of injured/Dane Kumari/LW­3. Later, she was shifted to Mamatha

General Hospital, Khammam for better treatment. On 28.2.2013 the PW­8 received death information from Mamatha General Hospital, Khammam that the injured/Dane Kumari @ Yesu Kumari, succumbed to injuries while under going treatment, after receipt of the death information of deceased the PW­8 altered the section of law from 337 IPC to 304­A IPC. Later, the PW­8 visited the Mamatha

General Hospital, where he examined and recorded the statements of LW­4 to

LW­7 and PW­6 and conducted inquest over the dead body of the deceased/Dane

Kumari @ Yesu Kumari in the presence of LW­11 and Pw­5 and also got photographs of the deceased with the help of PW­6 and he gave a requisition to

Medical Officer/PW­7, District Head Quarters Hospital, Khammam for conducting autopsy over the dead body of the deceased and also sent a requisition to Motor

Vehicle Inspector, for inspecting the crime vehicle and report. The accused was arrested on 12.3.2013 and on verification of documents the accused has not possessed valid driving licence to ride the crime vehicle and also the crime vehicle has not valid insurance. Subsequently, he obtaining PME report and MVI Report and after completion of further investigation he filed charge sheet against the acucsed for the offences under section 304­A IPC, Sec. 181 and 196 of MV Act.

3.This court took cognizance for the offences punishable under section 304­A IPC, Sec. 181 and 196 of MV Act, against the accused.

4. After appearance of the accused, case papers furnished to him as contemplated under section 207 of the Criminal Procedure Code.

5.The accused was examined under section 251 of the Criminal Procedure

Code by explaining substance of accusation found in the charge sheet for the offences punishable under sections 304­A IPC, Sec. 181 and 196 of MV Act against the acucsed, which is read over and explained to him for which he pleaded not guilty and claimed to tried.

6. In order to prove the case of prosecution, the learned APP examined the

PWs.1 to 8 and got marked Exs.P1 to Ex.P8. The learned APP given up the evidences of LW­5 to 7, LW­10, LW­11, LW­14.

7. After closure of prosecution evidence the accused was examined under section 313 of Criminal Procedure Code by explaining the incriminating material appearing in the prosecution evidence to which he denied the same and reported no defence on his behalf.

8.Heard arguments on both sides.

9. Point for Consideration:

1.“Whether the prosecution did prove the guilty of the accused beyond shadow of all reasonable doubt for the offences punishable under sections 304­A IPC Sec. 181 and 196 of MV Act gainst the acused?

4 10. Point Number 1:

The case of the prosecution is that the accused without having dirving licence drove the crime vehicle i.e.motor cycle bearing registration No:AP­05­AG­ 1758 in a rash and negligent manner and dashed agains the deceased/Dane

Kumari @ Yesu Kumari, who was proceeding to Lachannagudem Tirupathamma

Temple by walking, as a result she sustained severe bleeding injuries on her head and died while undergoing treatment and the crime vehicle has not having insurance and that thereby the accused committed the offences under section 304­A IPC, Sec. 181 and 196 of MV Act. In order to prove the case of the prosecution the prosecution examined Pws 1 to 8 . Out of which the PW­1 is the relative of PW­1; PW­2 is the eye witness to the alleged accident; PW­3 is the husband of deceased and circumstantial witness; Pw­4 is the panch witness to the

Scene of offence panchanama; PW­5 is the panch witness to the inquest panchanama; PW­6 is the Photographer; PW­7 is the Doctor who conducted autopsy over the dead body of the deceased and issued PME report; PW­8 is the

Investigation officer. 

To prove offences against the acused the prosecution has to establish that due to the rash and negligent driving of the accused the accident was occured and deceased died in that accident and the crime vehicle involved in the incident is the

Motor cycle bearing registration No: AP­05­ AG­1758 and that the accused who is facing trial was the rider of the motor cycle and the accused was not having valid driving licence and the crime vehicle has not insured. 

 The PW­1 deposed that on 22.2.2013 at about 7:00 p.m. when the deceased and Goura Laxmi were proceeding on foot to temple from Marlapdu to

Lachannagudem, in the meantime one motor cycle which was proceeding from

Marlapadu towards Venkatapuram, dashed the deceased from behind. Due to 5 which the blood was oozing from her ears and nose and she was shifted to

Government Hospital, Sathupally by 108 Ambulance and on the advice of doctors she was shifted to Khammam. The PW­1 further deposed that the accused drove the motor cycle in high speed and the accident was occured because of the negligence of the accused and after 5 days of the accident, the deceased died in

Mamatha General Hospital, Khammam and he further deposed that the deceased sustained injuries on her back side of the head. During the cross­examination nothing was elicited from him to disbelieve his evidence. 

PW­2 is said to be an eye witness to the alleged accident, she deposed that on 25.2.2013 at about 7:00 – 7:30 p.m. herself and deceased were proceeding on foot to Lachannagudem Tirupathammam temple and when they about to reach the temple, the accused who is present in the court hall by name Venkateswara rao, came on Hero Honda Motor cycle from behind and drove it in high speed and dashed the deceased who sustained severe injuries and immediately, after the accident the deceased was shifted to Government Hospital, Sathupally and from there to Khammam after 5 days of the accident the deceased died. During the cross­examination nothing was elicited from her to disbelieve the evidence of

PW­2. 

PW­3 is cited as circumstantial witness his evidence is supported the evidence of PW­1 and PW­2. PW­4 is the panch witness for Scene of offence panchanama he deposed that on 26.2.2013 the police called him to the place of accident and where the police prepared CDF after preparing the CDF the police obtained his signature on CDF which is marked as Ex.P2. During the cross­ examination the learned counsel for accused put a suggestiong that no Crime

Details Form was prepared and he denied the same. 

PW­5 is cited as panch witness for Inquest panchanama, he deposed that on 28.2.2013 the police conducted inquest over the dead body of the deceased who is 6 aged about 22 to 25 years and she was having injuries to the back side of the head, left leg and the blood oozed from her nose and ears and after that the police obtained his signature on inquest panchanama which is marked as Ex.P3. During the cross­examination, the learned counsel for accused put a suggestiong that no inquest panchanama was conducted in his presencem, he denied the same. 

 PW­6 is the Photographer, he deposed that the Station House officer, P.s.

Vemsoor requested him to take photographs of the deceased at Mamatha General

Hospital, Khammam and accordingly, he tok up (5) photographs and handed over the same to police along with CD which are marked as Ex.P4. During the cross­ examination nothing was elicited from him, to disbelieve the evidence of PW­6

PW­7 is the Civil Assistant Surgeon, who conducted autopsy over the dead body of the deceased. He deposed that on the requisition filed by the SHO PS

Vemsoor on 1.3.2013 conducted the PME on the dead body of the deceased namely D.Yesu Kumari who died in an road traffic accident and he conducted the

PME at 11:30 a.m. and concluded at 12.30 p.m. and he opined that the cause of death of the deceased was due to Cardio Respiratory arrest due to cerebellum.

During the cross­examination nothing was elicited from him to disbelieved his evidence. 

PW­8 is the investigation offcier, he deposed that on 25.2.2013 at 22:30 hours PW­1 came to police station and lodged a report, basing on which he registered a case in Cr.No: 16/2013 for the offence under section 337 IPC. During the course of investigation he examined and recorded the statements of PW­2 and

PW­3 and also statement of injured/ deceased and he visited the scene of offence and prepared CDF in the presence of PW­4 and LW­10. On 28.2.2013 he received death information from Mamatha General Hospital, Khammam then he arested the section of law from 337 IPC to 304­A IPC and filed alteration memo. Later, he visited the Mamatha General Hospital, Khammam there with the help of PW­6 he 7 got photoraphs of the deceased and also examined and recorded the statements of

PW­3 and PW­6 and also Lws 5 to 7, later he conducted inquest over the dead body of the deceased in the presence of PW­5 and LW­11 and thereafter he filed a requisition before the PW­7/Doctor, to conduct autopsy over the dead body of the deceased and also filed a requisition before the MVI to inspect the crime vehicle and issued report, the MVI inspected the crime vehicle and issued MVI Report. ON 12.3.2013 he arrested the accused and the accused failed to produce his driving licence and also insurance of the crime vehicle. During the cross­examination the learned counsel for the accused put a formal suggestions , but, the PW­8 denied the same. 

 So, on overall considering the entire prosecution case, the evidence of Pws­1 to 8 are supported the prosecution version. The PW­1 deposed the manner of accident that the accused drove his crime vehicle with high speed and negligently due to which the accident was occured and deceased died. The PW­2 who is the eye witnesses and crucial material witness she deposed the same facts as deposed by PW­1 and she identified the acused who is present in the court hall is the accused who drove the crime vehicle with high speed and negligently and dashed against the deceased as a result the deceased sustained bleeding injuries on his head and died while under going treatment. So, As per the evidence of PW­2 the accused is the rider of motor cycle and drove it in rash and negligent manner and caused accident to the deceased. The Investigation officer evidence is also corroborating with the evidence of PW­1 and 2 that he arrested the accused and during the course of interrogation the accused confessed to have committed the offence and he sent a requsition to M.V.I. for inspecting the crime vehicle i.e AP­ 05­AG­1758 and the M.V.I. inspected the crime vehicle and issued report that the accident was occured not due to any mechanical defects. So, the prosecution proved through the evidnece of PW1, 2, 3 and 8 that the accused is the rider of the 8 motor cycle at the time of accident and he drove the motor cycle in a rash and negligent manner and caused accident to the deceased, due to the accident the deceased received bleeding injury to her head and died. The evidence of

Doctor/PW­7 is also supported the prosecution case with regard to the injuries sustained by the deceased and he deposed that on the requisition filed by the

PW­8/Investigation officer, he conducted autopsy over the dead body of the deceased and he issued P.M.E. report and he opined that the deceased died due to cardio resporatory arrest due to cerebellem. So, the prosecution established that the deceased died due to road traffic accident.

Further, the evidnece of Investigaiton officer/PW­8 that he conducted the scene of offence panchanama under Ex.P2 in presence of the panch witnesses

PW­4 and LW­10, which is corroborated with the version of PW­4, he deposed that police visited the scene of offence and prepared scene of offence panchanama in his presence and in the presence of LW­10 and he subscribed his signature on

Ex.P2. Further, on testified the evidence of PW­8, he conducted the inquest panchanama under Ex.P3, in the presence of Pw­5 and LW­11, which is corroborated with the version of the panch witnesses for inquest/PW­6. Further, the Medical officer/PW­7 conducted PME over the dead body of the deceased on the requisiton filed by the PW­8/Investigation Officer, and he issued PME report.

So, the prosecution established that the police followed the procedure for registering the case to filing of charge sheet and PW­8 conducted scene of offence panchnanama and inquest panchanama, which is corroborated with the evidence of PW­5 and PW­6 and they all supported the prosecution case that the police conducted panchanama and inquest. Hence, the prosecution established that after the accident the investigation officer followed the procedure.

With regard to the offences under section 181 and 196 of MV Act, the investigation officer evidence is very much necessary to prove the said offences, since, he arrested the accused and verified the documents of the vehicle. The

PW­8/Investigation officer, deposed in his evidence after affecting arrest of accused the accused failed to produce his driving licence as well as insurance of the crime vehicle. So, the prosecution also established that the accused has not possessed valid driving licence to ride the crime vehicle and the crime vehicle has not insruance. 

In view of the above discussion, the prosecution prove the guilt of the accused for the offences punishable U/s. 304­A IPC, Sec. 181 and 196 of MV Act beyond reasonable doubt.

10.Point No.2.

In view of finding given in Point No.1, IN THE RESULT, the accused is found guilty for the offences punishable under section 304­A IPC, Sec. 181 and 196 of

MV Act and accordingly, he is convicted under section 255(2) Cr.P.C.

After finding the accused is found guilty for the offences under section 304­A

IPC, Sec. 181 and 196 of MV Act. he is questioned with regard to quantum of sentence proposed to be imposed on him for which the accused is submitted that he is having wife and children and old aged parents and he is the sole bread winner of his entire family and requested the court to take lenient view in awarding sentence against him.

However, in view of the above facts and circumstances of the case, the court is not inclined to take any lenient view or to invoke the provisions under the probation of offenders Act. Therefore, the accused is sentenced to suffer Simple

Imprisonment for a period of SIX MONTHS and to pay a fine of of Rs.1,000/­ for the offence U/sec. 304­A IPC. In default of payment of fine the accused shall suffer

Simple Imprsionemtn for a period of (15) days. The accused sentence to pay a fine of Rs.500/­ for the offence under section 181 of MV Act in default of payment of fine the accused shall suffer Simple Imprisonment for a period of (15) Days; and the accused also sentenced to pay a fine of Rs.500/­ for the offence under section 196 of MV Act in default of payment of fine the accused shall suffer Simple

Imprisonment for a period of (15) Days. The sentence of imprisonment for the offence under section 304­A IPC, default of payment of fine shall run concurrently.

The remand period of the Accused from12.03.2013 to 23.03.2013 shall be given set­off under Section 428 Cr.P.C. Office is directed to furnish copy of the Judgment to the accused forthwith. The accused is informed about the right of appeal and the availability of free legal aid.

J U D G M E N T

This is a case arising out of the charge­sheet filed by Sub­Inspector of

Police, Sathupally P.S. against the accused in Cr.No.193/2019 for the offences U/sec.457 and 380 IPC.

2.The brief facts of the case according to the charge­sheet are that the

PW­1/Pathi Viswanadha Vara Prasad came to police station and lodged a report stating that on the night of 6.7.2019 21:00 hours he closed his oil shop and took the collection cash of Rs.95,000/­ and returned to his house at 21:00 hours and kept the cash amount in a small bag and the same is kept in a cub­board of the bed room of his up­stair porition and taken dinner and slept at about 1:00 a.m. on 7.7.2019 the PW­1 and his wife heard some 2 sound from the bed room and he woke up and found that one person ran away in to the dark and also found opening grill of the window then he raised hues and on hearing the hues of PW­1 his brother who is present in the ground floor of his house woke up and came to his house and found that the cash bag was missing from the bed room and he further said that one

Kandukuri Somachary, remove the screws of his up­stair house window and gained entry into his bed rood and committed theft of Rs.95,000/­ and decamped with the stolen booty. Basing on the report of PW­1, the PW­4 registered a case and investigated into.

3.Cognizance was taken on file for the offences U/Sec.457 and 380 IPC against the accused and the process was issued.

4.On appearance of the accused before the court, copies of documents upon which the prosecution proposed to be relied upon, were furnished to him as required U/Sec.207 Cr.P.C.

5. The accused was examined U/Sec.239 Cr.P.C. and he denied the accusation. Charges U/Sec.457 and 380 IPC were framed, read over and explained to him in Telugu, to which he pleaded not guilty and claimed to be tried. 

6.In order to prove the guilty of the accused the prosecution examined

PWs1 to 4 and got marked Ex.P1 to P4 and MO­1, on its behalf. 

7.After closure of the prosecution evidence, the accused was examined

U/Sec.313 Cr.P.C., with regard to the incriminating material appearing against him in the evidence of prosecution witnesses for which he denied the same and reported no defense evidence.

8.Heard both sides arguments.

9.Now the point for determination is whether the prosecution has proved its case against the accused for the offences U/Sec. 457 and 380 IPC beyond all reasonable doubt or not ?

10.POINT:

It is the case of prosecution that the accused gained entry into the house of PW­1 by removing the screws of the window and committed theft of

Rs.95,000/­ which was kept in the cub­board and thereby the accused committed the offences punishable U/Sec. 457 and 380 IPC.

To prove the same the prosecution examined the Pws 1 to 4 and got marked Ex.P1 to P4 and MO­1. Out of which the Pw­1 is the de­facto complainant; PW­2 is the scene of offence panchanama; PW­3 is the panch witness for confession and recovery panchanama; PW­4 is the Investigation

Officer. 

Pw­1 De­facto complainant, deposed that on 6.7.2019 at about 12­00 to 12:30 a.m. one person entered into his house by break open the window of his house and committed theft of Rs.95,000/­ and he woke up due to heard the sound and made hues and cries and on hearing the hues and cries the accused escaped from that place and he came to know the accused as

Somachary and he committed theft of 2 or 3 times and he can identify the accused, if shown to him and the witness identified the accused who is present in the court hall. He lodged a report with the police. He further deposed that the police recovered an amount of Rs.25,000/­ from the accused and the same was received by him through the court. During the cross­examination he admitted that when a person escaped and only to see his back side only and he further admitted that he see the accused beside his bed. Except this nothing was elicited from his evidence in favour of accused.

PW­2 is the panch witness for scene of offence panchanama, he deposed that on one day police called him to the house of PW­1 , with regard to the theft took place at the house of PW­1 and conducted scene of offence panchanama and obtained his signatures on CDF. 

PW­3 is the panch witness for confession and seizure panchanama, he deposed before this court that on 4.8.2019 at about 6:00 p.m. at Bypass road near Vikas College road he along with LW­6 proceeding on that way and they noticed the SI of police along with his staff were present and the SI Of police called him to act as panch witness and took the house of accused by name

Kandukuru Soma Chary and at the request of police, he went to the house of accused and inquired with the accused and the accused disclosed his name and some amount i.e., Rs. 25,000/­ was lying with the accused, out of which

Rs.2000/­ notes are 12 and Rs.500/­ notes are 2 Nos and the accused further confessed that he committed theft by entering into the house at

Siddaram and while trying to commit theft the coins fell down on the ground due to which the inmates of the house woke up and then he escaped from the place and he committed theft of Rs.95,000/­ in that house . He further deposed that the accused further confessed that he spent some amount for his personal use and he is only having Rs.25,000/­ in his possession. Then the police drafted the confession panchanama and seized the above cash of

Rs.25,000/­ from the possession of accused under a cover of panchanama in his presence and in the presence of LW­6 . During the cross­examination nothing was elicited from him to discard his evidence. 

PW­4 is the investigation officer, he deposed that on 9.7.2019 at 3:00 p.m. PW­1 lodged a report in the police station, basing on which he registered a case in Cr.No: 193/2019 for the offences under section 457 and 380 IPC. During the course of investigation, he examined and recorded the statements of PW­1, LW­2, LW­3 , visited the scene of offence noted scene 5 particulars, drawn rough sketch of the scene of ofence in the CDF in the presence of PW­2 and LW­5. While the investigation is in progress, on 4.8.2019 he received reliable information, on receipt of the information he rushed to the house of accused which is situated at Kushi By pass road and apprehended him and interrogated him in the presence of PW­3 and LW­6 and recorded the confession statement of accused and seized an amount of

Rs.25,000/­from the possession of accused. Later, he produced the accused

before this court for judicial remand. During the cross examination nothing

was elicited from him. 

The learned counsel for the accused submitted that there is a delay of (3) days in lodging the police report by the PW­1 and the reasons for delay was not explained by the PW­1 in his report as such the accused is entitled for benefit of doubt. This court gone through the contents of the police report and in which the PW­1 categorically mentioned that whereabouts of accused are not known since from the date of offence. So, they searched for him, as such the delay was caused. Further, the PW­1 categorically mentioned in the police report about the reason caused for the delay in lodging the report. So, it is believable one.

Further, the learned counsel for the accused submitted that in the

Scene of offence panchanama the Investigation Officer mentioned in Column

No­2 the offence under section 379 IPC. But, whereas the Investigation

Officer filed the charge sheet and registered this case under section 457 and 380 IPC. So, there is no clarity on part of the Investigation officer whether the accused committed the ofence under section 380 IPC or 379 IPC. So, the accused is entitled for benefit of doubt. This court opined that due to fault on part of the Investigation Officer, the prosecution witnesses evidecnes are corroborating with each other and their evidence are not having any 6 suspicious circumstances and having their evidences are very much reliable.

This court cannot held that the accused is entitled for benefit of doubt. 

Further, the learned counsel for the accused submitted that the de­facto complainant presumed that the accused charged in this case may be committed the offence, But not stated accurately, that the accused committed this offence, only suspected that the accused had committed this offence. In the cross examination also the PW­1 categorically admitted that at that time the lights in the house are switched off and there is darkness. So, identity of the acucsed in the dark hours appears to be suspicion over the evidence of PW­1. 

The learned APP Submitted that when the accused belongs to their colony and there is having every possibility of seeing him frequently. So, identification of the accused before this court is not at all suspicious circumstances and no Test Identification Parade is required for identification of the accused by the PW­1 and saw the accused frequently as he belongs to the same colony. So, the evidence of PW­1 can be reliable without any suspicious circumstances, in the evidence of PW­1. 

So, agreeing with the submission of learned APP, he rightly argued that when the PW­1 having acquaintance with the accused prior to commission of this offence. So, no Test Identification parade is required for identification of the accused.

In the present case, the panch witnesses for Confession and recovery panchanama categorically deposed that the accused confessed about the commission of offence and evidencing that the police seized Rs.25,000/­ from the possession of accused and which was exhibited as MO­1. The seizure of property i.e. MO­1 clearly proving that the accused committed the alleged offences.

So, according to Sec. 27 of Indian Evidence Act, the confession leads to discovery of material thing or object is admissible in evidence. So, in the present case also the confession leads to the discovery of MO­1, fulfill the ingredients of Sec. 27 of Indian Evidence Act. 

According to Sec. 27 of Indian Evidence Act, reads as follws “ How much of information received from accused may be proved – Provided that when any fact is deposed to as discovered in consequences of information received from a person accused of any offence, in the custody of a police officer, so much of such information, whether it amounts to a confession or not, as relates distinctly to the fact thereby discovered, may be proved”. 

So, in the present case the prosecution successfully proved its case, beyond reasonable doubt. Hence, this court found the accused guilty for the offences under section 457 and 380 IPC. 

IN RESULT, the accused is found guilty for the offences U/Sec.457 and 380 IPC and accordingly the accused is convicted U/Sec.248 (2) Cr.P.C

After finding the accused is found guilty for the offences under section 457 and 380 IPC, he is questioned with regard to quantum of sentence proposed to be imposed on him for which the accused is submitted that he is having wife and children and old aged parents and he is the sole bread winner of his family and requested the court to take lenient view in awarding sentence against him. The offence committed by the accused is aggravated form of offence and undoubtedly reflects anti social depravity of mind and that the accused by break open the door/window and committed the ofence. Hence, It is not a fit case to invoke the provisions of the 8

Probation of Offenders Act. In­view of the facts and circumstances of the case, and submission of the accused and that in­view of the nature of the offence it is not a fit case to take lenient view. The maximum punishment for the offence U/sec. 457 IPC is imprisonment for 14 years and fine and for the ofence U/Sec. 380 IPC is imprisonment for 7 years and also fine.

Therefore this court opined the imprisonment for Three Years to each offence will meet the ends of justice. Therefore, the accused is sentenced to suffer

Rigorous Imprisonment for a period of THREE YEARS and to pay a fine of of

Rs.10,000/­ for the offence U/sec. 457 IPC. Whereas the accused is also sentenced to suffer Simple Imprisonment for a period of THREE YEARS and also to pay a fine of Rs.10,000/­ for the offence under section 380 IPC. in In­ default of payment of fine amount the accused shall suffer Simple

Imprisonment for a period of THREE MONTH for the offence U/Sec. 457 and 380 IPC each offence. The MO­1 which was given to Pw­1 shall be made as absolute after expiry of appeal time. The sentences imposed against the accused shall run consecutively. The accused is informed about his right to prefer appeal before the Hon’ble Court of Sessions, Khammam. The accused is also informed that if he is in need of legal Aid, he can approach the Hon’ble

District Legal Services Authority, Khammam. The remand period under gone by the accused shall be set off as per Sec. 428 Cr.P.C. The accused was lodged in jail from 5.08.2019 to till date i.e. 8.1.2020. Office is directed to furnish copy of the Judgment to the accused forthwith.
