J U D G M E N T

The Sub-Inspector of Police of Pakala P.S., filed charge sheet against the accused for the offences punishable U/Sec.269, 270 and 188 of IPC in Cr.No.79/2020 of Pakala Police.

2. The brief facts of the prosecution case are as follows :

On 05.04.2020 the S.I. of police, Pakala P.S. deputed

LW1/HC3068/A.Somasekhar and LW2/P.Rajesh/PC3597 on patrolling duty to implement the COVID-19 regulations and orders issued by the

Government for lock-down in-order-to control the spread of the COVID- 19 virus. At that time LW1 and LW2 noticed that the accused opened his Allabasha cool drinks shop and tea stall located at Damalcheruvu,

Nendragunta road, Pakala and allowed public into it without

maintaining social distance and thereby the accused has violated the

COVID-19 regulations. Then the LW1 prepared the occurence report and apprehended the accused with the assitance of LW2 under occurrence report and returned to police station and submitted the occurence report to SI police/LW3/K.Rajasekhar and LW3 basing on the occurence report registered the same as a case in crime No.79 of 2020 under Section 188, 269 and 270 of IPC. The accused was served with notice under Section 41-A Cr.P.C. and the After completion of investigation the LW3/SI filed charge sheet against the accused. Hence the charge.

3. This Court has taken Cognizance of this case for the offences punishable under 269 and 270 of IPC. though the charge sheet is filed for the offences punisable u/s 188 of IPC as conjoint reading of the provision of Section 188 of Indian Penal Code and

Section 195 of Cr.P.C., it is evident that if the alleged offence is punishable under Sections 172 to 188 of Indian Penal Code, the Court cannot take cognizance except on a complaint in writing of the public servant concerned, or some other public servant, to whom he is administratively subordinate.

4. On appearance of the accused copies of case documents furnished to him which is contemplated U/Sec.207 of Cr.P.C.

5. Accused examined U/Sec.251 of Cr.P.C. accusation for the offences U/Sec269 and 270 IPC are read over and explained to him he denied the offence, pleaded not guilty and claimed to be tried.

6. To prove its case, the prosecution examined P.w.1 and 2 and got marked Exs.P.1 and learned APP given up the evidence of

LW3/SI of Police since the accused admitted the evidence of PW1 and 2 and also the accused stated that he intends to admit the offence. On behalf of the accused no oral or documentary evidence was adduced.

7. After closure of the Prosecution evidence, the accused was examined under Sec.313 Cr.P.C. during which he admitted the offence and submitted that he has small grocery store inthe village and that his wife, children and old aged parents are depending on him and sought for lenient view in imposing sentence and reported no defence.

8. Now the points for consideration are:

“Whether the prosecution proved beyond all

reasonable doubt the guilt of accused for the

offences u/s 269 & 270 IPC?”

9. It is the case of the prosecution that the accused opened his shop and allowed public into it without maintaining social distance and thereby the accused has violated the COVID-19 regulations and thus he held liable for the offences U/Sec's 269 & 270

IPC. In order to prove the guilt of the accused, prosecution examined

PW's 1 & 2. PW1 is the head constable who prepared the occurence report,PW2 is the constable who assisted PW1.

10. As seen from the evidence of PW1, PW1 deposed that on 05.04.2020 he and LW2/Praveen were deputed on patrolling duty to implement the section 144 CrPC to control the public to prevent spread of dreadly Covid-19 virus. At that time they noticed that the accused opened his cool drink shop and tea stall located at

Damalacheruvu, Nendragunta road, Pakala and allowed the public into

shop without maintaining social distance and thereby the accused has violated the COVID-19 regulations issued by the government and as such he prepared the occurance report and submitted the same to

LW3. PW2 deposed onthe same lines of PW1. The evidence of PW's 1 and 2 is unchallenged one since they were not cross examined examined by the learned defence counsel. Moreover, the accused admitted the offence. Therefore, the evidence of PW's 1 and 2 clinchingly established that accused violated the covid-19 guidelines issued by the government and opened the shop and people gathered in large number and thus he acted negligently and tried to spread the infection of covid-19 virus. Therefore, this court has no hesitation to hold that the prosecution established the guilt of the accused for the offence u/s 269 & 270 of IPC. Accordingly this point is answered.

11. In the result, the accused is found guilty for the offence u/s 269 & 270 IPC and accordingly he is convicted u/s 255(2)

Cr.P.C. and having considered the facts and circumstances of the case and plea of accused he is sentenced to pay a fine of Rs.300/- for each offence and in default of payment of fine he shall under go SI for a period of 3 days each for the said offences respectively, which shall run concurrently. Total fine amount is Rs.600/-

At that time LW1 and LW2 noticed that the accused opened his petty shop located at Pachipalaindulu village,

social distance and thereby the accused has violated the COVID-19 regulations. Then the LW1 prepared the occurence report and apprehended the accused with the assitance of LW2 under occurrence report and returned to police station and submitted the occurence report to SI police/LW3/K.Rajasekhar and LW3 basing on the occurence report registered the same as a case in crime No.59 of 2020 under Section 188, 269 and 270 of IPC. The accused was served with notice under Section 41-A Cr.P.C. and the After completion of investigation the LW3/SI filed charge sheet against the accused. Hence the charge.

4. On appearance of the accused copies of case documents furnished to him which is contemplated U/Sec.207 of Cr.P.C.

5. Accused examined U/Sec.251 of Cr.P.C. the accusation for the offences U/Sec.269 & 270 are read over and explained to him for which he voluntarily pleaded guilty and submitted that he is the sole bread of family and sought to take a lenient view in imposing sentence.

6. Since the accused admitted his guilt voluntarily and in

CC 63 of 2020 3 JFCM Court, Pakala

view of the facts and the circumstances of the case, I found the plea of the accused a voluntary one and in my view it is a fit case to take a lenient view in imposing sentence.

7. In the result, the accused is found guilty for the offence U/Sec.269 and 270 I.P.C and the accused is convicted

U/Sec.252 Cr.P.C. and he is sentenced to pay a fine of Rs.500/- for each offence and and in default of payment of fine, he shall suffer a simple imprisonment for a period of 15 days each for said offences respectively, which shall run concurrently. The total fine of Rs.1000/-.
