PETITION FILED UNDER SECTION 166(1) (c) of MV Act.
The Petition dt: 20-12-2017 filed by the petitioners U/sec.166(1)(c) of M.V. Act, claiming compensation of Rs. 1,51,00,000/- on all counts.
For the purpose of valuation, court fee and jurisdiction is Rs.1,51,00,000/- upon which a Court fee of Rs.1,51,360/- is to be paid by the petitioners and the same is exempted by this court as per the Order in I.A.No.01/2018, dt: 03-01- 2018.
This petition is referred to Lok Adalat at the request of both parties.
This case is referred to Lok Adalat. The petitioners are present and they are identified by their Advocates Sri G. Narayana, Advocate for petitioner and Sri Syed Hasanuddin Chisty, Advocate for the Respondent No.3 are also present and stated that they are authorized to enter into compromise. Both parties to the petition have agreed for amicable settlement to that effect. They jointly filed a compromise memo. Hence, the following Award is passed as per the settlement arrived by the parties.
A W A R D
1.That the petitioners No.1 and 2 have agreed to receive an amount of Rs.34,00,000/- (Rupees Thirty Four Lakhs only) towards full and final settlement against the claim of Rs. 1,51,00,000/-. The 3rd respondent hereby indemnifies the acts of respondent No.2 and do hereby deposit the said amount within a period of (1) month from today, if the amount is not deposited within the stipulated time, it shall carry interest @7.5% per annum from the date of this Award till the realization.
2. On such deposit, the Petitioners No.1 is entitled to receive an amount of Rs.17,00,000/-(Rupees Seventeen Lakhs only) out of which she is permitted to withdraw an amount of Rs.7,00,000/- (Rupees Seven Lakhs only)soon after deposit is made and remaining amount of Rs.10,00,000/- shall be kept in fixed deposit for a period of two years in any nationalized bank.
3.The Petitioner No.2 is is entitled to receive an amount of Rs.17,00,000/- (Rupees Seventeen Lakhs only) out of which she is permitted to withdraw an amount of Rs.7,00,000/- (Rupees Seven Lakhs only)soon after deposit is made and remaining amount of Rs.10,00,000/- shall be kept in fixed deposit for a period of two years in any nationalized bank.
4.The claim of the petitioners against the Respondents No.1 and 2 reported as not pressed by the Advocate for the petitioners.
4.There shall be Award in the above terms.
Both the parties have put their signatures in evidence of their consent for the terms of Award.
