This case is coming before me for final hearing in the presence of APP for the State and Sri T. Hanman Singh, Advocate for the accused, having been heard and having stood over for consideration, the Court delivered the following: :: J U D G M E N T ::

1.The Sub Inspector of Police, PS Basanthnagar has filed the charge sheet against the accused for the offence punishable U/Sec.457, 380 of

IPC in Cr.No.10 of 2018.

2.The brief facts of the prosecution story are as follows:

LW1 is resident of GD Nagar h/o Kannala. On 04.01.2018 at 5.00

PM the LW1 went to Shabarimala Devastanam, due to which the LW2 went to Kataram where their second daughter living by locking their house. On 06.01.2018 at day time the accused came to GD Nagar and observed the locked house of LW1. He hatched a plan to commit theft on that house. On 07.01.2018 at night hours the accused entered into the house of LW1 by jumping wall, removed the window rods and committed theft of one gold ring and one silver lump. On 09.01.2018 the LW1 informed to the LW2 over phone that on 10.01.2018 he reached to GD

Nagar from Shabarimala, on that LW2 started to GD Nagar from

Kataram. On 10.01.2018 at 3.00 PM both were reached to GD Nagar, entered into their house by opening shutter and found that the accused entered into their house by removing the rear side window rods and committed theft of one gold ring weighing ½ tula and silver lump weighing about 10 tulas all W/Rs.10,000/. On 24.01.2018 when the accused proceeded to Peddapalli to sell the stolen property he was apprehended by the police. Hence, the charge.

3.The case was taken cognizance for the offence punishable U/Sec.

457, 380 IPC against the accused. On appearance of the accused, the copies of the charge sheet and other documents are furnished to him as contemplated U/Sec. 207 of Cr.P.C. Accused was examined U/Sec.239

Cr.P.C and charge under Sec.457, 380 IPC have been framed against him, read over and explained to him in Telugu, for which he denied the said allegation, pleaded not guilty and claimed to be tried.

4.During the course of trial to prove its case, the prosecution has examined PW1 to PW7, got marked Ex.P1 to P7 and MO1.

5.After closure of the prosecution evidence, accused has examined

U/Sec. 313 of Cr.P.C, with the incriminating material available against the accused in the evidence of prosecution witnesses, for which he denied and reported no evidence.

6.Heard both sides.

7.Now the point for determination is:

Whether the prosecution has been able to establish the guilt of the accused for the offence U/s. 457, 380 IPC beyond all reasonable doubt?

POINT:

8.The case of the prosecution is that the accused had committed theft of gold ring and silver lump from the house of LW1. In order to prove the same, the prosecution has examined PWs1 to 7.

9.PW1 (N. Maruthi) has stated that on 05.01.2018 himself left to

Shabarimala, his wife left to her parents house by locking the doors of thier house. On 10.01.2018 himself and his wife came to their house and found the household articles were in pelmel condition and they further found that the rods of the window were broken and committed theft of cash of Rs.10,000/, 10 tulas of silver and 5 grams of gold by unknown person. On the same day they went to police station and lodged a complaint under Ex.P1 with the police, Basanthnagar. After 10 days the police informed him about the recovery of 5 grams of gold ring, which he took from this court for interim safe custody. PW2 (N. Uma) has deposed in similar lines of PW1.

10.PW3 (K. Sivaiah) and PW4 (K. Srinivas) have stated that they do not know anything about the scene of offence panchanama, nobody conducted scene of offence panchanama also not prepared CDF in their presence. At about three months back when they were went to police station, Basanthnagar on their personal work where police obtained their signatures on some papers.

11.PW5 (P. Raju) and PW6 (E. Siva Kumar) have deposed that they do not know anything about the case facts, nobody confessed the offence and nothing was seized in their presence. At about three months back on one day they went to police station Basanthnagar on their personal work where the police obtained their signatures on some papers.

12.PW7 (A. Vijayender) has deposed that on 10.01.2018 at 04.00 pm, he received a complaint from PW1. Basing on that he registered a case in Cr. No.10 of 2018 U/Sec.457, 380 IPC and issued FIR. During the course of investigation he examined and recorded the statement of PW1 at police station. Later he visited the scene of offence and conducted the scene of offence panchanama and prepared CDF in the presence of PW3 and 4, he also examined and recorded the statement of PW2. After completion of investigation of LW7, he handed over the CD file to him for further investigation. He verified the investigation done by LW7 and found it on correct lines. During the course of investigation on 24.01.2018 at 7.30 AM he apprehended the accused, on his interrogation he confessed the offence and recorded his confessional statement and seized MO1 in the presence of PWs5 & 6, thereafter he affected the arrest of accused and produced before this court. After completion of investigation he filed charge sheet.

13.The case of the prosecution is that the accused had committed theft of MO1 from the house of PWs1 & 2. PWs1 & 2 stated in their evidence that one unknown offender committed theft of cash of

Rs.10,000/, 10 tulas of silver and 5 grams of gold from their house.

PW7 is the investigating officer stated that he recovered MO1 from the possession of accused before the PWs5 & 6, but they did not support the case and turned hostile. In their evidence they stated that nobody confessed the offence and nothing was seized i.e., MO1 in their presence.

In the absence of the same, it is not safe to come to a conclusion that the accused had committed theft of MO1 from the house of PWs1 & 2. The 4C.C.137/2018 punch witnesses i.e., PWs3 & 4 also did not support the case and turned hostile. There is no evidence to believe that the offence had took place in the house of PW1 as the PWs3 & 4 did not support the case. In view of above reason recorded, it is clear that the prosecution failed to prove the ingredients of offence U/sec.457, 380 IPC beyond all reasonable doubt, as such the accused is entitled for benefit of doubt and is acquittal. The point is answered accordingly.

14.In the result, the accused is found not guilty for the offence U/s.

457, 380 IPC and he is acquitted U/sec.248(1) Cr.P.C.

The Superintendent, District Jail, Karimnagar is hereby directed to release the accused forthwith from your custody, if he is not required in any other case.

1.The Sub Inspector of Police, PS Basanthnagar has filed the charge sheet against the accused for the offence punishable U/Sec.457, 380 r/w 511 IPC in Cr.No.01 of 2018.

2.The brief facts of the prosecution story are as follows:

LW1 is resident of Easalathakkallapalli village. On 30.12.2017 at 9.00 AM the LW2 went to Mandamarri where her daughter was residing, on 31.12.2017 the accused observed the locked house of LW1 and hatched a plan to commit theft. On 31.12.2017 at night hours the accused went to the house of LW1, broke open the doors, entered into the house and tried to commit theft of valuable, but he did not found any valuables. On 01.01.2018 the LW3 informed the same to LW1 through phone, then LW1 went to his house and found the same. Hence, the charge.

3.The case was taken cognizance for the offence punishable U/Sec.

457, 380 r/w 511 IPC against the accused. On appearance of the accused, the copies of the charge sheet and other documents are furnished to him as contemplated U/Sec. 207 of Cr.P.C. Accused was examined U/Sec.239 Cr.P.C and charge under Sec.457, 380 r/w 511 IPC have been framed against him, read over and explained to him in Telugu, 2 for which he denied the said allegation, pleaded not guilty and claimed to be tried.

4.During the course of trial to prove its case, the prosecution has examined PW1 to PW8, got marked Ex.P1 to P7.

5.After closure of the prosecution evidence, accused has examined

U/Sec. 313 of Cr.P.C, with the incriminating material available against the accused in the evidence of prosecution witnesses, for which he denied and reported no evidence.

6.Heard both sides.

7.Now the point for determination is:

Whether the prosecution has been able to establish the guilt of the accused for the offence U/s. 457, 380 r/w 511 IPC beyond all reasonable doubt?

POINT:

8.The case of the prosecution is that the accused had tried to commit theft in the house of LW1, but he did not found any valuables.

In order to prove the same, the prosecution has examined PWs1 to 8.

9.PW1 (P. Mohana Chary) has stated that on 30.12.2017 during morning hours his mother went to Mandamarri where his sister residing on her personal work. After one day he came to know that one unknown person was entered into their house by breaking the locks of the doors, he went there and found that the house hold articles were in pelmel condition and not committed theft of valuable. On the same day he went to police station and lodged a complaint. PW2 (P. Kamala) has deposed in similar lines of PW1.

10.PW3 (Abdul Kareem) has stated that at about two months back on one day he came to know from the villagers that some persons had committed theft in the house of PWs1 & 2 by breaking locks of the door, then he went to the house of PW1 where he found the locks of doors were broken.

11.PW4 (D. Shankaraiah) and PW5 ( O. Buchaiah) have stated that they do not know anything about the scene of offence panchanama and 3 also not prepared CDF in their presence. At about two months back when they were present center of their village, at that time police

Basanthnagar came and obtained their signatures on some papers. They do not know the contents of said papers.

12.PW6 (B. Raju) and PW7 (E. Siva Kumar) have deposed that they do not know anything about the case facts, nobody confessed the offence and nothing was seized in their presence. At about three months back on one day they went to police station of Basanthnagar on their personal work where the police obtained their signatures on some papers.

13.PW8 (A. Vijayender) has deposed that on 01.01.2018 at 02.00 pm, he received a complaint from PW1. Basing on that he registered a case in Cr. No.1 of 2018 U/Sec.457, 380 r/w 511 IPC and issued FIR. During the course of investigation he examined and recorded the statement of

PW1 at police station. Later he visited the scene of offence and conducted the scene of offence panchanama and prepared CDF in the presence of PW2 & 3 and Lw3 & 4 and recorded their statements. On 24.01.2018 at 7.30 PM he apprehended the accused at GD Nagar bus stop. On his interrogation the accused confessed the offence, recorded his confessional statement in the presence of PWs6 & 7, thereafter he affected his arrest and produced before this court. After completion of investigation he filed charge sheet.

14.The case of the prosecution is that the accused had tried to commit theft in the house of PW1, but he did not found any valuable.

PWs1 & 2 stated in their evidence that one unknown person entered into their house by breaking the locks to commit theft, but not committed theft of valuable. PW8 is the investigating officer stated that the accused confessed the offence before the the PWs6 & 7, but they did not support the case and turned hostile. In their evidence they stated that nobody confessed the offence and nothing was seized in their presence. In the absence of the same, it is not safe to come to a conclusion that the accused had tried to commit in the house of PW1. The punch witnesses i.e., PWs4 & 5 also did not support the case and turned hostile. There is no evidence to believe that the offence had took place in the house of

PW1 as the PWs4 & 5 did not support the case. In view of above reason recorded, it is clear that the prosecution failed to prove the ingredients of offence U/sec.457, 380 r/w 511 IPC beyond all reasonable doubt, as 4 such the accused is entitled for benefit of doubt and is acquittal. The point is answered accordingly.

15.In the result, the accused is found not guilty for the offence U/s.

457, 380 r/w 511 IPC and he is acquitted U/sec.248(1) Cr.P.C.

The Superintendent, District Jail, Karimnagar is hereby directed to release the accused forthwith from your custody, if he is not required in any other case.
