This suit is coming on 19.12.2019 before me for final hearing in the presence of Sri G.Rambabu, Advocate for the plaintiff and of Sri G.Narayana Rao Advocate for Defendant and the matter having stood over for consideration to this day, this court delivered the following:

J U D G M E N T

This suit is filed by the plaintiff for the relief of permanent injunction against the defendant with a prayer to restrain the defendant his men and men, agents, s from ever interfering with his peaceful possession and enjoyment over the suit schedule property and for costs..

2. The brief facts of the plaint, reads as under:­

The plaintiff is the owner and possessor of an extent of Ac.0.05 cents of house site situated in Grama Kantam of Kalaturu village, which is more fully described in the annexure schedule. Plaintiff acquired the Schedule property by virtue of unregistered will dt.05.02.1998 executed by his paternal grand father Nandamuri Sobhanachalam S/o. Simhachalam of Kalaturu village.

The plaintiff grand father Sobhanachalam is blessed with one son by name Naga

Malleswara Rao i.e., father of the plaintiff and three daughters namely Nagamani

Vejnkateswaramma and Vijayalakshmi. The paternal grandfather of the plaintiff performed the marriages of all his children during his life time. On 05.02.1998 his paternal grand father Sobhanachalam in a sound and disposing state of mind executed an unregistered will bequeathing the plaint schedule property and a thatched house there in bearing Door No.3­26. And assessment No.175 of

Kalaturu Grama Panchayat in favour of the plaintiff. His paternal grand father

Sobhanachalam got the plaint schedule property from one Mokhasadars of

Kalaturu and raised a round thatched hut in schedule property and began residing therein with his family members. The thatched house bearing dr. no.3­ 26 of Kalaturu Gram Panchayat is in the name of his paternal grand father

Sobhanachalam. The said Sobhanachalam died on 31.10.2002 without revoking the will dt. 05.02.1998 thus the will dt. 05.02.1998came into force and the plaintiff became the absolute owner of the plaint schedule property. The said

Sobhanachalam died in the plaint schedule property after his death the paternal grand mother of the plaintiff Papamma resided in the round thatched house in the schedule property till she died on 06.03.2008. The plaintiff father Naga

Malleswara Rao died on 01.07.2005 in the thatched house in the schedule property after his death plaintiff is mother and sisters migrated to Kothapalli village to eke out their lively hood. After the death of Papamma the thatched house in the schedule properjty was collapsed and schedule property became vacant. The plaintiff shifted his resident to Kalaturu about 5 years ago along his mother and began staying in Kalaturu by residing in the house of Nandamuri

Uma as a tenant for some time and later on residing in a hut situated in Guava orchard of Pallagani Seshaiah situated in Kalaturu Village. The schedule property remained vacant till two months ago as the plaintiff could not raise any house therein due to lack of funds. With the financial assistance of his employer Raghavarapu Suresh Kumar, plaintiff raised an asbestos roofed shed

in the plaint schedule property in the 2nd week of July 2014 on cement poles and began residing therein with his mother. Plaintiffs spent about Rs.10,000/­ for raising the shed while the plaintiff is continuing in peaceful possession and enjoyment of the schedule property, plaintiff and his mother went to

Vattigudipadud village to the house of sister on 30.07.2014. taking the advantage of his absence and his mother, the defendant who is younger brother of paternal grand father Sobhanachalam came to the plaint schedule property at about 2.00 PM along with his men removed the shed raised by the plaintiff and taken away the house hold articles belonging to the plaintiff and on coming to know about the situation plaintiff lodged a report with Arigipalli police but the police failed to take any action. Even now the collapsed house materials i.e., cement poles and asbestos sheets used for the roof were lying in the schedule property of later the defendant was proclaiming in the village that he will forcibly disposes the plaintiff, even at the risk of rioting.

Plaintiff further submits the defendant has neither title nor right over the schedule property. As a matter of fact the defendant left Kalaturu village about more than 40 years ago and began residing in Vijayawada by doing hotel business the defendant has no property at Kalaturu village. The defendant became rich by his hotel business and having muscle power, illegally removed the house and a schedule property without having any right. Plaintiff obtained certified copy of assessment register of 2001­2002 from the Secretary, Kalaturu

Gram Panchayat, Agiripalli Mandalam under right to information act and the assessment register clearly shows that the schedule property stands registered in the name of Paternal grand father of the plaintiff in Kalaturu Gram Panchayat with assessment No.175. Therefore he filed the present suit for to grant of PI restraining the defendant his men and agents from ever interfering with his peaceful possession and enjoyment of the plaint schedule property. Hence this suit.

3) The defendant filed the written statement denying the allegations made in the plaint and submitted that one Nandamuri Simhachalam is the father of the defendant the said Simhachalam had three sons by name Sobhanachalam,

Koteswara Rao and Rama Rao and three more daughters by name Venkata

Narasamma, Sakkubai and Vimalamma. The eldest son Sobhanachalam had a son by name Nagamalleswara Rao and three daughters. The plaintiff is the only son of the Nagamalleswararao. Originally the plaint schedule property stood in the name of Nandamuri Simhachalam and there used to be a house therein.

The panchayat records of Kalaturu true the fact that the plaint schedule property stands in the name of Simhachalam. Neither the plaintiff nor his father nor his grand father Sobhanachalam has no absolute rights or title over the plaint schedule property. And the plaintiffs paternal grand father has no manner of rights to execute the alleged will the alleged will dt.05.02.1998 is nothing but a forged one. The said Sobhanachalam never executed such a will in favour of the plaintiff and it does not bind the plaintiff. The plaint schedule property is a vacant site and it is in constructive possession and enjoyment of this defendant as this defendant permitted one Nandamuri Krishna Murthy totether cattle in the plaint schedule property. So the said Krishna Murthy is in permassive possession on the plaint schedule property there are pegs for tethering the cattle and there is a tub for the drinking water of the cattle.

Further there is a dung heep also in the plaint schedule property. The said

Krishnamurthy has taken a permission are this defendant for raising an asbestos roofed shed in the plaint schedule property for the protection of his cattle and this defendant accorded permission for the same. While it was so, the plaintiff filed the suit and obtained an order of status quo. Therefore shed could not be raised but the material is there. Taking the advantage of the material therein in the plaint schedule property the plaintiff procured the receipts and claiming the material. The plaintiff has no manner of right title are possession over the plaint schedule property the alleged will dt.05.02.1998 is a rank forged

one the defendant alone is in constructive possession and enjoyment of the plaint schedule property and the plaintiff ought to have filed the suit have declaration and there is no cause of action for the suit and the boundaries of the plaint schedule property are also not correct hence he prays the court to dismiss the suit.

4.Basing upon the above pleadings my learned predecessor in office framed the following issues for trial. 

1)Whether the plaintiff was in possession of the plaint schedule property as on the date of suit?

2)Whether the plaintiff is entitled for permanent injunction as prayed for?

3) To what relief?

5.On behalf of the plaintiff P.W.1 was examined and Ex.A1 to A5 marked on behalf of defendant D.W.1 was examined and Ex.B1 & B2 marked. 

6. Heard arguments on both sides.

Issue No.1 & 2:

7.It is the burden is on the plaintiff in the present suit it is the case of the plaintiff. The plaintiff is no other than the younger brother’s grand son of the defendant. The plaintiff filed the suit for a permanent injunction against the defendant. Along with the plaint he also filed I.A.362/2014 for granting a temporary injunction. On perusal of the documents he filed the Honourable court issued urgent notice and status quo. The contention of the plaintiff is the plaint schedule is in an extent of 0.05 cents of house site along with a thatched house therein bearing assessment No.175 with door No.3­26 situated at

Kalaturu village, Agiripalli Mandal, Krishna District. The further contention of the plaintiff is that he acquired the site under an unregistered will dt.05.02.1998 alleged to have been executed by his paternal grand father

Nandamuri Sobhana Chalam, son of Simhachalam. The paternal grand father of the plaintiff is blessed with one son by name Naga Malleswara Rao, who is the father of the plaintiff and three daughters by names Nagamani,

Venkateswaramma and Vijaya Lakshmi. On 05.02.1998 the paternal grand father of the plaintiff executed an unregistered will in favour of the plaintiff executed an unregistered will in favour of the plaintiff in respect of the plaint schedule property in a sound disposing state of mind and that the paternal grand father of the plaintiff got the plaint schedule property from Mokhasadars of Kalaturu and raised a thatched hut in the said schedule property and resided there. The paternal grand father of the plaintiff died on 31.10.2002 without revoking the will dt.05.02.1998 and the will came into force immediately after the death of his grand father. The further contention of the plaintiff is that after the death of his grand father Sobhanachalam his wife namely Papamma resided in the said house and he died on 06.03.2008. The father of the plaintiff died on 01.07.2005. After the death of the father of the plaintiff, the plaintiff, his mother and sister migrated to Kothapalli village to eke out their livelihood. After the death of Papamma the thatched house in the schedule property was collapsed and it became vacant. The plaintiff shifted his residence to Kalaturu about 4 years ago i.e., prior to the filing of the suit in 2014 and began to live at Kalaturu by residing in the house of one Nandamuri Uma as a tenant for some time and later on residing in a hut situated in Guava orchard of Pallagani Sitaiah situated at Kalaturu village. The schedule property remained vacant till two months prior to the filing of the suit as plaintiff could not raise therein due to lack of funds. With the financial assistance of his employer Raghavarapu Suresh

Kumar, plaintiff raised an asbestos roofed shed in the plaint schedule property in the 2nd month of July. 2014 on cement poles and began residing therein.

Plaintiff spent about Rs.10,000/­ and continuing in peaceful possession and enjoyment of the schedule property. Plaintiff and his mother went to

Vattigudipadu village to the wife of his sister on 30.07.2014. Taking advantage of the absence of the plaintiff and his mother the defendant who is the younger brother of paternal grand father of the plaintiff came to the schedule property at about 2 PM along with his men and removed the shed etc., and so he lodged a

complaint to the police etc., Even now the collapsed house material i.e., cement poles, asbestos sheets were lying in the schedule property and that the defendant proclaimed that he will forcibly dispossess the plaintiff even at the risk of rioting. The defendant has neither title, nor right over the schedule property and he has been residing at Vijayawada etc., The defendant became rich by doing hotel business and removed the house illegally. Plaintiff is a weak person and he is not in a position to protect his possession in the schedule property. 

8. In support of his contention plaintiff was examined as P.W.1 and he reiterated the contents of plaint he exhibited Ex.A1 to A5. Ex.A1 is the unregistered will dt.05.02.1998 executed by Nandamuri Simhachalam in my favour. Ex.A2 is the death certificate issued by register of births and deaths relating to the death of N.Simhachalam. Ex.A3 is the Bill dated 15.06.2014 issued by Sri Venkataraman concrete and hallow bricks works relating to purchase of cement poles. Ex.A4 is the Bill dated 15.06.2014 issued by

Subramanyeswara Enterprises, Agiripalli in my favour. Ex.A5 is the xerox copy of assessment register 2001 to 2002 from secretary, Kalaturu Gram Panchayat,

Agiripalli Mandal (Assessment No. 175 of Kalaturu Gram Panchayat) in support of his contention he has not examined any 3rd party to prove his version during his cross examination P.W.1 categorically admitted that by the time of the execution of the will his grand father who is executed the said will in his favour he was a small boy so that he do not know about the execution of the said will in his favour and there is no house tax receipts with him in respect of the plaint schedule property paid by his paternal grand father and also clearly admitted that there are pegs in the plaint schedule property for tethering cattle and also there is a sole tub in the PSP from his child hood and also admitted that one

Nandamuri Krishna Murthy tethered cattle in the plaint schedule property on the permission of the defendant and also there is dung heep in the plaint schedule property and he did not take steps towards to appointment of Advocate

commissioner to assured the plaint schedule property to show that the asbestos sheets raised by him, were removed by defendant and he do not know whether the plaint schedule property stands in the name of Nandamuri Simhachalam and it is the case of the defendant that One N.Simhachalam who is the great grand father of the plaintiff and the father of this defendant had three sons by name One Sobhanachalam 2. Koteswararao 3.Ramarao (defendants) and three daughters by name 1) Narasamma 2) Sakkubai and 3) Vimalamma the plaintiffs grand father is the eldest of all his brothers whereas the defendant is the youngest son of Sobhanachalam the father of the plaintiff is only son to

Sobhanachalam and he has three daughters. Neither the plaintiff nor his father nor his grand father has no absolute right title over the plant schedule property

The grand father of the plaintiff has no manner of right to execute the alleged will dt. 05.02.1998 and it is a forged one and the said Sobhanachalam never executed such a will in favour of the plaintiff and it does not bind on the plaintiff and he further submits that the plaint schedule property is a vacant site and it is in constructive possessive and enjoyment of the defendant as this defendant permitted one Nandamuri Krishna Murthy to tether cattle in the plaint schedule property and as such the said Krishnamurthy is in permissive possession of the said property and in turn the said Krishna Murthy raised and asbestos roofed shed in the plaint schedule property for the protection his cattle and the defendant accorded permission for the same and in view of the court order status quo the said Krishna Murthy could not raise shed with the material and the material was therein the schedule property and taking the advantage of the material therein the plaintiff procured receipts for the material and claiming the same. The defendant is in constructive possession and enjoyment of the

Schedule property in the support of his contention defendant son Nandamuri

Sridhar was examined as D.W.1 and he reiterated the contents of the plaint he exhibited Ex.B1 & B2. Ex.B1 is the attested copy house tax bill for the year 1961­62 (first half year) of Kalaturu village issued by Panchayat Secretary, Gram

Panchayat, Kalaturu. Ex.B2 is the certificate dt.19.09.2018 issued by

Panchayat Secretary, Gram Panchayat, Kalaturu.

9.On going through the rival contentions and on perusal of the entire evidence available on record, the plaintiff in this case failed to examine either the claim of the will dt.05.02.1998 under Ex.A1 are any one of the attestors and it is well settled law that a document must be proved by examining atleast two persons on the documents either the attestor or the scribe. Herein this case the plaintiff did not examine any person who is on the will dt. 05.02.1998 under Ex.A1 and the plaintiff did not file even a single cist receipt except filing the assessment register of 2001­2002 which is the general revision book of Kalaturu Gram

Panchayat. P.W.1 in his cross examination had given the boundaries which are contrary to the boundaries given in the plaint schedule and the plaintiff could not establish title possession are enjoyment on the plaint schedule property and he did not choose to file any tax receipt, voters list or anything to establish his contention that he is residing at Kalaturu village especially in the plaint schedule property. The plaintiff himself stated in the plaint as well as in the chief affidavit that he was residing elsewhere in the guava orchard of Pallagani

Seshaiah of Kalaturu. This clearly shows that as on the date of filing of the suit he is not in possession and enjoyment of the plaint schedule property.

Therefore he could not establish his title and possession. The house tax receipts which was filed by the N. Simhachalam for the period up to 30.09.1961 show that he paid house tax of Rs. 75 paisa for the house bearing No. 108 on 23.08.1961 there in the register house bearing door No. 109 Sl.No.97 it is find the name of Nandamuri Simhachalam the certificate issued by the Panchayat

Secretary Kalaturu clearly shows that Nandamuri Simhachalam had a house bearing assessment No. 98 and half yearly house tax for the years 1961­62 and the defendant established his contention that he is in possession and enjoyment of the property by clearly stating that he has given the plaint schedule property to one N.Krishmurthy for tethering cattle to it. Moreover the plaintiff himself

admitted that there are pegs for tethering cattle and rubber tubs in the land for tethering cattle. Apart from that, the plaintiffs admitted that there is dung heep and sour (kudithi) tub in the plaint schedule property. If the contention of the plaintiff is true and really the defendant removed the shed and cement poles as alleged by him, he would have got appointed a commissioner Advocate and got it noted. Moreover as the boundaries of the plaint schedule property are also not correct he had not seeking the court for appointment of commissioner to note down the physical feature of the correct boundaries of the plaint schedule property. Mainly ought to have filed the suit for declaration of title instead of seeking permanent injunction over the suit schedule property. As such the plaintiff fail to establish his contention and the main ingredients for granting injunction i.e. the title possession and enjoyment was not at all proved by the plaintiff and he did not even choose to examine any neighbours of the plaint schedule property. Accordingly I answer the issues against the plaintiff and in these circumstances this court has no other go except to conclude that the plaintiff is not entitle to equitable relief of permanent injunction as prayed for.

Issue No.3:

10.In view of my findings issued No.1 & 2 the plaintiff is not entitled to the decree as prayed for.

11. In the result, the suit is dismissed with costs.

This is a suit filed by the Plaintiff against the Defendants for permanent injunction restraining the defendants, their agents and men from dispossessing the plaintiff from the plaint schedule property by occupying and from interfering with her peaceful possession and enjoyment of the plaint schedule property and for costs.

2) Brief averments of the plaint are that:

The plaintiff is the absolute owner of the property to an extent of Ac.1.89 cents of Mango garden in R.S.No.21/1A situated at

Pothavarappadu village, Agiripalli Mandal as described in the schedule annexed to the plaint. Wherever the context so appear and is in peaceful possession and enjoyment of the same without interruption from anybody from any corner. The defendants 1 and 2 are the wife and husband.

Originally the plaintiff purchased the plaint schedule property from her vendor i.e., the 1st defendant herein under a registered sale deed bearing document No.3089/13 dated 08­05­2013 on the file of S.R.O Nuzvid for valuable consideration of Rs.8,51,000/­. The plaintiff paid the entire sale consideration to the 1st defendant and the 1st defendant executed the registered sale deed in favour of the plaintiff and delivered the possession of the same to the plaintiff ever since he is in peaceful possession and enjoyment of the plaint schedule property and as such she is having right, title, interest, possession and enjoyment over the plaint schedule property. Thereafter he applied for pattadar pass book and title deed book in her favour. Ever since she is cultivating the plaint schedule property.

She further submits that surprisingly on 04­07­2013 the 1st defendant filed a suit O.S.128/2013 on the file of Senior Civil Judge’s Court, Nuzvid against the plaintiff and her husband for cancellation of the registered sale deed No.3089/13 executed by her in favour of the plaintiff.

While the matter stood thus, on 24­07­2013 at about 10.00 A.M when the plaintiff is making agricultural operations in the plaint schedule

property the defendants who has manner of any right, title or interest or cancellation along with unruly men numbering in 10 who appears to be an anti­social elements came to the plaint schedule property and tried to occupy the same illegally and highhandedly. With the timely intervention of the neighbours and people who gathered from the adjacent properties thereby, the defendants went away along with their men proclaiming that they would occupy the plaint schedule property at any moment by force. 

The plaintiff further submitted that she learnt that the defendants are trying to create some documents to support their false contentions and also filed suit O.S.No.128/2013 and trying to took the possession of the plaint schedule property to cause wrongful loss to the plaintiff. Prima facie the plaintiff is in possession and enjoyment of the plaint schedule property. Balance of convenience is in her favour if the defendants or their henchmen are allowed their highhanded and illegally occupation of the plaint schedule property, she would suffer irreparable loss. Hence, the suit.

3) The Defendants 1 and 2 filed written statement denying the allegations made in the plaint and further submitted that the plaintiff and 1st defendant are cousins. The 2nd defendant is engaged in furniture business under the name and style of “Sai Ganesh Impex” at Vijayawada.

For his business purpose, the 2nd defendant required money and approached the husband of the plaintiff (Plaintiff in O.S.No.208/13 on the file of II Addl.District Judge Court, Vijayawada) for the same, who is doing jewellery business and also finance business. The plaintiff's husband agreed to advance amount @ 36% p.a. Having agreed for the same the 2nd defendant borrowed a sum of Rs.2,00,000/­ on 31­03­2011. At that

juncture plaintiff husband demanded the 2nd defendant to execute a blank promissory note for the double of the amount borrowed, stating that the rate of interest at which he was lending the amount cannot be shown officially in the promissory note. Keeping in view of the close relation ship and due to his pressing needs, the 2nd defendant executed the blank promissory note for an amount of Rs.4 lakhs as demanded by the plaintiff husband though he has borrowed only Rs.2,00,000/­. The 2nd defendant required further amount for his business purpose and again approached the husband of the plaintiff. The plaintiff's husband demanded an interest @ 48% p.a. The 2nd defendant has agreed for the same and borrowed the amounts. The 2nd defendant has executed blank promissory note as mentioned below mentioning the double of the amount borrowed.

On ;31­3­2011 he borrowed Rs.2,00,000/­ and mentioned in pronote as

Rs.4,00,000/­. On 10.1.2012 he borrowed an amount of Rs.2,50,000/­ and mentioned as Rs.5,00,000/­. On 08­02­2012 he borrowed an amount of Rs.2,50,000/­ and mentioned as Rs.5,00,000/­. On 14.4.2012 he borrowed an amount of Rs.2,50,000/­ and mentioned as 5,00,000/­. On 4.5.2012 he borrowed an amount of Rs.2,50,000/­ and mentioned as 5,00,000/­. On the same day he borrowed an amount of Rs. 2,50,000/­ and mentioned as Rs.5,00,000/­ and on the same day he borrowed an amount of Rs.2,50,000/­ mentioned as Rs.5,00,000/­ and on 01­07­2012 he borrowed an amount of Rs.1,00,000/­ mentioned as Rs.2,00,000/­.

The 2nd defendant could not discharge the debt and plaintiff husband start pressurizing the 2nd defendant to discharge the same. The 2nd defendant stated that he would discharge the debt by sale of Mango garden stating in the name of 1st defendant. On hearing the same, the

plaintiff and her husband asked 2nd defendant to transfer the said mango garden in their favour towards the amount due them instead of selling to others. The defendants agreed for the proposal and agreed to transfer the said mango garden to them. The plaintiff and her husband and defendants entered into an oral agreement in the presence of one

Tadikonda Satish Kumar, S/o.late Sambasivarao on the condition that the 1st defendant has to register the plaint schedule property in to the name of the plaintiff and the husband of plaintiff agreed to discharge the 2nd defendant from the entire debt due together with interest and further agreed to return the 8 unfilled blank signed promissory notes signed by the 2nd defendant which are lying with the plaintiff's husband. According to the oral agreement, the 1st defendant on 08­05­2013 executed the sale deed in favour of the plaintiff vide document bearing No.3089/13 on the file of Sub Registrars office, Nuzvid. After the registration of sale deed, the husband of plaintiff handed over the 8 promissory notes to the 2nd defendant in the presence of 1st defendant and in the presence of

1) Bhoganadhuni Srinivasarao, S/o.Somaiah, 2) Tadikonda Satish Kumar,

S/o.late Sambasivarao and husband of plaintiff stated that they are the original promissory notes executed by the 2nd defendant and that there is no debt due between him and the 2nd defendant. The valuation of the property is much higher than the valuation shown in the said deed, the plaintiff and her husband got the sale deed registered by undervaluing the property. Though it was recited in the sale deed that the possession was delivered to the plaintiff. The actual physical was not delivered to the plaintiff for the reason that the exact extent is to be measured and demarked, as the schedule land is a part of Ac.9.00 cents of land

purchased together by the 5 family members of the 2nd defendant. The ; 2nd defendant received notice in two suits in O.S.No.208/13 and

O.S.No.209/13 respectively filed by the plaintiff’s husband and plaintiff

respectively from this court. Having received the notices, the 2nd defendant was shocked after seeing the copies of the promissory notes filed in these suits, the 2nd defendant verified the genuineness of the promissory notes filed in the suit and the promissory notes returned to him by husband of the plaintiff. On comparison of both the sets of the promissory notes, the 2nd defendant found and realized that after obtaining the sale deed in favour of plaintiff in respect of plaint schedule property, the husband of plaintiff returned the fabricated promissory notes by forging the signature of the 2nd defendant instead of original once. The plaintiff filed these suits by filling the blank promissory notes executed by the 2nd defendant. On knowing the said fact that they have been cheated by the plaintiff and her husband, on 29­06­2013 at about 8.30 a.m the defendants along with 1) T.Satish Kumar, 2) B.Srinivasarao approached the plaintiff and her husband and questioned them about their illegal acts. Then, they threatened the defendants with dire consequences and she further submits that plaintiff does not have either the actual or symbolic possession of the plaint schedule property and thus does not have either prima facie case or balance of convenience in her favour. On the other hand, the defendants have in possession and enjoyment of the plaint schedule property and thus has both of them.

The plaintiff with malafide intention approached the Hon’ble Court on wrong pretext that the defendants are trying to interfere with the suit schedule property by showing false cause of action and prays the court to

dismiss the suit.

4)Basing on the above pleadings, the following issues were settled for trial.

1) Whether the plaintiff is entitled for permanent injunction as prayed for?

2) To what relief?

5)On behalf of the plaintiff, P.W.1 and 2 were examined and Ex.A1 is marked. On behalf of the defendants, 1st defendant is examined as

D.W.1 and no documents were marked on their behalf. The matter underwent several adjournments for the cross examination of D.W.1, but

D.W.1 failed to come to the court to stand for cross examination by other side even as on today. Hence with the knowledge of her counsel, her evidence is eschewed and her counsel reported no further defendant evidence.

 6)Heard both sides.

ISSUES No.1:

7) P.W.1 is the plaintiff. She produced one document i.e., the original sale deed which is marked as Ex.A1 and her chief examination is the repetition of the plaint averments. Ex.A1 is the Original sale deed

dated 08­05­2013. The main pleadings of the plaintiff is that the plaint

schedule property was purchased by the plaintiff from the 1st defendant under Registered Sale Deed No.3089/2013 on the file of SRO, Nuzvid and since the plaintiff is in peaceful possession and enjoyment of the same.

On 04­07­2013 the 1st defendant filed suit O.S.No.128/2013 against the

plaintiff and her husband with false and untenable allegations for cancellation of the Registered Sale deed No.3089/2013. On 24­07­2013 at about 10.00 A.M the defendants and their unruly men tried to occupy the plaint schedule property at the timely intervention of the neighbours the defendants went away by openly proclaiming that they would occupy the same as any moment and since the defendants are tried to create some documents to support their false contentions. In support of her version, she filed Ex.A1 i.e., Original sale deed dated 08­05­2013 which shows that she was in the possession of the schedule property in Survey

No.21/1A for an extent of Ac.1.89 cents of mango garden situated at

Pothavarappadu Gram panchayat, Agiripalli Mandal within the sub registry of Nuzvid. In support of her version, she got examined P.W.2 who categorically corroborated the plaintiff i.e., P.W.1 in all material aspects regarding his possession over the schedule property and the interference of the defendants with the suit schedule property P.W.1 and 2 were cross examined at length nothing was elicited from their cross examination to disprove the plaintiff's case.

8) The main pleadings of the defendants are that the plaintiff under the guise of status quo order is trying to interfere with the possession over the property in Survey No.21/1A for an extent of Ac.1.89 cents of mango garden situated at Pothavarappadu Gram Panchayat,

Agiripalli Mandal and the boundaries which were shown by the plaintiff in suit schedule property are in correct. But the defendants did not come

before this court and did not state their case on oath by offering an

opportunity to the plaintiff to test the veracity of their cross examination.

The defendants did not enter into the witness box and did not state their

case on oath. The 1st defendant filed his chief affidavit as D.W.1 at the time of defendants evidence, but he failed to turn up before this court for cross examination and as such, his evidence was eschewed.

 9) On perusal of entire evidence it is clear that the plea taken in the written statement is that the plaintiff under the guise of status­quo order is trying to interfere with the possession of land of Defendant No.1 in Survey No.21/1A for an extent of Ac.1.89 cents of mango garden situated at Pothavarappadu Gram Panchayat, Agiripalli Mandal. But the defendants are silent in proving their case. Since P.W.1 and 2 categorically corroborated the facts of the plaint in material aspect regarding plaintiff’s possession over the suit schedule property, it is to be presumed that the plaintiff is in possession and enjoyment of the schedule property as on the date of filing of the suit and there is unjustifiable interference with his possession by the defendants and the plaintiff is entitled to the relief of permanent injunction. Hence I answered the issue

No.1 accordingly in favour of the plaintiff and against the defendants.

Issue No.2:­

In the result, the suit is decreed with costs restraining the defendants, their men, agents, associates and representatives etc., from dispossessing the plaintiff from the plaint schedule property by occupying and from interfering with her peaceful possession and enjoyment of the plaint schedule property in any manner permanently.

J U D G M E N T

This is a suit filed by the Plaintiff’s Bank against the defendants for recovery of suit amount of Rs.3,36,545/­ from the defendants 1 and 2 jointly and severally with subsequent interest at contractual rate of interest from the date of suit till realization and for costs of the suit.

2. The brief facts of the plaint are as follows:­

The 1st defendant through his father, 2nd defendant approached the plaintiff bank for financial assistance of Rs.2,20,000/­ for the purpose of education of integrated B.Tech Course at IIIT campus, Nuzvid of RGUKT with application and offered to secure the debt with surety, the 2nd defendant to repay the loan from incomes after completion of said course in 72 equated installments. The plaintiff considered the application of the defendants and in pursuance of which defendants accepted the terms and conditions and entered into an agreement with plaintiff along with letter of Educational scheme and agreement for Term loan for SBI Education scheme on 15.12.2009. The defendants accepted the terms and conditions entered into and signed accordingly availed the said loan by agreeing to repay the same with interest @13.5% with quarterly rests subject to its change from time to time till the time of discharge of loan in full. As per the terms of agreement the liability of payment of loan starts one year after completion of course or six months after getting job in 72 equated installments. It is learnt that the 1st defendant got job around January, 2018 and as such period of liability of payment commences from or about from July, 2018 onwards. Subsequently the defendant did not discharge the loan amount in spite of repeated demands of the plaintiff but acknowledged the debt under revival letter. The plaintiff many times demanded the defendants for discharge of and used to sent notices also the defendants. Even after the final notice also the defendants neither discharged nor made any attempt to pay the outstanding amount on one pretext or other. The plaintiff has been attending all the incidental charges from time to time since the date of loan and crediting the same in the loan account of the defendants as they are liable to pay the same as per the terms of the agreement. Therefore the plaintiff is constrained to file this suit for recovery of the amount outstanding in the loan account from the defendants with interest and costs. Hence the suit.

3. Defendants called absent and remained set exparte.

4. On behalf of plaintiff, PW.1 was examined and Exs.A1 to A4 were marked.

6. Point for consideration is: Whether the plaintiff bank is entitled to recover the suit claim from the defendants ?

Accordingly, this point is answered in favour of the plaintiff.

8.In the result, the suit is decreed with costs for Rs.2,36,545/­ with subsequent interest @ 12%p.a. on principal sum of Rs.2,20,000/­ from the date of suit till the date of decree and thereafter at 6%p.a. from the date of decree till realization against D1 and D2 jointly and severally.

Claim: This is a suit filed by the Plaintiff’s Bank against the defendants for recovery of suit amount of Rs.2,38,245/­ from the defendants 1 and 2 jointly and severally with subsequent interest at contractual rate of interest from the date of suit till realization and for costs of the suit.

3.Value of the suit for the purposes of Court Fees and Jurisdiction U/s.50(1) of APCF and SV Act is Rs.2,38,245/­ on which a court fee of Rs.4,826/­ was paid U/s.20 (2) of APCF & S.V. Act of 1956.

4. Cause of action for the suit arose on and from when the defendants approached the plaintiff for a loan and on 27.10.2008 when the 1st defendant availed loan through 2nd defendant from the plaintiff bank and executed agreement of loan arrangement letter of repayment of loan along with 2nd defendant and on all the times whenever the defendants made payments and all the times whenever they were demanded by the plaintiff for the discharge of loan and the place of Nuzvid where the plaintiff branch is situated as well as the place of residences of defendants are within the jurisdiction of this

Hon’ble court.

5.This suit is coming on 09.01.2020 before me for final hearing in the presence of Sri K.V.K. Vikram Kumar, & A.A.P.Swamy Advocates for Plaintiff and defendants 1 & 2 are remained set exparte and the matter having stood over for consideration to this day, this court doth order and decree as follows:

i)that the defendants D1 and D2 jointly and severally do pay to plaintiff a sum of Rs.2,38,245/­ with subsequent interest at the rate of 12% per annum on principal sum of Rs.2,32,000/­ from the date of suit i.e., 31.10.2019 and thereafter at 6% per annum till realization. 

ii)That the defendants 1 and 2 do pay to plaintiff a sum of Rs.11,125/­ towards costs.

This case came up on 12.12.2018 before me for final hearing and disposal in the presence of Learned Addl.P.P. for the prosecution and of Sri K.Ramarao, Advocate for the Accused upon hearing on both sides, stood over for consideration, till this day, this court delivered the following:

J U D G M E N T

The Sub­Inspector of Police, Musunuru Police Station filed charge sheet against the Accused A1 to A3 U/sec. 498 (A) I.P.C in Cr.No.162/2017 of

Musunuru Police Station.

2.The case of the prosecution in brief is as follows:

That the marriage of the complainant Battina Sandhya Rani was performed on 02­04­2016 with A1 by giving dowry of Rs.3,00,000/­ and landed property of Ac.0.70 cents, Adapadachu katnam of Rs.25,000/­, gold jewelry of 3 sovereigns and sent her to lead conjugal life with sare samans of

Rs.50,000/­. The husband and in­laws of the complainant could not satisfied with the dowry brought by the complainant, used to harass her both mentally and physically and her father adjusted Rs.50,000/­ during Ashadamasam visit. Later also her husband did not satisfy and demanded Rs.1,00,000/­

additional dowry. The complainant and her husband i.e., A1 put up separate

family as per the advice of elders and it was breakdown with the instigation of her younger brother­in­law. A report was given at Krishnalanka police station and there also police held counseling to the couple where A1 agreed to treat the complainant well and quit his promise. Finally her husband i.e., A1 bet and necked out her besides suspecting her fidelity that she is having illegal contacts with others.

Basing on the report of the complainant, the S.I of police registered a case as FIR in Cr.No.162/2017 and took up investigation and examined the witnesses. Hence the charge.

3.The case was taken on file U/secs. 498­A I.P.C and 3 & 4 of D.P 

Act.On appearance of the Accused Nos.1 to 3 copies of documents have been furnished to them as required U/sec.207 Cr.P.C.

4.The Accused Nos.1 to 3 were examined U/sec.239 Cr.P.C for the offences U/sec. 498­A I.P.C and 3 & 4 of D.P Act, charges were framed against the Accused and the same was read over and explained to the Accused in

Telugu, for which, they pleaded not guilty and claimed to be tried.

5.At the time of trial, the prosecution has examined P.W.1 and P.W.2 and got marked Ex.P.1 to P3. The prosecution has given up the evidence of remaining witnesses namely Uppe Gangaratnam (L.W.3), Uppe Sambasivarao (L.W.4), Uppe

Venkateswarao (L.W.5), Penara Damodara rao (L.W.6), Ramavarapu Sambasivarao (L.W.7) and K.Sivanarayan (L.W.8) in view of hostile evidence of PW­1 and 2.

6)On closure of the evidence of the prosecution, the examination of the accused U/sec.313 Cr.P.C was dispensed with, as there are no incriminating

circumstances appearing against them found in the evidence adduced by the prosecution and proceeded with the judgment.

7)Heard the arguments on both sides and perused the relevant record.

8)POINT:

Now the point for determination is “Whether the prosecution established the guilt against the Accused U/secs. 498­A I.P.C and 3 & 4 of D.P Act beyond all reasonable doubt”?

9)The prosecution story, in brief, is that :

The Accused harassed P.W.1 for additional dowry both mentally and physically and necked out her and as such, the accused are liable for punishment for the offences punishable U/secs. 498­A I.P.C and 3 & 4 of D.P Act.

10)In order to prove the guilt against the accused, the prosecution has examined the defacto complainant to the alleged incident namely Battina Sandhya

Rani as P.W.1, who stated in her evidence that A1 is her husband, A2 and A3 are her in­laws. Her marriage with A1 was performed on 02­04­2016 at her parents’ house as per Hindu Rites and custom. Immediately after the marriage, she joined with A1 to lead marital life. No dowry was given by her parents at the time of marriage. The accused never demanded her to bring additional dowry from her parents. The accused never ill­treated her and insisted her for dowry. No physical harassment was caused by either by A1 of her in­laws. During her stay at her in­laws a petty dispute arose her and A1, then out of emotion she went to her parents and informed about the petty quarrel between her and A1. All her relatives approached her and obtained her signature on a written paper. She did not go through the contents of Ex.P1 report

dated 14­09­2017.

11) PW­2, who is the father of P.W.1 deposed that A1 is his second daughter and he performed her marriage with A1in the year 2016. Immediately after the marriage P.W.1 joined with A1 to lead marital life. 15 days after the marriage P.W.1 came to her house and informed that a petty quarrel was taken place between A1 and

P.W.1 informed the same to her relatives, who inturn visit him and prepared a report and obtained signature of P.W.1. He did n t know the contents of Ex.P1 report and police did not examine him.

12) As seen from the aforesaid evidence of PWs.1 and 2, they did not speak any incriminating circumstances against the accused and thereby they did not support the prosecution case. Therefore, the learned APP sought the permission of the court to declare P.W.s1 and 2 as hostile and subjected to cross examine them. Even after their cross examination, nothing incriminating was elicited as against the accused. P.Ws.1 and 2, who gave incriminating statements against the accused before the police, when they were examined U/sec.161 of Cr.P.C., turned hostile, while they were giving evidence before the court. At the instance of the Learned APP, PWs­1 and 2 were declared as hostile their Sec.161 Cr.P.C. Statements were marked as Exs.P2 and Ex.P3. There is neither direct evidence, nor circumstantial evidence to prove the guilt of the accused. There is no proof or evidence on record to show that the Accused harassed P.W.1 for additional dowry both mentally and physically and necked out her. 

13)As seen from the aforesaid evidence of P.W.1 and 2, it appears that subsequently the accused entered into compromise with PW­1 and 2 and settled the matter outside the court and as such, P.W.1 and 2 have not supported the prosecution case and after declaring them hostile, except suggestions and confronting

Exs.P.2 and P3 which are alleged statements made under section 161 Cr.P.C., no other material evidence was elicited. Absolutely, there is no evidence on record to substantiate the case of the prosecution.

14)From the foregoing reasons, I am holding that the prosecution has failed to establish the charges levelled against the accused beyond all reasonable doubts and as such, the accused are entitled for acquittal.

In the result, the Accused A1 to A3 are found not guilty for the offences

U/secs. 498­A r/w 34 I.P.C and Sec.3 & 4 of D.P.Act and they are acquitted

U/sec. 248(1) Cr.P.C. The bail bonds of the accused, if any, shall stand cancelled and they are set at liberty.
