This suit is coming before me for final hearing in the presence of Sri P.

Hari Babu, Advocate for the plaintiff and the Defendants No.1 and 2 are remained exparte; and having stood over for consideration to this day, this court delivered the following

The suit for recovery of Rs.12,02,093/- and for subsequent interest at the rate of 15% P.A., from the date of suit till the date of realization and for costs of the suit.

2.The case of plaintiff in brief :

The plaintiff humbly submits that they are doing whole sale Hosiery and Ready made cloth business under the name and style of Ravi Teja

Distributors, Chiral vide GSTIN: 37BMJPM8469D1ZK. 2nd defendant is the proprietor of 1st defendant’s firm and they have been doing Ready made dresses business under the name and style of 1st defendant/Sri Lakshmi

Prasanna Ready made Dresses, Kanigiri. On behalf of 1st defendant’s firm, 2nd defendant approached the plaintiff and opened a Khata with the plaintiff’s firm on 31-10-2022 used to purchase cloth on credit and used to make part payments. The defendants used to get the goods delivered through New Balaji Parcel Service Transport Kavali from time to time. The credit Invoices and the L.Rs issued by the New Balaji Parcel Service

Transport Kavali are filed herewith.

b) The defendants used to make part payments. As per the trade custom and mercantile practice and usage the defendants are liable to pay interest @ 15% per annum on the outstanding balance. The account copy of the defendants are filed herewith.

c) Subsequently, plaintiff several times personally demanded the defendants for repayment of the debt due under the above-referred Khata.

But the defendants are postponing the payment on some pretext or other.

d) Having no other option, plaintiff is constrained to file the suit against the defendants for recovery of the debt due under the Khata with subsequent interest and costs.

3. Summons on the Defendants served. The summons held sufficient, but Defendants No.1 and 2 did not appear before the Court and they are set exparte on 27.01.2026.

4. During the course of trial, plaintiff is examined as PW.1 and Ex.A1 to

A85 are marked. No oral or documentary evidence is adduced on defendant side.

5. Heard the counsel for the plaintiff.

6. Now the point for consideration is:

“Whether the plaintiff is entitled for the suit claim as prayed

for?

7. As noted above, the plaintiff is doing whole sale Hosiery and Ready

Made cloth business under the name and style of Ravi Teja Distributors,

Chirala. 2nd Defendant is the proprietor of 1st defendant’s firm and they have been doing ready made dresses business under the name and style of 1st defendant/Sri Lakshmi Prasanna Readymade Dresses, Kanigiri. On 4 PRL.CIVIL JUDGE (JD), CHIRALA, OS No.475/2025 Dt.24.04.2026 behalf of 1st defendant’s fir, 2nd defendant approached the plaintiff and opened a khata with their firm on 31.10.2022 used to purchase cloth on credit and used to make part payments. The defendants used to get the goods delivered through New Balaji Parcel Service Transport, Kavali from time to time.

The defendants used to make part payments. As per the trade custom and mercantile practice and usage the defendants are liable to pay interest at 15% per annum on the outstanding balance. In such a way as on 21.12.2025 the defendants are liable to pay a sum of Rs.12,02,093-00.

Subsequently, on several times the plaintiff personally demanded the defendants for repayment of the debt due under the above referred khata.

But, the defendants are postponing the payment on some pretext or other.

Having no other go, they are constrained to file the suit against the defendants for recovery of the debt due under the khata with subsequent interest and costs.

To prove the contention of the plaintiff, he himself examined as PW.1 by reiterating the contents of plaint and got marked Exs.A1 to A85.

8. To disprove the contention of PW.1, the defendants did not appear

before the court to give evidence and they remained set exparte. So, it is to

be presumed that the defendants admitted the case of PW.1. To prove his 11 PRL.CIVIL JUDGE (JD), CHIRALA, OS No.475/2025 Dt.24.04.2026 case, PW.1 got marked Ex.A1 to A85. Further, the oral evidence of PW.1 and documentary evidence under Ex.A1 to A85 it establishes that the 2nd defendant on behalf of 1st Defendant firm used to purchase cloth on credit from the plaintiff on credit and used to make part payments by opening khata at the plaintiff.

To disprove Ex.A1 to A85 and oral evidence of PW.1, the defendant did not appear before court and remained exparte. The oral and documentary evidence stands unrebutted and proved by PW.1. Hence, it is held that PW.1 is entitled for the suit claim and that PW.1 proved that the defendant purchased cloth on credit basis from the plaintiff under Ex.A1 to A85 and the defendant failed to repay the amount to him and that the plaintiff is entitled to recover the suit amount from the defendant as prayed for.

Accordingly, the point is answered.

9. In the result, suit is decreed with costs in favour of the plaintiff for

Rs.12,02,093/- (Rupees Twelve Lakhs Two Thousand and Ninety Three only) with subsequent interest @ 12% per annum from the date of filing of the suit till the date of decree and thereafter at 6% per annum from the date of decree till the date of realization.

The suit for recovery of Rs.12,02,093/- and for subsequent interest at the rate of 15% P.A., from the date of suit till the date of realization and for costs of the suit.

2.The case of plaintiff in brief :

The plaintiff humbly submits that they are doing whole sale Hosiery and Ready made cloth business under the name and style of Ravi Teja

Distributors, Chiral vide GSTIN: 37BMJPM8469D1ZK. 2nd defendant is the proprietor of 1st defendant’s firm and they have been doing Ready made dresses business under the name and style of 1st defendant/Sri Lakshmi

Prasanna Ready made Dresses, Kanigiri. On behalf of 1st defendant’s firm, 2nd defendant approached the plaintiff and opened a Khata with the plaintiff’s firm on 31-10-2022 used to purchase cloth on credit and used to make part payments. The defendants used to get the goods delivered through New Balaji Parcel Service Transport Kavali from time to time. The credit Invoices and the L.Rs issued by the New Balaji Parcel Service

Transport Kavali are filed herewith.

b) The defendants used to make part payments. As per the trade custom and mercantile practice and usage the defendants are liable to pay interest @ 15% per annum on the outstanding balance. The account copy of the defendants are filed herewith.

c) Subsequently, plaintiff several times personally demanded the defendants for repayment of the debt due under the above-referred Khata.

But the defendants are postponing the payment on some pretext or other.

d) Having no other option, plaintiff is constrained to file the suit against the defendants for recovery of the debt due under the Khata with subsequent interest and costs.

3. Summons on the Defendants served. The summons held sufficient, but Defendants No.1 and 2 did not appear before the Court and they are set exparte on 27.01.2026.

4. During the course of trial, plaintiff is examined as PW.1 and Ex.A1 to

A85 are marked. No oral or documentary evidence is adduced on defendant side.

5. Heard the counsel for the plaintiff.

6. Now the point for consideration is:

“Whether the plaintiff is entitled for the suit claim as prayed

for?

7. As noted above, the plaintiff is doing whole sale Hosiery and Ready

Made cloth business under the name and style of Ravi Teja Distributors,

Chirala. 2nd Defendant is the proprietor of 1st defendant’s firm and they have been doing ready made dresses business under the name and style of 1st defendant/Sri Lakshmi Prasanna Readymade Dresses, Kanigiri. On 4 PRL.CIVIL JUDGE (JD), CHIRALA, OS No.475/2025 Dt.24.04.2026 behalf of 1st defendant’s fir, 2nd defendant approached the plaintiff and opened a khata with their firm on 31.10.2022 used to purchase cloth on credit and used to make part payments. The defendants used to get the goods delivered through New Balaji Parcel Service Transport, Kavali from time to time.

The defendants used to make part payments. As per the trade custom and mercantile practice and usage the defendants are liable to pay interest at 15% per annum on the outstanding balance. In such a way as on 21.12.2025 the defendants are liable to pay a sum of Rs.12,02,093-00.

Subsequently, on several times the plaintiff personally demanded the defendants for repayment of the debt due under the above referred khata.

But, the defendants are postponing the payment on some pretext or other.

Having no other go, they are constrained to file the suit against the defendants for recovery of the debt due under the khata with subsequent interest and costs.

To prove the contention of the plaintiff, he himself examined as PW.1 by reiterating the contents of plaint and got marked Exs.A1 to A85.

Further, the oral evidence of PW.1 and documentary evidence under Ex.A1 to A85 it establishes that the 2nd defendant on behalf of 1st Defendant firm used to purchase cloth on credit from the plaintiff on credit and used to make part payments by opening khata at the plaintiff.

To disprove Ex.A1 to A85 and oral evidence of PW.1, the defendant did not appear before court and remained exparte. The oral and documentary evidence stands unrebutted and proved by PW.1. Hence, it is held that PW.1 is entitled for the suit claim and that PW.1 proved that the defendant purchased cloth on credit basis from the plaintiff under Ex.A1 to A85 and the defendant failed to repay the amount to him and that the plaintiff is entitled to recover the suit amount from the defendant as prayed for.

Accordingly, the point is answered.

9. In the result, suit is decreed with costs in favour of the plaintiff for

Rs.12,02,093/- (Rupees Twelve Lakhs Two Thousand and Ninety Three only) with subsequent interest @ 12% per annum from the date of filing of the suit till the date of decree and thereafter at 6% per annum from the date of decree till the date of realization.

01. This suit is filed for recovery of a sum of Rs.19,75,609/- for subsequent interest at 13.75% per annum with interest from the date of suit till the date of realization and for costs of the suit.

02.The brief averments of the plaint are that, the plaintiffBank submits that the defendants formed into a self-help group under the name and style of Ganesh Mahila Group, and the defendants 1 and 2 are the first and second leaders of the said

Ganesh Mahila Group. The defendants approached the plaintiff-bank for a term loan of RS.20,00,000-00 for the purpose of agriculture and allied activities. The loan was accordingly sanctioned to be availed and operated at its Chirala branch. The said defendants 1 and 2 executed a demand promissory note dated 09.08.2024 in favour of the plaintiff-bank for a sum of Rs.20,00,000-00 agreeing to repay the said sum with interest at the rate of 13.75% per annum with monthly rests. The defendants 1 and 2 also executed an arrangement letter, and articles of agreement for financing self-help group in favour of the plaintiff-bank on the same day itself. The defendants executed inter-se agreement to be executed by the members of the self-help group on 09.08.2024 in favour of the plaintiff-bank. The said

The defendants further agreed to repay the loan amount in 60 equated monthly installments at Rs.43,087-00 each commencing from September-2024. The defendants failed to pay the installments as agreed upon and committed default in payment of loan amount.

The plaintiff-bank requested the defendants to pay the amount outstanding but the defendants turned a deaf ear. The defendants as on 08.02.2026 became liable to pay a sum of Rs.19,75,609-00 as per the extract of the loan account of the defendant which is certified as true under Banker’s Books Evidence. As the defendants failed to repay the loan amount, the plaintiff-bank is constrained to file the suit for recovery of the amount with costs.

03.Suit summons on Defendants No.1 to 10 were not served on the defendants. Defendants No.1 to 10 called absent. Service held sufficient and hence the defendants No.1 to 10 are set exparte on 06.04.2026.

04. The plaintiff filed her proof affidavit, he himself examined as

05. Heard the learned counsel for the Plaintiff and perused the material available on record.

06. Now the point for consideration is:

Whether the plaintiff Bank is entitled for recovery of suit amount from the defendant, as prayed for?

07. Point:

It is the contention of the plaintiff that, the defendants formed into a self help group and the defendants 1 and 2 are the first and second leaders of the said Group, the defendant approached the plaintiff bank for a term loan of Rs.20,00,000/- for the purpose of agriculture and allied activities, the loan was accordingly sanctioned and in turn the defendants 1 and 2 executed a demand promissory note dated 09.08.2024 in favour of the plaintiff Bank for a sum of

08. To prove the contention of the plaintiff/Bank, one Ramakuri

Jaya Raju, who is the Assistant Manager of Plaintiff Bank, himself examined as PW1 by filing his chief examination affidavit, reiterating the contents of the plaint and he filed Ex.A1 to A7.

Ex.A1 is the Application dated 09.08.2024 to be submitted by SHG to link Branch while applying for loan assistance executed by the defendants 1 and 2 in favour of the Plaintiff Bank.

Ex.A2 is the Resolution, dated 09.08.2024 passed by Self Help

Group for taking loan from the Bank.

Ex.A3 is the Demand promissory note dated 09.08.2024 executed by the defendants 1 and 2 in favour of the plaintiff Bank for a sum of

Rs.20,00,000/-.

Ex.A4 is the articles of agreement dated 09.08.2024 for financing self help groups executed by the defendants 1 and 2 in favour of the plaintiff Bank.

Ex.A5 is the inter-se agreement, dated 09.08.2024 to be executed by the members of the Self Help Group executed by the defendants in favour of the plaintiff Bank.

Ex.A6 is the Arrangement letter executed by the defendants 1 and 2 in favour of the plaintiff Bank dated 09.08.2024.

09. As could be seen from the record, the Defendants No.1 and 2 approached the Bank and submitted Ex.A1 application for availing loan, in that regard Ex.A2 resolution passed by the Defendants

Group for taking loan from the Bank and then loan was accordingly sanctioned for an amount of Rs.20,00,000/- and then the Defendants

No.1 and 2 executed Ex.A3 Demand promissory note in favour of the

Bank on behalf of their self help Group, in turn all the group members that is Defendants executed an inter-se agreement in favour of plaintiff Bank under Ex.A5 and they arranged arragement letter in favour of the plaintiff Bank. Accordingly loan was sanctioned and the defendants No.1 to 10 failed to repay the same and as per Ex.A7 extract of the loan account of the defendants as on 08.02.2026, they are liable to pay Rs.19,75,609/- to the plaintiff

Bank.

As such, the oral testimony of PW.1 coupled with the documentary evidence Ex.A1 to A7 remains unchallenged. Since the defendants 1 to 10 remained exparte, this court is of the considered view that the oral testimony of PW.1 coupled with documentary evidence Ex.A1 to A7 clinchingly proved the plaintiff’s claim. Thus,

In the result, the suit is decreed with costs directing the defendants No.1 to 10 to pay the plaintiff, a sum of Rs.19,75,609/- jointly and severally with subsequent interest at the rate of 12% p.a., from the date of filing of the suit till the date of decree, and thereafter with future interest at the rate of 6% p.a., from the date of decree till the date of realization on the principal amount.

02. The brief averments of the plaint are that, the defendant approached the plaintiff-bank, for a term loan of Rs.1,00,000/- for the purpose of purchasing buffaloes and the loan was accordingly sanctioned to be availed and operated at its Chintagumpalli branch.

The defendant executed a demand promissory note for Rs.1,00,000/- in favour of the plaintiff-bank on 27.12.2022 agreeing to repay the said sum with interest at the rate of 8.55% at present with half- yearly rests above one year MCLR and strategic premium which is at present 8.55% with half yearly rests. The defendant executed composite hypothecation agreement for agriculture finance, on 27.12.2022 in favour of the plaintiff-bank for a sum of Rs.1,00,000/-.

The defendant executed Declaration cum undertaking cum authority and letter of installment with acceleration clause in favour of the plaintiff-bank. The defendant undertaken to repay the loan amount within 36 monthly installments of Rs.2777-00 each commencing from 10.01.2023 plus interest. The said documents filed here with and the recitals in the same may be read as part of the plaint.

b) The defendant committed default to pay the loan amount, and filed to repay the said amount as agreed upon. The plaintiff- bank through its officers, letters and notices demanded the defendant to repay the amount outstanding but the defendant turned a deaf ear. Inspite of best efforts made by the plaintiff-bank,

The first defendant as on 19.03.2025 became liable to pay a sum of

Rs.65,215-00 as per the extract of the loan account of the defendant which is certified as true under Banker’s Books Evidence. As the defendant failed to repay the amount, the plaintiff-bank is constrained to file the suit for passing of decree against defendant for the suit amount with costs.

03.Suit summons were served on the defendant and made his appearance through his counsel. Though made his appearance, but failed to file written statement. Hence, the defendant is set exparte on 12.02.2026.

04. The plaintiff Bank on his behalf examined one Karun Kumar

Karra by filing his proof affidavit, as PW.1 and got marked Exs.A1 to

A6.

05. Heard the learned counsel for the Plaintiff and perused the material available on record.

06. Now the point for consideration is:

Whether the plaintiff is entitled for recovery of suit amount from the defendant, as prayed for?

07. Point:

It is the contention of the plaintiff that, the defendant availed a term loan of Rs.1,00,000/- from the plaintiff Bank on 27.12.2022 that the defendant executed a demand promissory note composite hypothecation agreement for agriculture finance, for Rs.1,00,000/- in favour4 of the plaintiff Bank on that day itself agreeing to repay the said sum with interest at the rate of 8.55% at present with half yearly rests above one year MCLR and strategic premium which is at present 8.55% with half yearly rests and the defendant executed declaration clause in favour of the plaintiff Bank that the defendant undertaken to repay the loan amount within 36 monthly installments of Rs.2777/- each commencing from 10.01.2023 plus interest and the defendant committed default to pay the loan amount and failed to repay the said amount as agreed upon that the plaintiff Bank through its officers, letters and notices demanded the defendant to repay the amount outstanding but the defendant undertaken to repay the amount outstanding but the defendant turned a dear years and filed to repay the same.

08. To prove the contention of the plaintiff, he himself examined as

PW1 by filing his chief examination affidavit, reiterating the contents of the plaint and he filed Ex.A1 to A6. Ex.A1 is the Demand

Demand promissory note executed by the defendant for

Rs.1,00,000/- in favour of the Bank of Baroda, dated 27.12.2022.

Ex.A4 is the letter of installment with acceleration clause executed by the Defendant. Ex.A5 is the attestation memo of defendant and

Ex.A6 is the Extract of the loan account of the defendant.

As observed from the record, the defendant approached the plaintiff bank for term loan of Rs.1,00,000/-, the plaintiff Bank sanctioned the same and the defendant availed the said loan of

Rs.1,00,000/- and executed Ex.A1 Demand promissory note and

Ex.A2 composite Hypothecation agreement for agriculture finance.

Subsequently, the defendant failed to pay the said loan installments and committed default and thereby the defendant is liable to pay the remaining loan amount of Rs.65,125/- as per the extract of the loan account under Ex.A6.

As such, the oral testimony of PW.1 coupled with the documentary evidence Ex.A1 to A6 remains unchallenged. Since the defendant remained exparte, this court is of the considered view that the oral testimony of PW.1 coupled with documentary evidence

Ex.A1 to A6 clinchingly proved the plaintiff’s claim. Thus, the plaintiff is entitled for recovery of the suit amount from the defendant as prayed for. Accordingly, this point is answered in favour of plaintiff.

In the result, the suit is decreed with costs directing the defendant to pay the plaintiff, a sum of Rs.65,215/- with subsequent interest at the rate of 12% p.a., from the date of filing of the suit till the date of decree, and thereafter with future interest at the rate of 6% p.a., from the date of decree till the date of realization on the

principal amount.

This suit is presented before me for final hearing in the presence of Sri G. Ramesh Babu, learned counsel for the plaintiff and having stood over for consideration till this day, this court delivered the following:-

01. This suit is filed for recovery of Rs.1,18.253/- (Rs.70,000/- with interest Rs.48,253/-) being the principal and interest due on a plaintiff for Rs.70,000/- dated 20.06.2022 executed by defendant in

02. The brief averments of the plaint are that, the defendant personally approached the plaintiff and borrowed an amount of

Rs.70,000/- from the plaintiff on 20-06-2022 for his expenses, and agreeing to repay the same with interest @24% p.a. either to the plaintiff or her order on demand, and on the even date the defendant executed a promissory note in favour of the plaintiff for Rs.70,000/- at Rosaiah Colony, Vetapalem Mandal. The said Original Promissory

Note along with Xerox copy of the same is filed herewith as document Nos.1 & 2 and the contents of the same may be read as part of the plaint.

b) It is submitted that subsequently the plaintiff personally and through other demanded the defendant to pay the amount due under the said promissory note along with interest to her, but he did not choose to discharge the same will today, hence, the plaintiff is constrained to file the present suit against the defendant for recovery of amount due under the said Promissory note.

c) It is submitted that the defendant already agreed to pay the due amount with interest @24% P.A. as such, the plaintiff is also claiming interest at the same rate, hence the debt relief laws are not applicable to the suit debt.

03.Suit summons were not served on the defendant either by court or by post. Defendant called absent. No representation.

Hence, the defendant is set exparte on 01.04.2026.

04. The plaintiff filed her proof affidavit, he himself examined as

PW.1 and got marked Ex.A1 .

It is the contention of the plaintiff that, on 20.06.2022 the defendant borrowed an amount of Rs.70,000/- from the plaintiff, for his family expenses and the defendant executed the suit promissory note in favour of the plaintiff on the same day itself, agreeing to repay the same with interest at 24% p.a., either to the plaintiff or her order on demand. Subsequently, the defendant failed to repay the promissory note debt within stipulated period as promised by the defendant. Inspite of demands made by the plaintiff and through others, the defendant did not choose to repay the same till today.

Hence, the plaintiff is constrained to file the present suit.

08. To prove the contention of the plaintiff, she herself examined as PW1 by filing her chief examination affidavit, reiterating the contents of the plaint and she filed Ex.A1. Ex.A1 is the Original promissory note dated 20.06.2022 executed by the defendant in favour of the plaintiff.

As such, the oral testimony of PW.1 coupled with the documentary evidence Ex.A1 remains unchallenged. Since the defendant remained exparte, this court is of the considered view that

In the result, the suit is decreed with costs directing the defendant to pay the plaintiff, a sum of Rs.1,18,253/- with subsequent interest at the rate of 12% p.a., from the date of filing of the suit till the date of decree, and thereafter with future interest at the rate of 6% p.a., from the date of decree till the date of realization on the principal amount of Rs.70,000/-.
