This petition has come up before me for final hearing on 16­06­2021, in the presence of Sri M. Prabhakar, Advocate for the petitioner and Sri Mohazzam Mohammad, Advocate for the respondent and same having been stood over for consideration till this date, this Court delivers the following;

O R D E R

1)This petition is filed by the Petitioner/wife under Section 13 (1) (ia) (ib) of the Hindu Marriage Act, 1955 praying the Court to pass a decree of divorce in her favour by dissolving the marriage of the petitioner/wife and respondent/ husband that took place on 25­09­2015 on the grounds of cruelty and desertion.

2)The brief averments of the petitioner are that: the marriage of the petitioner with the respondent was performed on 25­09­2015 as per Hindu rites and caste customs at Machilipatnam, Krishna district in the presence of elders, friends and relatives and their marriage was a love marriage; and that they both had prior acquaintance when they joined one of the coaching institute at Avanigadda village in

Krishna district, and they both were employed as on the date of marriage; and that the petitioner joined the respondent at Komaravolu to lead marital life and the petitioner learnt that the respondent was habituated to vices such as drinking alcohol, womanizing, gaming etc., and that as the petitioner hails from a poor family she did not intimate to her parents, and she also learnt that respondent had got already married 2 prior to their marriage and thereby cheated the petitioner; and that though the petitioner lived with the respondent for about 6 months at Komaravolu, the respondent used to behave differently with the petitioner and further used to insist her to go to her parents place Gunadala by telling her that he would come there and live with her, and when the petitioner insisted to live with him at Komaravolu which is her in­laws place, he started abusing her in filthy language and used to beat her indiscriminately; and that the respondent further threaten her that he would treat her only as a servant maid and would not treat her as his wife if she lives with him at Komaravolu; and that the respondent did not provide basic meal and other provisions to her when she stayed at

Komaravolu, but despite the aversion of the respondent towards her, somehow made attempts to live with him; and that the petitioner thereupon raised a dispute through her parents and caste elders about the earlier marriage of the respondent; and that thereafter the petitioner and her parents came to know that the respondent married another woman and is living with her and he also begotten children through his first wife by keeping her at her parents place, and the petitioner tried to trace out the details of the woman but did not yield any result; and that after 8 months of residing at

Komaravolu the respondent somehow secured a job at Jaggayyapeta village in Krishna district and took the petitioner there and started living with her there, and the petitioner innocently believed the respondent and accompanied him; and that the respondent lived with the petitioner for about 6 months at Jaggayyapeta village and he later left the petitioner and went away to Komaravolu, and he used to come once in two months stating that his parents are not well and he is attending on them; and that the petitioner submits that what all the respondent told her are absolute lies and the respondent took shelter under the illness of his parents only to leave the petitioner and to part from her; and that finally the respondent completely deserted the petitioner during the month of

December 2017 and since then the petitioner started living at Komaravolu permanently; and that inspite of the repeated demands of the petitioner the respondent did not come 3 back and restore the conjugal relations with the petitioner; and that in view of the negligent behaviour of the respondent the petitioner filed DVC.304/2019 on the file of 1st Addl. Chief Metropolitan Magistrate Court, Vijayawada, inspite of filing of the said case the respondent did not take the petitioner to his conjugal fold; and that the respondent neglected the petitioner for morethan 2 years for no fault of her and also did not mend his ways; and subsequently to the filing of DVC the respondent has been contracting the petitioner over phone and demanded her to give divorce and that thereby the respondent never treated her as his wife and did not behave as a dutiful husband and subjected the petitioner physically, mentally and emotional torture and has neglected and refused to live with her and thereby cheated her. 

3) Counter affidavit is filed by the respondent stating that, the petition averments regarding the relation between the petitioner and respondent is true and correct; and subsequent to the receipt of the notices in this case, the matter was placed

before caste and marriage elders and the matter was settled and it was concluded that

the marital relation between both the parties cannot be continued any further, and the elders directed them to opt for dissolution of marriage; and further elders directed him to pay an amount of Rs.7,00,000­00 (Rupees Seven lakhs only) towards permanent alimony to the petitioner and the petitioner had also taken away all her articles from the respondent and thereby he has no objection to dissolve the marriage between them that was performed on 25­09­2015. 

4)Called through video conference. Petitioner present. Notice to respondent send and present. Respondent filed counter stating that he paid Rs.7,00,000­00 to the petitioner towards total settlement and reported no objection to allow this petition.

Petitioner filed her chief evidence affidavit as PW1 marked ExP1 and P2 through affidavit. Other side reported no objection. Petitioner side reported no further evidence.

Hence petitioner side evidence is closed. Heard, for passing divorce orders.

5)The unchallenged evidence of PW1, Ex.P.1 established the case of the petitioner. In the above circumstances petitioner is entitled for divorce as prayed for.

6)In the result, this petition is allowed by granting divorce to the petitioner/ wife from respondent/husband by dissolving the marriage, that took place on Dated:

25­09­2015 at Machilipatnam, Krishna District in between them on the grounds of cruelty and desertion.

This petition has come up before me for final hearing on 22­06­2021, in the presence of Sri K.Appala Naidu, Advocate for the petitioners and same having been stood over for consideration till this date, this court delivers the following;

O R D E R

1)The Petitioners 1 and 2 prays the Honourable Court to pass a decree of divorce by way of mutual consent in their favour by dissolving the marriage dt.25.08.2016 held between the petitioners. 

2)The brief averments of the petitioners are that: the 1st petitioner and the 2nd petitioner are the wife and husband and the marriage between them took place as per Hindu Rites and Caste Custom and usage and also in accordance with customs prevailing in the families of petitioners on 25.08.2016 at Sri Veera Venkata

Satyanarayana Swami Temple, Annavaram, East Godavari District. There were no exchanges of gifts etc., in between the families of the petitioners at the time of the marriage. After the marriage both the petitioners lead their marital life at parents house of the 2nd petitioner situated at Balighattam Village, Visakhapatnam. The marriage of the petitioners is consummated and both lived happily for about three years together and there were no issues to them during their wedlock. Subsequently during the month of September, 2019 differences arose in between the petitioners as 2 their attitude towards each other is changed abnormally and they started disliking each other. The petitioners started quarreling with each other and started abusing each other in filthy language. The petitioners behaved improperly with each other and they started suspecting the character of each other. The differences between the petitioners are reached to the extent that it made them impossible to live together and to lead conjugal life with each other. On that the 1st petitioner left the conjugal society of the 2nd petitioner on 17th day of November, 2019 and started living separately at her parents house situated at Kusarlapudi Village, Rolugunta Mandal,

Visakhapatnam District. 

3) Subsequently parents of the petitioners, their relatives, village elders, marriage elders and caste elders tried several times to resolve the differences between the petitioners by raising a dispute to above effect and also made efforts several times to make them to live together but all their efforts proved in vain. The differences between the petitioners came to the extent that there is no possibility for their reunion in future. On that both the petitioners decided to live their own separate individual life by taking divorce, as they came to the conclusion that their reunion is not possible and it is safe to take divorce. The petitioners expressed their above intention to the elders and family members of the petitioners. On that the elders advised the 2nd petitioner to give Rs.6,30,000­00 (Rupees Six lakhs thirty thousand only) towards full and final settlement cum permanent alimony to the 1st petitioner and the 2nd petitioner agreed to give the same and the 1st petitioner also agreed to receive the same. On that elders advised to give rs.4,30,000­00 (Rupees Four lakhs thirty thousand only) at the time of filing of present application and remaining

Rs.2,00,000/­ (Rupees Two lakhs only) at the time of sanction of the divorce by mutual consent by the Honourable Court and both the petitioners agreed for the above proposal of the elders. Accordingly the 2nd petitioner paid Rs.4,30,000­00 at the time of filing of present application and the 1st petitioner received the same accordingly.

Hence, the present petition for dissolution of their marriage by a decree of divorce by mutual consent. The petitioners not filed similar type of application before any other

Honourable Court having concurrent jurisdiction.

4)Today i.e. on 22­06­2021 both the petitioners are present and when this

Court ascertained them, they clearly stated that they do not want to live together and they required divorce only. Since both the petitioners have expressed the very same intention to go for divorce, it is a fit case to grant divorce by mutual consent.

5)On careful scrutiny of the contentions of both the petitioners and from their petition, it is quite evident that the grounds urged by both the Petitioners are clearly coming under the ambit of Section 13 B of Hindu Marriage Act, 1955.

Therefore this petition is liable to be allowed by granting divorce to both the petitioners on the ground of mutual consent. To substantiate their contention, the petitioners also filed and got marked Ex P1 and P2 viz., positive photograph and wedding invitation.

6)Called through Video Conference. Petitioners 1 and 2 present. Since the observation period of six months already over. PW1 and P.W.2 got filed their chief evidence affidavits and marked Ex.P.1 and P.2. Reported no further evidence. Hence, petitioners side evidence is closed. Heard. For passing mutual consent divorce.

7) In the result, this petition is allowed by granting divorce by dissolving the marriage that took place on Dt.25­08­2016 at Sri Veera Venkata

Satyanarayana Swami Temple, Annavaram, East Godavari District in between 1st petitioner/wife and 2nd petitioner/husband on the ground of mutual consent.

This is a petition filed by the petitioner/wife under Section 13(1) of the Hindu Marriage Act, 1955 to grant divorce in her favour by dissolving the marriage dated 01­07­2007 held between the petitioner/wife and respondent/ husband.

2) That the petitioner is the legally wedded wife of the respondent and their marriage took place on 01.07.2007 at Lingampeta Village, Nathavaram Mandal, Visakhapatnam District as per the Hindu caste custom land rites in the presence of the elders and relatives, later their marriage was solemnized. The petitioner submits that both the spouses adjusted and lived together for a short period of 4 years at the house of the respondent, during their wedlock the petitioner blessed one male child by name Devada

Harsha Vardhan on 26.08.2011, subsequently the respondent who is arrogant, and having no love and affection on the petitioner and and used to necked out from his house without any fault of the petitioner and used to live there at his parents house as per his will leading free life making new partners by ignoring the welfare of the petitioner, even her short stay of 4 years with the respondent, the respondent frequently visiting his relatives house and the petitioner who is innocent bared her silently, after dispute raised by the petitioner, the respondent visited the house of the parents of the petitioner and stayed with her for a little period of 15 days and again he went to his parents house, but he did not returned to the house of the petitioner parents for taking her for more than one year, then the petitioner about 2 years back raised a dispute before the elders and they chastised the respondent and advised him to take his society, the respondent acted as headed the words of the elders, the above mediation is held about 2 years back and it is the last occasion for the petitioner and the respondent lead the marital life. In fact the petitioner is looking fair and good as such she married the respondent, that even the village elders of the respondent was also severally chastised the respondent to take the petitioner and the respondent did not headed the words of the elders and demanding the petitioner to settle the properties in the name of the respondent. The petitioner submits that she and the elders rounded the village of the respondent for more than 5 occasions land not only the above elders and also other villagers of the respondent were also participated in the dispute raised by the petitioner and repeatedly asked the respondent to take the into his society, for which the respondent refused, the petitioner with a hope that the respondent will take her to his society continuously making efforts by making disputes but in vain. The petitioner submits that she is ready and willing to lead with the marital life with the respondent and even till today also the petitioner is having the love and affection on the respondent, and the respondent who have no love and affection on the petitioner and neglected the welfare of the petitioner. There is no collusion in between the petitioner and respondent, they have not filed any application seeking dissolution of the marriage previously before any court.

This is a petition filed by the petitioner/husband under Section 13(1) (ia) of the Hindu Marriage

Act, 1955 to grant divorce in her favour by dissolving the marriage dated 21­03­2019 held between the petitioner/wife and respondent/ husband.

2) That the marriage between the petitioner and respondent is solemnized on 21.03.2019 as per

Hindu caste custom and usage and also as per the customary practices existing in the families of petitioner and respondent at Rotary Club Kalyana Mandapam, Red Convent Street, Tuni Town, East Godavari

District. After the marriage the petitioner joined the respondent to lead conjugal life, since from the beginning of the marital life disputes arose between the petitioner and respondent, the respondent became very adamant against the petitioner and started ill treating the petitioner by objecting each and every moment of the petitioner, the respondent started quarreling with petitioner now and then though there is no any fault on the part of the petitioner, the respondent not cared about the petitioner, on that the petitioner also became adamant and the petitioner and respondent started quarreling with each other and also abusing each other in filthy language, the petitioner and respondent found that their ideologies and attitude towards each other are different and that is the reason for difference of opinion against each other, as a result, the petitioner and respondent started suspecting the conduct and character of each other and disliking each other, due to above attitude of the petitioner and respondent against each other there is no proper cohabitation in between them and as a result there were no issues to them, unbearable with the above attitude of the respondent, the petitioner left the conjugal society of the respondent and started living at her parents house. The petitioner have not filed similar type of application before any court.

Call work through Video Conference. Petitioner and respondent present. Respondent filed counter, stating that he has no objection to allow this petition. Accordingly, the petitioner filed chief evidence affidavit as PW1 and got marked Ex.P.1 and P.2. Reported no further evidence on both sides.
