J U D G M E N T

1.This is a suit filed by the plaintiff bank against the defendant for recovery of Rs.6,04,095/- (Rupees six lakhs four thousand and ninety five only) with subsequent interest @ 11.30 % per annum from the date of the suit till the date of realization and for costs of the suit.

2. The case of the plaintiff bank in nutshell as follows:

The plaintiff bank submits that the defendant approached the plaintiff bank and borrowed loan amount of Rs.5,00,000/- under Open Cash

Credit Loan Account No.211115140000003 under Prime Mudra Yojana

Scheme for doing Tiles business and executed all the relavent documents on 07-07-2023 at Arasavelli Branch, Srikakulam in favour of the plaintiff bank and that the defendant agreeing to repay the said loan amount with interest @ 11.30 % per annum (floating interest) and also executed other loan documents in favour of plaintiff bank. As per the loan account, the defendant paid few payments till 14-08-2024 and subsequently he committed default in the payment fo balance loan amount. The outstanding loan due amount as per the account statement of defendant is Rs.6,04,095/- as on 02-12-2025. As such, the plaintiff bank issued legal notice to the defendant on 21-01-2025 and the same was received by him and he kept quite. Hence, the suit.

3.Upon receipt of the summons, the defendant did not appear

before the court and he was set exparte as per the Docket Order, dated 11-02-

2026.

4.During the course of trial, the Branch Manager of Plaintiff bank himself stepped into witness box as PW-1 and exhibited Ex.A1:Loan application

dated 01-07-2023; Ex.A2:Sanctioned letter dated 07-07-2023; Ex.A3:Demand

promissory note executed by the defendant in favour of plaintiff bank dated 07-07-

2023; Ex.A4:True copy of loan account of defendant under Mudra Loan A/c

No.211115140000003, dated 02-12-2025; Ex.A5:Office copy of legal notice dated 21-01-2025 issued by plaintiff bank to the defendant; Ex.A6:Original postal receipts two in number dated 21-01-2025 and Ex.A7:Postal acknowledgment of the defendant two in number. The Testimony of PW-1 is very much available on record and the same are not reproducing to avoid repetition.

5.Heard arguments of the plaintiff.

6.Now the point germane for my determination is“Whether the plaintiff bank is entitled to recover suit amount from the defendant as prayed for?

7.POINT:-

PW-1 testified that the defendant approached the plaintiff bank and borrowed an amount of Rs.5,00,000/- on 07-07-2023 from plaintiff bank and on even date, the defendant executed Ex.A1 loan agreement and Ex.A3 promissory note and other relevant documents by agreeing to repay the same with interest @ 11.30 % per annum to the plaintiff bank. PW-1 also testified that, the defendant paid few installments till 22-05-2024 and thereafter the defendant committed default. Ex.A1 to A7 fortifies the evidence of PW-1. The

Testimony of PW.1 was remained un-challenged. Thus, from the unchallenged testimony of PW-1 coupled with Ex.A1 to A7, it is clear that having borrowed the amount from plaintiff bank and having executed Ex.A1 and A3, defendant did not choose to discharge the due amount. Hence the plaintiff bank is entitled to recover the suit amount from the defendant. The point is answered accordingly.

8.In the result, the suit is decreed with costs in favour of the plaintiff bank and against the defendant for recovery of an amount of Rs.6,04,095/- (Rupees six lakhs four thousand and ninety five only) along with subsequent

interest @ 11.3% per annum from the date of filing of the suit till the date of

Decree and there after @ 6% per annum from the date of Decree till the date of realization on the principal amount of Rs.5,00,000/- (Rupees five lakhs only).

1.This is a suit filed by the plaintiff against the defendant for recovery of Rs.1,71,066/- (Rupees One lakh seventy one thousand and sixty six only) with subsequent interest from the date of the suit till the date of realization and for costs of the suit.

2.The case of the plaintiff in nutshell as follows:

The plaintiff submits that the defendant approached the plaintiff and requested the plaintiff to arrange an amount of Rs.1,00,000/- to meet his urgent family needs and as per his request, the plaintiff lend the said amount of Rs.1,00,000/- to the defendant to meet his urgent family needs and the defendant executed a promissory note in favour of the plaintiff on 25.04.2021 and agreed to repay the same together with interest at the rate of 24% per annum to the plaintiff or any other person on his behalf and received the cash consideration in the presence of the witnesses, scribe at the plaintiff’s residence at Daravapuvenipeta village, Etcherla Mandal, Srikakulam District.

Subsequently, even after repeated demands made by the plaintiff and the defendant did not pay any amount to the plaintiff due under the promissory note but admitting his liability, but delaying to pay the promissory note amount on some pretext or other.

2(a). The plaintiff further submitted that finally when the plaintiff demanded the defendant to repay the due amount due on the suit promissory note, the defendant did not pay the said amount, the plaintiff got issued a registered legal notice, dated 22.03.2024 to the defendant demanding her to pay the due amount, the defendant received the same on 28.03.2024, but did not pay the due amount till to day. The plaintiff has no other way except to file this suit against the defendant. Hence, the suit.

3.Upon receipt of summons, the defendant having been called absent and remained exparte as per the docket order, dated 16.10.2024.

4.During the course of trial, the Plaintiff himself stepped into witness box as PW-1 and exhibited Ex.A-1 Original Promissory Note, dated 25.04.2021 for Rs.1,00,000/-, Ex.A.2 is the office copy of legal notice, dated 23.03.2024 and Ex.A.3 is online postal tracking receipt, dated 10.04.2024.

The Testimony of PW-1 is very much available on record and the same are not reproducing to avoid repetition.

5.Heard arguments of the plaintiff.

6.Now the point germane for my determination is“Whether the plaintiff is entitled to recover suit amount from the defendant as prayed for?

7.POINT:- PW-1 testified that the defendant borrowed an amount of

Rs.1,00,000/- on 25.04.2021 from PW.1 and on even date the defendant executed Ex.A.1 promissory note for Rs.1,00,000/- agreeing to repay the same with interest at 24% per annum to PW.1. PW-1 also testified that, despite his repeated demands, the defendant did not pay the amount. Ex.A.1 promissory note fortifies the evidence of PW-1. The Testimony of PW.1 was remained un-challenged. Thus, from the unchallenged testimony of PW-1 coupled with Ex.A.1 to Ex.A.3, it is clear that having borrowed the amount from PW-1 and having executed Ex.A-1 promissory note, the defendant did not choose to repay the amount in spite of repeated demand from the plaintiff.

Hence the plaintiff is entitled to recover the suit amount from the defendant.

The point is answered accordingly.

8.In the result, the suit is decreed with costs in favour of the plaintiff as against the defendant for recovery of an amount of Rs.1,71,066/- (Rupees

One lakh seventy one thousand and sixty six only) along with subsequent interest at the rate of 12% per annum from the date of filing of the suit till the date of Decree and at the rate of 6% per annum from the date of Decree till the date of realization on the principal amount of Rs.1,00,000/- (Rupees One lakh only).

The plaintiff submits that the defendant had borrowed an amount of Rs.2,50,000/- from the plaintiff on 09-10-2022 for the purpose of his family expenses and to clear his sundry debts and agreeing to repay the same with interest @ 24 % per annum to the plaintiff or to his Order on demand and with those conditions the defendant executed a promissory note in favour of the plaintiff on 09-10-2022 before the scribe and attestors of the promissory note on the same day itself and the defendant admitting his liability.

The plaintiff further submits that subsequent to the pronote, the plaintiff demanded the defendant to repay the amount due under pronote personally and through elders several times, but the defendant having admitted his liability, postpone the payment of amount due under the pronote from time to time. The defendant did not choose to re-pay anything so far on some pretext or other for the reasons best known to him. Finally the plaintiff got issued legal notice on 25-08-2025 to the defendant and the same was returned as refused by the defendant on 29-08-2025. Hence, the suit.

3.Upon receipt of the summons, the defendant did not appear

before the court and he was set exparte as per the Docket Order, dated 29-01-

before me in the presence of Sri Javana Srinivasarao, Advocate for

plaintiff; and Defendant have been called absent and remained set exparte on 05-03-2026; and having stood over till this day for consideration, this Court delivered the following:

J U D G M E N T

1.This is a suit filed by the plaintiff against the defendant for recovery of Rs.13,42,000/- (Rupees thirteen lakhs and fourty two thousand only) with subsequent interest @ 24 % per annum from the date of the suit till the date of realization and for costs of the suit.

2. The case of the plaintiff in nutshell as follows:

The plaintiff submits that the defendant borrowed an amount of

Rs.10,00,000/- from the plaintiff on 05-10-2023 for the purpose of his family expenses and for the purpose of business and agreeing to repay the same with interest @ 24 % per annum to the plaintiff or to his Order on demand and with those conditions the defendant executed a promissory note in favour of the plaintiff on 05-10-2023 before the scribe and attestors of the promissory note on the same day itself and the defendant admitting his liability.

The plaintiff further submits that subsequent to the pronote, need of money, the plaintiff demanded the defendant to repay the amount due under pronote personally and through elders several times, but the defendant having admitted his liability, postpone the payment of amount due under the pronote from time to time. The defendant did not choose to re-pay anything so far on some pretext or other for the reasons best known to him. Hence, the suit.

4.During the course of trial, the Plaintiff himself stepped into witness box as PW-1 and exhibited marked Ex.A1/Original Promissory Note

dated 05-10-2023 for Rs.10,00,000/- and he also examined 1st attestor of

Ex.A1 promissory note as PW-2 to support his contention. The Testimony of

PWs 1 and 2 are very much available on record and the same are not reproducing to avoid repetition.

5.Heard arguments of the plaintiff.

6.Now the point germane for my determination is“Whether the plaintiff is entitled to recover suit amount from the defendant as prayed for?

7.POINT:-

PW-1 testified that the defendant borrowed an amount of

Rs.10,00,000/- on 05-10-2023 from PW.1 and on even date the defendant executed Ex.A1 promissory note agreeing to repay the same with interest @ 24 % per annum to PW.1. PW-1 also testified that, despite of his repeated demands to repay the amount due under pronote personally and through elders several times, but the defendant having admitted his liability postpone the payment of amount due under the pronote. Ex.A1 fortifies the evidence of

PW-1. One of the attestors was examined as PW-2 and corroborated with the evidence of PW-1. The Testimony of PWs 1 and 2 remained un-challenged.

Thus, from the unchallenged testimony of PWs 1 and 2 coupled with Ex.A1, it is clear that having borrowed the amount from PW-1 and having executed

Ex.A1 promissory note, defendant did not choose to discharge the due amount. Hence the plaintiff is entitled to recover the suit amount from the defendant. The point is answered accordingly.

8.In the result, the suit is decreed with costs in favour of the plaintiff and against the defendant for recovery of an amount of Rs.13,42,000/- (Rupees thirteen lakhs and fourty two thousand only) along with subsequent interest @ 12% per annum from the date of filing of the suit till the date of

Decree and there after @ 6% per annum from the date of Decree till the date of realization on the principal amount of Rs.10,00,000/- (Rupees ten lakhs only).
