This calendar case is coming on this day before me for final hearing on 17.12.2024 in the presence of Sri.O.Mahalakshmi, Assistant Public Prosecutor for Complainant/State and of Sri.N.William Carey Assistant LADC for accused, upon hearing both sides, upon perusing the entire material on record and having stood over for consideration to this day, this court delivered the following:
:: J U D G M E N T ::
The State represented by the Sub-Inspector of Police of Bommuru PS filed charge sheet against accused in crime No.311/2023 for the offence punishable U/Sec.454, 380 or 411 of Indian Penal Code, 1860.
2. The case of the prosecution as follows:
On 22.09.2023 at 5.00 PM, the complainant along with his wife went to Siddaradha Hospital, Devichowk, Rajamahendravaram for medical checkup of his children. On the same day, at about 8.30 PM, they returned back to home and noticed that main door locks were broke open and some unknown offenders committed theft of 1) Gold black beads chain-1, 2) Gold chain-1, 3) Gold bangles-2, 4) Small Gold bangles-4, 5)Gold rings-2, 6) Gold rings small-2, 7) Gold ear studs-2 pairs, 8) Gold Anjaneya Swamy Billa – 1, 9) Silver plate-1, 10) silver chembu-1, 11) Small Sai baba & lakshmi Devi statues -2, 12) Silver kumkuma Barini-1, 13) Panchapatra & spoon-1, 14) Deeparadhana
Kundhus-2, 15) Kundhus and plates small-2, 16) Turmeric and Kunkuma 2 CC.No.1671/2024 VI AJFCM/RJY. patra-1. All the gold ornaments are weighing about fifteen sovereign. All silver items are weighing about 2 kgs and all worth of about
Rs.3,30,000/-. Later, the complainant searched for missing items and gave a report on 25-09-2023 at 8-00 PM for taking necessary action.
2a.Basing on the written report of PW1, on 25.09.2023 at 8.00
PM, PW6 registered as a case in Cr. No. 311/2023 U/Sec. 454, 380 IPC of
Bommuru PS and investigation into.
2b.During the course of investigation, the Investigation Officer visited the scene of offence, observed the same in the presence of scene observation mediators and drafted scene observation report. Also drawn the rough sketch of the scene of offence and secured prosecution witnesses and examined them and recorded their detailed 161(3) Cr.P.C statements in his part-II CD.
2c.During the course of investigation, on 08-07-2024, the
Inspector of Police, Bommuru PS received a credible information about the probable offender in this case and then secured mediators and rushed to opposite to G.P.R. Lay-out, Bommuru Village,
Rajamahendravram Rural Mandal, at about 11-00 AM and caught hold the accused person i.e., Kondeti sai and interrogated him in the presence of mediators and recorded his confessional statements.
2d.On interrogating about stolen items, then he confessed that he kept the same under a roof at his house. On such, they all proceeded to the accused house at Konthamuru village and seized 1) Gold black beads garland-1, weight-15.840 grams, 2) Gold chain-1, weight-15.00 grams, 3) Gold ear studs -2 Pairs (Plain Diddhs, Stone Diddhs), Weight- 5.500 Grams, 4) Gold Rings -3 (Ganapati, Lord Venkateswara Swamy,
Lakshmi Devi Ammavaru), Weight-14.300 Grams Items and 1) Silver
Plate -1, Weight-59.00 Grams, 2) Silver Bowl-1, Weight-137.00 Grams, 3)
Silver Saibaba Doll-1, Weight-24.00 Grams 4) Silver Lakshmi Devi Doll-1, 3 CC.No.1671/2024 VI AJFCM/RJY. Weight-15.00 Grams, 5) Silver Peacock Saffron Barina-1, Weight-87.00
Grams, 6) Silver Small Panchapatra-1, weight-24.00 gms, 7) silver lampshades-2, weight-41.00 gms, 8) silver four-bowl bunch of turmeric, saffron and axintala-1, weight-46.00 gms under cover of mediator reports.
2e.Considering the motorcycle bearing AP 31 DU 0134 as the crime vehicle used by the criminal to commit crimes in this case, the inspector allowed the seizure of the criminal at the time of arrest and asked their staff to take it along with them to recover the property.
2f.In pursuance of confession made by the accused, the
Inspector of Police, Bommuru PS weighed the stolen gold and silver items with the assistance of Gold Appraiser by name Kola Vijaya
Bhaskar.
2g.As per the evidence of prosecution witnesses, the accused is responsible for the offences U/S. 454, 380 or 411 IPC and he may be dealt with according to law. Hence, the Charge sheet.
3.The case was taken cognizance against accused for the offences U/Sec.454, 380 or 411 of Indian Penal Code, 1860.
4. After the appearance of accused, copies of documents were furnished to accused u/s. 207 of Criminal Procedure Code, 1973.
5. The accused was examined U/S. 239 Criminal Procedure
Code 1973. The charge for the offences U/Sec.454, 380 or 411 of Indian
Penal Code, 1860, were read over and explained in Telugu to accused.
For which he denied and pleaded not guilty. Hence the charge
U/Sec.454, 380 or 411 of Indian Penal Code, 1860 is framed against accused. The case is posted for trial.
6.During the course of the trial, the prosecution examined
PW1 to PW7 and Exs.P1 to P6 and MO1 to MO13 were got marked. The learned APP given up the evidence of LW2 Chinnapuvvula Sudha 4 CC.No.1671/2024 VI AJFCM/RJY. Madhavi, LW3 Yandamuri Ravi Teja, LW4 Narukula Eswari, LW5 Gorrela
Premalatha, LW6 Rajulapudi Adinarayana, LW9 Dodda Madhubabu, LW10
Gunapatii Murali Krishna and LW11 Kunjam Srinivasa Rao Dora.
7.After the closer of the Prosecution evidence, the accused was examined U/s.313 Criminal Procedure Code 1973. The accused denied the incriminating evidence and reported no defence of evidence.
8.Heard the arguments of the Learned Assistant Public
Prosecutor and the counsel for the accused.
9.Now the point for determination is
“Whether the prosecution proved the guilt of Accused
beyond all reasonable doubt for the offences U/Sec.454,
380 or 411 of Indian Penal Code, 1860 or not”?
10. P O I N T:
To prove the prosecution's case, the prosecution examined PW1 to
PW7 and Exs.P1 to P6 and MO1 to MO13 were marked. PW1 is the complainant. PW2 is the mediator who present at the time of arrest of accused and seizure of case properties under cover of mediator reports.
PW3 is the Gold Appraiser. PW4 is the mediator who present at the time of scene observation report. PW5 is the Investigation officer who arrested and seized case properties under cover of mediator reports.
PW6 and PW7 are Investigation Officers.
11.To prove the offence u/Sec.380 of Indian Penal Code, 1860, the prosecution has to establish that the accused herein taken away gold and silver articles from the house of the complainant without his consent.
12.To prove the offence U/Sec.454 of Indian Penal Code, 1860, the prosecution has to establish that the accused herein criminally trespassed into the complainant’s house and committed theft of gold and silver articles.
13.In order to prove the offence U/s.411 of Indian Penal Code, 5 CC.No.1671/2024 VI AJFCM/RJY. the prosecution has to establish that accused have dishonestly received or retained the stolen properties, having reason to believe the same to be the stolen properties.
14.As per the contents of Ex.P1 report, on 22.09.2023, during evening hours, the complainant along with his wife and daughter went to Sidhartha Children Hospital near Devichowk by locking his house. At about 7.30 PM, they return back and noticed the main doors were open and gold and silver articles were committed theft. Therefore he gave
Ex.P1 report.
15.PW1 who is the complainant has deposed that, on 22.09.2023 during evening hours, he along with his wife and his daughter went to Siddhardha Children Hospital, Near Devichowk by locking their house. At about 7.30 PM, they returned back and noticed their doors were broke open and some unknown offenders committed theft of silver Kumkuma Bharani, Ashtalakshmi Chembu, silver Bowl,
Harathi Plate, two pairs of Silver Kundulu along with Plates, Theertham
Glass and Spoon, two silver Plates, Silver Saibaba, Sri Krishna and
Lakshmi devi idols. He also noticed gold black bead chain, four rings, two pairs of bangles of his wife, two pairs of bangles of his daughter, his daughter’s chain and locket, four pairs of gold ear rings of his wife and his wife’s bracelet were committed theft. Therefore, he gave Ex.P1 report.
16.PW6 who is the Investigation Officer also deposed that, on 25.09.2023 he received a written report from PW1. Based on the report, he registered the same as in Cr.No.311/2023 U/s 454 & 380 of IPC and issued Ex.P6 FIR. Later PW7 took up investigation. During the course of the investigation, he examined PW1 and recorded his statements. Later, he proceeded to the scene of offence, observed the same and prepared
Ex.P7 rough sketch. At the scene of offence, he examined PW1, LW2 6 CC.No.1671/2024 VI AJFCM/RJY. C.Sudha Madhavi, LW3 Y.Ravi Teja, LW4 N.Eswari, LW5 G.Prema Latha and LW6 R.Adinarayana and recorded their statements.
17.The prosecution’s specific case is that the accused herein committed theft of gold and silver articles from the possession of PW1 without his consent. The learned APP contended that all the prosecution witnesses supported the prosecution’s case and their evidence corroborate each other. The prosecution established the guilt against the accused for the alleged offences. Hence, prays the court to convict the accused.
18.On the other hand, the learned counsel for the accused filed written arguments and submitted that the prosecution failed to prove the ownership of case properties. The mediators are stock mediators.
The investigation officer did not secure local witnesses and he did not issue any notice to the neighbors at Kubera Apartments and he did not prepare a separate list of seized properties. Further the investigation officer did not obtain the signatures of mediators in form-60 which is necessary under Order 444 of A.P.Manual
19. In the present case, the evidence of PW1 is not corroborated by any independent witnesses. No direct witnesses witnessed the alleged theft of gold and silver articles. Further, from the contents of Ex.P1 report, it clearly shows that PW1 gave complaint with an allegation that some unknown offenders committed theft of gold and silver articles. The evidence of PW6 is not corroborated by any independent witnesses. There is no sufficient material placed by the prosecution to establish that accused here in criminally trespassed into the complainant’s house and committed theft of gold and silver articles from his house.
20.Further, the prosecution’s case is that on 08.07.2024 the
Inspector of Police, Bommuru Police Station got credible information and 7 CC.No.1671/2024 VI AJFCM/RJY.
21.PW2 has deposed that on 07.07.2024, at about 10.00 AM, at the request of Bommuru Police, he and another VRO acted as mediators and they proceeded towards GPR layout Bommuru and noticed a person with Passion motorcycle. By observing them he tried to escape from the place. On interrogating he revealed his identity as his name is Kondeti
Sai and confessed that he committed theft of gold and silver ornaments.
On such confession, they proceeded towards the accused house at
Konthamuru village and police seized gold, silver and cash under cover of mediator reports.
22.PW5 has deposed that during the course of investigation, on 08.07.2024, at about 10.30 AM, he got credible information and he secured mediators and proceeded towards GPR layout and found a person under a suspicion circumstances. Then he caught hold that person and interrogated. On interrogating he revealed his name as
Kondeti Sai and confessed the alleged offence. On such confession he arrested accused under the cover of mediator report dt. 08.08.2024 at about 11.00 AM.
23.Further, based on the confession of accused, they again all proceeded towards the accused house at Konthamuru village and seized

DU 0314 under the cover of mediator report dt. 08.08.2024 at about 3.00 PM.
24.The evidence of the mediator is corroborated with evidence of Inspector of Police. From the consisting evidence of the mediator and the Inspector of Police it clearly established that the Inspector of Police,
Bommuru Police station seized M.O.1 to M.O.13 from possession of accused under the cover of mediator reports.
25.Further,the learned counsel for the accused took objection regarding the date mentioned on the mediator report drafted at 11.00 am. During the cross examination, the Inspector of Police, Bommuru P.S categorically deposed that by mistakenly the date of mediator report was mentioned as 07.07.2024 instead of 08.07.2024. It is a purely typographical mistake. Further, mere not obtaining the signatures of mediators on form-60 is also not sufficient to disprove the entire prosecution’s case. Therefore, objections raised by the accused counsel are not maintainable.
26.In the light of above discussion this court holds that the prosecution established the guilt against accused for the offence
U/Sec.411 of Indian Penal Code, 1860. The prosecution failed to establish the guilt against the accused for the offence u/sec.454 and 380 of Indian Penal Code, 1860.
27.In the result, accused found guilty for the offence punishable U/s.411 of Indian Penal Code 1860. Accordingly he is convicted U/Sec.248(2) of Criminal Procedure Code, 1973 for the said offence. Accused found not guilty for the offence punishable U/sec.454 9 CC.No.1671/2024 VI AJFCM/RJY. and 380 of Indian Penal Code 1860. Accordingly he is acquitted
U/s.248(1) of Criminal Procedure Code, 1973.

Before awarding sentence, accused are questioned with regard to
the quantum of sentence that can be imposed against them for offence
U/s.411 of Indian Penal Code 1860. Accused stated that he has been in
Jail for eight months and prays the court to set off the remand period.
He has widow mother and he has to look after her.
In the present case, accused retained the stolen valuable properties i.e., Gold, Silver and cash. Therefore, this Court is not inclined to invoke benevolent provision provided under Prohibition of Offender
Act,1958. On considering the facts and circumstance of the case and also considering the mitigating circumstances put forth by accused, to meets ends of justice the accused is sentenced to undergo rigorous imprisonment for a period of one year for the offence U/s.411 of Indian
Penal Code 1860.
The remand period of the accused i.e., from 23.07.2024 to till date, shall be set off U/s.428 of Criminal Procedure Code 1973. The case properties i.e., MO1 Gold black beads garland-1, weight 15.840 grams.

The case property i.e., MO13 – Hero Honda Passion Pro motorcycle bearing No AP 31 DU 0314 shall be sold in public auction and remit the sale consideration to the state after the expiry of the appeal time. The punishment in the present case and in other cases i.e., CC. No.
1670/2024, CC.No. 1672/2024, CC.No. 2538/2024 and CC.No.2595/2024 shall run concurrently.
