This suit came up on this day before me for final hearing in the presence Sri P. Babu Rao, learned Advocate for the plaintiff and the defendant ha ving been called absent set exparte as per the order dated 07.12.2020 and upon hearing the counsel for the plaintiff having stood over for consideration, this Court delivered the following:

J U D G M E N T

1.This suit is instituted by the plaintiff against the defendant seeking the relief of recovery of a sum of Rs.1,36,000/-- (Rupees One Lakh Thirty Six

Thousand only) being the principal and interest due under the Suit promissory note dated 30-07-2017 executed by the defendants for Rs.1,00,000/- (Rupees

One Lakh only) in favour of plaintiff along with subsequent interest thereon and for costs.

2.The pith and marrow of the plaint is that:

The defendants No.1 & 2 are originally borrowed an amount of

Rs.1,00,000/- from the plaintiff, on dt: 30-07-2017 for the purpose of clear off the debts, agreeing to repay the same together with interest at 12% per annum on demand either to the plaintiff or to his order and executed the suit promissory note in favour of the plaintiff on the same day, after receiving the 2 cash consideration there under in the presence of attestors and the scribe.

But the defendants have borrowed the aforesaid amount to clear their debts.

Subsequent to the execution of the suit Promissory note, both the defendants have not paid any amount either towards the principal or interest accrued thereon. The plaintiff demanded both the defendants to discharge the entire debt due under the suit promissory note, dt:30-07-2017 in person and through elders on many time. But the defendants admitting their liability, have been postponing the payment on one pretext or the other. Finally the plaintiff got issued a registered legal notice,dated on 14-10-2019 through his advocate, calling upon both the defendants to pay the amount due under the suit promissory note together with interest. Both the defendants have received the said registered legal notices and kept quiet.

3. Though summons properly addressed to the defendants, but they refused to receive through the court so also through registered post. As such, the defendants are set ex-parte as per the order dated 07.12.2020.

4.In substantiation of the contention of the plaintiff, he is examined himself as P.W.1 and exhibited Ext.A.1 to A4.

5. Heard the counsel for the plaintiff.

6.Now the points for determination are:

1. Whether the plaintiff is entitled for the suit amount?

2. To what relief?

7. Point No.1:-

(i) In substantiation of the contention of the plaintiff, he deposed through his chief evidence affidavit, which is the replica of the plaint, as such, there is no need to reiterate the contents of the same for the sake of brevity and in order to avoid repetition. As the testimony of the P.W.1 as regards to passing of the consideration and execution of Ext.A.1, As the testimony of the P.W.1 as 3 regards to passing of the consideration and execution of Ext.A.1 is remained unchallenged and as there is no iota of evidence leaving a room to doubt the genuineness of the Ext.A.1, A2 to A4 are remained unchallenged and as there is no iota of evidence leaving a room to doubt the genuineness of the above said documents. The suit is filed with in limitation. The plaintiff by examining himself and by exhibiting A1 to A4 proved that defendants borrowed amount from plaintiff and failed to repay the suit amount. the irresistible conclusion that can be arrived is that the plaintiff is entitled for the suit amount. This point is answered accordingly in favour of the plaintiff.

Point No.1 is answered accordingly in favour of the plaintiff.

8. Point No.2:-

In view of the finding under Point, No.1, the plaintiff is entitled for the decree in his favour. This point is answered accordingly.

In the result the suit is decreed with costs for the suit amount of

Rs.1,36,000 /-(Rupees One Lakh, Thirty Six Thousand only) and subsequent interest at the rate of 12% per annum from the date of institution of the suit to till the date of decree and thereafter at the rate of 6% per annum till the realization on the principal sum of Rs.,1,00,000/- (Rupees One Lakh only ).

J U D G M E N T

1.This suit is instituted by the plaintiff against the defendant seeking the relief of recovery of a sum of Rs.1,23,240/-- (Rupees One Lakh Twenty Three

Thousand and Two Forty only) being the principal and interest due under the

Demand promissory note dated 30-10-2015 executed by the defendant for

Rs. 1,30,000/- (Rupees One Lakh Thirty Thousand only) in favour of plaintiff along with subsequent interest thereon and for costs.

2.The pith and marrow of the plaint is that:

The defendant originally borrowed an amount of Rs.1,30,000/- from the plaintiff by on submitting a loan application on dt: 30-10-2015 under Scheme

Sector-SME i.e., for doing Tailoring and Material Business to the plaintiff

Bank which was sanctioned by the plaintiff on dt: 30-10-2015 as per the

Sanction Letter with Terms and Conditions and the plaintiff bank disbursed the said loan amount to the said defendant under an account maintained in his name bearing No.566873410000069. The said loan amount is to be paid in 60 2 (Sixty) monthly installments commencing from 30-11-2015 along with interest and at present, the stipulated rate of interest is 10.70% per annum with monthly rests residing and falling from time to time.

2(i)The defendant secured the said debt amount, by executing DEMAND

PROMISSORY NOTE on dated 30-10-2015 for an amount of Rs.1,30,000/- and the defendant further executed the necessary documents in favour of the plaintiff bank on dt:30-10-2015 namely, Bearer Letter, Installment , Letter,

Declaration, Composite Agreement and Hypothecation-cum-Loan Agreement.

2(ii)The Plaintiff Bank several times demanded the Defendant to repay the said Debt with up to date stipulated rate of interest, but to no affect as such, the plaintiff filed for suit.

3. Though summons served to the defendant personally to made his appearance neither he appeared in person nor through any advocate by filing vakalat, in spite of ample opportunity provided to him, Hence, defendant is set ex-parte as per the order dated 04.12.2020.

4.In substantiation of the contention of the plaintiff, he is examined himself as P.W.1 and exhibited Ext.A.1 to A10

5. Heard the counsel for the plaintiff.

6.Now the points for determination are:

1. Whether the plaintiff is entitled for the suit amount?

2. To what relief?

7. Point No.1:-

The suit is filed with in limitation. The plaintiff by examining himself and by exhibiting A1 to A10 proved that defendant borrowed amount from plaintiff bank and failed to repay the suit amount. The irresistible conclusion that can be arrived is that the plaintiff is entitled for the suit amount from the defendant as defendant failed to repay the suit amount.

Point No.1 is answered accordingly in favour of the plaintiff.

8. Point No.2:-

In view of the finding under Point, No.1, the plaintiff is entitled for the decree in his favour. This point is answered accordingly.

In the result the suit is decreed with costs for the suit amount of

Rs.1,23,240/-(Rupees One Lakh, Twenty Three Thousand Two Hundred and

Forty only) and subsequent interest at the rate of 10.40% per annum from the date of institution of the suit to till the date of decree and thereafter at the rate of 6% per annum till the realization on the principal sum of Rs.,1,30,000/- (Rupees One Lakh Thirty Thousand only ).

1.This suit is instituted by the plaintiff against the defendant seeking the relief of recovery of a sum of Rs.43,462-50 (Rupees Forty Three Thousand Four

Hundred Sixty Two and Fifty Paise only) being the principal and interest due under the Suit promissory note dated 20-03-2017 executed by the defendants for Rs.30,000/- (Rupees Thirty Thousand only) in favour of plaintiff along with subsequent interest thereon and for costs.

2.The pith and marrow of the plaint is that:

The defendant is originally borrowed an amount of Rs.30,000/- from the plaintiff, on dt: 20-03-2017for the purpose of business, agreeing to repay the same together with interest at 15% per annum and executed the suit promissory note in favour of the plaintiff on the same day in the presence of the attestors and scribe at the residence of the plaintiff. Therefore, in spite of repeated demands made by the plaintiff personally and through mediators, the defendant is willfully and intentionally evading to repay the amount together 2 with interest to the plaintiff on some pretext or repay the amount together with interest to the plaintiff on some pretext or other while admitting his liability.

Thus, the defendant is liable to pay the entire amount to the plaintiff due under the suit promissory note together interest and costs. Hence this suit is filed and the suit is within time.

3. Though summons served through court. But defendant absent. No representation. Hence, defendant is set ex-parte as per the order dated 14.12.2020.

4.In substantiation of the contention of the plaintiff, he is examined himself as P.W.1 and exhibited Ext.A.1.

5. Heard the counsel for the plaintiff.

6.Now the points for determination are:

1. Whether the plaintiff is entitled for the suit amount?

2. To what relief?

Point No.1 is answered accordingly in favour of the plaintiff.
