This court is of the view that accused cannot be given benefit of either 360 Cr.P.C. or the provisions of probation of offenders Act and this court intends to impose punishment on accused. The facts and the circumstances of the case and in view of the representation by accused this court inclined to lessen the sentence considering the age of accused and facts and circumstances of the case, this court intend to take lenient view with regard to the quantum of sentence. Hence, accused is sentenced to undergo Simple imprisonment for a period of eight months for the offence punishable U/s 411 IPC. As per the record, the detention undergone by the accused from 09.10.2018 to till date shall be set off U/s 428 Cr.P.C. accused is also informed about his right of appeal on this Judgment and also informed about the right to free legal aid to prefer appeal.
