The prosecution was conducted by the Special Public

Prosecutor and the accused was defended by Sri M.L.Sreenivasa

Reddy, Advocate.

The case was committed by the learned Judicial Magistrate of

First Class, Atmakur, in P.R.C.No.34/2012 and the same was

taken on file as SC/ST SC No.44/2014.

2 This case coming on 5­1­2015 for final hearing before me and having stood over for consideration till this day, this court delivered the following:­

J U D G M E N T

The State represented by the Sub­Divisional Police

Officer, Atmakur, laid charge­sheet against the accused in Crime

No.51 of 2012 of Atmakur Police Station for the offences punishable under sections 341, 354 IPC and Section 3(1)(xi) of the

SCs & STs (PoA) Act.

2.The case of the prosecution in brief is that the defacto­ complainant , Kalla Lakshmi Devi, belongs to Madiga of Scheduled

Caste and she worked as computer operator in Nagara Panchyat

Office, Atmakur on contract basis till 31­3­2012. She was surrendered to the District Panchayat Office by the senior officers when the Atmakur panchayat became Municipaliy from Nagara

Panchayat. The accused is a Branch Post Master and also a

Reporter in Andhra Bhoomi newspaper. On 4­4­2012 at about 10­ 15 Hours, while the defacto­complainant was proceeding to the office, she was wrongfully restrained by the accused on the road and he demanded the complainant, by discarding her husband if she cooperates to him to fulfill his desire, he would recommend and manage to get back her job. He tried to catch her and pulled her bag. The accused abused her touching the caste saying “Yemi

Chesukuntaave Madiga Lanja Daana”. She could escape from the clutches of the accused and informed the incident to her uncle, 3 husband and family members. Since three months prior to the date of the present incident also, the accused had been torturing her to fulfill his desire and propagated that she is his concubine.

On the same day at about 8­30 p.m, she presented a written report to the police, basing on which the Sub Inspector of Police registered a crime against the accused, sent the copies of First Information

Report to the concerned authorities. As per the proceedings of the

Superintendent of Police, Kurnool, PW.6 took up investigation.

During the course of investigation, he visited the scene of offence, drawn the rough sketch of the scene, recorded the statements of witnesses, arrested the accused and collected the caste certificates of the complainant and accused. After completion of investigation, filed charge­sheet against the accused.

3.The case was taken on file by the learned Judicial

Magistrate of First Class, Atmakur, for the offences punishable

under sections 341, 354 IPC and section 3(1)(xi) of the SCs & STs (PoA) Act.

4.On appearance of the accused before the learned

Magistrate, copies of documents relied upon by the prosecution

were served on him under section 207 of Cr.P.C. As the offences under section 3 (1) (xi) of SCs & STs (PoA) Act is exclusively triable by the Special Judge for trial of cases under SCs & STs (PoA) Act, this case was committed to this court vide P.R.C.No.34 of 2012 under section 209 (a) of Cr.P.C and numbered as SC/ST SC No.44 of 2014.

5.On appearance of the accused before this court and after hearing, on consideration, charges under sections 341, 354

IPC and sections 3(1)(xi), 3(1)(x) of the SCs & STs (PoA) Act, framed.

The charges were read over and explained to him in Telugu. The accused abjured his guilt and claimed to be tried.

6.In order to substantiate the case of the prosecution, the prosecution examined PWs.1 to 6 as witnesses and got marked

EXs.P1 to P7. EXs.D1 and D2 were marked on behalf of the defence.

PW.1 is the defacto­complainant who presented written report under Ex.P1. PW.2 is the husband of the complainant.

PW.2 is the maternal uncle of the complainant who was informed about the incident by PW.1 immediately after the occurrence. PW.4 is the Tahsildar who issued the caste certificate of PW.1 and the accused. PW.5 is the Sub Inspector of Police who registered the crime under Ex.P5. PW.6 was authorized to take up investigation under ex.P6 and drawn rough sketch under Ex.P7 and did investigation and filed charge­sheet against the accused.

7.After completion of the prosecution evidence, the accused was examined under section 313 Cr.P.C. He denied the incriminating material against him and further stated that his wife worked as ward member thrice, when PW.1 requested them to help her to continue in the post even after Atmakur became

Municipality, when they could not help them, they attacked him, police due to threat of their caste, first registered the case against 5 him. The accused pleaded innocence of the offence and reported no defence evidence.

8.Heard both counsel.

9.Now the points that arise for determination are 

1) Whether the accused wrongfully restrained PW.1?

2) Whether the accused assaulted PW.1 with an intention to outrage her modesty?

3) Whether the accused outraged the modesty of P..W.1 since she belongs to Scheduled Caste?

4) Whether the accused abused PW.1 touching the caste with an intention to insult or humiliate her in a place within public view?

5) Whether the prosecution is able to prove the guilt of accused for the offences punishable under sections 341, 354 IPC, sections 3(1)(xi) and 3(1)(x) of the SCs & STs (PoA)

Act, beyond all reasonable doubt?

10.This court has gone through the evidence of PWs.1 to 6 and EXs.P1 to P7, EXs.D1, D2 and the material on record, and this court feels that it is not necessary to reproduce the evidence either oral or documentary, and this court will refer the evidence as and when necessary to the extent required in the Judgment.

11.Points 1 and 2:

The case of the prosecution is that on 4­4­2012 at about 10­15 Hours while the defacto­complainant was going to the office, the accused wrongfully restrained her and assaulted her with an intention to outrage her modesty. On the other hand, the accused pleaded innocence of the offence. Hence, the burden is on the 6 prosecution to prove the guilt of the accused beyond all reasonable doubt to show that on that specific day, the incident occurred in the manner stated by the complainant.

12.It is pertinent to mention here that the prosecution relied upon the evidence of PW.1 who is the victim. PWs.2 and 3 are not eye witnesses to the occurrence. According to the complainant, she has informed the incident to them subsequently.

Though Ex.P1 does not contain that LW.5, Delar Lakshmaiah, witnessed the occurrence, the complainant developed her version in the evidence stating that LW.5, Dealer Lakshmaiah witnessed the occurrence. The prosecution could not examine LW.5, Dealer

Lakshmaiah since he died. Hence, the evidence available on record is only the evidence of PW.1. If PW.1is able to stand for the cross­ examination by the defence, the evidence of PW.2 is helpful to the prosecution to corroborate her evidence. 

It is significant to note here that though PW.1stated 13.

that immediately after the occurrence, she informed the incident to her uncle­PW.3, PW.3 testified that he knows nothing about the incident. He pleaded total ignorance of the incident. PW.3, in fact, is not an independent witness, but he is a close relative of PW.1.

she cited him as a witness in her case. Though he is her close relative, he pleaded ignorance of the incident. It is needless to say that the court can rely upon the sole testimony of the victim to punish the accused and convict him if it is not suffering from any vice.

14.It is well settled in law that the court can rely upon the testimony of witnesses and it can form basis of conviction if the same is credible, truthful and corroborated by other evidence brought on record. Corroboration is not a must to record conviction, but as a rule of prudence the court thinks it desirable to see that corroboration from other reliable evidence placed on record. The principles that apply for placing reliance on the solitary statement of witnesses, namely that the statement is true, correct and is of quality and cannot be discredited solely on the ground of lack of corroboration. So also, it is to be noted that the reaction of witnesses should not have been regarded as same, because every person reacts to a situation in a different manner, for human behavior differs and varies from person to person depending upon the situation.

15.The fundamental aspects to be kept in mind for appreciation of evidence are:

(i) the interestedness of the witness to speak falsehood to support the victim due to their relationship or for money or any other favour or the interestedness to the witness to send the accused to jail in view of the grudge, animosity.

(ii) Consistency in their evidence with their previous statements recorded by the police under section 161 of Criminal

Procedure Code;

(iii) Probability to believe their version.

It has been held in catena of decisions of Hon’ble Apex

Court that there is no hurdle in convicting a person on the sole testimony of single witness, if that version is clear and reliable, for 8 the principle under section 134 of Evidence Act that the evidence has to be weighed and not counted. It is not the quantity, but the quality of the evidence which clinches the issue in criminal trial of this type. Hence, it can be noticed that truthfulness is the only test to rely upon the evidence of any witness to record the conviction of the accused, irrespective of their status i.e, partisan, interested, hostile, chance, related, injured, official, medical, family members, natural etc,.

16.It is also a fact that there is a delay in giving information to the police. So also, there is a delay in submitting the

First Information Report to the Magistrate Court. According to

PW.1, the alleged incident occurred on 4­4­2012 at about 10­15 a.m and she gave information to the police on the same day at about 8­30 p.m. If the delay is explained with reasonable cause, if it is excusable, it is not a hindrance to the case of the prosecution. PW.1 testified that on 31­3­3012, the commissioner addressed a letter to the District Panchayat Office, Kurnool with reference to her job as computer operator working in panchayat on contract basis, and not attending the works of the municipality and he wanted to surrender her and requesting them to utilize her services in any other gram panchayat with effect from 1­4­2012 on humanitarian grounds. In the cross­examination, she firmly admitted t hat in view of the above letter, she deemed to be relieved and she has no connection with the office since 1­4­2012.

According to her, immediately after the incident, she went to the office and she worked in the office as usual, which appears to be 9 not reasonable. According to her, she has informed about the incident first to her uncle i.e, PW.3. But, PW.3 turned unfriendly to the prosecution. There is on specific reason for the delay caused in giving the information to the police. According to the defence, on the same day at about 6 p.m, while the accused was working in his office being paper reporter, PWs.1, 2 and 3 attacked him on the ground that he is the reason for her removal from the job. It is also to be noted that the wife of the accused is worked as ward member.

When PWs.1 to 3 requested them to help PW.1 to continue her job in the municipality, when they did not cooperate, with the said grudge they attacked him on that day and when he went to the

Police Station to give report against them, in anticipation that the case would be lodged against them, they also approached the police and got registered a case against the accused. When PW.1 is not in a position to speak about the specific reason why she was going to the office on 4­4­2012 even after her removal on 31­3­2012, it would probablize the version of the defence that there is no reason for PW.1 to go to office on that particular day.

17.The record further shows that there is a delay in sending the First Information Report to the Court. PW.5, in the cross­examination, admitted that as per the endorsement in Ex.P5, the court received it on 6­4­2012 at about 12­45 p.m. He further stated that the Magistrate Court is at a distance of 2 KMs from the

Police Station. When PW.1 gave report to the police at about 8­30 p.m on 4­4­2012 and immediately it was registered as Crime

No.51/2012 against the accused, what made the police not to send 10 the First Information report immediately to the court, is not explained. Further, EXs.D1 and D2 are marked in the cross­ examination of PW.5. They show that on 4­4­2012 the accused made a complaint under Ex.D1 to the police, which is against

PWs.1 to 3 herein which is registered as Crime No.52/2012 and police also filed charge­sheet in that case vide Ex.D2. Though

Ex.P1 does not disclose the place of the incident, PW.1 testified that when she was going to the office from her house, when he reached near the house of Dealer Lakshmaiah, LW.5, the accused obstructed her on the road and demanded to fulfill his sexual desire by leaving her husband and assaulted her with an intention to outrage her modesty. It is pertinent to mention here that the

First Information Report is not “be all” and “end all”. One can give information to the police immediately after the occurrence and they may state several things in detail in their statements before the police, the same they can depose before the court. But, in the present case when the incident occurred at about 10­15 a.m, the information given to the police at about 8­30 p.m, the reason for the delay is not explained and not convincing. On the other hand, in view of EXs.D1 and D2, it probablizes the version of the accused that only to get over the said case, this complaint has been lodged against the accused. The evidence of PW.1 in respect of the place of the incident, she also stated that LW.5, Dealer Lakshmaiah witnessed the incident. These two facts do not find place in Ex.P1.

When the complaint was given to the police with a delay, we expect the entire case with material particulars at least, can submit to the 11 police if the incident had been true. PW.6 in the cross­ examination, stated that Ex.P1 does not disclose the place of the incident. PW.s.1 to 3 did not state before him, the place of the incident. But, it was shown by PW.1, the place of incident is in front of the house of Dealer Lakshmaiah. The case diary does not disclose the same. The place of incident is a material point which needs to be recorded in the First Information Report itself. So also, when the prosecution could not examine Dealer Lakshmaiah, in the absence of any independent corroboration to the evidence of PW.1, the evidence of PW.2 has no value and her evidence cannot be believed in view of the case lodged against them by the accused.

PW.6 further stated that he has not examined any witness to show that after the incident PW.1 went to her office. In view of the aforementioned premises, this court is of the view that the prosecution could not prove the guilt of the accused for the offences punishable under section 341 and 354 IPC. These point are answered accordingly.

18.Point No.3:

In view of my finding on Point No.2 that the prosecution could not prove that the accused assaulted PW.1 with an intention to outrage her modesty, though the prosecution proved that PW.1 belogns to Scheduled Caste by examining PW.4 as his evidence in respect of the caste of both parties is remained unchallenged, it has no significance to prove the guilt of the accused for the offence under section 3(1)(xi) of the Scheduled Caste. Accordingly, this 12 point is answered in favour of the defence as against the prosecution.

19.Point No.4:

The case of the prosecution is that the accused abused PW.1 touching the caste with an intention to insult or humiliate her in a place within public view. PW.1 testified that she belongs to Madiga of Scheduled Caste. The evidence of PW.4 in respect of the caste of the complainant and also the accused, remained unchallenged, vide EXs.P3 and P4, respectively. The prosecution further has to prove that the accident occurred in the manner stated by the complainant. According to her, when she was going to the office on 4­4­2012 at about 10­15 a.m, the incident occurred wherein she was abused by the accused saying “Yevariki chepputhavo cheppu madiga lanja”. No doubt, PW.2 corroborated the evidence of PW.1, stating PW.1 was abused by the accused saying “Madiga Lanja”. It is pertinent to mention here that PW.3 is the uncle of PW.1, but he did not support the prosecution. According to her, immediately after the occurrence she informed the incident to PW.2 and PW.2 came to her and they presented a report to police immediately. The case record further shows that though she left for office immediately after the incident and in night at about 8­30 p.m, they presented a report to the police. As I discussed above while answering Points 1 and 2, delay in giving report to the police is fatal to the case of the prosecution. So also, there is a delay in sending the First Information Report to the Magistrate Court in 13 view of EXs.D1 and D2. It is needless to say that when the evidence of PW.1 is reliable, cogent, convincing and truthful, the evidence of PW.2 helps the prosecution to support her version.

When the evidence of PW.1 is suffering from vices as I mentioned while answering Point No.1 i.e, interestedness, enmity against the accused, when her evidence cannot be believed, the evidence of

PW.2 has no value. Ex.P1 does not disclose any eye witness to the occurrence. Coming to the court, the complainant developed her version stating that one Dealer Lakshmaiah witnessed the incident.

But the prosecution could not examine him, since Dealer

Lakshmaiah, LW.5, died. 

20.The offence alleged against the accused is under section 3(1)(x) of the SCs & STs (PoA) Act. For the sake of convenience, the said provision of law is extracted hereunder.

3. (1) (x) Whoever, not being a member of a Scheduled Caste or a Scheduled Tribe, intentionally insults or intimidates with intent to humiliate a member of a Scheduled Caste or a Scheduled Tribe in any place within public view; shall be punishable with imprisonment for a term which shall not be less than six months but which may extend to five years and with fine.

When once the entire section of law i.e, section 3(1)(x) of the SCs & STs (PoA) Act is looked at, there is any amount of difference from the wording that is used in section 3(1)(x) of the Act with that of the other provisions of law mentioned in Section.3 of the Act. It appears, the insult or intimidation mentioned in section 3(1)(x) should have happened in any place within the view of the public. Whereas, for the other offences as defined under section 3 of the Act, it is not stated that such offence should have happened within public view. Hence, it can be said that the offence must 14 have happened within the public view to attract the provisions of section 3(1)(x) of the Act. In the present case, there is no eye witness account to show that the incident occurred in a public place in the presence of public. The prosecution rest s upon the sole testimony of PW.1, which cannot be done under section 3(1)(x) of the Act. On conglomeration of the facts and circumstances, on appreciation of the evidence on record and by following the legal cardinal principles, I am of the considered view that the prosecution failed to prove the guilt of accused for the offence punishable under section 3(1)(x) of the SCs & STs (PoA) Act. This point is answered accordingly.

21.Point No.5:

In view of my findings on Points 1 to 4, the prosecution failed to prove the guilt of accused for the offences punishable under sections 341, 354 IPC, sections 3(1)(xi) and 3(1)(x) of the

SCs & STs (PoA) Act, accordingly he is entitled for acquittal.

22.In the result, the accused is found not guilty for the offences punishable under sections 341, 354 IPC, sections 3(1)(xi) and 3(1)(x) of the SCs & STs (PoA) Act; and he is acquitted of the said offences, U/s.235(1) Cr.P.C. The bail bond of accused shall stand cancelled subject to section 437 (A) of Cr.P.C, after six months as per the provisions. The un­marked non­valuable property if any, shall be destroyed after the expiry of appeal time.

 A.2 himself appeared before the Court and he is unable to speak or move. He was brought by his son. Considering the facts and circumstances of the case and the mitigating circumstances of the accused, instead of sentencing him to prison, he is sentenced to pay a fine of Rs.9,000/­ (Rupees nine thousand only), in default to suffer simple imprisonment for a period of three months, for the offence under sec.324 IPC. Out of fine amount if paid, an amount of Rs.5,000/­ (Rupees five thousand only) is awarded towards the compensation of PW.1 Mala Avula Ayya Swamy after expiry of appeal time.

Office is directed to address letter to police, recalling the warrant of A.2.

J U D G M E N T

The State represented by the Assistant Superintendent of Police, Adoni, laid charge­sheet against the accused in Crime

No.56 of 2011 of Yemmiganur Town Police Station for the offences 3 punishable under sections 323, 324, 509 read with 34 IPC and

Section 3(1)(x) of the SCs & STs (PoA) Act.

2.The case of the prosecution in brief is that the defacto­ complainant, Mala Avula Ayyaswamy, is a sub contractor doing polish stone flooring work and he has completed many works under

A2. While so, on 29­4­2011 at about 7 a.m, while he was in his house, A2 went there and asked him to complete the work. On that he requested some time to complete the work, on which A2 grew wild against him, called A1 and A3 and all of the accused abused him touching the caste and beat him with sticks. When his wife intervened, she was also abused by him in filthy language and they beat her and insulted her modesty. PWs.3 and 4 intervened and rescued them from the clutches of the accused. Basing on the statement of the complainant, the Yemmiganur Town Police Station registered crime against the accused. PW.12 was authorized to take up investigation as per proceedings of the Superintendent of

Police, Kurnool. During the course of investigation, she visited the scene of offence, drawn the rough sketch, recorded the statements of witnesses, obtained the caste certificates of the complainant and the accused and also obtained the wound certificate of the complainant from the Government General Hospital, Kurnool.

After completion of investigation, filed charge­sheet against the accused.

3.The case was taken on file by the learned Judicial

Magistrate of First Class, Yemiganur, for the offences punishable

4 under sections 323, 324, 506 read with 34 IPC and section 3(1)(x) of the SCs & STs (PoA) Act.

4.On appearance of the accused before the learned

Magistrate, copies of documents relied upon by the prosecution

were served on them under section 207 of Cr.P.C. As the offence under section 3 (1) (x) of SCs & STs (PoA) Act is exclusively triable by the Special Judge for trial of cases under SCs & STs (PoA) Act, this case was committed to this court vide P.R.C.No.39 of 2012 under section 209 (a) of Cr.P.C and numbered as SC/ST SC No.18 of 2014. 

5.On appearance of the accused before this court and after hearing, on consideration, charges under section 3(1)(x) of the

SCs & STs (PoA) Act and sections 509, 324 and 323 IPC, framed against A1 to A3. The charges were read over and explained to them in Telugu. The accused pleaded not guilty and claimed to be tried.

6.In order to prove the case of the prosecution, the prosecution examined PWs.1 to 12 as witnesses and got marked

EXs.P1 to P14.

PW.1 is the defacto­complainant who presented report under

Ex.P1. PWs.2 to 7 are the eye witnesses to the occurrence, out of them PWs.5 to 7 turned unfriendly to the prosecution. PW.8 is the

Tahsildar who issued the caste certificates of the complainant and accused vide EXs.P5 to P8 respectively. PW.9 is the Sub Inspector 5 of Police who recorded the statement of PW.1. PW.10 is the

Assistant Sub Inspector of Police who recorded the statement of

PW.1 on receipt of MLC intimation. PW.9 is the Sub Inspector of

Police who registered the crime. PW.11 is the doctor who treated

PW.1 and issued wound certificate under Ex.P12. PW.12 is the

Assistant Superintendent of Police who did investigation and filed charge­sheet against the accused.

7.After completion of the prosecution evidence, the accused were examined under section 313 Cr.P.C. They denied the incriminating material against them and reported no defence evidence.

8.Heard both counsel.

9.Now the points that arise for determination are 

1) Whether A1 to A3 abused PW.1 touching the caste with an intention to insult or humiliate him in a place within public view?

2) Whether A1 to A3 abused PW.2 with an intention to insult her modesty?

3) Whether A1 to A3 beat PW.1 with sticks and caused voluntary hurt to him?

4) Whether A1 to A3 voluntarily beat PW.2 and caused hurt to her?

5) Whether the prosecution is able to prove the guilt of A1 to

A3 for the offences punishable under section 3(1)(x) of the

SCs & STs (PoA) Act and under sections 509, 324 and 323

IPC, beyond all reasonable doubt?

10.This court has gone through the evidence of PWs.1 to 12 and EXs.P1 to P14 and the material on record, and this court feels that it is not necessary to reproduce the evidence either oral or documentary, and this court will refer the evidence as and when necessary to the extent required in the Judgment.

11.Point No.1:

The case of the prosecution is that on 29­4­2013 at about 7 a.m when the complainant was present in his house, A2 went there and asked him complete the flooring work. When he requested some time, A2 grew wild against him, called A1 and A3 and abused PW.1 touching the caste. On the other hand, the accused pleaded innocence of the offences. Hence, the burden is on the prosecution, first to establish that the complainant belongs to Scheduled Caste and the accused not being members of either

Scheduled Caste or Scheduled Tribe, abused him touching the caste with intention to insult him in a place within public view.

12.The complainant as PW.1, testified that he is a resident of Yemmiganur, belongs to Mala of Scheduled Caste. The accused belongs to Golla caste. Except putting a suggestion to PW.1 that he is a Christian but not a Scheduled Caste person, no acceptable material is placed before the court to discredit the testimony of

PW.1 that he belongs to Scheduled Caste. The evidence of PW.1 is corroborate d by the evidence of PW.8 who issued the caste certificate of PW.1 under Ex.P5 stating that PW.1 belongs to Mala of Scheduled Caste. PW.8 also testified that the accused belong to 7 BC­D vide EXs.P6 t o P8 respectively. He flatly denied to the suggestion put to him by the learned defence counsel that PW.1 is a christian but not a Scheduled Caste person. The positive evidence of PW.1 coupled with EXs.P5 to P8 would go to show that

PW.1 belongs to Scheduled Caste and the accused do not belong to either Scheduled Caste or Scheduled Tribe.

13.PW.1 testified that A2 came to his house and asked him to complete the napa slab flooring work and when he requested time, he grew wild against him and called A1 and A3 and all of them abused him touching the caste saying “Mala Lanjakodaka

Neevu Maa Paniki Rava Mala Lanjakodaka, Ninnu Oorulo Lekunda

Thanthamu”.

14.PW.2, the wife of PW.1, corroborated the evidence of

PW.1 in this regard stating that A1 to A3 abused her husband touching the cast saying “Mala Nakodaka Neevu Maa Paniki

Rakunda Yekkadiki Pothavu Maa Pani Chesina Tharuvathe Po”.

15.PW.3 is eye witness to the occurrence. He testified that

A2 abused PW.1 touching the caste saying “Mala Lanja Kodaka”.

According to PW.4, in that incident A2 abused PW.1 saying “Mala

Naa Kodaka”.

16.PWs.1 to 4 gave different versions in respect of the specific words of abusal alleged to have been uttered by the accused against PW.1. According to PWs.1 and 2, all the accused abused PW.1 touching the caste. According to PWs.3 and 4, A2 8 only abused PW.1 touching the caste. It is significant to note here that it was elicited in the cross­examination of PW.2 that by the time LW.3­Venkataramudu and LW.4­Avula Krishna came to the scene, the accused left the place. Even the evidence of PW.2 falsifies the version of PWs.3 and 4 that they watched the incident wherein they heard while the accused abused PW.1 touching the caste. It is needless to say that PWs.5 to 7 who are the witnesses to the occurrence, according to PW.1 they are neighbours of the locality. They did not support the prosecution and pleaded total ignorance of the incident. PWs.3 and 4 are admittedly the close relatives of PW.1. It appears, they supported PW.1 due to the said relationship.

17.The offence alleged against the accused is under section 3(1)(x) of the SCs & STs (PoA) Act. For the sake of convenience, the said provision of law is extracted hereunder.

3. (1) (x) Whoever, not being a member of a Scheduled Caste or a Scheduled Tribe, intentionally insults or intimidates with intent to humiliate a member of a Scheduled Caste or a

Scheduled Tribe in any place within public view; shall be punishable with imprisonment for a term which shall not be less than six months but which may extend to five years and with fine.

When once the entire section of law i.e, section 3(1)(x) of the SCs & STs (PoA) Act is looked at, there is any amount of difference from the wording that is used in section 3(1)(x) of the Act with that of the other provisions of law mentioned in Section.3 of the Act. It appears, the insult or intimidation mentioned in section 9 3(1)(x) should have happened in any place within the view of the public. Whereas, for the other offences as defined under section 3 of the Act, it is not stated that such offence should have happened within public view. Hence, it can be said that the offence must have happened within the public view to attract the provisions of section 3(1)(x) of the Act. As PWs.1 to 4 gave different versions in respect of the specific abusive words, so also PW.2 clarified that by the time PWs.3 and 4 reached the scene, the accused left the place, in view of the same, it can be said that the prosecution failed to prove the guilt of accused for the present charge under section 3(1)

(x) of the SCs & STs (PoA) Act. Accordingly, this point is answered.

18.Points 2 and 4:

It is the case of the Prosecution that when PW.2 intervened to rescue her husband, the accused abused her in filthy language and beat her. It is pertinent to mention here that PWs.1 to 4 nowhere spoke about the specific abusive words alleged to have been uttered by the accused against PW.2. It is needful to say that Ex.P1 also does not disclose the specific abusive words alleged to have been uttered by the accused against PW.2. Moreover, it is the case of the prosecution that when PW.2 intervened, all the accused beat her. If it had been true, she would have suffered any injury, tenderness or pain, but no wound certificate of PW.2 is filed by the prosecution. According to PW.11, he examined PW.1 on 29­ 4­2011 at about 2­25 p.m and observed injuries on him. But he never stated that he found any injury on PW.2 or that PW.2 atleast complained of any feeling of pain. In such circumstances, the case 10 of the prosecution that she was beaten by A1 to A3 when she intervened to rescue her, appears to be not believable. So also, as I discussed while answering Point No.1 that according to PW.2, when

PWs.3 and 4 reached the scene by that time the accused left the scene. Hence, the evidence of PWs.3 and 4 that they witnessed the occurrence, has no legs to stand. In view of the above, the prosecution failed to prove the guilt of the accused for the offences charged, under sections 509 and 323 IPC. Accordingly, these points are answered.

19.Point No.3:

The case of the prosecution is that in the incident, A1 to

A3 beat PW.1 with sticks. While narrating the incident, PW.1 stated that A1 fisted him on his mouth, A2 pressed his neck, A3 beat him on his legs with a stick and he sustained injuries. PW.2 also corroborated the version of PW.1 in respect of the place of injury and the specific overt acts against the accused. It is pertinent to mention here that in the cross­examination, PW.4 stated that he was not present in the village when the Assistant Superintendent of

Police came to the village and she has not recorded his statement.

PW.9 testified that on 30­4­2011 at about 6 p.m, he received intimation under Ex.P9 from the OP Police Station along with statement of PW.1 basing on which he registered the crime under

Ex.P10. PW.10 testified that on 29­4­2011 at about 5 p.m, he received Ex.P9 i.e., the MLC intimation, approached PW.1 and recorded his statement. In the cross­examination, he stated that

Ex.P1 does not disclose the place of injuries on PW.1. PW.11 11 corroborated the version of PW.1 stating that he found an abrasion over the lower lip and upper lip of 2 x 1 and 1 x 1 cms in size respectively, red in colour, multiple scratch marks over neck and chest, complaint of pain in right knee joint and chest and issued

Ex.P12 and opined that the injuries are simple in nature, the age of injuries may be 0 – 6 Hours prior to his examination. According to

PW.1, the incident occurred at about 7 a.m, PW.11 examined him at 2.25 p.m. The time of the incident is also tallied from the evidence of PW.11. PW.11 further stated that Injury No.1 is possible with fist, the second injury is possible when a person presses the neck and the third injury is possible with a stick.

Simply because PW.11 in the cross­examination stated about the possibility of injuries when a person fell down on a hard surface, do not destroy the case of the prosecution in toto. The evidence of

PW.1, PW.2, PW.11 coupled with Ex.P12, would go to show that a quarrel took place between the accused and the complainant on the date of the incident, wherein the complainant was beaten by the accused and he sustained simple injuries. Ex.P1 also discloses that all the accused beat him. PW.12 narrated about the investigation done by her. In the cross­examination, she stated that PWs.1 to 3 did not state before her the specific overt acts against the accused, so also, the place of injuries. PW.3 did not state before her that A1 fisted PW.1 on his face, A2 pressed the neck of PW.1 and A3 bat PW.1 with stick. The above evidence of

PW.12 would help the defence, particularly to exonerate A1 and A3 from the liability, for the reason that according to PW.1, A2 came to 12 the house and when PW.1 refused to complete the work of A2, he called A1 and A3 to the house and beat him. When Ex.P1 is silent about the specific overt acts against the accused, so also when the witnesses did not speak about the specific overt acts in their previous statements, their evidence for the time before the court attributing specific overt acts against each of the accused, cannot be believed and it is of course an improvement. Hence, the prosecution failed to prove the guilt of A1 and A3 in this regard.

Accordingly this point is answered partly in favour of the prosecution as against the defence and this court has not hesitation to say that A2 is liable for punishment for the offence under section 324 IPC for beating PW.1.

20.Point No.5:

In view of my findings on Points 1 to 4, the prosecution failed to prove the guilt of A1 to A3 for the offences punishable under section 3(1)(x) of the SCs & STs (PoA) Act and sections 509, 323 IPC. The prosecution also failed to prove the guilt of A1 and A3 for the offence punishable under section 324 IPC, but found A2 guilty of the said offence, for having beat PW.1. Accordingly, A1 to

A3 are entitled to be acquitted of the offences punishable under section 3(1)(x) of the SCs & STs (PoA) Act, sections 509, 323 IPC; and A1, A3 are entitled to be acquitted of the offence punishable under section 324 IPC. A2 is found guilty of the offence under section 324 IPC, accordingly he is liable to be convicted for the said offence.

21.In the result, A1 to A3 are found not guilty for the offences punishable under section 3(1)(x) of the SCs & STs (PoA)

Act, Sections 509, 323 IPC, A1 and A3 are found not guilty for the offence punishable under section 324 IPC and they are acquitted of the said offences, under section 235 (1) Cr.P.C.

The bail bonds of A1 and A3 shall stand cancelled subject to section 437 (A) of Cr.P.C after six months as per the provisions. The un­marked non­valuable property if any, shall be destroyed after the expiry of appeal time.

A2 is found guilty for the offence under section 324 IPC and convicted under section 235 (2) Cr.P.C.

22. A.2 himself appeared before the Court and he is unable to speak or move. He was brought by his son. Considering the facts and circumstances of the case and the mitigating circumstances of the accused, instead of sentencing him to prison, he is sentenced to pay a fine of Rs.9,000/­ (Rupees nine thousand only), in default to suffer simple imprisonment for a period of three months, for the offence under sec.324 IPC.

Out of fine amount if paid, an amount of Rs.5,000/­ (Rupees five thousand only) is awarded towards the compensation of PW.1

Sri.D.Yella Reddy, Advocate for the second respondent, having stood over for consideration till this day, this court delivered the following:­

J U D G M E N T

This appeal is preferred against the impugned Judgment and Decree dated 12­12­2011 in Original Suit No.572/2007 on the 2 file of Principal Junior Civil Judge’s Court, Kurnool, by the unsuccessful plaintiff, challenging the validity and correctness of the impugned judgment.

 2.The appellant herein was the plaintiff before the lower court, the respondents herein were the defendants before the lower court; and they will be hereinafter referred to as they were arrayed in the lower court, for the sake of convenience. 

3.The case of the plaintiff in brief is that the plaintiff is the owner of the house bearing Door NO.43/194 situated in N.R.Pet,

Kurnool. As his grandmother purchased it under a registered sale deed in 1950, his family has been in possession and enjoyment for more than 50 years. The first defendant recently purchased the house situated on the west of his house and making extensive alterations to the building in violation of the rules. He constructed two floors without leaving space and without permission from the municipality and converting the house into a commercial hub and causing nuisance to the neighbours in the street and he converted the house into a nursing home. The dumped waste material of the hospital causes unhygienic condition in the locality. The second defendant is not taking any steps against the first defendant though he violated the rules of the municipality. Hence, the suit for mandatory injunction and for direction to the second defendant to take steps for demolition of the illegal constructions made by the first defendant.

4.The first defendant filed written statement denying the material averments made in the plaint and further stated that he has purchased old house having ground floor and first floor with overhead tank over the first floor. As the house needs repairs, he removed the old plastering to the walls and roof and replaced the old windows and doors with new one. He only made repairs to the building. He neither re­constructed nor made any alterations to the basic structure by violating the rules of the municipality. The plaintiff wants to purchase the said house at cheaper rates. So he developed grudge against him with a malafide intention to harass him and filed the present suit. The repairs made to the house of the first defendant, in no way cause any nuisance to the plaintiff and prayed for dismissal of the suit.

5.The second respondent filed written statement denying the material averments in the plaint and inter­alia contending that the first defendant never violated the rules of the municipality. He has not reconstructed nor made any alterations or additions to the building. The first defendant is a doctor by profession and he has put a name board to his house. A clinic or dispensary is permissible in a residential zone as per the regulations. As he has not made any

additional constructions nor violated any rules, the corporation has

not taken any steps against him. The suit is not maintainable as the plaintiff did not issue the statutory notice under section 685 of the

Hyderabad Municipal Corporation Act. The second respondent has 4 been unnecessarily dragged into the litigation and the suit has no cause of action. Requesting for dismissal of the suit.

6.Basing on the pleadings of both parties, the following issues have been settled for trial:

1) Whether the plaintiff is entitled for mandatory injunction for removal of the violative construction made by the first defendant in his house bearing D.No.43/94­1, Kurnool, as prayed for?

2) To what relief?

The following additional issues were also framed:

1) Whether the first defendant made any repairs to the old building?

2) Whether the first defendant violated t he building rules as alleged by the plaintiff?

3) Whether the first defendant constructed steps illegally?

4) Whether the firs defendant dumped waste material of the hospital causing nuisance to the plaintiff and others as alleged by the plaintiff?

7.The trial went on. The plaintiff was examined as PW.1.

EXs.A1 to A3 were the documents marked. On behalf of the defendants, DWs.1 to 4 were the witnesses examined and Ex.B1 was marked.

8.After hearing both counsel, on appreciation of the evidence on record, the learned trial judge dismissed the suit on the ground that the plaintiff failed to prove that construction was made by the first defendant in violation of any building plans or rules 5 which caused any public nuisance, accordingly dismissed the suit with costs.

9.Having aggrieved by the impugned judgment and decree of the lower court, the plaintiff preferred the present appeal on the grounds that:

The learned trial judge failed to appreciate the evidence in right perspective. The commissioner report clearly discloses new construction has come up without any permission from the second defendant. The lower court failed to consider important aspects and dismissed the suit. Requesting the court to set aside the impugned judgment and decree of the lower court by allowing the appeal with costs throughout.

10.Heard both counsel.

11.Now the points that arise for determination are:

1) Whether the plaintiff is entitled for mandatory injunction for removal of the alleged constructions made by the first defendant without approval of the municipal corporation?

2) Whether the impugned judgment and decree of the lower court is sustainable or it suffers from any irregularity or illegality, which needs interference of this court while sitting in the appeal?

12.For better appreciation, this court being the last court for fact finding, this court has gone through the pleadings, evidence of

PW.1, DWs.1 to 4, Exs.A1 to A3, Ex.B1 and other material on record, and this court feels that it is not necessary to reproduce the 6 evidence either oral or documentary, and this court will refer the evidence as and when necessary to the extent required in the

Judgment.

13.Point No.1 :

The learned counsel for the plaintiff submitted that the first defendant recently purchased the house in the year 2006 and he is making constructions by violating the building rules, converting the residential house to nursing home. No parking place is available for parking the vehicles. The dump of the hospital waste creates health hazards in the locality. Inspite of information given to the second defendant about the illegal constructions, the municipal authorities were influenced by the first defendant and they did not take any steps against the first defendant for removal of the illegal constructions. The learned trial judge failed to consider these aspects and dismissed the suit wrongfully. Requesting to allow the appeal by setting aside the impugned judgment and decree of the lower court. 

14.Per contra, the learned counsel for the first defendant stated that he did not make any illegal constructions. Having purchase the old house, he replaced the old windows and doors with new ones and re­plastered the walls and made some renovation. The first defendant being government doctor, he wants to open a clinic and attend the people in evening hours. Moreover, there are several hospitals and medical shops in that locality. As he did not make any re­construction, the question of getting permission from the 7 corporation does not arise. There is a compound wall between their house apart from set backs as per rules of the corporation and he made constructions within the boundaries. The learned trial judge rightly dismissed the suit. Requesting the court to dismiss the appeal with costs.

15.The learned counsel for the second respondent submitted that the first Defendant did not violate any building rules and conditions of the municipal corporation. There is no requirement for obtaining permission for opening a clinic or nursing home in a residential locality. No notice was served on the second defendant prior to filing the suit. The second defendant was unnecessarily dragged to the court. Sought for dismissal of the appeal.

16.It is needless to say that to prevent a breach of an obligation existing in favour of the party, and where no standard for ascertaining actual damage caused or likely to be caused by such invasion, to prevent such act, the interference of the court is required by way of granting perpetual injunction. It is significant to note here that to prevent breach of an obligation there is a necessity to compel the parties for certain acts which the court is capable or enforcing. It is needless to say that when a public nuisance or any wrongful act affecting the interest of the public is made, it definitely comes under nuisance. A suit for declaration and injunction is also maintainable by two or more persons elevating the grievance of the public at large. It is pertinent to mention here that the relief of 8 injunction is a discretionary relief. One cannot claim injunction as a matter of right, but the discretion shall be exercised judiciously.

17.The case of the plaintiff against the first defendant is that the defendant made some illegal constructions violating the rules of the municipality. The other grievance of the plaintiff is that the first defendant is converting the residential house into a nursing home which is likely to cause inconvenience to the neighbours in the street for parking of the vehicles and also due to dumped waste material of the hospital causes unhygienic conditions in the neighbourhood. The plaint further reveals that the grievance of the plaintiff is that the act of the defendant may cause inconvenience to the general public at large. In order to prove his case, the plaintiff deposed in replica to the averments made in the plaint, in his chief examination affidavit, stating that the first defendant made illegal constructions and he pleaded ignorance whether the first defendant made some plastering work to the walls inside the house with lime muster. But it is elicited in the cross­examination of PW.1 that the first defendant fixed new windows and door frames in the place of old ones and there is a overhead tank over the first floor. He further admitted that there are several clinics in N.R.Pet area and one medical shop and kirana shop and Rainbow Hospital is situated very near to the locality, so also, the clinic of Dr.Pushpalata and a hotel to the western side of the first defendant’s house intervening one house. It is the evidence of the plaintiff that so many hospitals and medical shops are constructed in the locality for the last 15 years.

18.The specific contention of the second defendant is that no prior notice has been issued to the second defendant. Though the plaintiff claims that he has issued notice to the second defendant, no scrap of paper filed in support of his contention. In the cross­examination, it was elicited that there is a compound wall in between his house and the house of the first defendant and gap is about 3 to 4 feet and a gap on the southern side of the house of the first defendant and compound is more than 4 ½ feet and the first defendant made entire construction within his boundaries. It is pertinent to mention here that having filed suit on the ground that the constructions made by the defendant and also maintaining clinic in the premises, caused much inconvenience to the public, the plaintiff admitted that he is not residing in that house and he is resident of Jallapuram of Alampur Taluq, but he used to visit the house at N.R.Pet and no tenant of his house was examined to support his contention that the act of the first defendant is causing much inconvenience to them. Except the plaintiff, no other inhabitant of the locality came forward to speak against the first defendant that the clinic in his house is causing public nuisance in that area. When the constructions made by the first defendant did not affect any of the personal rights or easementary right s of the neighbours, he cannot claim any mandatory injunction against the first defendant. It is not the case of the plaintiff that his easemantary rights of light and air is being affected on account of the renovation made by the first defendant to his house. Moreover, 10 the first defendant examined DWs.3 and 4 who are the inhabitants of the locality. DW.3 testified that the first defendant is running only a clinic in the front portion of ground floor of house and using the rest of the house for his residence and no inconvenience is caused to anybody on account of running of clinic by the first defendant and the first defendant used to attend the clinic in free hours in the evening and the first defendant renovated his house.

DW.4 is another neighbor. According to him, the first defendant purchased the old house and effected some repairs and he did not make any additional constructions and he left open site on all sides and the first defendant has been using first two rooms for clinic.

DW.1 is the Town Planning Building Overseer. He testified that the first defendant has only removed the gatchu plastering and made plastering with cement mortar and replaced with windows and doors and he did not make any reconstructions and the constructions made by him are no illegal. He denied that the first defendant made constructions violating the building rules. Moreover, PW.1 himself admitted that sufficient place is left to the sides of the first defendant’s building. The first defendant as DW.2 deposed in replica to the averments made in his written statement, in his chief examination affidavit, stating that he did not make any new constructions in his house. He just renovated the house within his boundaries. It was elicited in the cross­examination of DW.1 that he converted the car parking into medical shop and further constructed portigo in the front side. But admittedly they are within his boundaries. He constructed water tank in the second floor.

19.On conglomeration of the facts and circumstances of the case, it is clear that the first defendant made repairs to the old house. While doing so, he renovated his house in the first floor and replaced the old windows and doors and flooring and he constructed them within his boundaries. DW.1 firmly stated that no illegal construction has been made by the first defendant. There is no reference about the steps constructed by the first defendant in the commission report. The plaintiff failed to prove the alleged nuisance that is caused or likely to be caused on account of the constructions made by the first defendant and also failed to prove that his personal rights are affected on account of the constructions made by the first defendant within his area. Since the said constructions did not in any way affect any of the rights of the plaintiff to prove the nuisance, the plaintiff is not entitled to the relief of mandatory injunction. The learned trial judge rightly dismissed the suit and there is nothing to interfere with the findings of the lower court.

Accordingly, this point is answered.

20.Point No.2:

In view of my finding on Point No.1, the judgment and decree passed by the lower court is on correct lines and there is nothing to interfere with the impugned judgment of the lower court.

Accordingly, the lower court judgment has to be confirmed.

21. In the result, the appeal is dismissed with costs, confirming the judgment and decree dated 12­12­2011 in Original 12

This appeal is preferred against the impugned

Judgment and Decree dated 29­06­2012 in Original Suit

No.21/2008 on the file of Senior Civil Judge’s Court, Atmakur, by the unsuccessful defendants, challenging the validity and correctness of the impugned judgment.

 2.The appellants herein were the Defendants 1 to 3 before the lower court, the Respondents herein were the Plaintiffs 1 an 2

before the lower court; and they will be hereinafter referred to as

they were arrayed in the lower court, for the sake of convenience. 

3.The case of the plaintiffs in brief is that they filed the suit for permanent injunction against the defendants from trespassing into the ABCD and CDEF plaint schedule lands and costs of the suit. Originally, the plaint schedule property belongs to one Ediga Venkata Swamy as he purchased Ac.1­22 cents of land in Survey No.72/2 of Krishnapuram village, from one Midde

Seshaiah which includes ABCD shown in the plaint schedule, for a consideration of Rs.2,500/­ under a registered sale deed dated 6­6­ 1978. Later, he acquired Ac.3­04 cents which is CDEF in the plaint schedule, from Chowthi Subbamma of Krishnapuram village under a registered gift deed dated 19­9­1963. He had given Ac.1­ 22 cents of land which includes ABCD plaint schedule to his wife.

The government acquired Ac.0­50 cents of land out of it, to assign to the Scheduled Caste people and the government, in turn, had given it to one Dargamma of Krishnapuram village. The first plaintiff has been in possession and enjoyment of the remaining 3

Ac.0­72 cents of land. The pattadar pass books and title deed books also issued in the name of the first plaintiff. But they were taken away by the first defendant after the death of the husband of the first plaintiff on the pretext of getting fertilizers. After the death of Ediga Venkata Swamy, the first plaintiff and her children have been in continuous possession and enjoyment of the CDEF lands shown in the plaint schedule. The revenue records also show their possession over the CDEF property. While so, Ediga Venkata

Swamy addicted to vices, was bed ridden for six months and died on 5­7­2008 leaving behind him his wife and four sons. After the death of Venkata Swamy, the defendants tried to trespass the schedule property. Ediga Venkata Swamy or the first plaintiff never executed any agreement of Sale in favour of the first defendant dated 28­9­2001 nor delivered possession to him and it is a created and forged document. They have not received any consideration from the first defendant. The first defendant was never in possession and enjoyment of the schedule lands at any point of time. Hence, the suit for permanent injunction against the defendants.

4.The first defendant filed written statement. The defendants 2 and 3 filed a memo adopting the written statement of the first defendant. They denied the material allegations made in the plaint, inter­alia contending that the fist plaintiff and her husband Ediga Venkata Swamy, agreed to sell the schedule property for Rs.80,000/­ and executed an agreement of sale on 28­ 4 9­2001. The first defendant paid Rs.40,000/­ towards part performance and agreed to discharge the loan obtained from the primary agriculture co­operative society, Atmakur. Hence, he paid the entire consideration and he was inducted in possession of the schedule land since the date of agreement. After the death of Ediga

Venkata Swamy, though the first defendant is ready and willing to perform his part of the contract, the plaintiff and other legal heirs of Ediga Venkata Swamy, did not honour the agreement. The first defendant got issued a legal notice demanding the execution of regular registered sale deed in his favour. In anticipation of filing of the suit by the plaintiffs, the first defendant filed Caveat Petition

before the Junior Civil Judge’s Court, Atmkur and notices were

served upon the plaintiffs. The plaintiffs filed suit before the Senior

Civil Judge’s Court, Atmakur by enhancing the value of the relief to

get interim injunction orders. The first defendant got issued another notice to the plaintiffs and other heirs after depositing an amount of Rs.33,541/­, demanding them for execution of registered sale deed. On receipt of the notice, the second plaintiff paid the mortgage loan amount to primary agriculture co­operative society,

Atmakur on 12­9­2008 to defeat the rights of the first defendant under the agreement of sale. Later, on 19­9­2008 the plaintiffs and other legal heirs of Ediga Venkata Swamy got issued a reply notice.

The suit is not maintainable as the plaintiffs alone filed the suit stating that they are the absolute owners of the property and the other legal heirs have not joined in the suit. Sought for dismissal of the suit.

5.Basing on the pleadings of both parties, the following issues have been settled for trial:

1) Whether the plaintiffs are in possession and enjoyment of the plaint schedule properties?

2) Whether the plaintiffs are entitled for permanent injunction as prayed for?

3) To what relief?

The following additional issue was also framed:

Whether the plaintiffs alone can maintain the suit without adding

other legal heirs of late Ediga Venkata Swamy?

6.The trial went on. The plaintiff herself was examined as

PW.1, the second plaintiff was examined as PW.2 and they got examined one Yemmani Sivanna as PW.3. EXs.A1 to A4 were the documents marked, apart from EXs.X1 to X3.

On behalf of the defendants, the first defendant himself was examined as DW.1. DWs.2 to 4 were the witnesses examined.

EXs.B1 to B23 were marked. The V.R.O of Krishnapuram village was examined as CW.1 and EXs.C1 and C2 were marked thorugh him.

7.After hearing both counsel, on appreciation of the evidence on record, the learned trial judge decreed the suit in favour of the plaintiffs, restraining the defendants from trespassing into the plaint schedule lands.

8.Having aggrieved by the impugned judgment and decree of the lower court, the defendants preferred the present appeal on the grounds that

The learned trial judge did not appreciate the evidence in right perspective and failed to frame proper issues. The trial court failed to observe that the revenue records were not genuine.

The documents filed by the plaintiffs are inadmissible. The learned trial judge filed to consider that as per Ex.A1, the possession of the lands was given to the defendant. It corroborates the evidence of

DW.2. The lower court failed to observe the entries made by the then V.R.O for three years after Ex.B1. Requesting the court to allow the appeal by setting aside the impugned judgment and decree passed by the lower court with costs throughout.

9.Heard both counsel.

10.Now the points that would arise for determination are:

1) Whether the plaintiffs are entitled for permanent injunction?

2) Whether the impugned judgment and decree of the lower court is sustainable or it suffers from any irregularity or illegality, which needs interference of this court while sitting in the appeal?

11.For better appreciation, this court being the last court for fact finding, this court has gone through the pleadings, evidence of PWs.1 to 3, DWs.1 to 4, CW.1, Exs.A1 to A14, Exs.B1 to B23,

EXs.X1 to X3, EXs.C1, C2 and other material on record, and this court feels that it is not necessary to reproduce the evidence either oral or documentary, and this court will refer the evidence as and when necessary to the extent required in the Judgment.

12.During the pendency of the appeal, I.A.No.205/2014 filed under Order 1 Rule 10 CPC requesting the court to permit the petitioners to add the legal heirs of late Ediga Venkata Swamy.

I.A.No.206/2014 filed under Order 6 Rule 17 CPC requesting the court to permit the petitioners to amend the pleadings of the plaint

I.A.No.207/2014 filed under Order 41 Rule 23 CPC requesting the court to remand the appeal to the lower court for amendment of the plaint.

13.The Respondents filed counters in I.A.No.205/2014 and 206/2014 with similar averments, stating that the documents filed by the petitioners are concocted documents. The lower court correctly believed that the names of plaintiffs were rounded off and their names were inserted. The plaintiffs deliberately did not add the correct legal heirs though their names were shown in the pleadings. There are no merits in the petitions. Requesting the court to dismiss the petitions with costs.

14.I.A.No.207 of 2014 is filed by the respondent/plaintiff under Order 41 Rule 23 read with Sec.151 CPC requesting the court to remand the matter to the lower court for amendment of the plaint, stating that they filed the suit for permanent injunction basing on not only possession as on the date of the suit, but also continuous possession over the schedule property from the time of their predecessors in title. During the course of arguments, the counsel looked into the judgment of the Hon’ble Apex Court in

Ananthula Sudhakar .v. P.Bhchi Reddy in Civil Appeal No.6191 of 8 2001 and realized the bonafide mistake of non­filing the suit for declaration of title. The petitioner has four brothers and two sisters. During pendency of the suit, one younger brother died without marriage. Hence, requesting the court for proper amendment of the suit for declaration of title and add the other brothers and sisters, as plaintiffs. Requesting the court to remand the matter to the lower court.

15.The respondent/appellants filed counter denying the averments made in the petition and further stated that the request for remand of the matter to the lower court is not fair. The petition for amending the suit for declaration of title is not valid. There are no merits in the petition. Sought for dismissal of the petition with costs.

16.It is pertinent to mention here that the case of the plaintiffs is that the first plaintiff being the wife of Ediga Venkata

Swamy, she got the property under ABCD shown in the plaint schedule and Ediga Venkata Swamy was also given Ac.3­04 cents in Survey No.72/3 under registered gift deed while he was a minor under CDEF shown in the plaint schedule. The pattadar pass book and title deed book were given in the name of the first plaintiff in respect of ABCD of the plaint schedule property and they were given in favour of late Venkata Swamy in respect of the land shown in CDEF. It is the contention of the defendants from the beginning that late Venkata Swamy and the first plaintiff executed agreement 9 of sale and agreed to sell the schedule lands for a valid consideration of Rs.80,000/­ and having received Rs.40,000/­ on the date of agreement of sale, delivered possession of the suit lands to the first defendant. On the other hand, the plaintiffs denied the execution of Ex.B1 in favour of the first defendant. There is a finding in favour of the defendants in respect of execution of Ex.B1 by late Venkata Swamy and the plaintiffs. Ex.B1 further shows that the first defendant has to pay Rs.40,000/­ out of the consideration of Rs.80,000/­ to the bank on behalf of late Ediga

Venkata Swamy and get the document registered in his favour.

The record further shows that the first defendant did not make such attempt to discharge the loan. There is a finding against the first defendant that in such case he is not entitled to claim protection under section 53­A of the Transfer of Property Act to retain possession. The record further shows that Ediga Venkata

Swamy died leaving behind him his wife and four sons and daughters. The first plaintiff being the wife and the second plaintiff who is the eldest son, only filed the suit. Now the plaintiffs, who got a decree in their favour before the lower court, want to amend their suit to declaration of title and they also want to add the other legal heirs of Ediga Venkata Swamy. The record further shows, there was exchange of notices between the parties even prior to filing of the suit. When the rival contentions are there in respect of title and the property, a simple suit for bare injunction is not maintainable. Now the respondents/plaintiffs want to amend the suit to declaration of title. Hence, in the interest of justice, instead 10 of letting parties to file another suit for declaration of title in second round of litigation, remanding the matter to the lower court for fresh disposal according to law by adding all the legal representatives of Ediga Venkata Swamy, would serve the purpose.

Moreover, no prejudice would be caused to the appellants if the matter is remanded to the lower court, for the reason that the appellants herein were the unsuccessful defendants before the lower court. They would also get opportunity to defend their case to prove their title and possession over the property. Accordingly, the petitions filed by the respondents/plaintiffs herein, as I discussed supra, are allowed.

17.In view allowing of the petitions, the matter has to be remanded to the lower court for fresh disposal according to law by giving opportunity to the plaintiffs to add all the legal heirs of late

Venkata Swamy and thereby consequential amendment of prayer of the suit for declaration of title on payment of proper court fee. In view of the nature of the suit, the court is supposed to give opportunity to both parties to adduce any further evidence.

Accordingly, these points are answered.

18.In the result, the appeal is allowed, setting aside the judgment and decree dated 29­07­2012 in Original Suit

No.21/2008 on the file of the Senior Civil Judge’s Court, Atmakur.

The matter is remanded to the lower court for fresh disposal according to law, giving opportunity to the plaintiffs to add all the legal heirs of late Ediga Venkata Swamy and for consequential 11 amendment of prayer of the suit for declaration of title, on payment of proper court fee. The lower court shall give opportunity to both parties to adduce further evidence, if any. There is no order as to costs.

J U D G M E N T

This criminal appeal is directed against the Judgment and sentence in C.C.No.152 of 2011 passed by the Judicial Magistrate of First Class (Mobile Court), Kurnool, dt.10.11.2011 wherein the appellant was found guilty for the offence punishable under section 138 of N.I.Act (For Short, the Act) and sentenced to undergo Simple

Imprisonment for a period of one year and to pay a fine of

Rs.2,000/­ (Rupees two thousand only) in default to suffer Simple

Imprisonment for 3 months.

2. Appellant is the accused before the Court below and the respondent herein is the complainant. For the sake of convenience, the parties herein after referred to as complainant and the accused.

 3. The case of the complainant in brief is that the accused borrowed a sum of Rs.5,00,000/­ from the complainant and issued a cheque under Ex.P.1 drawn on State Bank of India, Gadwal

Branch, Gadwal. When it was presented for encashment on 13.7.2009, it was returned with an endorsement, the funds insufficient under Ex.P.2. The complainant issued a legal notice under Ex.P.4, dt.17.8.2009, demanding the payment of the amount due under the Ex.P.1, within 15 days. In spite of receiving the notice by the accused under Ex.P.6, he did not pay the amount or give any reply.

4. The defence of the accused is that he has not direct nexus with the complainant but he issued a blank signed cheque to one

Mohan Rao as he was in need of money, the complainant in collusion with Mohan Rao, and taking advantage of the cheque in the possession filed the complaint for wrongful gain.

5. The case was taken on file by the learned Magistrate and in due course the trial went on.

6. In order to prove the case of the complainant, he himself was examined as P.W.1 and Ex.P1 to P6 are the documents marked.

7. In 313 examination the accused denied the incriminating material found in the evidence of P.W.1 but reported no defence evidence.

8. After hearing both counsel and on perusal of the entire material on record, the learned Magistrate convicted the accused for the offence under section 138 of N.I. Act and passed the sentence to undergo Simple Imprisonment for one year and also to pay a fine of Rs.2,000/­ i/d to suffer Simple Imprisonment for 3 months.

9. Aggrieved by the said impugned Judgment of conviction and sentence passed by the learned magistrate, the accused preferred the present appeal on the grounds that the Judgment of the lower court is illegal and against law. The learned Magistrate erred in relying the testimony of P.W.1 without there being any documentary evidence of lending the amount and the legal notice and the sworn statement of the complainant does not disclose the date of lending the amount. The learned Magistrate failed to appreciate that P.W.1 did not file any document to show his source of income to give such huge amount of Rs.5,00,000/­ so also to rebut the presumption under section 139 of N.I, the accused need not examine himself. Hence, prayed to allow the appeal by setting aside the judgment of conviction and sentence passed vide impugned judgment.

11. For better appreciation this court has gone through the entire record, pleadings and the evidence of P.W.1 and Ex.P.1 to P6 and other material on record. 

12. Now the points for determination are 

1.Whether the complainant has proved the guilt of the accused under section 138 of Negotiable Instrument

Act beyond all reasonable doubt.

2.Whether the judgment of the learned Magistrate convicting the appellant sentence passed is sustainable or it needs interference of this court while sitting in the appeal.

13. For establishing the charge under section 138 of

Negotiable Instrument Act, the complainant has to establish the following aspects.

(1) The cheque which is undisputed was issued by the accused in respect of his account maintained with his banker.

(2) the said cheque was issued in discharge of whole or part of the debt or other legal liability., (3) the cheque was returned un paid due to in sufficient funds., (4) the cheque was presented within six months from the date of its issuance., (5) The complainant has issued statutory notice intimating the accused about the dishonour of the cheque within time., and 6 (6) in respect of receiving the notice, the drawer of the cheque/accused did not make any payment within the statutory period of time.

14. The maintenance of the bank account by the accused drawing the cheque in respect of his account and returning of the cheque due to insufficient funds for which the prosecution would lie under section 138 of Negotiable Instrument Act .

15. Here it is not the case of the accused that the cheque under Ex.P.1 does not belong to him and he never signed on it (Ex.P.1) the signature on Ex.P.1 does not belong to him. But it is the case of the accused that he is not directly related to the complainant, but he gave a blank signed cheque to one Mohan Rao when he was in need of money, in collusion with one Mohan Rao,

P.W.1 got it and for wrongful gain filed the present case.

16. The learned counsel for the appellant argued that

Mohan Rao is the cousin brother of wife of P.W.1, the accused issued blank cheque to Mohan Rao, the complainant and Mohan

Rao are doing business as partners and Mohan Rao due some amount to the complainant, for which Mohan Rao gave that cheque to the complainant. But accused is no way has access with the complainant and no issued the cheque for discharging any liability.

It is the case of the complainant that accused borrowed an amount of Rs.5,00,000/­ and issued Ex.P.1 but failed to pay the amount when he presented the cheque which was returned with a memo under Ex.P2, dt.17.7.2009 after that he got issued a legal notice and requested the accused to pay the amount under Ex.P.4 and in spite of receiving the same under Ex.p.6, he did not choose to pay the amount. Though the accused denied the case of the complainant and pleaded innocence of the offence but did not choose to adduce any evidence on his behalf. In the cross examination P.W.1 it was elicited that he has not mentioned the date on which he lent the amount to the accused in the legal notice, complaint, sworn affidavit nor in his evidence affidavit. It is pertinent to mention here that P.W.1 is not in a position to say the date on which the amount was borrowed by the accused. Even in the cross examination a specific question was put to him that on what date, he lent that amount to the accused. Simple he stated that he lent the amount to the accused prior to the date mentioned in Ex.P.1. He further admitted that for the first time, in the cross examination he is stating that on receipt of Ex.P.1 he lent the amount to the accused. It is pertinent to mention here that in the cross examination he stated that he has acquaintance with the accused since 8 months prior to the issuance of Ex.P.1, he lent

Rs.2,00,000/­ to the accused and obtained some document in proof of the loan transaction and within one month the accused repaid the said Rs.2,00,000/­ and the said document was torned 8 off. From the above evidence, it clearly goes to show that when

P.W.1 gave Rs.2,00,000/­ to the accused he obtained some document in proof of the loan transaction. But in the present transaction, except Ex.P.1, he did not take any document from accused in proof of the loan transaction. P.W.1 in the cross examination stated that he cannot produce any document to show that he had Rs.5,00,000/­ with him at the time when he lend the amount to the accused. Except Ex.P1 no document filed to show that accused borrowed Rs.5,00,000/­ from him.

The learned counsel for the appellant argued that when the accused is able propablise his defence through the cross examination of P.W.1. The very fact that the complainant has not placed on record any material to peak of the lending of the amount to the accused is sufficient to infer that accused is able to rebut the presumption available in favour of the complainant under section 118 and 139 of NI.Act. For this proposition, he relief upon a decision which is reported in 2007 (3) ALT (Criminal) 38 AP in between G.Veerasam versus S.Sivasankare and another.

19. On perusal of the record, though the complainant proved that the cheque under Ex.P.1 signed by the accused and he presented the said cheque for encashment and it was returned with endorsement of funds insufficient and he issued the legal notice.

In spite of receiving the notice, the accused failed to pay the amount within 15 days from the date of the receipt of the notice 9 and in view of the admissions made by P.W.1 in the cross examination that he cannot say the date on which he lent

Rs.5,00,000/­ to the accused which appears to be not correct so also he cannot say the source of his getting Rs.5,00,000/­ as on the date of the lending the amount. Except stating that he lent the amount prior to date of Ex.P.1 which appears to be improbable?

Moreover, during the course of arguments, the learned counsel for the respondent filed memo stating that the complainant received the cheque amount which probablies the case of the accused that when he issued the cheque to one Mohan Rao who is the cousin of the defacto complainant and doing business with him, for security of the amount due to the defacto complainant, the said Mohan Rao gave this cheque to P.W.1 as P.W.1 could not say anything in respect of the date of borrowing or source of his income, he failed to prove the guilt of the accused for the offence under section 138 of

Negotiable Instrument Act.

20. In view of the above discussion, this court found the accused not guilty for the offence punishable under section 138 of

N.I. of Act. The impugned judgment of conviction and sentence passed is not sustainable. Accordingly, the appeal is allowed by setting aside the Judgment of conviction and sentence passed by the learned magistrate of lower court.

In the result, the appeal is allowed by setting aside the

Judgment of conviction and sentence passed by the lower court 10 against the accused and he is acquitted of the same under section 255 (1) of Cr.P.C. The accused is entitled for refund of the fine amount paid after expiry of the appeal time. The bail bonds of the accused shall stand cancelled after the expiry of appeal time.
