Heard, this petition filed the petitioner/complainant under section 311 CrPC praying this court to recall PW1 to got mark the register postal cover under which Ex.D1 was received by the counsel for the petitioner/complainant. The learned counsel for the petitioner submitted that the respondent during his cross examination disputed that the date of receipt of notice as 22-03-2017 but the petitioner counsel had received the notice on 12-07-2017 which is after the appearance of the respondent/the accused. The learned counsel for the petitioner further submitted that the register cover under which Ex.D1 was received by him was mixed with another file in his office and it is traced out now and the said document is very important and necessary to establish the service of Ex.D1 on him.
On the other hand the learned counsel for the respondent filed his courter where in the learned counsel submitted that he received legal notice in this case in the month of January, 2017 and he had issued reply to the said notice under Ex.D1 on 22-03-2017. The learned counsel for the respondent further submitted that the registered cover under which Ex.D1 was sent to the petitioner/complainant counsel has got no vital role to decide this case. Further PW1 has clearly admitted in his cross examination as to receipt of Ex.D1 reply notice, therefore recalling of PW1 at this stage is not desired and it is only the delay the proceeding and therefore prayed to dismiss the petition.
Perused the record. The present case is filed by petitioner/complainant under section 138 of NI Act. The trial in this case was commenced by examination of PW1 on 16-03-2018 and the prosecution evidence is closed on 24- 01-2020. The accused himself was examined on 18-01-2021 and after his evidence the matter was coming of for arguments. The present petition under section 311 CrPC is filed to got mark the register postal cover in which Ex.D1 was received by the learned counsel for the complainant. Admittedly, the reply notice said to have received by the learned petitioner counsel is already marked as Ex.D1. Further the document which sought to be marked before this court through PW1 by recalling him is not at all filed before this court, therefore the question of recalling of PW1 for marking of the registered postal cover which is not filed before this court, does not arise. Hence, this court is of considered view that the petition is devoid of merits.
Accordingly this petition is dismissed.

Immediately LW1 attended the said case and gave treatment to the injured. While so after some time i.e., around 2-00pm while he and LW1 were discussing about the other case records, they heard some noise outside of the hospital and two persons rushed to our room saying that “meeru doctorlara, how could to treat the injured without giving information to the police” and tried to assault and in the meantime LWs3 to 5 came to their rescue. LW1 immediately called the police and by the time the police visited the scene the two persons who assaulted them escaped from the scene. The said two persons obstructed them from discharging their duties. The accused standing in the court are the said persons who came over on them and assaulted and obstructed them from discharging their duties. Police examined and recorded his statement. What do you say?
Ans: Q.No.3:PW2/Dr.Rakesh Chandra, Asst.Professor has deposed that on 23-03-2017 around 10.30 am to 11-30 am after his duty hours he was in OP room with PW1, in the meantime one patient by name Hasan had visited the hospital with cut injury on his left hand. He found the patient was under shock he attended on him and gave treatment and the injury was sutured. Three hours after the said treatment two persons by name Vajith and Firoz had came to hospital and enquired about the doctor who is on duty and questioned the office staf as to how they can attend the patient with cut injury without informing the police. The said two persons also visited his room in abrasive manner and quarrelled with you and abused you and his staf and also threatened you with dire consequences, due to which he was forced to staf his work from discharging his duty. Later he informed the about the incident to the police and also lodged report. Police examined and recorded his statement. What do you say?

Thereafter on enquiry by him at the instance of you/A3 and found 10 kgs of raw chloral hydrate, 50 kgs of sugar, 20 kgs of soap nuts, 30 kgs of silver paste and 28 kgs of dried east and A3 confessed that the said items were supplied from A4. Thereafter he enquiry the labour revealed their particulars as you/A5 to A7 and confessed that you/accused have been working in the toddy depot in question and you have been adulterated toddy under the instructions of you/A1 and you/A8 was working as the driver of lorry in question, you/A9 is the owner of the lorry and with your help the other you/accused used to transport the adulterated toddy. Thereafter he has drawn 3 samples of each 450 ml and also seized the above articles and the lorry in question under a cover of panchanama and the remaining toddy was destroyed. You/accused A1, A3, A5, A6 and A7 were arrested. Thereafter the sample bottles case papers and you/accused were handed over to Lw-6 Syed Khaja Hussain for further investigation. What do you say ?

Thereafter on enquiry with you/A1 lead him to a small room in which found 10 kgs of raw chloral hydrate, 50 kgs of sugar, 20 kgs of soap nuts, 30 kgs of silver paste and 28 kgs of dried east and you/A1 confessed that chloral hydrate was supplied to them you/A4. Thereafter he proceeded to the lorry where he collected the samples from the contraband found in the lorry and on test he found that the said toddy was adulterated with chloral hydrate. On enquiry you/A3 and other 3 persons disclosed your particulars and also the roll of each of you/accused in toddy business in respect of toddy shop in question. he have drawn 3 samples from the vat and the toddy found in the lorry and sealed as per procedure. We have also drawn the samples out of 10 kgs of raw chloral hydrate, 50 kgs of sugar, 20 kgs of soap nuts, 30 kgs of silver paste and 28 kgs of dried east. MO-1 is the sample. Thereafter he arrested you/A1, A3, A5 to A7 and the case papers and the accused were handed over to Pw-5 for further investigation. What do you say ?

Q.No.5: PW.6 S.Krishna Kishore, P&ESI has deposed that 25-7-2007 at 7.30 am, on credible information of adulteration toddy at Toddy depot, Bijinepally, he along with Pws.2 & 4 went to Lattupally village and secured the presence of Pws. 1 & 2 and 5 raided on the toddy depot in Sy.No.90 at Bijinepally in the presence of Pws.1 & 2 and found you/A1, on which Pw-3 served search proceeding on you/A1 for search of the toddy depot. He also found that and one lorry bearing No. AP 22T 7189 with a load of 95 plastic crates containing 12 bottles each of 650 ml filled with toddy also found and further found one wooden vat in which you/A3 was mixing the toddy and three persons were filling toddy into the bottles and drawn samples from it and conducted the chloral hydrate test and found that the toddy was adulterated. Thereafter on enquiry with you/A1 lead him to a small room in which found 10 kgs of raw chloral hydrate, 50 kgs of sugar, 20 kgs of soap nuts, 30 kgs of silver paste and 28 kgs of dried east and you/A1 confessed that chloral hydrate was supplied to them you/A4. Thereafter he proceeded to the lorry where he collected the samples from the contraband found in the lorry and on test he found that the said toddy was adulterated with chloral hydrate. On enquiry you/A3 and other 3 persons disclosed your particulars and also the roll of each of you/accused in toddy business in respect of toddy shop in question. he have drawn 3 samples from the vat and the toddy found in the lorry and sealed as per procedure. We have also drawn the samples out of 10 kgs of raw chloral hydrate, 50 kgs of sugar, 20 kgs of soap nuts, 30 kgs of silver paste and 28 kgs of dried east. MO-1 is the sample. Thereafter he arrested you/A1, A3, A5 to A7 and the case papers and the accused were handed over to Pw-5 for further investigation. What do you say ?

Q.No.6: PW.7/A.Vijaya Bhaskar Reddy Excise Superintendent has deposed that on 25-7- 2007 the STF team consisting of PW3 to 6 raided on the toddy depot, Bijinapally and found the adulteries toddy and accordingly he seized raw CH, Yeast, Sugar, and also seized one lorry bearing No.AP22-T-7189. The STF staf have also you/A1 to A3, A5 to A7 and he handed over the papers to PW.5 along with you/accused and the contraband who registered the case. he has received the case record from Pw.5 and verified the investigation done by him and found on correct lines. Later he collected FSL report and the Lorry in question along with plastic crates containing bottles were deposited before the Dy. Commissioner, Excise, Mahabubnagar. After completion of investigation he filed charge sheet against you/accused. What do you say ?
