ORDER

Accused called present. Judgement pronounced VSO. \ In the result, the accused is found guilty for the offence under section 138 of Negotiable instruments Act, he is convicted under section 255(1) of Criminal Procedure Code. \ The accused is present, accused is heard on the quantum of the sentence. Accused stated that he is poor, having two children and Aadivasi. He further stated that Sunitha filed this case against him as there were old grudges between himself and herself, One Radhabai, Manaji, Devrao along with him participated in the auction, they failed to give cash but only one case against him filed. \ The Honble Supreme court in a decision between, Suresh kumar Vs Jagadeeshan, reported in 2002 Lwa Suit (SC) 49, held that it shou7ld be look out of trial court Magistrate that the sentence for the offence under section 138 of Negotiable instruments Act, 1881 should be of such a nature sas to give proper effect to the object of the legislation. No drawer of the cheque can be allowed to take dishonour of the cheque issued by him light heatedly. The very object of the enactment of the provisions like 138 of Negotiable instruments Act, 1881 would stand defeated if the sentence is flee bite in nature,l it is a different matter, if the accused is paid the amount at least during the pendency of the case. \ Honrable supreme court in another decision between R.Vijayan Vs Baby and another, reported in 2011 Lwa suit (SC) 1121, held that granting of compensation is must in cheque bounce cases to maintain uniformity in the decision of the court. It was helf tht As the provisions of Chapter XVII of the Act strongly lean towards grant of reimbursement of the loss by way of compensation, the courts should, unless there are special circumsstances, in all cases of

CC/420/20161 / 1 conviction, uniformly exercise the power to levy fine up to twice the cheque amount (keeping in view the cheque amount and the simple interes there on at 9 percent annum as the reasonable quantum of loss) and direct payment of such amount as compensation. Direction to pay compensation by way of restitution in regard to the loss on account of dishonour of the cheque should be practical and realistic, which would mean not only the payment of the cheque amount but interest there on at a reasonable rate. Uniformity and cosistency in deciding similar cases by different courts, not only increase the credibilty of cheque as a negotiable instrument but also the credibility of courts of Justice. \ With regard to default sentence, the Honble supreme court discussed in between K.Abbas H.S.A Vs Sabu Joseph and another, reported in 2010 Law suit S.C. 291, held that the default sentence can be imposed for non payment of compensation. \ \ In view of the above decision and on going through the facts and circumstances of the case, I am of the view that this is not a fit case to invoke PO Act. But circumstances are taken into consideration to take a lenient view to impose minimum sentence. \ \ Therefore, the accused is sentenced to under go simple imprisonment for six months for the offence under section 128 of Negotiable Instrument Act, and to pay compensation of Rs.3,20,000/- (Rupees three lakhs and twenty thousand) under section 357(3) of Criminal Procedure code, to the complainant in this case, In default of payment of compensation, accused shall under go three months simple imprisonment. \ \ The period of detention of accused, if any, set off under section 428 of Criminal Procedure Code. \ \ Accused is informed about his right of appeal and if he has no means to engage a counsel to prefer appeal, he is at liberty to approach the District Legal Services Authority, Adilabad, Dis
