This case came before me on this day i.e., 11.09.2021 for copies of documents under section 207 of Cr.P.C in the presence of Assistant Public Prosecutor for the State/complainant and the accused appeared party in person; upon perusing the material on record and this Court delivered the following:

J U D G M E N T

1.The Sub Inspector of Police, Nagari Urban Police Station laid charge sheet against the accused in Cr. No.114 of 2021 for the offences under Sec.269 & 270 of Indian Penal Code, 1860 (herein after referred as

IPC).

2. The brief facts of the case are that while the lockdown orders promulgated by the Central and State Governments are in force, on 11.05.2021 at about 12:15 P.M at Kuppaiah Chetty provision, store, On Nagari- Nagalapuram road, TR kandriga, Nagri, the accused was running a provision store and violated the lockdown orders negligently and he was spreading infection of Covid-19 disease which is dangerous to human life. Basing on the special report of LW3, the case was registered and investigated into. Hence, the charge.

3.This Court took cognizance of offences under Sec.269 & 270

IPC against the accused.

4.After receipt of summons accused present before this Court and copies of documents was furnished to him as contemplated under

Sec.207 Cr.P.C.

5.Accused is examined under section 251 of Cr.P.C for the offence under Sec.269 & 270 IPC by explaining the substance of the said offence in Telugu. Accused is having understood the offence alleged against him, he voluntarily pleaded guilty for the above offence.

Accused is warned of the consequences of pleading guilty, for which he still stated that he had committed the offence and that he is pleading guilty for the offence. The plea of accused appears to be voluntary and without any coercion or influence. So, the plea of accused is accepted by this Court. As section 269 & 270 of IPC is not attracted to the facts, hence charges under Section 269 & 270 of IPC is not proved.

6.In the result, the accused is found guilty for the offence under Sec.269 & 270 IPC and accordingly, he is convicted under

Sec.252 Cr.P.C for the above offence.

QUANTUM OF SENTENCE

7.Now the accused is questioned with regard to quantum of sentence to be imposed on him for the offence under Sec.269 & 270

IPC, for which, accused stated that he is living by running provision store and that he is the sole bread winner of his family and prayed for the mercy of this Court.

8.Having regard to the facts and circumstances of the case and keeping in view of the plea of the accused, it is a fit case to impose fine in lieu of imprisonment.

9.Accordingly, the accused is sentenced to pay a fine of

Rs.500/- (Rupees five hundred only) each for the offence under Sec.269 & 270 of IPC and in default of payment of fine amount, accused is sentenced to undergo simple imprisonment for a period of one month each for the aforesaid offence respectively.

Total fine amount is Rs.1,000/- (Rupees one thousand only).

Nagalapuram road Nagri mandal, the accused was drove his auto bearing Regn.No.AP03-TD-7830 with twelve female passengers, not wearing masks, not maintained social distance and violated the lockdown orders negligently and he was spreading infection of Covid-19 disease which is dangerous to human life. Basing on the special report of LW3, the case was registered and investigated into. Hence, the charge.

3.This Court took cognizance of offences under Sec.270 IPC against the accused.

1.The Sub Inspector of Police, Nagari Urban Police Station laid charge sheet against the accused in Cr. No.283 of 2020 for the offences under Sec.269 of Indian Penal Code, 1860 (herein after referred as IPC).

2.The brief facts of the case are that while the lockdown orders promulgated by the Central and State Governments are in force, on 27.05.2020 at about 08:45 P.M at Mandapam Junction, on Nagari-Puttur road, Nagari Municipality the accused was drove his Auto bearing Regn.No.AP03-Y- 2406 with four passengers, but they were wore face mask, not maintained social distance in his auto and violated the lockdown orders negligently and he was spreading infection of Covid-19 disease which is dangerous to human life. Basing on the special report of LW3, the case was registered and investigated into. Hence, the charge.

3.This Court took cognizance of offences under Sec.269 IPC against the accused.

4.After receipt of summons accused present before this Court and copies of documents was furnished to him as contemplated under

Sec.207 Cr.P.C.

5.Accused is examined under section 251 of Cr.P.C for the offence under Sec.269 IPC by explaining the substance of the said offence in Telugu. Accused is having understood the offence alleged against him, he voluntarily pleaded guilty for the above offence.

Accused is warned of the consequences of pleading guilty, for which he still stated that he had committed the offence and that he is pleading guilty for the offence. The plea of accused appears to be voluntary and without any coercion or influence. So, the plea of accused is accepted by this Court. As section 269 of IPC is not attracted to the facts, hence charges under Section 269 of IPC is not proved.

6.In the result, the accused is found guilty for the offence under Sec.269 IPC and accordingly, he is convicted under Sec.252

Cr.P.C for the above offence.

QUANTUM OF SENTENCE

7.Now the accused is questioned with regard to quantum of sentence to be imposed on him for the offence under Sec.269 IPC, for which, accused stated that he is living by running auto and that he is the sole bread winner of his family and prayed for the mercy of this Court.

8.Having regard to the facts and circumstances of the case and keeping in view of the plea of the accused, it is a fit case to impose fine in lieu of imprisonment.

9.Accordingly, the accused is sentenced to pay a fine of

Rs.500/- (Rupees five hundred only) for the offence under Sec.269 of IPC and in default of payment of fine amount, accused is sentenced to undergo simple imprisonment for a period of one month.

Total fine amount is Rs.500/- (Rupees five hundred only).
