This suit is filed for specific performance for registration of regular sale deed in pursuance of agreement of sale dated 26-10-2017 for the plaint schedule property and for delivery of possession and for costs of the suit.

Plaint Presented on 15-03-2018 and Registered on02-05-2018.

Value of the suit for the purpose of court fee and jurisdiction is Rs.4,04,000/- and a court fee or Rs.6,526/- is paid on plaint u/sec. 39 (a) of APCF and S.V. Act.

Cause of action for the suit arose on 26-10-2017 when the defendants 1 and 2 have executed a sale agreement in favour of the plaintiff after receiving an amount of Rs.2,04,000/- as an advance and on 24-1-2018 when the defendants 1 and 2 have received jointly an amount of Rs.1,00,000/- out of balance of sale consideration and on 16-2-2018 when the defendants 1 and 2 have jointly received an amount of Rs.60,000/- out of balance of sale consideration and made endorsements on the back of the sale agreement and on 3-3-2018 when the plaintiff issued a legal notice to the defendants 1 and 2 and when there is no reply after acknowledging the legal notice from the defendants 1 and 2 and where the properties is situated in Utakuru village polam limits, Parigi Mandal within the Jurisdiction of this Court.

This suit coming on this day for hearing before me in the presence of Sri P. Ramarathnam Sastry, Advocate for Plaintiff and of the Defendants having been remained exparte, upon perusing the material available on record and upon hearing the arguments and having stood over for consideration, till this day, this Court doth order and decree:

i That the defendants are hereby directed to execute registered sale

deed in respect of the suit schedule property in favour of the plaintiff on or before 25-09-2018 in pursuance of the agreement of sale dt.26-

10-2017 within one month from the date of judgment ;

ii That if the defendants failed to execute registered sale deed as

mentioned in clause No.1, the plaintiff is at liberty to get the registered sale deed through process of Law;

iii That the plaintiff is directed to deposit the balance of sale

consideration of Rs.40,000/- (Rupees forty thousand only) within one month under intimation to the defendants; and

iv That the defendants do pay to plaintiff a sum of Rs.16,528/-being the

costs of the suit.
