This case is coming before this Court on 24-04-2026 for final hearing and disposal in the presence of Sri. K. Sheshu, Learned Addl. Public Prosecutor(In charge) for the State and Sri. P. Srinivas Rao, Learned Advocate for the Accused, and upon hearing the arguments, upon considering the material available on record and the matter having stood over for consideration, till this day, the Court delivers the following:-

:: J U D G M E N T ::

1.This is a case of “Abetment of suicide’, for which the Sub Inspector of Police, P.S. Sadashivnagar, has filed charge sheet against the Accused for the offence punishable under section 306 of the Indian Penal Code(in short I.P.C).

2. The brief averments of the prosecution case are as follows:- 2.1.That on 23-04-2024 at 07-30 hours the defacto complainant/PW-1 came to police station, Sadashivnagar, and lodged a telugu scribed petition, in which stated that they had agriculture land admeasured 2.30 acres, in survey no. 339, situated in outskirts of Markal village, they were well possession in that land and raising various crops, adjacent land owners Accused No.1 and his brother Jogini Chinna Rajaiah together hatched a plan and had mutated 77 guntas of land from their Ac. 2-30 of land on favour of them, several times panchayath has been conducted

before their caste elders regarding 77 guntas of land, but Accused No.1

told that he would not give return to their land. On 20-04-2024 at about 8-30 p.m, when his brother Palle Nagaraju/PW-2 was walking towards

Palle Sayavva’s house to bring to his mother Palle Mallavva who was at

Palle Sayavva’s home, on that way Accused, Jogini Sayavva and Jogini

Balamani were sleeping, when Nagaraju reached to near their legs they all and Jogini Suman started abusing to Nagaraju in filthy language, mean while Palle Mallavva asked them as why they are abusing to her, upon that they also abused her indiscriminately like “Chavu Lanja” if she would have died it will be happy to them and said she has to die and thrown her on the ground, at that time Palle Nadipi Bhumaiah, Kottala

Beeraiah, Gouda Srikanth, Palle Gangamani were witnessed to the incident, due to which his mother Palle Mallavva vexed over her life and consumed grass poison at about 1-30 hours, immediately, they took his mother to Government hospital, Kamareddy, in 108 ambulance around 1-00 hours, on the doctor refer her mother was shifted to private hospital, Yellareddypeta. her videography in his mobile phone. Finally his mother was admitted to

Government hospital, Nizamabad on 21-04-2024 at 4-00 p.m, where while undergoing treatment his mother was died at 6-00 hours, on 23- 04-2024 hours, further they added that due to abets and motivate of

Accused No.1, Jogini Sayavva, Jogini Suman and Jogini Balamni words his mother vexed over her life and took extreme step by consumed grass poison. Hence, PW-1 set the criminal law into motion.

3.Basing on the report given by Lw-26/Kajal(MS)/ASP, IPS, SHO, SS

Nagar police station, has registered the case vide crime No. 109/2024 for the offence u/sec. 306 of the IPC against the Accused. During the course of investigation, examined and recorded the statement of PW-1.

Then, Lw-28 has visited to scene of offence situated at PW-1’s house

Markal village along with PW-1 and observed the scene of offence minutely, no incriminating material has been found for seize at crime scene, secured the scene panchas i.e., LW-20/Balle Beeraiah and LW- 21/Kotholla Yadagiri, in their presence drawn rough sketch and conducted scene of ofence panchanama in crime details form. Later, LW- 28 deputed LW-27/T. Gangasagar/ASI of police, Sadashivanagar, subjected to conduct inquest, Lw-27 immediately rushed to mortuary room of Government District Hospital, Nizamabad, where observed the dead body of the deceased and secured the inquest panchas i.e., LW- 22/Markanti Buchaiah and LW-23/Gangireddy Bhagyamma in their

presence conducted inquest over the deceased corpse from 10-30 to 12- 00 hours on 23-04-2024. LW-27 examined and recorded the statements of LW-2/Palle Rajaiah, PW-2 and PW-3, Lw-2/Sri Palle Rajaiah,

Lw-4/Markanti Bhoomaiah, Lw-6. On receipt of postmortem examination requisition letter filed by LW-27, the duty doctor held autopsy over the deceased corpse and preserved the viscera for FSL report. After postmortem examination deceased corpse was handed over to his kith and kin for funerals by taking acknowledgment on a receipt. Later, the

LW-27 came to police station and submitted the inquest acknowledgment

PME requisition and dead body handed over acknowledgment. Later, LW- 28 rushed to Markal village where he examined the Pws 4 and 5 and LW- 8/Gouda Srikanth and recorded their statements. On 24-04-2024 at 8-45 hours LW-28 rushed to the house of the Accused at Markal village and apprehended the Accused. On interrogation, the accused No.1 has voluntarily confessed to have committed this offence and brough him to police station at 10-00 hours and issued arrest memo against him and informed the grounds of his arrest to him and his relatives complied

U/sec. 50 Cr.P.C and completed all the mandatory provisions and being produced in the Court for judicial custody and lodged in District Jail at

Nizamabad. On 02-08-2024, PW-6 assumed CD file from LW-28 vide

D.O. No. A1/168/DPO-Kamareddy 2024, Dated: 02-08-2024 and found the investigation in correct lines. Later, PW-6 proceeded to the Markal

village of Sadashivnagar mandal and examined the other witness and examined and recorded his detailed statements of witnesses LW-10/M.

Beeraiah, LW-11/K. Pedda Beeraiah, LW-12/K. Nadipi Mallaiah, LW-13/P.

Beeraiah, LW-14/B. Bakkaiah, LW-15/D. Lingaiah, LW-16/D. Ramulu,

LW-17/B. Yadagoud, Lw-18/B. Rajaiah and LW-19/B. Siddaiah. As per the statement of witness the alleged Accused persons Nos 2 to 4 i.e.,

Jogini Sayavva, Jogini Suman and Jogini Balamani all R/o. Markal village of Sadashivnagar mandal were not involved in this case and their role is clearly not established in this case. As per the statements of above witnesses, the involvement of the Accused Nos 2 to 4 is not proved, hence, PW-6 prepare a letter for deletion of alleged accused persons

No.2 to 4 and sent to SDPO, Yellareddy and otbained deletion permission for not mentioning the alleged Accused Nos 2 to 4 all R/o. Markal village of Sadashivnagar mandal obtained deletion permission from SDPO,

Yellareddy vide No.27/CD-File/Del/SDPO-Yellareddy/2024, Dated on 21- 11-2024. After completion of investigation, PW-6, has filed charge sheet against the Accused for the offence under section 306 of the Indian Penal

Code.

4.The learned Addl. Judicial Magistrate of First Class–cum–Junior

civil Judge (Spl.Mobile) court, Kamareddy, has taken cognizance for the

offence punishable under section 306 of the Indian Penal Code against the Accused and registered the case as PRC No. 16 of 2025 and

committed the same to the Hon’ble Court of Sessions, Kamareddy. The

Hon’ble Prl. District & Sessions Judge, Kamareddy, has registered the

case as Sessions Case on file for the offence punishable u/sec. 306 of the

IPC against the Accused and made over the same to this Court for disposal according to law.

5.On appearance of the Accused before this Court, based on the material available on record, as well as the allegations leveled in the charge sheet, this Court has framed the charge against the Accused, for the offence punishable u/sec. 306 of the I.P.Cand explained to him, for which he pleaded not guilty and claimed to be tried.

6.During the trial, in order to prove the case of prosecution, it has examined PWs.1 to 6 out of 29 cited witnesses and got marked Exs.P1 to

P14. The prosecution/Lr. Addl. P.P. has given up the evidence of witnesses namely Lw-4/Markanti Bhoomaiah, LW-6/Gangaputra,

Lw-8/Gouda Srikanth, LW-10/M. Beeraiah, LW-11/K. Pedda Beeraiah,

LW-12/K. Nadipi Mallaiah, LW-13/P. Beeraiah, LW-14/B. Bakkaiah, LW- 15/D. Lingaiah, LW-16/D. Ramulu, LW-17/B. Yadagoud, Lw-18/B.

Rajaiah and LW-19/B. Siddaiah, LW-20/Balle Beeraiah, LW-21/Kotholla

Yadagiri, LW-22/Markanti Buchaiah, LW-23/Gangireddy Bhagyamma,

P.S. Sadashivnagar. The evidence of LW-2/Palle Rajaiah is closed as died on the copy of D.C filed by the prosecution.

7.After closure of prosecution evidence, the Accused was examined

U/sec 313 Criminal Procedure Code (in short Cr.P.C) by explaining the incriminating material appearing against him in the evidence of prosecution witness, for which he denied the same and reported no defence evidence on his behalf. Hence, defence evidence is closed.

8.Heard oral arguments of both side counsels and perused the material available on record.

9.Now the point for determination is :

1. “Whether the prosecution has proved the guilt of the Accused for the offence punishable u/sec. 306 of the IPC beyond all reasonable doubt ?”

On appreciation of oral and documentary evidence available on

record :

10.The present case on hand is registered as Session’s case for the offence punishable under section 306 Indian Penal Code (IPC) against the Accused. The case of the prosecution is that PW-1s family had agriculture land admeasured 2.30 acres, in survey No. 339, situated in outskirts of Markal village, Accused No.1 is adjacent land owner of PW- 1’s land. Sayavva’s house to call deceased to home who was at Palle Sayyavva’s home, on that way Accused No.1 was slapping, when Pw-2 reached to

Accused have started abusing to PW-2 filthy language, meantime deceased asked to Accused persons as why they are abusing PW-3, the

Accused started abused her indiscriminately like “Chavu Lanja”, if deceased would have died it will be happy to them and said she has to die at any costs, at that time PW-3 and PW-4 were eye witnessed to the incident, due to which deceased vexed over her life and consumed grass poison at about 1-30 p.m,. immediately, deceased was rushed to

Government hospital, Kamareddy in 108 ambulance around 1-00 hours, on the doctor refer deceased was shifted to Private Hospital,

Yellareddypeta. While deceased admitted in hospital staff have asked her that what was happened, while deceased was saying, PW-2 taken videography by mobile phone, in that video deceased said “NADHI

11.The prosecution to prove its case has examined PWs 1 to 6 witnesses and got marked Ex.P1 to Ex.P14 documents. PW-1 is the

Defacto-complainant and son of the deceased, PW-2 is witness and deceased’s younger son, PWs-3 to 5 are the eye witnesses and PW-6 is the Investigation officer.

12.From the entire prosecution witnesses, it is evident from the testimony of PW-1 and PW-2, they categorically deposed that “about two years back, his mother/deceased by name Palle Mallavva has consumed unknown pesticide in their house as she was suffering with health issues, due to which she was shifted to government hospital, Kamareddy, and from there his mother/deceased was shifted Nizamabad government hospital and she died after three days of consuming poison while undergoing treatment at Nizamabad government hospital. There police came and obtained PW-1 signature on white paper. They do not know the contents of the same, they did not give any complaint against the

Accused, PW-1 identified his signature on the report, signature is marked under Ex.P-1. The Learned Additional P.P declared the witnesses as

hostile and during their cross examination by the Learned APP nothing was elicited in favour of prosecution against the Accused, except marking report and their 161 Cr.P.C statement under Ex.P-1 to Ex.P-3.

13.PWs3 to 5 who are eye witnesses, they categorically deposed that they do not know anything about the case, they did not witness any incident happened, they do not know who is responsible for the death of the deceased, police did not examine them and not recorded their statements. The Learned Additional P.P declared the witnesses as hostile and during their cross examination by the Learned APP nothing was elicited in favour of prosecution against the Accused, except marking their 161 Cr.P.C statement under Ex.P-4 to Ex.P-6.

14.PW-06 who is the Investigation officer in the present case has deposed that on 23-04-2024 at about 7-30 hours LW-26/Kajal(MS) IPS, received written report from PW-1 under Ex.P-7, basing on the report she registered the case as in crime No. 109/2024 U/sec. 306 IPC and issued F.I.R under Ex.P-8, thereafter, LW-26 hand over the CD file to

LW-28, who in turn recorded the statement of PW-1 at police station, on the same day, LW-28/N. Raju/S.IP of P.S. Sadashivnagar, visited the scene of offence situated at the house of the PW-1 and secured the presence of LW-20/Balle Beeraiah and LW-21/Kotholla Yadagiri and in their presence recorded the scene of offence panchanama/C.D.F under

Ex.P-9. And LW-28 deputed LW-27/T. Gangasagar/ASI of police, P.S

Sadashivnagar, to conduct inquest, accordingly, LW-27 went to the Dist.

Government hospital, Nizamabad, and there secured the presence of

LW-22/MarkantiBuchaiah,LW-23/GangireddyBhagyamma,

LW-24/Gouda Shivaramulu and in their presence conducted inquest panchanama over the dead body of the deceased/Palle Mallevva under

Ex.P-10 and he also recorded the statements of Pws 2 and 3, LW-2/Palle

Rajaiah, LW-4/Markanti Bhoomaiah and LW-6 after that LW-27/T.

Gangasagar/ASI of police made requisition to LW-25 under Ex.P-11 to conduct P.M.E over the deceased body, and LW-25 issued P.M.E report under Ex.P-12 by preserving body parts of the deceased. Thereafter,

LW-27 hand over the deceased body to her family members for funerals only. Thereafter, LW-28 took the C.D file and went to the Markal village and there he recorded the statements of Pws 4, 5 and LW-8/Gouda

Srikanth, during the course of investigation, on 24-04-2024 LW-28 received credible information that the Accused was present at his house in Markal village, then LW-28 rushed along with his staff and apprehend the accused, on interrogation, the accused voluntarily confessed the guilt, then LW-28 send the Viscera of the deceased to FSL for analysis and report. Thereafter, on 02-08-2024 PW-6 received the C.D file in this case and verified the investigation done by the earlier I.O and found to be in correct lines. On 05-08-2024 he went to Markal village and there he secured the presence of witnesses i.e., LW-10/Malala Beeraiah, LW-

11/Kaapu Pedda Beeraiah, LW-12/Kottolla Nadipi Mallaiah,

LW-13/Pogaaku Beeraiah, Lw-14/Bulle Bakkaiah, Lw-15/Dharnin

Lingaiah, LW-16/Donthula Ramulu, LW-17/Bombothula Yadagoud, LW- 18/Bandari Rajaiah, LW-19/Bulle Siddaiah and recorded their statements, from the statements of witnesses it was not established any role against other Accused Nos 2 to 4, as such, he had applied letter to

S.D.P.O, Yellareddy, for deletion of the names of the other Accused i.e.,

Accused Nos 2 to 4 and he obtained deletion permission on 21-11-2024 from S.D.P.O, Yellareddy, thereafter, he had received FSL report of the deceased under Ex.P-13 and basing on the same, LW-25/Dr. Sudha,

Professor on 31-08-2024 has issued final P.M.E report under Ex.P-14.

After completion of investigation, he filed charge sheet against the

Accused, PWs 1 to 5 stated before them as in Ex.P-1 to Ex.P-6.

15.Hence, from the entire prosecution witnesses it was elicited that the main witnesses i.e,. PW-1 and 2 who are the defacto complainant and sons of the deceased and PWs-3 to 5 who are eye witnesses have totally turned hostile, except the evidence of Investigation officer/PW-6 none of the prosecution witnesses have supported the case of the prosecution due to which the prosecution has failed to established their case. And the Learned Addl. P.P has given up the evidence of all the remaining witnesses due to hostile of PWs 1 to 5. As such, except the evidence of PW-6 there is no material on record against the Accused and

also hostile of PWs 1 to 5 are fatal to the prosecution, due to which the prosecution has failed to prove the case against the accused beyond all reasonable doubt. Hence, Accused is entitled for acquittal. Accordingly, point No. 1 is answered.

Point No. 2:

16. In the result, The Accused is found not guilty for the offence punishable under Section 306 of the Indian Penal Code. Accordingly, the

Accused is acquitted, under Section 235(1) of Criminal Procedure Code.

The bail bonds of the Accused shall stands canceled after expiry of appeal time.

This case is coming before this Court on 20-04-2026 for final hearing and disposal in the presence of Sri K. Sheshu, Learned Additional Public Prosecutor (Incharge) and Sri M. Venkat Ram Reddy, Learned Advocate for the Accused, and upon hearing the arguments, upon considering the material available on record and the matter having stood over for consideration, till this day, the Court delivers the following:-

:: J U D G M E N T ::

1.This is a case of “Abetment of suicide”, for which the Sub

Inspector of Police, P.S. Rajampet, has filed charge sheet against the

Accused for the offence punishable under section 108 of the Bharatiya

Nyaya Sanhita, 2023 (in short B.N.S).

The brief averments of the prosecution case is as follows:-

2.That on 20-08-2024 at 5-00 p.m,, the PW-1/defacto complainant came to police station and lodged petition in which she stated that she have two sons elder son Lakavath Ganesh and younger son Lakavath

Mallesh. PW-1 younger son Mallesh performed marriage with Rajitha R/o.

Meergadda temple, they blessed with two sons 1. Rishinth, 2. Goutham,

Mallesh and her wife Ranjith quarreled with eacho ther in their family issue. As usually on 19-08-2024 at about night 10-30 hours Mallesh and his wife were quarrel with each other in the issue of chicken curry. Then,

Rajitha quarrel issue was told to her own elder sister by namely

Kethawath Shanthi W/o. Chandar, who was opposite to her house, immediately Shanti/Accused came to Rajitha’s house and grabbed

Mallesh coller and threw him against the wall and beaten with her hands.

PW-1’s younger son Mallesh got upset about above issue and went into

the room and drank unknown pesticide, immediately, defacto complainant/PW-1 took mallesh with the help of his elder son Ganesh to

Government hospital, Kamareddy, in a motor cycle. While undergoing treatment on 20-08-2024 at about afternoon 12-00 hours deceased

Lakavath Mallesh was died. Hence, she requested to take the necessary action against Kethavath Shanthi for caused her son Mallesh death, as per law. Hence, PW-1 set the criminal law into motion.

3.Basing on the report given by PW-1, PW-5 has registered the case vide in crime No. 111/2024 for the offence u/sec. 108 of the BNS against the Accused and issued F.I.R, and examined and recorded the statement of PW-1 at P.S Rajampet. Due to late night hours, PW-5 did not visit the crime scene and also hospital for P.M.E. On 21-08-2024, PW-5 visited government hospital, Kamareddy and observed deceased dead body in the presence of mediators and conducted inquest panchanama before inquest panchas i.e., LW-5/Nenavath Devidas and LW-6/Kethavath

Santhosh and examined the witnesses i.e., Pws-2 to 4 and recorded their statements. After that PW-5 filed a requisition to the duty medical officer to conduct the PME over the deceased. As per requisition the Duty

Medical officer was conducted autopsy over the deceased dead body from 10-30 hours to 12-30 hours and kept his opinion in pending for

FSL, after P.M.E the dead body was handed over to his relatives for funeral rites with proper acknowledgment. And PW-5 has visited the

scene of offence which is located at Salipally thanda of Gudi thanda village G.P of Rajampet mandal and in the presence of scene panchas i.e., LW-7/Kethavath Saibabu and LW-8/Kethavath Peerya conducted the scene of offence panchanama and drawn rough sketch in CDF and took the photographs of crime scene. On 25-08-2024, PW-5, received the

D.P.M.E report of the deceased Lakavath Mallesh, from LW-9/Dr.

Srilatha/CAS Government hospital, Kamareddy. On 28-08-2024 PW-5 prepared the letter of advise and send the viscera box for chemical examination. On 12-09-2024 at morning hours the PW-5 received credible information that the Accused was present in the village, on that the PW-5 along with staff PCO-417, WPC 2699 rushed to the Salipaly thand of Gudi thanda village and apprehended and admitted her guilt.

Then, PW-5 brought the Accused to police station at 10-00 hours. Then, the PW-5 issued arrest memo against her at about 11-30 hours and informed the grounds of her arrest to them and to her relatives complied

U/sec. 47 of BNSS, and 48 BNSS complied with the Accused persons and being produced her in the Court for judicial custody. On 20-09-2024 LW- 10 received the FSL report of the deceased from TFSL Red Hills,

Hyderabad, that Items 1 to 4 analyzed and organophosphate an insecticide poison is found in items. On 03-10-2024 LW-10 received the final opinion of deceased from LW-9/Dr. M. Srilatha, Asst. Professor,

General Surgeon, Government hospital, Kamareddy and she opined that

the deceased/Lakavath Mallesh was died due to “Organo Phosphorous poisoning”. After completion of investigation, PW-5 has filed charge sheet against the Accused for the offence under section 108 of the

Bharatiya Nyaya Sanhita, 2023.

4.The learned I Addl. Judicial Magistrate of First Class, Spl(Mobile),

Kamareddy, has taken cognizance for the offence punishable U/sec. 108 of Bharatiya Nyaya Sanhita against the Accused and registered the case as PRC No. 23 of 2024 and committed the same to the Hon’ble Court of

Sessions, Kamareddy. The Hon’ble Prl. District & Sessions Judge,

Kamareddy, has registered the case as Sessions Case on file for the offence punishable for the offence under section 108 of the Bharatiya

Nyaya Sanhita, 2023 against the Accused and made over the same to this Court for disposal according to law.

5.On appearance of the Accused before this Court, based on the material available on record, as well as the allegations leveled in the charge sheet, this Court has framed the charge against the Accused for the offence under section 108 of the Bharatiya Nyaya Sanhita, 2023 and explained to her, for which she pleaded not guilty and claimed to be tried.

6.During the trial, in order to prove the case of prosecution, it has examined PW’s.1 to 5 out of 10 cited witnesses and got marked Exs.P1

to P11. The prosecution/Lr. A.P.P has given up the evidence of witnesses namelyLW-5/NenavathDevidas,LW-6/KethavathSanthosh,

LW-7/Kethavath Saibabu, LW-8/Kethavath Peerya and LW-9/Dr. Srilatha,

Duty Medical Officer, Kamareddy Government hospital.

7.After closure of prosecution evidence, the Accused was examined

U/sec 313 Criminal Procedure Code(in short Cr.P.C) by explaining the incriminating material appearing against her in the evidence of prosecution witness, for which she denied the same and reported no defence evidence on her behalf. Hence, defence evidence was closed.

8.Heard oral arguments of both side counsels and perused the material available on record.

9.Now the point for determination is :

1 . “Whether the prosecution has proved the guilt of the Accused for the offence punishable u/sec. 108 of the BNS beyond all reasonable doubt ?”

2. “To what result?” Point No. 1:-

10.The case of the prosecution is that the defacto complainant/PW-1 had two sons elder son LW-2/Lakavath Ganesh and younger son deceased/Lakavath Mallesh were performed marriage with LW-3/Rajitha

R/o. Meergadda thanda, they blessed two sons 1. Rishinth 5 years, 2.

Goutham, 4 years. Deceased Mallesh and her wife Rajitha quarreled with

each other, in their family issue. As usually on 19-08-2024 at 10-30 p.m,

Mallesh ad his wife were quarrel with each other in the issue of chicken curry. Then, LW-3 quarrel issue was told to her own elder sister/Accused, who was opposite to her house. Immediately, Accused/Shanti @ Santhi came to PW-3’s house and grabbed deceased Mallesh collar and threw him against the wall and beaten with her hands. PW-1’s younger son

Mallesh got upset about Accused behaviour on him and went into the room and took unknown pesticide. Immediately, PW-1 took the deceased with the help of PW-2 to government hospital, Kamareddy on a motor cycle. While undergoing treatment on 20-08-2024 at about afternoon 12-00 hours deceased/Lakavath mallesh was died. The deceased committed suicide due to abetment and grabbed deceased collar and threw him against the wall and beaten with hands, for which he got upset on behaviour of Accused and committed suicide.

11.The prosecution has examined Pws 1 to 5 witnesses out of them

PW-1 is the defacto complainant and mother of deceased, PW-2 is the witness and brother of deceased and PW-3 is the witness and wife of deceased, PW-4 is witness and uncle of deceased and PW-5 is the investigation officer who filed charge sheet.

12.From the entire prosecution witnesses, it is evident from the testimonies of PW-1 to PW-4 as they categorically deposed at one voice that about one year back, deceased by name Lakavath mallesh has consumed unknown pesticide as he was suffering with unbearable stomach pain, due to which he was shifted to government hospital,

Kamareddy, and he died while undergoing treatment. There police came and obtained PW-1 thumb impression on white paper. They do not know the contents of the same, they did not give any complaint against the

Accused, police did not examine them and not recorded their statements. The Learned Additional P.P declared the witnesses as hostile and during their cross examination by the Learned APP nothing was elicited in favour of prosecution against the Accused, except marking their 180 BNSS statements under Ex.P-1 to Ex.P-4.

13.PW-05 who is the Investigation officer in the present case has deposed that on 20-08-2024 at about 5-00 p.m, he received written report from PW-1 under Ex.P-5 basing on the report, he registered the case as in crime No. 111/2024 U/sec. 108 of BNS and issued F.I.R under

Ex.P-6 and also recorded the statement of PW-1, on the next day i.e., on 21-08-2024 he went to government hospital, Kamareddy and there he secured the presence of LW-5/Nenavath Devidas and LW-6/Kethavath

Santhosh in their presence he conducted inquest panchanama over the dead body of the deceased by name Lakavath Mallesh under Ex.P-7 and

also recorded the statements of Pws 2 to 4, after that he made requisition to LW-9/Dr. Srilatha to conduct P.M.E over the dead body of the deceased, after completion of P.M.E he hand over the dead body of the deceased to his family members for funerals. On the same day, he visited to the scene of offence at about 15-00 hours and secured the presence of LW-7/Kethavath Saibabu and LW-8/Kethavath Peerya, in their presence he conducted scene of offence panchanama/C.D.F under

Ex.P-8. On 25-08-2024 he received PME report under Ex.P-9 from LW- 9/Dr. Srilatha, mentioning pending FSL report. On 28-08-2024 he sent the body parts of the deceased to FSL for analysis. During the course of investigation, on 12-09-2024 at morning hours, he received credible information that the accused was present in her village, then he rushed along with his staff and apprehended the Accused, on interrogation, the accused voluntarily confessed the guilt, then he came to police station along with the Accused and effected her arrest and produced her before the Hon’ble Addl. J.F.C.M, Kamareddy, for judicial remand, thereafter, on 20-09-2024 he had received FSL report of the deceased under Ex.P-10 and basing on the same LW-9/Dr. Srilatha on 03-10-2024 has issued final P.M.E report under Ex.P-11. After completion of investigation, he filed charge sheet against the Accused. Pws 1 to 4 stated before him as in Ex.P-1 to Ex.P-4. During the course of cross examination, he denied all the suggestions given by the counsel for the Accused.

14.Hence, from the entire prosecution witnesses it was elicited that the main witnesses i.e,. PWs 1 to 4 who are family members of the deceased have totally turned hostile, except the evidence of

Investigation officer/PW-5 none of the prosecution witnesses have supported the case of the prosecution due to which the prosecution has failed to established their case. And the Learned Addl. P.P has given up the evidence of all the remaining witnesses due to hostile of PWs 1 to 4.

As such, except the evidence of PW-5 there is no material on record against the Accused and also hostile of PWs 1 to 4 is fatal to the prosecution, due to which the prosecution has failed to prove the case against the accused beyond all reasonable doubt. Hence, Accused is entitled for acquittal. Accordingly, point No. 1 is answered.

Point No. 2:

15. In the result, The Accused is found not guilty for the offence punishable under Section 108 of the Bharatiya Nyaya Sanhita.

Accordingly, the Accused is acquitted, under Section 258(1) of B.N.S.S, 2023. The bail bonds of the Accused shall stands canceled after expiry of appeal time.

The brief averments of the prosecution case is as follows:- 2.1.That on 25-04-2025 at 03-00 p.m, the PW-1/defacto complainant came to police station and lodged petition in which stated that earlier two years her relative named Mangali Yashwanth/Accused had sent the messages to her snap chat mobile application like he is liking her, he fall in love with her and he would marry to her. She refused his proposal and said to him that she will marry to someone who should shown by her parents, ever since Yashwanth have not sent a message to her. On 24- 04-2025 at about 10-00 p.m, she and her mother ate supper and slept in two separate rooms, later on 24/25-04-2025 intervening 12-00 hours she heard that someone is knocking her house doors, then she asked who is outside, he replied that he is Yashwanth, on that she opened

doors and asked him as why he came here in mid night, the Yashwanth, started harassing her by saying that he is liking her, since many days, he is loving her and he will marry her and behaved obscenely with her, immediately she get back into house and closed her house doors.

Accused/Yashwanth has been harassing her since many days by forwarding marriage proposal before her despite she refused to him.

Hence, PW-1 set the criminal law into motion.

3.Basing on the report, PW-4, has registered the case vide in crime

No. 104/2025 for the offences u/sec. 75 and 78 of the BNS against the

Accused and examined and recorded the statement of PW-1. During the course of investigation, PW-4 directed to LW-7/C. Prameela, WASI of P.S.

Sadashivnagar, to record the statement of Pw-1. And as per the direction of PW-4, the LW-7 examined PW-1 and recorded her statement. Then,

PW-4 visited the scene of offence situated at PW-1’s home situated in

Markal village and observed the scene of offence in the presence of two mediators i.e., LW-5/Dokuri Rajareddy and LW-6/Bombothula Yadagoud and conducted the scene of offence panchanama and drawn the rough sketch of the scene. And PW-4 took up the photographs. Later examined the circumstantial witness i.e., Pws 2 and 3 and LW-4/Mangali Anasuya and recorded their statements. On 28-04-2025, PW-4 aligned the

Accused and the Accused admitted his guilt offence in this case. Later,

PW-4 issued 35(3) BNSS notice to the Accused and instructed him to

appear before the Hon’ble court as and when received summons from the court. After completion of investigation, PW-4 has filed charge sheet against the Accused for the offences under section 75 and 78 of the

Kamareddy, has taken cognizance for the offences punishable U/sec. 75 and 78 of Bharatiya Nyaya Sanhita against the Accused and registered the case as PRC No. 14 of 2025 and committed the same to the Hon’ble

10.The case of the prosecution is that the PW-1 and the Accused were relatives. The Accused has sent the messages to her Snap Chat mobile application stating that he was in love with her and he want to marry her. On this the Pw-1 and her family members denied the request of the

Accused. On 24-04-2025, the father of the PW-1 i.e., Pw-3 went to the house of the Accused to attend a function in the house of the Accused on

that day, after having supper, the PW-1 and her mother/PW-2 went to sleep in their rooms. Then on 25-04-2025 at 12-00 hours, the Accused came to the house of the PW-1 and knocked the door, on hearing this, the PW-1 asked that who has come there, then the Accused replied he was Yaswanth, then the PW-1 opened the door and came out from the house and questioned him “why he came here”. Then the Accused replied that he loves her, and he misbehaved with her, then the PW-1 fell afraid and went into the house and closed the door.

11.The prosecution has examined Pws 1 to 4 witnesses out of them

PW-1 is the defacto complainant, PWs-2 and PW-3 are the parents of the

PW-1 and PW-4 is the investigation officer who filed charge sheet.

12.From the entire prosecution witnesses, it is evident from the testimonies of Pws-1 to 3 that they categorically deposed at one voice that about one year back some galata took place between them and the

Accused parents at agriculture fields for which they went to police station, there somebody obtained Pw-1 signature on white paper. They do not know the contents of the report given to the police, they did not give any complaint against the Accused, they do not know anything about this case and PW-1 identifies her signature on the report given to the police, hence, signature is marked under Ex.P-1. 13.PW-04 who is the Investigation officer in the present case has deposed that on 25-04-2024 at about 3-00 p.m, he received written report from PW-1 under Ex.P-5 and basing on the report he registered the case as in crime No. 104/2025 u/sec. 75 and 78 of BNS and issued

F.I.R., under Ex.P-6, during the course of investigation, LW-7/W.A.S.I has recorded the statement of PW-1, on the same day he went to the scene of offence i.e., house of the PW-1 and there he secured the presence of

LW-5/Dokuri Raja Reddy and LW-6/Bombothula Yadagoud and in their presence he conducted scene of offence panchanama/C.D.F under Ex.P-7 and also he recorded the statements of Pws 2, and 3 and LW-4/Mangali

Anasuya. On 28-04-2025 the Accused himself came to the police station and admitted his guilt, then he issued notice u/sec. 35(3) of BNSs and directed the Accused to appear the before the Court after receipt of summons, after completion of investigation, he filed charge sheet against the Accused, Pws 1 to 3 stated before him as in Ex.P-2 to P-4.

During cross examination PW-4 has denied all the suggestions given by the counsel for the Accused.

14.Hence, from the entire prosecution witnesses it was elicited that the main witnesses i.e,. PW-1 who is the defacto complainant and PWs-2

and 3 who are the parents of the PW-1, the above all witnesses have totally turned hostile, except the evidence of Investigation officer/PW-4 none of the prosecution witnesses have supported the case of the prosecution due to which the prosecution has failed to established their case. And the Learned Addl. P.P has given up the evidence of all the remaining witnesses due to hostile of PWs 1 to 3. As such, except the evidence of PW-4 there is no material on record against the Accused and also hostile of PWs 1 to 3 is fatal to the prosecution, due to which the prosecution has failed to prove the case against the accused beyond all reasonable doubt. Hence, Accused is entitled for acquittal. Accordingly, point No. 1 is answered.

Point No. 2:

15. In the result, The Accused is found not guilty for the offences punishable under section 75 and 78 of the Bharatiya Nyaya Sanhita, 2023. Accordingly, the Accused is acquitted, under Section 258(1) of

Criminal Procedure Code. The bail bonds of the Accused shall stands canceled after expiry of appeal time.

And Defendant remained set exparte and upon hearing the arguments, upon considering the material available on record and the matter h aving stood over for consideration, till this day, the Court delivers the following:-

1.The plaintiff bank has filed this suit for recovery of an amount of Rs.

13,78,888/- (Rupees Thirteen Lakhs Seventy Eight Thousand Eight Hundred and Eighty Eight only) from the Defendant with future interest @ 11.55% p.a. with monthly rests from the date of the suit to till the date of its realization of the entire suit amount against the Defendant and to pass a

decree for recovery of an amount of Rs. 13,78,888/- against the Defendant with future interest @ 11.55% p.a with monthly rests from the date of suit till the date of realization of the amount and to award the costs of the suit may be awarded to the plaintiff and to award any other relief or reliefs as this Hon’ble Court deem fit and proper in the circumstances of the case.

2.The Brief facts of the case of the plaintiff bank is as follows :- 2.1.That the plaintiff bank is financier to firms, industries, Advancing loans to agriculturists, personal loans, Housing Loans apart from other banking activity in Kamareddy and surrounding villages.

2.2.And the Defendant is a State Government Employee working under the Telangana State Girijan Co operative Corporation Ltd., Government of Telangana, Tribal Welfare Department came to the Bank and approached the Bank Officials requested for advances personal loan scheme variant Xpress Credit Elite on Dated: 21-09-2023, for the purpose to meet personal expenses under the Term Loan amount of Rs. 15,00,000/- vide Application No. 101230920024537 with rate of interest of 11.05% p.a running account to be repayable in 72 installments with Rs.28,590/- EMI under the Scheme Code: X press Credit A/c. No.42286919173. And that the Defendant is due to the plaintiff bank the present outstanding loan amount of Rs. 13,78,888/- including interest, charges, penalties etc as on 02-07-2025. As such, the account was turned into NPA on 01-03-2025. The plaintiff bank has been demanding the Defendant to make payment of loan with interest, as such the Defendant became liable individually and he is liable to pay due amount to the bank. Hence, the Defendant is liable to pay the above said personal loan account with interest, penal interest and costs etc., of charges which workout Rs.13,78,888/-(Rs.12,87,706/0 principal amount + Rs. 91,182/- interest from Dated: 01-03-2025 to Dated: 02-07-2025). Grand total amount = Rs. 13,78,888/-. As the Defendant did not discharge his liabilities, the plaintiff is also caused to issue a legal notice through its/their advocate which was acknowledged by the Defendant, and another notice is returned to the sender, still he is not cared to make payment of the suit amount. That the details of the principal amount and interest are

shown in the statement of Account maintained by the plaintiff bank as usual course of business. Hence, this suit. The plaintiff bank is herewith filing the office copy of legal notice sent to the Defendant along with the registered postal receipts and returned registered post cover tot he sender which was addressed to the Defendant. The plaintiff bank is also filing the true extract the statement of account duly certified under Banker’s book of evidence Act. As the Defendant have defaulted in payment of personal loan, the plaintiff bank has every right to recover the entire dues. The above facts constitutes the cause of action for the plaintiff bank to file the suit against the Defendant. Hence, filed the present suit.

3.After receipt of the summons, Defendant appeared before this Court through his counsel but failed to file written statement and there was no representation by the counsel for the Defendant before this Court though statutory period of 90 days exhausted, hence, Defendant is set exparte on 10-12-2025.

4.Now the point for consideration is:

i. “Whether the plaintiff is entitled for recovery of the suit amount from the defendant ”? ii. “ If so, to What relief”?

5.During the course of trial, in order to prove its case, the Plaintiff bank examined its present Branch manager as PW-1 and got marked as Ex.

A-1 to Ex. A-10 documents. On perusal of the documents shows that:- i.Ex.A-1 is original express Credit Loan application given by the Defendant to the bank, Dated: 21-09-2023. ii.Ex.A-2 is original arrangement letter executed between the Defendant and the plaintiff bank for term loan amount of Rs.15,00,000/-, Dated: 21-09-2023. iii. Ex.A-3 is Original Personal loan agreement between the Defendant and the plaintiff bank, Dated: 21-09-2023. iv. Ex.A-4 is original control report scheme name Express Credit,

Issue No. 1:

7.This suit is filed by the plaintiff bank for recovery of money based on

Ex.A1/Original Express Credit Loan application given by the Defendant to the bank, Dated: 21-09-2023 and Ex.A-2 to A-10, which shows transaction with regard to loan application and sanctioning of the same between the plaintiff bank and Defendant and also the legal notice issued by the plaintiff bank to the Defendant. 8.Whereas PW-1/plaintiff in his chief examination has reiterated the contents of the plaint. The evidence of PW-1 coupled with Ex.A-1 to A-10 substantiates the pleadings of the plaintiff and proves the case of the Plaintiff.

The above said oral and documentary evidence as discussed in brief supra is fully supported with the oral evidence of PW-1 to prove the pleading of the plaint, even though the Defendant remained exparte and the plaintiff evidence is unchallenged. This Court holds that the plaintiff bank has proved the suit claim and entitled for recovery of suit amount together with interest and costs and the Defendant is liable to pay the said amount. Accordingly, the point No. 1 is answered in favour of the plaintiff against the Defendant.

Issue No.2: “ To What Relief”?

10.In the result, the suit is decreed in favour of the Plaintiff bank and against the Defendant. The Defendant is liable to pay the suit amount of Rs.13,78,888/- (Rupees Thirteen Lakhs Seventy Eight Thousand Eight Hundred and Eighty Eight only) with interest @ 11.55 % per annum from the date of suit till the date of decree and interest @ 6 % per annum from the date of decree till the date of

realization.
