This case is coming before me in the presence of A.P.P.O representing the prosecution and of Sri M. Suresh Reddy, for the accused person, having heard and stood over, till this day for consideration, this Court passed the following:
:: COMMITTAL ORDER::
1. The Inspector of Police, Seerole has fled a charge sheet against the
Accused No.1 in Cr.No. 156/2024 of Seerole PS, for the ofence under
Section. 109 of BNS.
2. The brief facts of the case of the prosecution are that:
On 15.11.2024 at 20.30 hours the complainant/LW1 G. Ramulu lodged a report before police Seerole alleging that he has agriculture land on the outskirts of their village, beside their land, the land of their villager
Patthi Anjaiah/Accused is situated. To go to his agriculture land, he has to take pathway from the land of Accused, so for the last 4-5 years quarrels
PRC. 03 of 20252 Dt. 01.05.2025 going on. In this regard 4-5 times panchayaths held by the elders and they set up path way and fied boundary. Though Accused did not listen the words of elders and quarreling with him. In the month of June, 2022
Accused damaged the motor cycle of his son G. Sudhakar, at that time he lodge complaint at P.S. and case registered against him. About 4-days back to establish Primary Health Centre (PHC) the Revenue Department authorities measured the land on the outskirts of Seerole village and allotted land, in which about 20 guntas of land Accused going, so he suspected that, his son Sudhakar is responsible for losing of his land, keeping it in the mind on 15.11.2024 at about 04.30 pm, his son Sudhakar went to Harvestor and while returning back on his Motor Cycle No. TS 26
H 7463 on the way when he reached at ZPHS School, Accused who was coming driving his tractor No. TS 26 T 3011 on seeing his son keeping previous land dispute in the mind with intention to kill his son, dashed to his son with tractor, that his son fell down and the motor cycle fell on him, that he thought his son was not died, that he reverse the tractor and run over on his son, his son fell into the SRSP canal situated by the side by shouting, this was witnessed by Adige Uppalaiah and rushed to his son and informed to him and his daughter-in-law over phone. Immediately he and his daughter-in-law Gangarapu Jyothi rushed there and found his son lying in the canal with injuries. He and his daughter-in-law taken him to
Govt. Hospital, Mahabubabad. Hence requested to take necessary action against Accused.
3. On receipt of report the LW17/Ch. Nagesh, the then Sub-Inspector of
Police, Seerole registered a case against Accused person after completion of investigation charge sheet was fled by him against accused person.

4.On perusal of the record, this court has taken cognizance for the ofence punishable under Section. 109 of BNS. On appearance of the accused person copies were furnished to him. Since the ofence under section 109 of BNS against A1 eiclusively triable by Hon'ble sessions Court, as such this case is committed to the Hon'ble session court under section 209(a). Accused person is on bail shall continue to be on bail. under section 209 (b). Submit the case records and the property if any to the Hon’ble Court of Sessions, Mahabubabad under Section 209(c) Cr.P.C. Notifed the learned Public Prosecutor, Mahabubabad about the commitment of the case to the Hon’ble
Sessions Court, Mahabubabad under Section 209(d) Cr.P.C. When questioned,
the accused person submitted that he has sufcient means to engage a lawyer in the Hon’ble Court of Sessions, Mahabubabad. Accused person bound over to appear before the Hon’ble Court of Sessions, Mahabubabad on receipt of summons.
