Sangeetha, Counsel for accused persons having been heard and stood over for consideration till this day, this Court delivered the following:-
* J U D G M E N T *
1.The Sub-Inspector of Police, Bellampalli-I Town has filed charge-sheet in Cr.No.34/2020 for the offence punishable U/s.120(b), 417, 420, 468, 472, 473, 498-A of IPC against the accused no.1 to 3.
2. The brief facts of the prosecution case are as follows:
On 18.03.2020 at 2100 hours the complainant/LW1/Marpu
Soumya went to Police station Bellampalli-I Town and lodged a written petition stating that in the month of April 2018 while she was working as
Fashion Designer and residing at Srinagar colony, Hyderabad, accused no.1 made friendship with her deceitfully induced her and offered her to provide
Senior Associate Job in SBI, and also proposed to marry her. After some time on 19.05.2018 he brought an job appointment order of SBI Koti
Branch, Hyderabad and informed that for the procurement of job they have asked to give Rs.13,00,000/- Rupees, out of which he will give Rs.6,75,000/- and he asked her to give Rs.6,25,000/-. Believing the words of Karthik, she gave net cash that he will provide Rs 42.000.00/loan to her mother Nirmala
Devi for "Ladies Garments making and hotel Functioning" so that she has to deposit 25% of Margin money ic. Rs.10.50,000/-in Somajiguda Industrial sector bank, he asked her to give Rs. 10,50,000/- and he will deposit the amount in the bank. Believing his words, his mother gave some net cash to
Karthik, and deposited some amount in the ICICI bank A/c.

No.006901582617 of Lalitha who is mother of Karthik and also deposited remaining amount in the SBI A/c no.62476224456 of Sandhya Rani. On 19.07.2018 he brought copy of SBI loan sanctioned letter, and Bank cash with drawl forms and given to her. he further informed her that he also provide Senior Associate Job in SBI to her younger brother Sukirth babu and asked to provide Rs: 6,00,000/-. Believing the words of accused no.1 she gave some amount directly to him and some amount deposited in the A/c of
Lalitha & Sandhya Rani accused no.2 and 3 herein, Further he took
Rs.5,00,000/- for the kidney transplantation of his Mother. Later he proposed her to marry him immediately as the condition of his Mother is very serious. Believing the words of accused no.1, her mother urgently fixed the date of marriage and on 07-9-2018 her marriage with accused no.1
Karthik was held in Joseph church at Bellampalli in the present of her family members. After the marriage she lead marital life with accused no.1 in her house at Bellampalli for one week, Later he assured her that, within months after taking the consent of his family member he will take her to his house to lead marital life and went to Hyderabad. After few days she posted the marriage photos in Facebook, After seeing the photos his mother Lalitha and
Sister in law Sandya Rani made a phone call to her and abused her and threatened her saying the if she came to Hyderabad they will kill her. Later she made a phone call to accused no.1 and asked him that in the appointment order the due date of joining is 18-09-2018, She asked him that can she go for the job, upon which on 22.09.2018 accused no.1 came to her home at Bellampalli and asked her to give additional amount of 4 of 9

Rs.3,00,000/- for the Job, When she express her inability to give money he harassed her mentally & physically, when she asked him to take her to his house, he replied that for the purpose of money only he married her, not for living with her. Later she went to SBI Headquarter Branch at Koti Hyderabad and enquired about the appointment letters and loan sanction letter, she came to know that all the letters and documents given by accused no.1 are fake and forged documents, She tried to en-cash the Kotak bank Cheque, given by accused no.1 for security the bank authorities informed that there is no sufficient balance in the amount. Hence, she requested to take necessary action against the persons who deceitfully induced her and cheated her.
3.Basing on the complaint of LW1, LW10/M. Rajendra Prasad, SI of
Police, Bellampalli-I Town has registered a case in Cr.No.4/2020 U/sec.
120(8), 417, 420, 468, 472, 473, 498(A) IPC and issued FIR to all concerned and took up the investigation. During the course of investigation, the LW10 examined and recorded the statement of LW1. Later he visited the scene of offence i.e., the house of LW1 situated in Station Road colony, Bellampalli, examined and recorded the statements of LW2/Konidela Nirmala Devi,
LW3/Konidela Sukeerth Babu, LW4/Rasapalli Jospeh, LW5/Kagitha
Nagarathanamma and drafted CDF in the presence of mediators LW6/Sk.
Sajidh, LW7/Md. Sameer. Later the LW10 sent requisitions to the Managers of ICICI, SBI, Kotak Mahindra Banks and obtained Bank transactions statements of ICICI bank A/c.No.006901582617, of Lalitha (A-2), SBI A/c no.62476224456 of Sandhya Rani (A-3), Kotak Bank A/C No. 62446224456 5 of 9

of Karthik (A-1).
On 29-9-2020 the LW10 served Notices u/s 41-A Cr.P.C to the accused no.2 and 3 with instructions to appear before the LW10 at PS Bellampalli-I town on 01-10-2020 at 1000 hours to ascertain the facts and to defend the case. But the accused no.2 and 3 did not appear before the LW10 on due date and violated the provisions u/s 41-A Cr.P.C. accused no.1 to 3 approached the Hon'ble High Court for the State of Telangana at Hyderabad and filed a petition vide Criminal Petition No. 5706 of 2020 for Anticipatory
Bail. Upon which the Hon'ble High court issued orders dated 19-11-2020 in the above criminal petition and granting Anticipatory Bail to the Accused no.1 to 3 and also directed the accused no.1 to 3 to surrender before the
SHO Bellampalli-I town, and the SHO shall release the accused on their executing a bonds for sum of Rs.10,000/- each with two sureties.
On 26-11-2020 at 1600 hours the accused no.1 came to P.S. and surrendered before the LW10 at Police station Bellampalli-I town.
Immediately the LW10 secured the presence of mediators LW8/Maddela Gopi
Krishna, LW9/Budida Odesh and interviewed the accused no.1 in their presence. During the course of interview the accused no.1 voluntarily confessed to have committed the offence. The LW10 recorded the detailed confessional statement of accused no.1 in the presence of above said mediators. On 26-11-2020 at 1700 hours the accused no.2 and 3 also surrendered before the LW10 at Police station Bellampalli-I town. The LW10 interviewed the accused no.2 and 3. Thoroughly During the course of interview the accused no.2 and 3 voluntarily confessed to have committed 6 of 9

the offence. The LW10 issued surrender memos of accused no.1 to 3 and released the accused accused no.1 to 3 on bail after obtaining surety bonds of Rs. 10,000/- each with two sureties. After completion of investigation,
LW10 filed charge sheet against accused no.1 to 3 before this court.
4.This court took cognizance of the offences punishable U/s.120(b), 417, 420, 468, 472, 473, 498-A of IPC against accused no.1 to 3.
5. On appearance of accused person before the Court, copies of all documents that are relied upon by the prosecution side were furnished to accused persons as required under section 207 Cr.P.C.
6.Accused no.1 to 3 are examined under section 239 of Cr.P.C., charge
U/s.120(b), 417, 420, 468, 472, 473, 498-A of IPC framed against them.
The contents of the charges were read over and explained to him in his vernacular language, for which accused person pleaded not guilty and claimed to be tried.
7.In order to establish the guilt of accused, the prosecution got examined Three witnesses i.e., PW1/Marpu Soumya/Complainant,
PW2/Konidela Nirmala Devi/Mother of PW1 and PW3/Konidela Sukeerth
Babu/Brother of PW1, has got marked as in Ex.P1 is the signature of PW1 on report, Ex.P2 is the 161 CrPC statement of PW1, Ex.P3 is the 161 CrPC statement of PW2, Ex.P4 is the 161 CrPC statement of PW3. The learned
Assistant Public Prosecutor given up the remaining witnesses and reported prosecution evidence is closed.
8.After closure of the prosecution evidence, the 313 CrPC examination of the accused person is dispensed with as there is no incriminating evidence 7 of 9

against accused persons.
9.Heard the learned Assistant Public Prosecutor and the learned counsel
for the accused persons.
10.Now the point for determination is,
Whether the prosecution has established the guilt of the accused for
the offence punishable under section U/s.120(b), 417, 420, 468, 472,
473, 498-A of IPC and beyond all reasonable doubts?
11. POINT: -
(i).PW1 who is the Complainant deposed that her marriage was performed with accused no.1 on 07.09.2018 at Joseph Church, Radagambala
Basthi. After marriage due to some petty issues she filed report against the accused persons. Later a panchayath was held before elders and there they compromised this matter. Police never examined and recorded her statement. Ex.P1 is the signature of PW1 on report. During cross examination PW1 denied that police recorded her statement. Ex.P2 is 161
CrPC statement of PW1. PW1 admitted that she has compromised the case out of the court.

(ii). PW2 and 3 are the mother and brother of PW1 deposed that PW1 marriage was performed with accused no.1 on 07.09.2018 at Joseph Church,
Radagambala Basthi. After marriage due to some petty issues PW1 filed report against the accused persons. Later a panchayath was held before elders and there they compromised this matter. Police never examined and recorded their statements. During cross examination PW2 and 3 denied that 8 of 9

police recorded their statement. Ex.P3 and Ex.P4 are 161 CrPC statements of
PW3 and 4. PW2 and 3 admitted that they have compromised the case out of the court.

Therefore, upon careful scrutiny of the above testimony of PW1, who is the complainant, PW2 and 3 are the Mother and Brother of PW1, PW1, 2 did not depose anything about the case and against the accused. PW1 just stated that, her marriage was performed with accused no.1 on 07.09.2018 at Joseph Church, Radagambala Basthi. After marriage due to some petty issues she filed report against the accused persons. Later a panchayath was held before elders and there they compromised this matter. PW2 and 3 also deposed similar. Here, the material witnesses PW1 tp PW3 turned hostile and did not support the case of the prosecution in any manner. PW1 admitted that the matter was compromised with the accused persons.
Therefore learned Assistant Public Prosecutor has given-up the remaining witnesses, as no purpose would be served by examining other witnesses. As such, there is no evidence against the accused persons on record to prove the case of the prosecution. In view of these factors, this Court is of the considered opinion that the prosecution failed to prove the guilt of the accused beyond reasonable doubt, thereby accused is entitled for benefit of doubt. The point is answered accordingly.
13. IN THE RESULT, the accused no.1 to 3 are found not guilty for the offence punishable U/s.120(b), 417, 420, 468, 472, 473, 498-A of IPC against accused persons and accordingly they are acquitted of the same under sec.248(1) CrPC. The bails bonds executed by the accused by the 9 of 9

accused persons shall stand cancelled after the expiry of six months as contemplated under sec.437A CrPC.
