JUDGMENT

Complainant/Injured/LW1 and LW2 and Accused no.1 and 2 are present. Prosecution filed joint memo requesting to refer the matter to Lok Adlath since they compromise the case. In view of compromise between the parties on application to compromise the matter which is punishable U/Sec.323 of IPC which are compoundable nature with permission of the court, since the parties are willing to settle the mater as they settled the matter out of the court. There fore the offence U/sec 323 of IPC is compoundable and the same are compounded by the victim with the permission of the court. Accordingly in view of compromise arose in between them. Accordingly the accused no.1 and 2 are acquitted U/sec.320(8) Cr.P.C. for the offence U/s 323 r/w 34 of IPC, the bail bonds of the accused executed earlier shall stands cancelled forthwith, since there is no case property seized and deposited, therefore there is no order as to case property.

1. The accused is/are acquitted of the offence/offences punishable under 323,324,34 of INDIAN PENAL CODE, 323,324,34 of INDIAN PENAL CODE, 323,324,34 of INDIAN PENAL CODE, 323,324,34 of INDIAN PENAL CODE, vide Section 235(1) or 248 (1) or 255(1) of the Code of Criminal Procedure.

2. His bail bonds are cancelled. He is set at liberty.

3. After appeal period,

ORDER

Plaintiff present. The learned counsel for plaintiff stated that she is not intending to proceed with the case as they settled the matter out of the Court and permit her to withdraw the present suit, and after hearing plaintiff, since plaintiff does not want to proceed with the present case against the defendants, since the plaintiff is at liberty to with draw the suit at her request, the present petition is allowed and she is permitted to withdraw the present suit, and the plaintiff endorsed n the suit as not pressed. Therefore the present suit is dismissed against defendants, hence the suit is dismissed as withdrawn.
