This petition is coming on this day for final hearing before me in the presence of Sri N.Krishna Reddy, Advocate for Petitioner and Respondent is having remained exparte, this court made the following :-

O R D E R

Petition filed by the petitioner under section 13 (1) (1a) (1b) of Hindu

Marriage Act, praying to dissolve the marriage between the petitioner and respondent held on in the year 2002 by granting decree of divorce and for costs of the petition.

2. Petitioner is present. Filed affidavit of chief examination. Ex.P1 and P2 are marked. Heard learned counsel for the petitioner. Perused the record. The averrments of the petitioner and evidence disclose that the marriage of the petitioner with the respondent took place in the year 2002 at the house of the respondent and both of them lived together happily for some time and she begot three male children. The respondent is addicted to drinking and started suspecting fidelity of petitioner. The respondent used to beat the petitioner for no fault of her.

Even the parents of respondent used to ill treat the petitioner. Unable to bear the treatment petitioner went away her parents house and residing there. Even then, the respondent and his parents used to harass her. The report given to police against them did not make any change in their attitude. Hence this petition for dissolution of marriage and grant of divorce.

The unchallenged testimony of PW.1 supported by Ex.P1 and P2 disclose as to the ill treatment of petitioner by respondent and his parents. Petitioner has been living at her parents house with her three minor children. There is no possibility of reunion between the petitioner and respondent and the marriage was irretrievably broken down. Therefore the petitioner is entitled for decree of divorce by dissolution of their marriage.

3. In the result, Petition is allowed by dissolving the marriage between the petitioner and the respondent and accordingly a decree of divorce is granted.

This petition is coming on this day for final hearing before me in the presence of Sri C.Nagaraja, Advocate for Petitioner and Respondent is having remained exparte, this court made the following :-

O R D E R

Petition filed by the petitioner under section 13 (1) (1a) (1b) of Hindu

Marriage Act, prays to pass decree of divorce by dissolving the marriage between the petitioner and respondent held on 22-8-2008 on the ground of cruelty and for costs of the petition.

2. Petitioner is present. Filed affidavit of chief examination. Ex.P1 is marked. Heard learned counsel for the petitioner. Perused the record. The averrments of the petitioner and evidence discloses that the marriage of the petitioner with the respondent took place on 22-8-2008 at the house of the respondent and both of them lived together happily for some time. The respondent is addicted to drinking and started coming to house at late nights. When she questioned him about his behaviour he used to beat her abusing in filthy language.

A mediation was held but it proved futile. About 4 years back she was beaten and necked out of the house. Since then she has been residing her parents house at

Thettupalli. The respondent has harassed her physically and mentally and there is no possibility of reunion. Hence she requests to grant divorce.

The unchallenged testimony of PW.1 supported by Ex.P1 discloses as to the ill treatment of petitioner by respondent and his parents. Petitioner has been living at her parents house. There is no possibility of reunion between the petitioner and respondent and the marriage was irretrievably broken down.

Therefore the petitioner is entitled for decree of divorce by dissolution of their marriage.

3. In the result, Petition is allowed by dissolving the marriage between the petitioner and the respondent and accordingly a decree of divorce is granted.
