In the result, I found the accused guilty for the offence U/Sec.3(a) Railway Property (Unlawful possession)Act 1966 and he is convicted U/Sec.248(2) Cr.P.C. When questioned regarding the quantum of sentence to be imposed, the accused submitted that he has got 2 daughters and dependent old parents and prayed to take a lenient view. Considering the facts and dicrumstances and the plea submitted by the accused, and alsoconsidering the cost of the property involved in this case, this court is not inclined to invoke the provisions of P.O.Act and the following sentence would meet the ends of justice. The accused is sentenced to undergo R.I., for four(4) months for the offence U/Sec.3(a) of Railway Property (Unlawful Possession) Act 1966. The period of imprisonment already undergone by the accused i.e., 120 days from 27-12-2012 to 25- 04-2013 (both days inclusive) shall be set off U/Sec.428 Cr.P.C. Mo.1 shall be returned to the converned Railway Authorities after appeal time is over. The accused was informed that he is having right of appeal on the Judgment passed by this court. He was also informed that he can approach the District Legal Services Authorit, Anantapur if he is having no means to engage an advocate at the stage of appeal.
