This suit is coming up before me for final hearing in the presence of Sri M.V

Pawan Kumar Advocate for the Plaintiff and Defendant remained Exparte, after hearing and on perusing the material on record and having been stood over for consideration till this day, this Court delivered the following:

1) This suit is filed by the plaintiff firm for grant of preliminary decree for recovery of money of Rs.5,34,106/- (Rupees Five Lakhs Thirty Four Thousand

One Hundred and Six only) and costs and future interest at the rate of 36 % P.A

2 and directing him that in default of payment of the said amount the plaintiff shall be entitled to apply for final decree, directing the mortgaged property or sufficient part thereon be sold and the sale proceeds be paid to the plaintiff to the extent due under the decree and the balance if any be paid to the defendants &

2) The brief facts of the plaint is as follows :

2.1) The Plaintiff is a Non-Banking Finance Company engaged in the business of lending. Defendant No.1 approached the Plaintiff and applied for an Enterprise Finance Expansion Loan of Rs.5,00,000/- on 30.10.2021, offering Defendant Nos.2 and 3 as guarantors. The Plaintiff sanctioned the loan on the same day on agreed terms. As per the loan agreement,

Defendant No.1 agreed to repay a total sum of Rs.8,33,040/- including interest, in 60 monthly installments of Rs.17,355/- each, and issued post- dated cheques towards repayment. Defendant Nos.2 and 3 stood as sureties, and Defendant No.2 created a mortgage over the schedule property by depositing title deeds bearing Document No.8740 of 2021 dated 30.10.2021.

Defendant No.2 is the wife of Defendant No.1.

2.2) The defendant No.1 paid only Rs.3,99,618/- towards loan amount and failed to pay remaining installments as agreed. The plaintiff company demanded the defendants to pay the amount but in vain. Finally the plaintiff issued legal notice through Sri. M. V. Pavan Kumar, Advocate

3 given reply to the notice. Hence, the Plaintiff has filed the present suit for recovery of the said amount from the Defendants, who are jointly and severally liable.

3) Despite serving of summons on defendants, failed to appear before the court hence the Defendant D1 to D3 are set exparte on 11.11.2025.

4) Plaintiff firm is represented by Sri T. Ramakrishna who filed affidavit in lieu of examination in chief and got marked Ex.A1 to Ex.A10 on his behalf.

5) Now the point for consideration is:

1)Whether the Plaintiff bank is entitled for the recovery of the suit claim amount along with interest ?

2) Whether the plaintiff is entitled for preliminary decree?

Point :

6) It is the simple case of plaintiff that defendant No.1 approached their bank and had obtained expansion of loan however after obtaining the loan amount, defendant failed to pay the installments regularly which warranted the plaintiff to come up with the present suit. Further defendant Nos.2 and 3 stood as sureties, and Defendant No.2 created a mortgage over the schedule property by depositing title deeds bearing Document No. 8740 of 2021 dated 30.10.2021 which she obtained through registered gift settlement deed vide Doc.

No.6569/2021 dt: 29-07-2021. The suit amount is Rs.5,34,106/-. The plaintiff marked Ex.A1 to A10 on his behalf.

7) Ex. A1 is the loan application, dt: 30.10.2021, Ex. A2 is loan agreement and

Ex. A3 sanction advice where in it shows that the Defendant No.1 obtained loan of Rs.5,00,000/- and Defendant No. 2 & 3 stood as guarantors. Ex. A4 shows that the property was mortgaged in favour of plaintiff by defendant No.1. Ex. A9 is the power of attorney executed in favour of T. Ramakrishna for looking after the cases. Ex. A10 shows that there is an outstanding amount of Rs.5,34,106/-. The

Ex. A5 is legal notice addressed to defendant No.1 to 3 and the Ex. A6 & A7 shows that the same were delivered to the defendant No.1 & 2 and Ex. A8 is the certificate of incorporation, dt:04.12.2024.

8) The oral evidence of the plaintiff coupled with the documentary evidence substantiates the case of the plaintiff for the recovery of the amount as sought.

On the other hand defendants neither appeared nor contested the suit claim and did not put forth any rebuttal evidence as such plaintiff is entitled to the relief as claimed for.

9) In the result, the suit is decreed preliminary with costs directing the defendants to pay an amount of Rs.5,34,106/- (Rupees Five Lakhs Thirty Four

Thousand One Hundred and Six only) with an interest of 36% per annum from the date of suit till the date of decree and with future interest of 6% per annum from the date of decree till the date of realization. Time for redemption is six months.

10)The defendants are given six months time from today to redeem the

5 mortgage and if the defendants fail to redeem the mortgage within time given by the court, the plaintiff is at liberty to apply for final decree for sale of property.

11)If the sale proceeds of the mortgage of the property is not sufficient to discharge the loan amount, the defendants are personally liable for balance amount. The balance sale proceeds, after full satisfaction of the loan amount, shall be paid to the Defendants.

This suit is coming up before me for final hearing in the presence of Sri M.V

1) This suit is filed by the plaintiff firm for grant of preliminary decree for recovery of money of Rs.5,34,106/- (Rupees Five Lakhs Thirty Four Thousand

One Hundred and Six only) and costs and future interest at the rate of 36 % P.A

2) The brief facts of the plaint is as follows :

Defendant No.2 is the wife of Defendant No.1.

3 given reply to the notice. Hence, the Plaintiff has filed the present suit for recovery of the said amount from the Defendants, who are jointly and severally liable.

3) Despite serving of summons on defendants, failed to appear before the court hence the Defendant D1 to D3 are set exparte on 11.11.2025.

4) Plaintiff firm is represented by Sri T. Ramakrishna who filed affidavit in lieu of examination in chief and got marked Ex.A1 to Ex.A10 on his behalf.

5) Now the point for consideration is:

1)Whether the Plaintiff bank is entitled for the recovery of the suit claim amount along with interest ?

2) Whether the plaintiff is entitled for preliminary decree?

Point :

No.6569/2021 dt: 29-07-2021. The suit amount is Rs.5,34,106/-. The plaintiff marked Ex.A1 to A10 on his behalf.

7) Ex. A1 is the loan application, dt: 30.10.2021, Ex. A2 is loan agreement and

Ex. A5 is legal notice addressed to defendant No.1 to 3 and the Ex. A6 & A7 shows that the same were delivered to the defendant No.1 & 2 and Ex. A8 is the certificate of incorporation, dt:04.12.2024.

8) The oral evidence of the plaintiff coupled with the documentary evidence substantiates the case of the plaintiff for the recovery of the amount as sought.

On the other hand defendants neither appeared nor contested the suit claim and did not put forth any rebuttal evidence as such plaintiff is entitled to the relief as claimed for.

9) In the result, the suit is decreed preliminary with costs directing the defendants to pay an amount of Rs.5,34,106/- (Rupees Five Lakhs Thirty Four

10)The defendants are given six months time from today to redeem the

5 mortgage and if the defendants fail to redeem the mortgage within time given by the court, the plaintiff is at liberty to apply for final decree for sale of property.
