This suit coming on 30.4.2013 for hearing before me in the presence of Sri P.Lakshmaiah, Advocate for the plaintiff and the defendant having been set ex parte on 24.1.2013, upon perusal of the material, Oral and documentary evidence available on record and this matter having stood over till this day for consideration, this Court made the following:

J U D G M E N T

This is a suit filed by the plaintiff for recovery of

Rs.20,64,000/- (Rupees twenty lakhs sixty four thousand only) being the principal and interest due on a pronote dated 19.7.2009 executed by the defendant.

2.The allegations in the plaint, in brief are that

The defendant borrowed Rs.12,00,000/- from the plaintiff and executed promissory note on 19.7.2009 and later, on demands, he issued cheque for Rs.18,00,000/-. When presented, the same was bounced. He also lodged a complaint in

C.C.No.5/2012 on the file of III Additional Junior Civil Judge,

Ongole for the offence under section 138 of Negotiable

Instruments Act. As the defendant failed to discharge the amount, he filed the suit.

3.The defendant remained ex parte.

4.Now the point for consideration is:

Whether the plaintiff is entitled for the suit claim?

5.Issue No.1:-

The plaintiff filed his chief affidavit and also the chief affidavits of P.Ws. 2 to 4, who are the attestors and scribe of the promissory note marked as Ex.A1. He also marked Ex.A2-copy of the complaint filed under section 138 of Negotiable Instruments

Act. The testimony of P.W.1 coupled with chief affidavits of P.Ws.

2 to 4 and Exs.A1 an A2 clearly shows, after borrowing Rs.12 lakhs from the plaintiff, the defendant executed promissory note and failed to pay the same. Hence, in these circumstances, the suit is liable to be decreed. This point is answered accordingly.

6.In the result, the suit is decreed for a sum of Rs.20,64,000/- (Rupees twenty lakhs fixty four thousand only) with costs and subsequent interest at the rate of 9% p.a. from the date of the suit till the date of decree and thereafter at the rate of 6% p.a.

till realization, on the principal sum of Rs.12,00,000/- (Rupees twelve lakhs only).

This is a suit filed by the plaintiff for recovery of Rs.10,54,453/- (Rupees ten lakhs fifty four thousand four hundred and fifty three only) being the principal and interest due on a pronote dated 8.2.2012 executed by the defendant. Cause of action for the suit arose on 8.2.2012 when the defendant borrowed Rs.8 lakhs from the plaintiff and executed suit promissory note in favour of the defendant agreeing to repay the same with interest at the rate of Rs.2-60 ps. per hundred per month, when the defendant failed to repay the amount inspite of demanded made by the plaintiff both oral and written, at Ongole where the transaction took place and both parties reside within the jurisdiction of this Court.

The suit is valued at Rs. 10,54,453/- being the principal amount of Rs.8,00,000/- and Rs.2,54,453/- being the interest at Rs.2.60 Ps. per hundred per month from 8.2.2012 to 15.2.2013.

Value of the suit for the purpose of jurisdiction is Rs.10,54,453/-. This suit coming on 26.6.2013 for hearing before me in the presence of Sri K. This is a petition filed by the petitioner wife under Section 10(ix) of Divorce Act for grant of divorce.

2. The allegations in the petition, in brief, are that

The petitioner married the respondent on 9.6.1999 at

Santharavuru village, Chinaganam Mandal, Prakasam District as per

Christian rites and later she joined the respondent and the marriage was consummated. She has also got a male child, who is living with her.

After the marriage, there was change in the attitude of the respondent and he subjected her to cruelty. He also demanded additional dowry of

Rs.50,000/- and later necked her out from the house in the month of

May, 2001 and since 12 years, she has been residing separately and hence, under these circumstances, she sought divorce on the ground of desertion.

3. The respondent remained ex pate.

4. The petitioner filed her chief affidavit reiterating the allegations in the petition and exhibited Exs.A1 and A2, which are the marriage certificate and marriage photos. The allegations in the chief affidavit would indicate that the respondent, without any reasonable cause and excuse, deserted her and also subjected her to cruelty. Hence, under these circumstances, the petitioner is entitled for divorce.

5. In the result, the petition is allowed with costs and the marriage between the petitioner and respondent is hereby dissolved.

Inspite of mediations and efforts, the respondent did not respond and he also necked out her from matrimonial house and since then she has been residing in her parents’ house since February, 2011.

Under these circumstances, she sought for divorce on the ground of desertion and cruelty.

3. The respondent remained ex pate.

4. The petitioner filed her chief affidavit reiterating the allegations in the petition and exhibited Exs.A1 and A2, which are the marriage photos and marriage certificate. As seen from the allegations in the affidavit, the respondent subjected the petitioner to cruelty and also deserted her.

5. In the result, the petition is allowed with costs and the marriage between the petitioner and respondent is hereby dissolved.

before the police on every Wednesday and Sunday, as he is a coolie

and thereby losing his livelihood.

2. As seen from the facts of the case, bail was granted on 12.5.2014 and since then he has been complying with the condition and no breach is reported so far. Bail was granted on the ground that almost entire investigation is completed and only FSL is awaited. Hence, under these circumstances, the condition of directing the petitioner/accused to attend before the SHO, Ongole

Taluk P.S. on every Wednesday and Sunday is herby relaxed.

3. In the result, the petition is allowed and the condition imposed against the petitioner/accused dated 12.5.2014 in

Crl.M.P.No.356/2014 directing him to attend before the SHO,

Ongole Taluk P.S. on every Wednesday and Sunday in between 10.00 a.m. and 2.00 p.m. is hereby relaxed.

3. As seen from the C.D., investigation is not yet completed and some more witnesses are to be examined. Considering the nature of the offence alleged to have been committed by the accused, it is not desirable to let him on bail at this stage and hence the petition is dismissed.
