This suit is coming before me on 23.04.2026 for hearing in the presence of M/s.Aparajitha, Sri M.Srikanth, Advocates for plaintiffs No.1 and 2 and D1 to D3 were set exparte, and after having perused the evidence adduced and having been heard and having stood over for consideration till this day, this Court delivered the following:

J U D G M E N T

1.This is a suit filed by the plaintiffs No.1 and 2 seeking relief of declaration that they are the only legal heirs of Late Smt Tanuku

Lakshmi, who died intestate on 25.09.2021, to represent Late Smt

Tanuku Lakshmi and her estate.

2. The brief contents of the plaint are as follows:

The deceased Late Smt Tanuku Lakshmi is the wife of plaintiff No.1 and mother of plaintiff No.2. Late Smt Tanuku Lakshmi died on 25.09.2021, leaving behind the plaintiffs No.1 and 2 as her legal heirs.

The deceased Late Smt Tanuku Lakshmi was the owner of Plot No.3 admeasuring 200 sq.yards in survey No.98 situated at Nagireddy palli

Village, Maheshwaram Mandal, which is herein after to be referred to as suit schedule “A” property, and also plot No.13 admeasuring 200 sq.yards or 167.2 sq.meters situated at Mothighanapur Village, Balanagar Mandal,

Mahabubnagar District, Sub District Jadcherla, which is herein after to be referred to as suit schedule “B” property, having purchased the same under registered sale deed bearing doc.Nos.10408/2008, dtd.24.12.2008 and 7886/2012, dtd.05.10.2012 respectively. After the death of Late Smt

Tanuku Lakshmi, Plaintiffs No.1 and 2 came into possession of the suit schedule property. On 17.06.2022, plaintiff No.1 approached defendant

No.1 for issuance of a legal heir certificate, but defendant No.1 advised him to approach the competent Civil Court. Hence, the suit.

3. Summons were served to D1 and D2. D1 and D2 were called absent and no representation on behalf of D1 and D2 was made. Hence,

D1 and D2 were set exparte. Paper publication was effected against D3.

None appeared and no objections were received. Hence, D3 was also set exparte.

4. In order to prove their claim, Plaintiff No.1 was examined as PW1.

Ex.A1 to Ex.A9 were marked.

5. Heard the Learned Counsel for plaintiffs. Perused the record.

6. Now the point for consideration is :

“Whether the plaintiffs No.1 and 2 proved the death of

Late Smt Tanuku Lakshmi and if so, whether plaintiffs are legal

heirs and are entitled to represent her estate including suit

schedule property?”

POINT:-

7. The contention of the plaintiffs is that they are the legal heirs of Late

Smt Tanuku Lakshmi, who died on 25.09.2021. To substantiate the said contention, plaintiff No.1 got himself examined as PW1. PW1 testified the plaint averments in his examination-in-chief. Ex.A1 to Ex.A9 are brought on record by PW1. Ex.A1 is the Meeseva death certificate of Lakshmi

Tanuku, dtd.06.10.2021 issued by the Sub-Registrar of Births and Deaths,

Begumpet. Ex.A2 is the true copy of registered sale deed bearing doc.No.10408/2008, dtd.24.12.2008. Ex.A3 is the Meeseva registered sale deed bearing doc.No.7886/2012, dtd.05.10.2012. Ex.A4 is the statement of encumbrance on property, dtd.09.01.2025 issued by SRO,

Maheswaram. Ex.A5 is the statement of encumbrance on property, dtd.18.01.2025 issued by SRO, Jedcherla. Ex.A6 is the General Power of

Attorney, dtd.03.12.2024. Ex.A6 is the General Power of Attorney, dtd.03.12.2024. Ex.A7 is the Aadhar card of deceased/Lakshmi Tanuku.

Ex.A8 and Ex.A9 are the aadhar cards of plaintiffs No.1 and 2 respectively.

8. To prove their case, plaintiffs filed Ex.A1 to Ex.A9. Ex.A2 and Ex.A3 sale deeds show that Late Smt Tanuku Lakshmi purchased the suit schedule “A” and “B” properties respectively. The statement of encumbrance on property, dtd.09.01.2025 issued by SRO, Maheswaram and the statement of encumbrance on property, dtd.18.01.2025 issued by

SRO, Jedcherla were brought on record as Ex.A4 and Ex.A5. From Ex.A2 to Ex.A5, it is clear that Late Smt Tanuku Lakshmi was the owner of the suit schedule ”A” and “B” properties. Further, Ex.A1 death certificate of

Smt Tanuku Lakshmi clearly shows that she died on 25.09.2021. Ex.A1 further reveals that Smt Tanuku Lakshmi is the wife of plaintiff No.1. Also,

Ex.A7 aadhar card of Smt Tanuku Lakshmi reveals that she is the wife of plaintiff No.1. Ex.A9 aadhar card of plaintiff No.2 clearly shows that she is the daughter of plaintiff No.1. Therefore, from Ex.A1, ExA7 and Ex.A9, it is clear that plaintiff No.2 is the daughter of plaintiff No.1 and Late Smt

Tanuku Lakshmi. Also, PW1 testified that except plaintiffs herein, there are no other legal heirs to Late Smt Tanuku Lakshmi. The evidence of PW1 is unchallenged. Also, this Court did not receive any rival claim despite paper publication. Therefore, this Court on the strength of evidence of PW1, coupled with Ex.A1 to Ex.A7 and Ex.A9 holds that the deceased Smt

Tanuku Lakshmi died intestate on 25.09.2021 leaving behind plaintiffs

No.1 and 2 as her legal heirs. Hence, plaintiffs No.1 and 2 are entitled to the estate of the deceased Smt Tanuku Lakshmi. Accordingly, this point is answered in favour of plaintiffs No.1 and 2.

9. In the result, suit is decreed by declaring the plaintiffs No.1 and 2 as the legal heirs of Late Smt Tanuku Lakshmi, who died intestate on 25.09.2021, to represent Late Smt Tanuku Lakshmi and her estate. No order as to costs.
