This case coming today before me for final hearing in the presence of the learned Assistant Public Prosecutor for the complainant and the accused himself with the assistance of learned Legal Aid Counsel and upon hearing, perused the material on record and having stood over for consideration till this day, this Court delivered the following:-

J U D G M E N T

The accused has been arraigned before this Court for the offenses punishable under Sections 457, 380 of Indian Penal Code (herein after referred as ‘IPC’) in Cr. No.207/2019 of Balajinagar P.S. Nellore.

2. The brief material averments of the prosecution case are as follows:

Modem Sathyanarayana Gupta/LW1 has been running Sri

Venkateswara Steels and Cements shop situated on Mini Bypass road,

Nellore city since last 20 years. He along with his son Raja Karthik/LW3 used to look after the business and used to open the shop by 9 am in the morning and closed it by night at 9 PM, Olla Venkatesh/LW4 and Pujari

Muni Sekhar/LW5 are working in the shop of defacto complainant. As usual 2CC.No.603/2021 on 28.10.2019 night defacto complainant locked his shop night at 9 PM and went to home. In the night hours some unknown offenders gained entrance into the shop by removing the roof sheet of the shop and committed theft of cash of Rs.4000/- in the cash counter and decamped with the booty. On 29.10.2020 Modem Sathyanarayana Gupta/LW1 gave a report in the police station and basing on the report, a case was registered in Cr.No.207/2019 and investigated into, K.Venkateswara Rao/LW09, ASI,

Balaji Nagar PS, Nellore visited scene of offence and examined witnesses and prepared rough sketch.

During the course of investigation, on 09.11.2020 at 14.30 hours, S.

Moulani, S.I. of Police, Koyilakuntla PS, Kurnool District arrested accused in their case in Cr.No.207/2020 for the offence under sec.457 & 380 IPC in the presence of mediators ie., Dudekula Shafiya/LW6 and Bandela Obulesu /LW7 and recorded his statement under cover of mahazarnama. During the course of confession, the accused admitted his involvement in this case

before the above said mediators and stated that he spent away the said

amount and so no property was seized relating to this case. On 02.12.2020

K.Pavan Kumar/LW10, SI of Police, Balajinagar PS, Nellore produced accused before this court in this crime on execution of PT warrant and remanded to judicial custody in this case. After completion of entire investigation, K. Pavan Kumar/LW10, SI of Police, Balajinagar PS, Nellor filed charge sheet for the offense under section 457, 380 Indian Penal Code against accused. Hence the charges.

3. This Court has taken the cognizance of the offences punishable under Sections u/s. 457, 380 or alternatively u/s 411 of IPC against the accused and proceeded.

4. Copies of documents as contemplated under Sec.207

Cr.P.C. were furnished to the accused through concerned jail authorities.

5.Accused was examined under Section 239 Cr.P.C. through

Blue jeans when produced from the District Jail, Kurnool, Charges for the offences punishable under Sections u/s. 457, 380 of Indian Penal Code against accused and the substance of accusation is made against accused is read over and explained to him in Telugu in which the accused voluntarily admitted the guilty. The accused also submitted a written requisition through the Jail authorities and pleaded to take lenient view by giving set off his remand period.

6.Though the Accused is explained the consequences lead to him admission, he pleaded guilty. The plea of guilty of the accused is appearing voluntary one and there is no coercion or force from anybody.

Hence, the admission of guilty of the accused is accepted.

7.In the Result, the accused is found guilty for the offense under section 457, 380 of Indian Penal Code and he is convicted of the same Under Section 241 Cr.P.C.

When the accused is questioned with regard to the quantum of sentence, Accused submitted that he is having a family consisting of wife children and that they are solely depending on him and if he is in jail his family will suffer a lot. Further submitted that he will be cautious in future and he will not commit any offense. Hence, this is not fit case to invoke benevolent provisions of P.O. Act or Section 360 Cr.P.C.

Considering the Submissions of the accused, the nature of the offence, the property involved in this case, no property seized and in view of pandemic situation of Covid-19 this court feels the following sentence would meet the ends of justice. Hence, the accused is sentenced to undergo simple imprisonment for a period from 02.12.2020 till this date i.e., 08.09.2021 i.e,, the remand period of the accused in the above case is treated as sentence and further sentenced to pay a fine of Rs.100/-(One hundred rupees only) for the offence under Section 457 of IPC. In default of payment of fine the accused has to undergo simple imprisonment for a period of one week. He is further sentenced to undergo simple imprisonment for a period from 02.12.2020 till this date i.e., 08.09.2021 i.e,, the remand period of the accused in the above case is treated as sentence and further sentenced to pay a fine of Rs.100/-(One hundred rupees only) for the offence under Section 380 IPC. In default of payment of fine the accused has to undergo simple imprisonment for a period of one week. Both the above sentences shall run concurrently.

The remand period of accused i.e., from 02.12.2020 to 08.09.2021 shall be given set off under Sec.428 Cr.P.C. No property recovered in this case hence no order passed with regard to the same.

Accused is informed of his right to prefer appeal and right to get free legal aid from District Legal Services Authority, Nellore.

This case coming on this day for examination of the accused No.1

before me through Blue Jeans Video Conference for hearing in the presence of the

learned Assistant Public Prosecutor for the complainant and Accused No.1 appeared through Blue Jeans from Central Prison, Nellore with the assistant of learned legal aid counsel Sri Sk. Anwar Basha and the accused No.1 having admitted the offence voluntarily and upon hearing and perusal of the material, this Court delivered the following:-

J U D G M E N T

The Sub-Inspector of Police, Dargamita Police Station, Nellore filed charge sheet against the accused in crime No.14/2020 for the offences under

Sections 457 and 380 r/w 511 of Indian Penal Code.

2. The case of the prosecution, in brief, is as follows:

(i) On 27.11.2019 after night supper Ganipineni Prasad Rao and his wife/Edara Swarajya Lakshmi at D.No.113, Tekkemitta, Saraswathi Nagar,

Nellore slept in the upstairs bedroom. On 28.11.2019 at 07.00 A.M., they woke up and notice that the main door lock was found broken and the ground floor 2 bedroom doors and three almirah doors were found opened, that on verification the wooden almirah locker, found 32 grams of gold bangles and 10 grams of pain gold ring are missing.

(ii) On 19.01.2020 at 11.30 hours the said Prasada Rao presented a report about the occurrence in Dargamitta Police station, Nellore and the sub-

Inspector of Police, Nellore registered the same as a case in Crime No.14/2020 under Sec.457 and 380 IPC and submitted FIR to the concerned and recorded the statements. During the course of further investigation on 21.02.2020 at 5.45 P.M., the Inspector of Police, Kavali I town Police Station, arrested the accused at Pullareddy Nagar, Kavali in the presence of mediators and drafted their confessional statements, wherein they admitted their involvement in this crime and also confessed that no valuable found in the almirah and forwarded the accused to judicial custody. As no property was alleged to be committed theft no property was recovered from the accused in the above crime.

(iii) The Sub-Inspector of Police, Dargamitta PS, Nellore obtained the copies of Mahazarnamas from Sub-Inspector of Police, Kavali, obtained P.T.

Warrant before this Hon’ble Court and produced accused 2 to 4 on 05.03.2020 and A-1 on 15.03.2020 and obtained their remand in this case, that on completion of investigation laid charge sheet into court. Hence, the charges.

3. Cognizance for the offences punishable under Sections under sections 457 and 380 r/w 511 IPC was taken against the accused by my learned predecessor.

4. A-1 is in Judicial custody intimated the same to the concerned jail and A-2 to A-4 are on bail. As A-2 to A-4 did not appear before this court and as there is no representation from the them, taking into consideration of

Covid-19 and lock down situation and keeping the accused No.1 in judicial custody for a long period will not serve any purpose, in the interest of justice and in view of the representation from the accused No.1, who is in judicial custody by following the procedure, case against accused No.2 to 4 is split-up and numbered as C.C.No.1552/2021 and proceeded against accused No.1 only.

5. On appearance of the accused No.1 through Blue jeans Video

Conference from Central Prison, Nellore, copies of documents as contemplated under Sec.207 Cr.P.C. were furnished to the accused through e-mail of the

Central Prison, Nellore.

6. Accused No.1 was examined through Blue Jeans Video conference from Central Prison, Nellore under Section 239 Cr.P.C. Charges for the offences punishable under Sections under Sections 457 and 380 r/w 511 of IPC read- over and explained to him in vernacular, for which the accused No.1 voluntarily admitted the guilt. He also sent written requisition to this Court through e-mail admitting the guilt and pleading set off. The learned legal aid counsel through Blue Jeans appeared and prayed to take lenient view of set off by considering the plea of the accused No.1 by taking into consideration of his more than15 months judicial custody and pandemic situation of Covid-19.

7. Though Accused No.1 is explained the consequences leading to his admission, he pleaded guilty. The pleading of guilt of the accused No.1 is appearing voluntary one and there is no coercion or undue influence from anybody. Hence, the admission of guilt of the accused No.1 is accepted.

8. In the result, the accused No.1 is found guilty for the offense under sections 457 and 380 r/w 511 of IPC and he is convicted of the same Under

Section 241 Cr.P.C.

V Addl. Judicial Magistrate of I Class, Nellore.

When the accused No.1 is questioned with regard to the quantum of sentence, Accused No.1 submitted that he is having old aged mother and family and that he is sole bread-winner of his family and they are entirely depending on him and if he is in jail further his family will suffer a lot in this pandemic situation of Covid-19. Further submitted that he will be cautious in future and he will not commit any offense. Hence, this is not fit case to invoke benevolent provisions of P.O. Act or Section 360 Cr.P.C.

Considering the Submissions of the accused No.1, the nature of the offence, the property involved in this case ie., no property recovered in this case and in view of pandemic situation of Covid-19, this court feels the following sentence would meet the ends of justice. Hence, the accused No.1 is sentenced to undergo simple imprisonment for a period from 15.03.2020 till this date i.e., 30.06.2021 i.e,, the remand period of the accused in the above case is treated as sentence and further sentenced to pay a fine of Rs.100/-(one hundred rupees only) for the offence under Sec.457 r/w 511 of IPC. In default of payment of fine the accused No.1 has to undergo simple imprisonment for a period of fifteen (15) days. He is further sentenced to undergo simple imprisonment for a period from 15.03.2020 till this date i.e., 30.06.2021 i.e,, the remand period of the accused No.1 in the above case is treated as sentence and further sentenced to pay a fine of Rs.100/-(one hundred rupees only) for the offence under Sec.380 r/w 511 IPC. In default of payment of fine the accused No.1 has to undergo simple imprisonment for a period of fifteen (15) days. Both the above sentences shall run concurrently.

The remand period of accused No.1 i.e., from 15.03.2020 to 30.06.2021 shall be given set off under Sec.428 Cr.P.C. The sentence passed in the above case and the sentences passed in CC Nos. 873 / 2021, CC 899/2020 and CC 240/2021 on the file of this court shall run concurrently. Since the split-up case in C.C. No.1552/2021 is pending and no property was recovered and produced in this case, no order passed with regard to property.

Accused No.1 is informed of his right to prefer appeal and right to get free legal aid from District Legal Services Authority, Nellore.

J U D G M E N T

The Sub-Inspector of Police, Vedayapalem Police Station, Nellore filed charge sheet against the accused in crime No.42/2019 for the offences under

Sections 457 and 380 Indian Penal Code or alternatively under section 411 of

Indian Penal Code (for short IPC)

2. The case of the prosecution, in brief, is as follows:

(i) In between 05.02.2019 at 16.30 hrs. to 10.02.2019 at 6.30 hrs. at

Ummareddygunta, Nellore City some unknown offenders gained entrance into the house bearing D.No.22-13-71 Ummareddygunta, Nellore of Obili Naga

Penchalaiah (de-facto complainant) by brake open northern side door and break open the iron safe in bed room and committed theft of 1. Gold necklace 2

Chandraharam)- Wg.5 sovs., 2.gold rings 3-wg. 2 sovs. 3. Gold ear studs-3 pairs-wg.10 gms, 4. Silver glasses-4, 5. Pooja bowl-1, 6. Deeparadhana

Kundulu-2, silver bell-1, and cash of Rs.50,000/- all worth Rs.85,000/- and absconded with booty. Again Obili Naga Penchalaiah on 11.02.2019 gave another complaint that the above articles were found in another bed room and only Gold Necklace/ Chandraharam wg. 7 sovs. committed theft of basing on which a case in crime No.42/2019 under Sections 457 and 380 IPC was registered and submitted FIR to all concerned, took up investigation, visited the scene of offence, drafted rough sketch of the scene, examined witnesses and recorded their statements.

(iii) During the course of investigation on 21.02.2020 A-1 and another (A-

2) arrested by Inspector of Police, Kavali Town at Pullareddy Nagar Park, Kavali town and seized the property under cover of mahazarnama and received stolen property from the accused. On 17.03.2020 produced the accused through PT warrant before this court and in the identification parade, Obili Naga

Penchalaiah and his wife/Malliswari identified their stolen property and on completion of investigation laid charge sheet into court. Hence, the charges.

3. Cognizance for the offences punishable under Sections 457 and 380

IPC or alternatively under Sec.411 IPC was taken against the accused No.1 and 2 and proceeded.

4. A-1 is in Judicial custody intimated the same to the concerned jail and A-2 is on bail. As A-2 did not appear before this court and as there is no representation from the accused No.2, taking into consideration of plea of accused No.1, legal aid counsel and in view of pandemic situation of Covid-19 and lock down situation and also keeping the accused No.1 in judicial custody for a long period will not serve any purpose, in the interest of justice and in view of the representation from the accused No.1, who is in judicial custody, by following the procedure, case against accused No.2 is split-up and numbered as C.C.No. 1551/2021 and proceeded against accused No.1 only.

5. On appearance of the accused No.1 through Blue jeans Video

Conference from Central Prison, Nellore, copies of documents as contemplated under Sec.207 Cr.P.C. were furnished to the accused No.1.

6. Accused No.1 was examined through Blue Jeans Video conference from Central Prison, Nellore under Section 239 Cr.P.C. Hence, the accused No.1 is sentenced to undergo simple imprisonment for a period from 17.03.2020 till this date i.e., 30.06.2021 i.e,, the remand period of the accused in the above case is treated as sentence and further sentenced to pay a fine of Rs.100/-(one hundred rupees only) for the offence under Sec.457 of IPC. In default of payment of fine the accused No.1 has to undergo simple imprisonment for a period of fifteen (15) days. He is further sentenced to undergo simple imprisonment for a period from 17.03.2020 till this date i.e., 30.06.2021 i.e,, the remand period of the accused No.1 in the above case is treated as sentence and further sentenced to pay a fine of Rs.100/-(one hundred rupees only) for the offence under Sec.380 IPC. In default of payment of fine the accused No.1 has to undergo simple imprisonment for a period of fifteen (15) days. Both the above sentences shall run concurrently.

The remand period of accused No.1 i.e., from 17.03.2020 to 30.06.2021 shall be given set off under Sec.428 Cr.P.C. The sentence passed in the above case and the sentences passed in CC Nos. 801 / 2020, CC 899/2020 and CC 240/2021 on the file of this court shall run concurrently. The case property one Gold chandra haram was given to Defacto complainant for interim custody.

Since the split-up case in C.C. No.1551/2021 is pending no final property order in CPR NO. 26/2021 is passed.

Accused No.1 is informed of his right to prefer appeal and right to get free legal aid from District Legal Services Authority, Nellore.

J U D G M E N T

The Sub-Inspector of Police, Vedayapalem Police Station, Nellore filed charge sheet against the accused in crime No. 05 /2019 for the offences under

Sections 457 and 380 of Indian Penal code or alternately under section 411 of

Indian Penal Code (for short “IPC”).

2. The case of the prosecution, in brief, is as follows:

(i) In between 08.01.2019 at 19.00 hours to 10.01.19 at 8.30 hours at

Dora Thotha, Sneha Nagar, Nellore, some unknown offenders gained entrance into the house of Thummathati Sailja and committed theft of 1. Gold necklaces-3., 2.Gold small chains-2, 3. Gold Big rings-2, Gold small rings-2, 5.

Dell Computer-1, Pattu Sarees-4 and some cash which were kept in iron safe 2 and decamped with the booty. On 10.01.2019 Thummathati Sailaja came to

Vedayapalem Police Station and presented a report, which was registered as a case in crime No.5/2019 under Sec.457 and 380 IPC and Submitted FIR to all concerned officers, took up investigation, visited the scene of offence and drafted rough sketch of the scene, examined the witnesses, recorded their statements and caused enquiries about the offenders and stolen property.

(ii) On 11.01.2021 again Defacto complainant came to the police station and presented another report that the above articles were found and only Gold

Black Beeds Chain-1, 2. White Stones ear studs-2 pairs all worth Rs.60,000/- were committed theft of.

(iii) During course of investigation on 21.02.2020 at 5.45 P.M. at

Pullareddy Nagar Park, Kavali town, the accused arrested by Inspector of

Police, Kavali Town and seized stolen property from the accused under cover of mahazarnama.

(iv) On 17.3.2020 the Sub-Inspector of Police, Vedayapalem Police Station produced the accused through PT warrant before this court, that on completion investigation laid charge sheet in the court. Hence, the charges.

3. Cognizance for the offences punishable under Sections 457 and 380

IPC or alternatively under Sec.411 IPC was taken against the accused No.1 and 2 and proceeded.

5. On appearance of the accused No.1 through Blue jeans Video

Conference from Central Prison, Nellore, copies of documents as contemplated under Sec.207 Cr.P.C. were furnished to the accused No.1.

6. Accused No.1 was examined through Blue Jeans Video conference from Central Prison, Nellore under Section 239 Cr.P.C. Charges for the offences punishable under Sections under Sections 457 and 380 or alternatively under section 411 IPC read-over and explained to him in vernacular, for which the accused No.1 voluntarily admitted the guilt. He also sent written requisition to this Court through e-mail admitting the guilt and pleading set off. The learned legal aid counsel through Blue Jeans appeared and prayed to take lenient view of set off by considering the plea of the accused No.1 by taking into consideration of his more than 15 months judicial custody and pandemic situation of Covid-19.

8. In the result, the accused No.1 is found guilty for the offense under sections 457 and 380 of IPC and he is convicted of the same Under Section 241 Cr.P.C.

Considering the Submissions of the accused No.1, the nature of the offence, the property involved in this case and in view of pandemic situation of

Covid-19, this court feels the following sentence would meet the ends of justice.

The remand period of accused No.1 i.e., from 17.03.2020 to 30.06.2021 shall be given set off under Sec.428 Cr.P.C. The sentence passed in the above case and the sentences passed in CC Nos. 801 / 2020, CC 899/2020 and CC 873/2021 on the file of this court shall run concurrently. The case properties in CPR NO.01/2021 were given to Defacto complainant for interim custody.

Since the split-up case in C.C. No.1550/2021 is pending no final property order in CPR NO. 01/2021 is passed.

Accused No.1 is informed of his right to prefer appeal and right to get free legal aid from District Legal Services Authority, Nellore.

This case coming today before me for final hearing in the presence of the learned Assistant Public Prosecutor for the complainant and the accused no.1 and 2 themselves, learned Legal aid counsel and upon hearing, perused the material on record and having stood over for consideration till this day, this Court delivered the following:-

J U D G M E N T

The accused no.1 and 2 have been arraigned before this Court for the offenses punishable under Sections 379 or alternatively under section 411 of Indian Penal Code (herein after referred as ‘IPC’) in Cr.No.03/2021 of Balajinagar P.S. Nellore.

2. The brief material averments of the prosecution case are as follows:

On 16.10.2020 night at 21.30 hours, Dronadula Sasidhar/LW1 went to house of

Korivi Sukumar/LW2 near Auto stand, Brahmana street, Gowda Hostel centre, Balajinagar,

Nellore on his motor cycle bearing No.AP-26-AY-2875, parked and locked on road in front of house and slept in the house. On the next day morning i.e., on 17.10.2020 at about 7.00 hours,

Defacto complainant noticed his motor cycle was missing. Some un known offenders 2CC.1292/2021 committed theft of his Bajaj Pulsar Black colour motor cycle bearing No.AP-26-AY-2875, its chasis No.MD2A11CZ7EWK06268 & Eng. NO.DH2WEK00960 worth of Rs.15,000/- by using another key or any other source and decamped with the booty. Adverting to the above and basing on the report of defacto complainant, a case was registered in Cr.No. 03/2021 and investigated into, K.Pavan KUmar/LW07, SI of Police, Balaji Nagar PS, Nellore visited scene of offence and examined witnesses and prepared rough sketch.

During the course of investigation, on 09.01.2021 at 19.00 hours, S.A. Bhaskar Babu,

S.I. of Police, Chinnabazaar PS, Nellore arrested accused no.1 and 2 in their case in

Cr.No.876/2020 for the offence under sec.356, 382 IPC of Chinnabazaar PS in the presence of mediators ie., Shaik Thahir/LW4 and Saik Shabbir/LW5 and seized the motor cycle concerned in this case along with some other cases under a cover of arrest and seizure mahazarnama.

During the course of confession, the accused no.1 and 2 admitted their involvement in this case. K.Pavan KUmar/LW07, SI of Police, Balaji Nagar PS, Nellore filed a memo for PT warrant against A1 and A2 in order to produce them in this case. Accordingly the accused no.1 and 2 were produced before this court through video conference on 20.01.2021 and ordered for remand and K.Pavan Kumar/LW07, SI of Police, Balaji Nagar PS, Nellore sent property to the court vide form-60, and after completion of entire investigation he filed charge sheet for the offense under section 379 or alternatively 411 Indian Penal Code against accused no.1 and

2. Hence the charges.

3. This Court has taken the cognizance of the offences punishable under

Sections u/s. 379 or alternatively u/s 411 of IPC against the accused no.1 and 2 and proceeded.

4. Copies of documents as contemplated under Sec.207 Cr.P.C. were furnished to the accused no.1 and 2 through concerned jail authorities and obtained acknowledgments.

5.Accused were examined under Section 239 Cr.P.C. through blue jeans application Charges for the offences punishable under Sections u/s. 379 or alternatively u/s 411 Indian Penal Code against accused no.1 and 2 and the substance of accusation is made 3CC.1292/2021 against accused are read over and explained to them in Telugu in which the accused no.1 and 2 voluntarily admitted the guilty. The accused no.1 and 2 also submitted a written requisition

before this court today admitting the guilt and pleading to take lenient view by giving set off

their remand period.

6.Though the Accused are explained the consequences lead to them admission, they pleaded guilty. The plea of guilty of the accused are appearing voluntary one and there is no coercion or force from anybody. Hence, the admission of guilty of the accused are accepted.

7.In the Result, the accused no.1 and 2 are found guilty for the offense under section 379 of Indian Penal Code and they are convicted of the same Under Section 241

Cr.P.C.

When the accused no.1 and 2 are questioned with regard to the quantum of sentence,

Accused no.1 submitted that he is having family, they belong to poor family and his entire family depending on him and that he is the bread winner of the family and that in view of his detention in the jail his entire family suffering a lot and accused no.2 submitted that he is 4CC.1292/2021 having family and they are leading poor life and that he is the sole bread winner of his family, if he is in jail his family will suffer a lot. Further submitted that they will be cautious in future and they will not commit any offense. This is not fit case to invoke benevolent provisions of

P.O. Act or Section 360 Cr.P.C.

Considering the Submissions of the accused No.1 and 2, the nature of the offence, the property involved in this case and in view of pandemic situation of Covid-19, this court feels the following sentence would meet the ends of justice. Hence, both the accused No.1 and 2 are sentenced to undergo simple imprisonment for a period from 20.01.2021 till this date i.e., 06.08.2021 i.e,, the remand period of the accused no.1 and 2 in the above case is treated as sentence for the offence under Sec.379 of IPC..

The remand period of accused No.1 and 2 i.e., from 20.01.2021 to 06.08.2021 shall be given set off under Sec.428 Cr.P.C.

The unmarked case property ie., Bajaj Pulsar Black colour motor cycle bearing No.AP- 26-AY-2875, is ordered to be released to the defacto complainant after expiry of appeal time.

Accused no.1 and 2 are informed of their right to prefer appeal and right to get free legal aid from District Legal Services Authority, Nellore.
