Thissuitisfiledforevictionofthedefendantfromthebuilding

consistingoneshopandsixroomsingroundfloor,threehallsand threeroomsinfirstfloor,totalbuilt-upplinthareaof2980Sq.Feet over216Sq.Yardsofplot,whichiswithintheboundariesasshownin
thescheduleofpropertyandtohandoverthevacantpossessionto
theplaintiff,ii)todirectthedefendanttopaythearrearsofrentsof
Rs.3,60,000/-totheplaintiff,iii)todirectthedefendanttopaythe
futurerents@Rs.12,000/-permonthfromthedateofthesuittill
actualdeliverytotheplaintiff,iv)todirectthedefendanttopaythe
damages@Rs.25,000/-permonthfromthedateofthesuittill

ShaikAhmedAlam,S/oLateShaikAlamwhowastheoriginalowner
ofthesame.Infact,theentirepropertyD.No.1-4-121andother propertiesareacquiredbygrandfatherofplaintiffnamelyLateShaik
Alamandafterhisdeathhissevensonsdividedthesameandthesuit

schedulepropertywasfallentotheshareofpaternaluncleofplaintiff
namelyShaikAhmedAlam.Itwastheagreementbetweenthe
brothersthatincaseanybrotherintendstoselltheproperty,hehas
togiveprioritytootherbrothers.WhenShaikAhmedAlamintended
tosellhisshareofproperty,theplaintiffbeinghisyoungerbrother's
sonpurchasedthesame.
(ii).Evenpriortothepurchasebytheplaintiff,thedefendantis
thetenantofoneshopinD.No.1-4-121/Dandpayingrentof
Rs.7,000/-toShaikAhmedAlam.Infact.asperinformationgivento
plaintiff,theelderbrotherofdefendantnamelyMd.Maqboolhad
takentheshoponrentbutnowheissayingthatheisnotthetenant
butthedefendantisthetenant.Onenquiry,theplaintiffhascameto
knowthatinitiallyfamilyofdefendanthastakentheshoponrentfor
theirbusinessbutlatertheyhavedividedfromthefamilyanddoing
businessseparatelyandthedefendantisdoingthebusinessinthe
aboveshopoftheplaintiffunderthenameandstyleas"Omer
Furniture"inthenameoftheirfather.TheoriginalownerShaik
AhmedAlaminformedthefamilyofdefendantaboutsellingof
propertytotheplaintiffandpayrentstohim.Afterpurchasebythe

andpaidtillMay,2012andthereafterstoppedpayingrents.Onthe
otherhand,intheabsenceafplaintiff,inthemonthofJune,2012
thedefendanthasillegallyopenedtherearportionandfirstfloorand
occupiedthesame.Oncomingtoknowabouthisillegalactivity,the
plaintiffapproachedthedefendantandsoughtexplanationandon
thatthedefendantstatedthatasthesameisvacantheisusingitfor godownandassuredtheplaintifftopayrentsforthesaidpremises also.TheplaintiffdemandedrentofRs.5,000/-permonthforthe
additionalareaandthedefendantacceptedtopaythesaidrentalong
withtheoldrent.Buttilltodaythedefendantneitherpaidtherentof
oneshopnorentirepremisessincethemonthofJune,2012.
(iii).Theplaintiffseveraltimesrequestedthedefendanttopaythe rentsregularly.Thedefendantalsoassuredplaintifftopaythesame withinshorttimeonthegroundoffacingsomefinancialtroublesin thebusinessetc.Inviewofgoodrelationshipwiththedefendantand hisfamily,theplaintiffkeptquietforsometimebutdemanded frequently.Butinspiteofgrantingsufficienttimethedefendanthas notpaidtherentssincethemonthofJune,2012.Theplaintiff demandedthedefendanttoeitherpaytherentsregularlyorvacate
thepremisesbutheneitherpaidtherentsnorvacatedthepremises.

Thedefendantisholdingthepremiseswithoutpayingrentswhichis
illegalandhencehispossessionoverthepremiseshasbecomeillegal
sinceJune,2012.
(iv).Furthertheplaintiffalsoinneedofpremisesforhispersonal
occupation.Afterexhaustingallremediestosettlethematter
amicably,theplaintiffgotissuedalegalnoticeundersection106
TransferofPropertyActtotheelderbrotherofdefendantnamely
Md.Maqboolon01.09.2014terminatingthetenancyanddemanding
tovacatethepremisesandtopaythearrearsofrents.Thesaidnotice
wasservedonhimatthesuitpremisesandhegotissuedareply
dated10.9.2014denyingthatheisthetenantofsuitpremises.The
plaintiffwasunderimpressionthatthefamilyofdefendantisjointly
doingthebusinessuntilreplytothenoticebyelderbrotherofplaintiff
Md.Magbool.Onenquirytheplaintiffcametoknow.thatthebrothers
ofdefendanthavedividedandthedefendantisdoingthebusinessin
thesuitschedulepremises.Hence,theplaintiffagainissuedanother
legalnoticeundersection.106ofTransferofPropertyActon
22.09.2014toavoidfurthercomplications,terminatingthetenancy
w.e.f.,10.10.2014andtovacatethepremisesby31.10.2014andalso
topaythearrearsofrents.EarliernoticeonthenameofMd.Maqool
SeRasr—

wasreceivedatthesuitpremisesandreplywasissued.Thedefendant
receivedthesaidnoticeandgotissuedareplyon11.10.2014denying
theownershipoftheplaintiffoverthesuitpremisesandstatingthat
hislandlordisShaikAhmedAlamandhetookthepremisesonrent
fromhissonsandthatheisregularlypayingrentstothem,thathis leaseperiodwasextendedtillJune,2019,thatShaikAhmedAlamis nowayconcernwiththesuitpropertyandthatsaledeedmightbe createdundercollusionofShaikAhmedAlam.Fromtheabovereply, itisclearthatthedefendantandhisbrotheraretryingtocreate
landlordandtenantrelationshipprobleminordertoharassthe
plaintiff.Infact,thedefendanthasacceptedtheplaintiffashis
landlordandpaidrentsforthreemonthsandthereafterstopped.This
factclearlyshowsthemalafideintentionofthedefendanttowithhold thepropertywithoutpayingrentsandcreateproblemstotheplaintiff toextractmoneyfromhim.Thetenancyofthedefendantwasalready terminatedthroughanotice,hispossessionoverthesuitpremises from01.11.2014hasbecomeillegalandthereforehefiledthepresent suit.
3.DefendantfiledwrittenstatementadmittingthatoriginallyLate

propertiesbutdeniedthematerialavermentsintheplaintcontending
asunder.
ThisdefendantdonotknowthatafterthedeathofShaikAlam
hissevensonsdividedthesameandthesuitschedulepropertywas
fallentotheshareofpaternaluncleofplaintiffnamelyShaikAhmed
Alamandhedonotknowthatitwastheagreementbetweenthe
brothersthatincaseanybrotherintendstoselltheproperty,hehas
togiveprioritytootherbrothersandwhenShaikAhmedAlam
intendedtosellhisshareofpropertytotheplaintiffbeinghisyounger
brother’ssonpurchasedthesame.Heisthetenantofoneshopin
D.No:1-4-121/D,hehasobtainedthelet-outpremisesundermonthly
leasepriorto1998fromthesonsofDr.ShaikAhmedAlam,whoare
theoriginalownersofthelet-outpremises,sincethedateofleasethe
defendantisrunningthebusinessinthenameandstyleof"Omer
Furniture"andpayingthemonthlyrenttilltodaytothesonsof
Dr.ShaikAhmedAlam,withoutanydefault.Theoriginalownersof
suitpremisesareenhancingthemonthlyleaseandenteringintofresh
leasedeed,withaenhancedrefundablesecuritydeposit.Accordingto
thetermsandconditionsofleasedeedthisdefendantisregularly

ofDr.ShaikAhmedAlamaretheoriginalownersandpossessorsof
thelet-outpremisesandreceivingtherents.
(ii).Itislearntthatoriginallythesuitschedulepropertybelongs
totheownersofthisdefendant’sgrandfatherbynameLateShaik
Alam,whoistheoriginalownerpossessorofthesuitschedule property,alongwithotherpropertiesandhissonDr.ShaikAhmed
Alam,whoistheoriginalownerofthisdefendantletoutthepremises
isresidentofAmericaanddoingworkthere.Hedevelopedimmoral
activitiesandwhenthethingswerebroughttotheknowledgeofLate
ShaikAlam,hehasgiftedthepropertiesonthenameofhisgrand
sonsbyvirtueofthesaidgiftbyLateShaikAlam.Theownersofthis
defendantarebecametheabsoluteownersofthesuitschedule
propertiesandotherpropertiesatMahabubnagarandHyderabad.It
islearntthatfamilydisputesaregoingoninbetweenhislandlords andtheiragnatesinrespectofsuitscheduleproperty.
(iii).Thesuitforpartitionisalsofiledbytheownersofthis defendantinrespectofthesuitscheduleofpropertyinwhichthis
defendantisalsooneofthedefendantintheabovesaidpartitionsuit,
assuchhecametoknowaboutthefamilydisputesandpendingsuits
inrespectofsuitscheduleofproperty,evenafterfilingthesuitthis

defendantisregularlypayingtherentstohislandlordsi.e.,sonsof
Dr.ShaikAhmedAlamandtheyarereceivingtherentagainstthe
receipts.VeryrecentlythesonsofDr.ShaikAhmedAlamenhanced
thesecuritydepositamountandextendedleaseperioduptoJune,
2019andaccordinglythisdefendantispayingtherentsand
continuinghisbusinessinthesaidletoutpremisesastenant.
(iv).Theplaintiffisnottheowneroftheletoutpremises,ashe
cannotfilesuitforevictionofdefendantasthedefendantisnothis
tenant.Furthernopointoftime,thereisrelationinbetweenplaintiff
anddefendantaslandlordandtenant.Tilltodaythisdefendantis
regularlypayingtherentstohisowners,whopermittedandhanded
overtheletoutpremisestothisdefendanttorunbusiness.The
plaintiffisnothavinganylocus-standitofilethepresentsuitfor
evictionoftenantandassuchthesameisliabletobedismissed.

arethattheplaintiffhaspurchasedthesuitschedulepropertyfrom
itsownerwhogotthesameinthepartitionamonghisbrothers,that
thoughthedefendantdidnotadmittheownershipoftheplaintiffover
thesuitschedulepropertyDW-2whoistheplaintiffsvendorsonand
towhomthedefendantisclaimingashisowner,hasclearlyadmitted
theprioragreementofsalewasenteredbyhisfatherinfavourofthe
fatheroftheplaintiffinrespectofthesuitschedulepremisesandthe
receiptswereissuedbyhisfatherinrespectofthesaidagreementto
sellandthatDW-2incollusionwiththedefendanthereinfiledsuitfor
partitionvideOS.No.276/2012onthefileoftheJuniorCivilJudge,
Mahabubnagarjusttoavoidpaymentofrentstotheplaintiff.Itis
furthersubmittedInthewrittenargumentsfiledbytheplaintiffthat

andthatdefendantdidnotfileanysingledocumenttoshowthat
DW-2istheownerofthesuitschedulepremisesandthatheispaying rentstohimanddepositedthesecurityamountasdeposedbyhim
andDW-2.
Ontheotherhandthelearnedcounselforthedefendanthas
submittedthatthedefendantisnotthetenantoftheplaintiffand thereisnorelationshipofownerandtenantinbetweentheplaintiff
anddefendant,thatheobtainedthepremisesfromDr.ShaikAhmed
Alamwhoisthevendoroftheplaintiffandpayingrentstohis
vendor'ssonwhoisnoneotherthanDW-2andthattheplaintiffisno
wayconcernedtohisrentedpremisesandtheplaintiffcannotevict
himandprayedtodismissthesuit.
7.IssueNo.1:Whethertheplaintiffisentitledforadecreefor possessionofplaintschedulepropertybyevictingthe defendants?.

markedasEx.Al.ItisthefurtherevidenceofPW-1thatasonthe
dateofhispurchasedefendantwasthetenantofoneshopin
toShaikAhmed
D.No.1-4-121/DandpayingarentofRs.7,000/-
Alamandhisvendorinformedthefamilyofthedefendantabout
sellingofpropertytotheplaintiffandpayrentstohim,thatafterhis
purchasedefendantstartedpayingthesamerenttotheplaintiffand
paidtillMay,2012andthereafterstoppedpayingtherents.
8.Ontheotherhand,thecontentionofthedefendantisthathedo
notknowaboutthepartitionofthepropertiesinthefamilyofhis
vendorandthatitisnotknowntohimthatthedoorNol-4-11/Dwas
fallentotheshareofhisowner/paternaluncleoftheplaintiffandthe
purchaseofthepropertybytheplaintiff,thathehasobtainedthelet
outpremisesundermonthlyleasepriorto1998fromthesonsof
Dr.ShaikAhmedKhan,whoaretheoriginalownersofthelet-out
premisesandsincethedateofleaseheisrunninghisbusinessinthe
nameandstyleof“OmerFurniture”andpayingthemonthlyrenttill
todaytothesonsofDr.ShaikAhedKhan,withoutanydefaultand

enteringintofreshleasedeedwithaenhancedrefundablesecurity
depositandenteringinto
freshleasedeed,withenhancedrefundable
securitydepositandheispayingtherentstothelandlordagainst
thereceiptandassuchthesonsofDr.ShaikAhmedAlamarehis
originalownersandpossessorsoftheletoutpremisesandreceiving
therents.
9.Plaintiffisclaimingownershipoverthesuitscheduleproperty
basedontheregisteredsaledeedexecutedbyShaikAhmedAlam,S/o
ShaikAlamandreliedonthesaidregisteredsaledeedcertifiedcopy
ofwhichismarkedasEx.Al.Defendantisnotdenyingtheownership
ofDr.ShaikAhmedAlamwhoisthesonoftheoriginalownerShaik
Alam,butdenyingtheownershipoftheplaintiffoverthesuit
schedulepropertyandtherelationshipoflandlordandtenantin
betweentheplaintiffandhimself.DefendantsummonedDW-2whois
saidtobethesonofhislandlordandtowhomheispayingrents.In
hiswrittenstatementdefendanthaspleadedthathelearntthatfamily
disputesaregoingoninbetweenthelandlordandtheiragnatesin respectofthesuitscheduleproperty,thatsuitforpartitionfiledby
hisownersinrespectofthesuitschedulepropertyispendingin
whichheisalsooneofthedefendantinthesaidsuit,assuchhe

cametoknowaboutthefamilydisputesandpendingsuitsinrespect
ofthesuitschedulepropertyandhefiledcertifiedcopiesofplaint,
writtenstatementfiledbyhimasdefendantNo8andthewritten
statementfiledbytheplaintiffasdefendantNo.8inthesaidsuitOS
No.276/2012.Inthecourseofcrossexamination,DW-1sadthatin
thesaidcasehiscounselisSri.Mujeebandthesaidcounselalso
representedtheMubasirAlam/DW-2hereininthesaidsuit.The
learnedcounselfortheplaintiffhasarguedthattoevadethepayment
ofrentstotheplaintiff,defendantgotfiledthesaidsuitOS
No.276/2012throughDW-2ShaikMubasirAlamthroughhiscounsel
ShaikAbdulMujeebthoughthepropertywasalreadysoldtothe
plaintiffandthoughhehasnorighttoseekpartitionofthesuit
property.
10.TheevidenceofDW-2isthathehashousepropertybearing
DoorNo.1-4-121/Di.esuitschedulepropertyherein,hegotthis
housefromhisgrandfatherbywayoforalgiftintheyear1990,that
defendantishistenantsince2010andheispayingrentsregularly
andtillthedateofgivinghisevidencedefendantishistenant.Hehas
furtherdeposedthataleasedeedwasexecutedbythedefendantin
O.SNo.232of20141801.10.2024
leasedocumentwasexecutedintheyear2019till2027andthesame
isstillinsubsistence.Butnosuchdocumentsarefiledeitherthrough hisevidenceorbythedefendant.Thevendoroftheplaintiffisnone otherthanthefatherofDW2.Defendantisalsoadmittingthatheis
thetenantofthefatherofDW-2.Asseenfromtherecordandas

ZahoorAlamwhoisoneofthesonofShaikAlamusedto engagethe entireproperties,thatallthetenantshavetakentheshopsfrom

SubRegistrarandShaikAhmedKhanexecutedtheregisteredsale
deedinfavouroftheplaintiffandhimselfMushrafRiyaz(vendor’s
wife)havesignedasattestorstothesaiddocument.Inhiscross
examination,hecouldnotsaythedateofregistration,boundariesof
thesuitshop,saidthathedonotknowtheexactreliefsoughtbythe
plaintiffthoughsaidthatthesuitisfiledbytheplaintiffagainstthe
defendantandthathedonothaveanyrentaldeed.Butnothingis
elicitedfromthemouthofPW-3todiscardhisevidenceandhis

presenceandheisthetenantofShaikZahoorAlam,oneofthe brotherofthevendoroftheplaintiffandthatafterallottingshopsto eachsonofShaikAlamallthetenantsarepayingrentstotheir respectiveowners.
12.Itissettledlawthatthetenantcannotdenythetitleofthe
vendeewhosaidtohaveclaimedtheownershipoftheletout
premises.Plaintiffhasfiledthepresentsuitonthebasisofderivative
titlefromtheerstwhilelandlordShaikAhmedAlamandthepresent
suitisnotasuitfordeclarationoftitle.Theburdenofprovingthe ownershipinanevictionsuitisnotthesamelikeatitlesuit.The
plaintiffsvendor’sson/DW-2whoisnotadmittingtheexecutionof
Ex.Alwithallrights,isnotchallengingthesamebyprosecutingthe casefiledbyhim.Hence,thoughitisnotrequiredbytheplaintiffto provestrictlyhis:ownershipoverthesuitschedulepropertyinthe natureofthissuit,thedocumentaryevidenceandtheoralevidenceof
PWs-1toPW-3provedthattheplaintiffistheownerofthesuit

alsoafactthatinitiallyplaintiffhasfiledasuitforevictionandmesne
profitsagainstthesaidMohd.MaqboolvideO.SNo.61/2013onthe
fileoftheJuniorCivilJudge,Mahabubnagarandlaterthesaidsuit

ownerofthesuitpremises.Butasdiscussedabove,itisprovedthat
earlierthefamilyofthe defendantwasdoingbusiness andnowthe

caseofdefendantthathisbrotherMohd.Maqboolvacatedthe

Hence,thereisnoforceintheargumentofthedefensecounselforthe defendant.
15.ItistheevidenceofPW-1thathisvendorinformedthetenants aboutthepurchase ofthepremisesbytheplaintiff.Itispertinentto notethatatthattimeofpurchase oftheplaintiff,defendantwasthe tenantinoneshopinD.No.1-4-121/Danddefendantisnotdenying

thestatutorynoticeunderEx.A2.Thepurchaseofthesuitschedule
propertybytheplaintiffisaregistereddocumentanditissettledlaw
thatitisnoticetoeveryone.Defendantwhoisthetenanthastopay
rentstothelandlord.ItistheevidenceofPW-1thathepurchasedthe
premisesinJanuary,2012andafterhispurchasethedefendant
startedpayingthesamerenttohimandpaidtillMay,2012and
thereafterstoppedpayingrents.PW-3hasdeposedthathehasalso
gotoneshoponrentfromthejointfamilymemberoftheplaintiff
viz.,ShaikZahoorKhanwhoislookingaftertheaffairsoftheshops
andafterallotmentofallthesevenshopsandotherpropertyallthe
tenantsarestartedpayingrentstotheirrespectiveowners.
16.It isthecaseoftheplaintiffthathewasunderimpressionthat
thefamilyofthedefendantisjointlydoingthebusinessuntilreplyto
thenoticebythesaidMd.Maqboolandafterknowingthatthe
brothersofthedefendanthavedividedandthedefendantisdoing
businessinthesuitschedulepremisesandthenhegotissuednotice
undersection.106ofTransferofPropertyActterminatingthetenancy
ofthedefendantw.e.f10.10.2014anddemandinghimtovacatethe
premisesby31.10.2014andalsotopaythearrearsofrents.Inthe

PW-2saidthattheelderbrotherofdefendantwasdoingchit fund
businessandlatertheychangedchitfundbusinesstofurniture
business.AgainitwasputtoPW-2thatfamilymembersofthe
defendanthaveobtainedthesuitshopto runfurniturebusinessand
sincebeginningheisrunningfurniturebusinessinthesuitshop,to
whichhedeniedthesame.Butitdoesnotmeanthatthedefendant
familywas notthetenantoftheshopinthesuitpremises.Itisan
admittedthatthereisnowrittenagreementbetweenhisson(PW-1)
andthedefendantregardingtenancy.Thebesuggestionputbythe
learnedcounselforthedefendanttoPW-2,isclearthatthedefendant wasthetenanttothevendoroftheplaintifftillthepurchaseofthe premisesbytheplaintiffandafterpurchaseofthepremisesplaintiff hassteppedintothe shoes ofthelessor(hisvendor)andhasallthe rightsofthelessor.
17.PW-2categoricallydeposedthatafterpurchasingoftheproperty
ShaikAhmedAlamintroducedhissontothedefendantanddirected
himtopayrenttohissonashewasthenewowner.PW-2deniedthe
suggestionthatdefendantneverdefaultedinpaymentofrentsand thatdefendantneveragreedtheplaintiffastheownerofthesuit
property.In suchcasehewouldhaveinformthesametotheowner

ShaikAhmedAlamandseekclarificationinthisregardtowhomhe
hastopaytherents.Butsayingthatheispayingrentstohisvendor’s
son/DW-2whoissayingthathegotthesuitschedulepropertyfrom
hisgrandfatherbywayoforalgiftintheyear1990andwhichis
falsifiedthroughtheevidenceofPWs-2andPW-3andhencethe
evidenceofDW-2isnottrustworthyandunreliable.
18.Insofarastheoccupationofthedefendantintheotherportion
ofthesuitpremisesisconcerned,theevidenceofPW-1isthatinthe
monthofJune,2012defendanthasillegallyopenedtherearportion
andfirstfloorandoccupiedthesame,oncomingtoknowabouthis
illegalactivityhehasapproachedthedefendantandsought
explanationandonthatdefendantstatedthatasthesameisvacant
heisusingitforgodownandassuredhimtopayrentsforthesaid
premisesalso.ItisthefurtherevidenceofPW-1thathedemandeda
rentofRs.5,000/-permonthfortheadditionalareaandthe
defendantacceptedtopaythesaidrentalongwitholdrentbuttill
filingofthesuitandtillthedateofhisevidencedefendantneither
paidrentofoneshopnortheentirepremisessincethemonthof
June,2012.Defendantisnotdenyingtheoccupationoftheentire

onrentfromthevendoroftheplaintiff.Duringhiscrossexamination on10.10.2023hehascategoricallydeposedthatinitiallyhetookthe premisesinfrontportiononlyandlatertookthebacksidepremises also,thattheelectricityconnectionstohisshopaeinthenameofthe plaintiff,butsaidthathecametoknowthesameintheyear2014.
Theaboveevidenceisclearthattheplaintiffisowneroftheother portionofthesuitpremisesandthatthepossessionofthedefendant overtheareaotherthantheshoppremisesisthepermissive possessionandthedefendanthasagreedtopayadditionalrentof
Rs.5,000/-permonthfortheadditionarea.Defendantisnot specificallydeniedthatinitiallyhewasthetenantofonlyoneshopin
theschedulepremises.InthisregardtheevidenceofDW-2isnoway
helpfultothecaseofthedefendantasobservedabove.Itisalso provedthatonlytoevadethepaymentofrentsdefendantgotfiledthe
suitO.SNo.276/2012byDW-2forpartitionofthepropertiesgotby
hisfathertakingthestandthatthesuitpremiseswasgiftedto himselfandhisbrothersundertheoralHibaandthathisfatherhas noexclusiveownerofthesuitpremisestosellthesametothe plaintiff,butthesaidsuitwasdismissedfordefaultandthatDW-2 didnotprosecutethesame:forthereasonsbestknowntohim.Even

hadoccupiedtheadditionalareaofthepremisesandassured to pay
rents attherate ofRs.5,000/-.Thesameissufficienttosaythatthe
defendantisinpermissivepasseazionoftheplaintiffoverthe
additionalareawhichheoccupied,hepaidrentsuptoMay2014and
heisnotpayingrentsthereafterandthushispossessionoverthesaid
additionalareabecomeillegal.Thedefendanthas to paytherentsto
hislandlordwhoisnoneotherthanthevendoroftheplaintiffbut sayingthatheispayingrentstohis landlordssonwhoisclaiming
ownershipoverthesuitschedulepremises adversetohisfatherbut
failedtosucceedinhiseffortsasdiscussedabove.
19.Inviewoftheabovediscussionandonthebasisoftheevidence onrecordtheplaintiffhasbeensatisfactorilyabletodischargethe onus toprovehisownershipoverthesuitschedulepropertyandthat heisentitledforadecreeforpossessionofplaintscheduleproperty byevictingthedefendant.Accordingly,thisissueisansweredin favouroftheplaintiff.
